MINUTES OF REGULAR MEETING DANIA BEACH CITY COMMISSION TUESDAY, JULY 30, 2019 - 7:00 P.M. 1. Call to Order/Roll Call Mayor Lewellen called the meeting to order at 7:22 p.m. Present: Mayor: Lori Lewellen Vice-Mayor: Lauren Odman Commissioners: Chickie Brandimarte Bill Harris Tamara James City Manager: Ana M. Garcia, ICMA-CM City Attorney: Thomas Ansbro City Clerk: Thomas Schneider 2. Moment of Silence and Pledge of Allegiance Mayor Lewellen called for a moment of silence after the Pledge of Allegiance to the United States Flag. 3. Presentations and Special Event Approvals 3.1 Swearing-in of BSO Captain Sergio Pellecer as Dania Beach District Fire Chief Mayor Lewellen spoke briefly about Captain Pellecer and administered the Oath of Office to him as Dania Beach District Fire Chief. Each Commissioner commented and congratulated Fire Chief Pellecer. Fire Chief Pellecer gave a brief fire report. 3.2 Presentation of Certificates of Acknowledgment to the Parks, Recreation, and Community Affairs Advisory Board members for their service to the community and Board Eric Brown, Director of Parks & Recreation commented on the board members and presented them with Certificates of Acknowledgement. Parks and Recreation Department Most Valuable Employee (MVE) Presentations Eric Brown, Director of Parks & Recreation, presented the Most Valuable Employee (MVE) award for the third quarter to Kayla Gardner. 3.3 City Manager commendation to Lifeguard Kristen McLaren City Manager Garcia noted Ms. McLaren found a Rolex watch on the beach, turned it in, and it was reclaimed by the owner the next day. She presented Ms. McLaren with a Certificate of Commendation for her honesty, integrity and outstanding contributions and service to the citizens of Dania Beach. 3.4 Special Event request from Ragnar Events, LLC for the Ragnar Florida Sprint 2020 Relay Race to be held on February 29, 2020 from 4:00 a.m. - 12:00 p.m., with an exchange point located at Frost Park, 300 NE 2nd Street Commissioner James motioned to approve the Special Event request for the Ragnar Florida Sprint 2020 Relay Race; seconded by Commissioner Harris. The motion carried unanimously. 3.5 Update on City's 115th Birthday- Mayor Lewellen Mayor Lewellen reported Jack Studiale, owner of Tropical Acres Restaurant, agreed to sponsor a champagne brunch hosting Dania Beach's I I5 h Birthday celebration. Rickelle Williams, CRA Executive Director, agreed to meet with City Staff about expanding the Dania after Dark(DAD) event for the month of November. The Commission consensus was to have an expanded DAD on November 91h and a brunch at Tropical Acres on November I O b, by Commission invitation only, to celebrate the City's 1151h Anniversary. 3.6 Parks and Recreation Citywide Master Plan Presentation Randy Hollingsworth, Director of Planning & Urban Design Department, and Alfredo Sanchez, Senior Partner, Bermello, Ajamil & Partners, Inc., gave a presentation, which is attached to and incorporated into these minutes. Commissioner James noted she would like the Olsen Middle School property removed from the plan. 3.7 Acknowledgement of Chamber/Atrium refurbishment -Vice-Mayor Odman Vice-Mayor Odman spoke of the upgrades to City Hall and the Commission Chamber. She thanked members of the CACAB and City staff for their efforts to accommodate tonight's meeting. Minutes of Regular Meeting 2 Dania Beach City Commission Tuesday,July 30,2019—7:00 p.m. 4. Proclamations 4.1 Parks and Recreation Month- Eric Brown, Parks &Recreation Director Mayor Lewellen read the Parks and Recreation Month Proclamation and presented it to Eric Brown, Parks &Recreation Director. 5. Citizen Comments John Daizovi, 41 SE 6 Street, representative of Lighthouse Community Church, 650 S. Federal Highway, spoke of providing consoling support for small business employees, and recruiting mentoring volunteers for the church's mentoring program. Bobbie H. Grace, 110 NW 8"' Avenue, spoke of signage concerns with older businesses such as Dania Casino and Mr. M's Subs, due to the longevity of the businesses. Linda Wilson, Friends of Dania Beach Library, addressed budget concerns the Friends of the Library is having, and requested the City increase its charitable donation for 2019-2020 so additional programs can be offered at the library. Joyce Davis, 500 NE 2nd Street, founder of Pearl Girls Youth Program, commented on bringing her youth program to Dania Beach parks and the Library. Randall Suhr, 309 N.E. 2nd Avenue, spoke of a code enforcement and special magistrate matter related to his property. Emmanuel George, 17 NE 2nd Avenue, requested an update of the status of the Historical Society. Craig Valentine, 1982 Tiger Tail Drive, spoke of a simulated live pay-per-view wrestling show and toy drive being held at the Dania Beach Casino on December 14t'. 