WHEREAS, pursuant to Chapter 28 "Land Development Code" (the "LDC"), Part 6 "Development Review Procedures and Requirements," Article 640 "Plats," of the City of Dania Beach, (the "City) Code of Ordinances ("City Code"), Pulice Land Surveyors, on behalf of BCD Dania Oaks, LLC (the "Applicant") has applied to the City for approval of a Re-Plat (DR-54-19) attached as Exhibit`B," for property legally described in Exhibit"A;" and WHEREAS, the City Commission previously granted Plat (PL-13-18) approval via Resolution No. 2018-057 (the "Oaks Place Plat"); and WHEREAS,the Oaks Place Plat(PL-13-18), is restricted to fifty-seven(57)Townhomes; and WHEREAS,City Code Section 105-40,"Townhouses,"requires Townhome developments to comply with one of the specified methods of land transfer and ownership; and WHEREAS,the Applicant seeks to comply with City Code Section 105-20,by Re-Platting the subject property into individual lots, each to contain one (1)townhouse dwelling unit; and WHEREAS, the City's Development Review Committee (the "DRC"), which includes representatives from the Broward Sheriffs Office, Broward Fire Department, Public Services Department,the City's landscape consultant and the Planning Division staff,reviewed the proposed plat for compliance with all applicable regulations; and WHEREAS, staff recommends approval of the proposed Oaks Place Re-Plat for the residential Townhome development; and WHEREAS,the City Commission conducted a duly noticed public hearing in accordance with Article 640 of the LDC; and WHEREAS,the City Commission finds that the approval of the proposed Re-Plat(DR-54- 19) will protect the public health, safety and welfare of residents of the City, and furthers the purposes,goals, objectives and policies of the City's Land Development Code and Comprehensive Plan. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA: Section 1. That the foregoing"WHEREAS"clauses are ratified and confirmed as being true and correct, and they are made a specific part of this Resolution. Section 2. That the application for the Oaks Place Re-Plat(DR-54-19),a copy of which is attached as Exhibit "B," which is made a part of and incorporated into this Resolution by this reference, is approved. Section 3. That the issuance of a development permit by a municipality does not in any way create any right on the part of an Applicant to obtain a permit from a state or federal agency,and does not create any liability on the part of the municipality for issuance of the permit if the Applicant fails to obtain requisite approvals or does not fulfill the obligations imposed by a state or federal agency, or undertakes actions that result in a violation of state or federal law. Section 4. On July 24, 2018, the City Commission approved BCD's site plan application to construct 57 townhomes ("Development") on the Property (Resolution R-2018-058). The Dania Oaks Plat has already been submitted and approved by the City Commission and is scheduled for final approval by the County by the end of March 2019. Additionally, BCD has submitted plans to the City's Building Department for an informal/ preliminary review as well as a tree removal permit application. Section 105-40 (B) of the City's Land Development Code states: (B) Townhouse developments shall comply with one (1) of the following methods of land transfer and ownership: (1) The subdivision of the whole tract into individual lots, each to contain one (1) townhouse dwelling unit, together with the platting of the property in accordance with this code; or (2) Establishment of a condominium corporation by which the actual dwelling units are under individual ownership and the common areas of the development are owned by the condominium corporation; or (3) Maintaining the entire development in single ownership by recording a unity of title agreement with the city as a party, stipulating that the development shall not be subdivided unless in compliance with all requirements of this code and the city's release of the property from the unity of title. In order to comply with one of the methods of land transfer and ownership required in Section 105-40(B), BCD agrees to submit an application to the City and County to re- plat the Property into "individual lots, each to contain one (1) townhouse dwelling unit, together with the platting of the property in accordance with this code." BCD understands that the City will not issue a Certificate of Occupancy ("CO") for any unit in the Development until the above referenced re-plat of the Property is executed and recorded. This is to ensure that no unit within the Development is sold prior to the re-plat being completed and that the requirements set forth in Section 105-40(B) are fully satisfied.
