HomeMy WebLinkAboutR-2019-065 City Approving Site Plan Modification (SP-114-17MOD) Request & Special Exception (SE-28-19) Request Submitted by Dennis Mele, Esq./Greenspoon Marder LLP, on behalf of Stiling Square, LLC RESOLUTION NO. 2019-065 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA, APPROVING THE SITE PLAN MODIFICATION (SP- 114-17MOD) REQUEST AND SPECIAL EXCEPTION (SE-28-19) REQUEST SUBMITTED BY DENNIS MELE, ESQ./GREENSPOON MARDER LLP, ON BEHALF OF STIRLING SQUARE, LLC, FOR PROPERTY GENERALLY LOCATED ON THE NORTH SIDE OF STIRLING ROAD BETWEEN 12TH AVENUE AND PHIPPEN WAITERS ROAD IN THE CITY OF DANIA BEACH, FLORIDA AS LEGALLY DESCRIBED IN EXHIBIT "A;" PROVIDING FOR CONFLICTS; FURTHER, PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, The City Code of Ordinances, Chapter 28, entitled "Land Development Code" (the "LDC"), of Part 6, entitled "Development Review Procedures and Requirements," Article 635, entitled "Site Plans," states that site plan approval is required as a condition to the issuance of a building permit; and WHEREAS, Stirling Square, LLC, ("Applicant") has requested Site Plan Modification (SP-114-17MOD) approval for property generally located on the north side of Stirling Road between 12th Avenue and Phippen Waiters Road, in the City of Dania Beach, Florida, (the "City"), as legally described in Exhibit "A;" (the "subject property"), to permit the removal of a 9,750 square foot multi-tenant commercial building ("Commercial Building"), and to permit the construction of a 3,500 square foot convenience store and motor fuel pumps for a total of a 21,998 square foot free-standing grocery store ("Grocery Store"), and a 3,500 square foot convenience store with associated motor fuel pumps and accessory car wash ("Gas Station") on Parcel 1 on the subject property and a 124,950 square foot self-storage facility ("Storage Facility") on Parcel 2 of the subject property; and WHEREAS, Chapter 28, Part 6 of the LDC Article 630 "Special Exception Uses," Section 630-50 states that the City may approve a Special Exception use based upon its determination that the Applicant has demonstrated that the criteria identified in the LDC have been satisfied; and WHEREAS, pursuant to Section 110-20 of the LDC, the Applicant has requested a Special Exception (SE-28-19) to permit a Gas Station to be located on Parcel I in the General Commercial District (C-3) zoning district; and WHEREAS, the City Commission conducted a duly noticed public hearing in accordance with Article 610 of the LDC; and WHEREAS, the City Commission finds that the approval of the proposed Site Plan Modification (SP-114-17MOD) and Special Exception (SE-28-19) will protect the public health, safety, and welfare of the residents of the City, and furthers the purpose, goals, objectives and policies of the Comprehensive Plan; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA: Section 1. That the foregoing "WHEREAS" clauses are ratified and confirmed as being true and correct, and they are made a part of and incorporated into this Resolution by reference. Section 2. That pursuant to Chapter 28, "Land Development Code," Part 6 "Development Review Procedures and Requirements," Article 635 "Site Plan," the following Site Plan Modification (SP-114-17MOD), attached as Exhibit `B," which is made a part of and incorporated into this Resolution by reference, is approved. Section 3. That pursuant to Chapter 28, Part 6 of the LDC, Article 630, "Special Exception Uses," the Special Exception (SE-028-19) is approved consistent with the Site Plan provided in Exhibit`B." Section 4. That the approvals granted by this Resolution are subject to the Applicant's compliance with the following conditions: 1. Provide location of building roof drains, and their proposed connection(s) to the on-site drainage system.(As applicable) (Engineering) 2. In compliance with Article 805. CONCURRENCY OF DETERMINATIONS of the City Code of Ordinances, applicants shall provide projected water demand, sewage and solid waste generation amounts in tabular format—utilities —plan. Please provide calculations to support tabular projected generation amounts. (Engineering) 3. Provide a Complete Pavement, Marking and Signage Plan with details. Preliminary plan provided, pending complete PMS plan to be provided. (Engineering) 4. Preliminary Paving, Marking and Signage Plan pending to be provided' missing parking lot dimensions and width dimensions at ingress and egress of driveways, parking stalls dimensions, etc. Provide maneuvering. (Engineering) 2 RESOLUTION#2019-065 5. Provide drawing file (.dwg or .dgn) disk of the approved site plan in Florida State Plane Coordinate (NAD 83). This should be addressed as part of the final submittal. (Engineering) 6. Per Dania Code of Ordinances (Article 415-Sidewalks and Swales), Owner is responsible for sidewalks and swales improvements within ROW. (Engineering) 7. Erosion and Sediment Control Plan shall be reviewed for the drainage impacts to adjacent properties, surrounding ROW, storm-water facilities, and neighboring water bodies. (Engineering) 8. For all projects resulting in buildout of the site, such that construction staging cannot occur on site, must obtain Staging Plan approval by the Community Development Director prior to issuance of a building permit. The applicant must also obtain Maintenance of Traffic Plan approval by the City Engineer for period of construction prior to issuance of a building permit. The Staging Plan must include, but is not limited to, location of equipment and material during construction. (Engineering) 9. Contractor shall provide, before issuance of C.O., to the FOR and City of Dania Beach "hard-copies and CD with As-Built drawings of the project giving horizontal and vertical dimensions of connections signed and sealed by a Florida Registered Professional Land Surveyor. (Engineering) 10. Provide regulatory agencies' approval documentation (as applicable) as part of the final submittal (FDOT, Broward County Surface Water License, Broward County Health Department Permit, EPD, etc.) before issuance of Building Permit. (Engineering) 11. SIGNS: Revise note on sheets SP-01, SP-02, SP-03, SP-04 regarding traffic control sign, to be mounted 7'-0" above finished floor to identify for Traffic Control Signs only. (Zoning) 12. Dimensions: Provide exterior perimeter setbacks dimensions from Property Line. (Zoning) Section 5. That such application must be reviewed by Broward County Aviation Department. That pursuant to LDC Section 635-100 "Expiration of Site Plans," Section 630-70 "Expiration of special exceptions," and Section 625-50 "Expiration of Variances," the Site Plan Modification (SP-114-17MOD) and Special Exception (SE-28-19) approvals shall automatically expire and become null and void unless the Applicant files a 3 RESOLUTION#2019-065 complete building permit application with construction drawings for the improvements shown on the Site Plan, within eighteen (18) months from the date of this Resolution. Section 7. That the issuance of a development permit by a municipality does not in any way create any right on the part of an Applicant to obtain a permit from a state or federal agency, and does not create any liability on the part of the municipality for issuance of the permit if the Applicant fails to obtain requisite approvals or does not fulfill the obligations imposed by a state or federal agency, or undertakes actions that result in a violation of state or federal law. Section 8. That all resolutions or parts of resolutions in conflict with this Resolution are repealed to the extent of such conflict. Section 9.