6. Public Safety Reports Captain Daniel Marks, BSO Chief of Police, spoke of a back-to-school event that would be co- sponsored by the Dania Beach Lions Club. He noted the First Annual BSO/Teen Partnership event, a fishing tournament, would be held on August 9 at Boaters Park in furtherance of building a relationship between kids and law enforcement. He also noted crime prevention training is available to any Homeowners Association as well as active killer training, which is also available to local business and places of worship. 7. Public Hearings and Site Plans 9.1 ORDINANCE#2019-009 Amended AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA, AMENDING CHAPTER 17, "OFFENSES-MISCELLANEOUS," OF THE CITY'S CODE OF ORDINANCES BY REPEALING ARTICLE IV, "NOISE" AND REPLACING WITH A NEW ARTICLE IV, "NOISE" TO PROVIDE TERMINOLOGY, PROHIBIT CERTAIN NOISES, EXEMPT CERTAIN NOISES, LIMIT THE UNREASONABLE AND EXCESSIVE LEVELS OF NOISES AND PLAINLY AUDIBLE NOISES IN CERTAIN CIRCUMSTANCES, PROVIDE TEMPORARY NOISE PERMITS; PROVIDE ENFORCEMENT STANDARDS, PENALTIES, AND REMEDIES; PROVIDING FOR SEVERABILITY; PROVIDING FOR CONFLICTS; PROVIDING FOR INCLUSION IN THE CODE; AND PROVIDING FOR AN EFFECTIVE DATE. (SECOND READING) City Attorney Ansbro read the title of Ordinance #2019-009. Marc LaFerrier, Director of Community Development, reviewed the changes made to the ordinance since first reading. City Attorney Ansbro addressed a change that needs to be made to Section 17-83 of the ordinance included in the agenda packet, noting that the phrase "or in any motor vehicle located on any public street or property" would be removed. Mayor Lewellen opened the Public Hearing. Seeing as there was no one to speak in favor or opposition, she closed the Public Hearing. Vice-Mayor Odman motioned to adopt Ordinance #2019-009, on second reading, as amended; seconded by Commissioner Harris. ON BEHALF OF THE DESIGN CENTER OF THE AMERICAS FOR PROPERTY LOCATED AT 1855 GRIFFIN ROAD, IN THE CITY OF DANIA BEACH, FLORIDA, AS LEGALLY DESCRIBED IN EXHIBIT "A;" PROVIDING FOR CONFLICTS; AND FURTHER, PROVIDING FOR AN EFFECTIVE DATE. Marc LaFerrier, Director of Community Development, gave an overview of the DRI abandonment request. Mayor Lewellen opened the Public Hearing. Seeing as there was no one to speak in favor or opposition, she closed the Public Hearing. Commissioner James motioned to adopt Ordinance #2019-010, on first reading; seconded by Commissioner Brandimarte. The motion carried on the following 5-0 Roll Call vote: Commissioner Brandimarte Yes Vice-Mayor Odman Yes Commissioner Harris Yes Mayor Lewellen Yes Commissioner James Yes 9.3 RESOLUTION#2019-084 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA, APPROVING THE SITE PLAN MODIFICATION (SP-08-13MOD) REQUEST AND VARIANCE (VA-80-19) REQUEST SUBMITTED BY CHEN MOORE AND ASSOCIATES, INC., ON BEHALF OF THE PROPERTY OWNER, BROWARD COUNTY BOARD OF COUNTY COMMISSIONERS, FOR PROPERTY LOCATED AT 4980 SW 40TH AVENUE, IN THE CITY OF DANIA BEACH, FLORIDA, AS LEGALLY DESCRIBED IN EXHIBIT "A," A COPY OF WHICH IS ATTACHED TO THIS RESOLUTION; PROVIDING FOR CONFLICTS; FURTHER,PROVIDING FOR AN EFFECTIVE DATE. City Attorney Ansbro read the title of Resolution #2019-084, and noted this is a quasi-judicial hearing and swore-in those who would speak. He asked the Commission to disclose any communication they had on this matter. Marc LaFerrier, Director of Community Development, gave a presentation on the site plan modification and variance requests. Mayor Lewellen opened the Public Hearing. Seeing as there was no one to speak in favor or opposition, she closed the Public Hearing. Commissioner James motioned to adopt Resolution #2019-084; seconded by Vice-Mayor Odman. Discussion and Possible Action 10.1 RESOLUTION NO. 2019-085 - Requested by Commissioner James Minutes of Regular Meeting 8 Dania Beach City Commission Tuesday,July 30,2019—7:00 p.m. A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA, CREATING A CITY CONTRACTS POLICY; PROVIDING FOR CONFLICTS; FURTHER, PROVIDING FOR AN EFFECTIVE DATE. City Attorney Ansbro read the title of Resolution#2019-085. Commissioner James noted she requested the contracts come before the City Commission at least five months before expiration in case the Commission decides an RFP is needed. Commissioner James motioned to adopt Resolution #2019-085; seconded by Vice-Mayor Odman. The motion carried unanimously. 