Home My WebLink AboutR-2019-074 City Authorizing the Release of Additional Code Enforcement Liens and Other City Liens for Four (4) Parcels of the Ten (10) Parcels Conveyed by the City to the CRA RESOLUTION NO. 2019-074 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA AUTHORIZING THE RELEASE OF ADDITIONAL CODE ENFORCEMENT LIENS AND OTHER CITY LIENS FOR FOUR (4) PARCELS OF THE TEN (10) PARCELS CONVEYED BY THE CITY TO THE DANIA BEACH COMMUNITY REDEVELOPMENT AGENCY ("CRA") FOR THE PURPOSE OF HOUSING AND OTHER DEVELOPMENT; AUTHORIZING THE PROPER CITY OFFICIALS TO PREPARE AND RECORD RELEASES AND RELATED DOCUMENTS FOR EACH PARCEL FOR THIS PURPOSE; PROVIDING FOR CONFLICTS; FURTHER, PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, at its May 14, 2019 meeting, the City Commission, pursuant to Resolution No. 2019-048, identified ten(10) vacant parcels (the "Property") in the Dania Beach Community Redevelopment Area which are owned by the City and which the City Commission, by motion and consensus, desired to convey to the CRA for the purpose of accomplishing the redevelopment goals that are outlined in the CRA community redevelopment plan; and WHEREAS, at its May 14, 2019 meeting, the City Commission authorized the release of City liens that were found on two (2) of the ten (10) conveyed parcels (Resolution No. 2019- 049); and WHEREAS, a law firm specializing in real estate and retained by the City as outside counsel performed title searches on all parcels while preparing the Quit Claim Deeds; and WHEREAS, the firm identified additional City liens that pertain to four (4) of the parcels included in the conveyance of property to the CRA; and WHEREAS, the liens will need to be released in order to finalize the transfer of the parcels in order to provide clean title, free of encumbrances and liens; and WHEREAS, the Releases of Liens are attached as composite Exhibit "A", and incorporated by this reference; and WHEREAS,the City Commission finds that all City liens should be released; and WHEREAS, all liens and all recording fees to release the liens will be charged to General Fund General Administration Miscellaneous Operating Account 001-18-00-519-52-20; and WHEREAS,the City Commission finds that this action is in the best interest of the City; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY DANIA BEACH, FLORIDA: Section 1. That the above "WHEREAS" clauses are ratified and confirmed, and they are made a part of and incorporated into this Resolution by this reference. Section 2. That the City Commission authorizes the release, payment or both of all liens related to the four(4)parcels as described in Exhibit"A". Section 3. That the proper City officials shall record in the County public records all releases of liens and shall provide a copy of such recorded instruments to the Clerk of the City Commission and CRA Board within thirty (30) days of execution and final acceptance. Section 4. That all resolutions or parts of resolutions in conflict with this Resolution are repealed to the extent of such conflict. Section 5. That this Resolution shall be in force and take effect immediately upon its passage and adoption. PASSED AND ADOPTED on July 30, 2019.