10.2 Expansion of plastic straw ban -Vice-Mayor Odman Vice-Mayor Odman asked if the City Commission wanted to look at expanding the current ban citywide for eating and drinking establishments. Mayor Lewellen questioned if there were any legal prohibitions expanding the ban citywide. City Attorney Ansbro responded no. The Commission consensus was to expand the current plastic straw ban citywide for all restaurants and drinking establishments. 10.3 Wellness Program - Commissioner James Commissioner James addressed the wellness program that would be kicking off September 1, 2019, which would offer teams, competition and incentives. She has been working with Human Resources, which will offer Fitbits and the wellness program. Commissioner Harris welcomed the program, and mentioned reaching out to YouFit and United Health Care to collaborate with their fitness programs. The Commission consensus was to establish a wellness program for City employees. 10.4 Youth Advisory Board - Commissioner James Commissioner James discussed establishing a Youth Advisory Board along with the help of Parks and Recreation and other non-profits. Mayor Lewellen felt the idea was great, and suggested changing the name to something else as she had sunshine violation concerns. Commissioner James noted it would be a program. Commissioner Harris supported the program and commented on a previous youth program the City created. Minutes of Regular Meeting 9 Dania Beach City Commission Tuesday,July 30,2019—7:00 p.m. The Commission consensus was to establish a youth advisory program. 10.5 Beach vendors - Commissioner James Commissioner James questioned how to go about getting rental umbrellas and chairs on the beach regardless of the forthcoming beach RFP. City Manager Garcia indicated Parks and Recreation Director Brown is working to pursue a vendor; there is a possibility of piggy-backing off an RFP to provide beach equipment rental services. Commissioner Brandimarte suggested Commissioner James meet with Dania Beach Casino management on the possibility of collaborating. The Commission consensus was for Commissioner James to meet with Dania Beach Casino management and bring the item back to the Commission. 10.6 Local Association meetings - Commissioner James Commissioner James requested local association meeting lunches be included in the recently amended travel policy. Commissioner Harris suggested adding a dollar amount. Mayor Lewellen expressed apprehension as the Commission was already given an increased expense allowance which could be used for this purpose. The Commission consensus was to discuss this item at a future time. 10.7 Commission access to City Clerk's G Drive - City Manager Garcia City Manager Garcia explained there had been a request from a Commissioner for access to the City Clerk's G Drive. After discussion with the City Clerk, it was determined the best way to meet this request would be to prohibit everyone, aside from the Clerk's office, from having access to the public records requests folder within the drive. City Clerk Schneider noted removing access to the public records folder is in line with best practices for those having access to the City Clerk's G drive. City Manager Garcia recommended access to the public records requests folder be prohibited in order to grant the requested access to the Clerk's drive. She confirmed this would also include access to Board Sync,the City's agenda program. The Commission consensus was to allow Commissioners access to the G drive, with the exception of the public records requests folder, and to Board Sync. Commission Comments 11.1 Commissioner Brandimarte Commissioner Brandimarte requested enforcement of signage violations be suspended until a meeting is held with staff to revise the signage ordinance. She suggested the idea of the Code Compliance Department falling under BSO's jurisdiction. The Commission consensus was to defer enforcement on C.K. McElyea's businesses as well as on Mr. M's Sandwich Shop, and to hold a workshop to follow-up. 11.2 Commissioner Harris Commissioner Harris spoke about the U.S. Conference of Mayors meeting he recently attended. 11.3 Commissioner James Commissioner James described her experience of attending the U.S. Conference of Mayors. She noted the Lions Club, along with BSO, would be sponsoring a back-to-school drive, and Tamara James Day would be on August 3ra 11.4 Vice-Mayor Odman Vice-Mayor Odman introduced and welcomed her intern, Kaleb, and commented on the Dania Beach Lions Club dinner to be held on August l0u'. 11.5 Mayor Lewellen Mayor Lewellen spoke of the extensive agenda at the Mayors Conference and ideas she is looking into. She addressed the preemption issue with the State of Florida relating to plastic regulations, a local food drive and homeless program, and the recent commissioning of the USS Ignatius at Port Everglades. 12.
