HomeMy WebLinkAboutR-2019-094 Related to (RFP No. 19-006) City Center Redevelopment Opportunity Public Private Partnership; Authorizing City Manager to Establish a Negotiating Team to Enter Into Negotiations RESOLUTION NO. 2019-094 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA, RELATED TO REQUEST FOR PROPOSALS (RFP NO. 19-006) CITY CENTER REDEVELOPMENT OPPORTUNITY PUBLIC PRIVATE PARTNERSHIP; AUTHORIZING THE CITY MANAGER TO ESTABLISH A NEGOTIATING TEAM TO ENTER INTO NEGOTIATIONS FOR A DEVELOPMENT AGREEMENT WITH ARMADA HOFFLER PROPERTIES/CAPITAL GROUP (DANIA BEACH CITY CENTER LLC) IN FURTHERANCE OF THE CITY CENTER REDEVELOPMENT PROJECT; PROVIDING FOR CONFLICTS; FURTHER, PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, on October 9, 2018, the Dania Beach Community Redevelopment Agency (CRA) Board, adopted Resolution No. 2018-CRA-020 accepting the Florida International University Metropolitan Center City Center Community Charrette and Preliminary Action Plan (the "Action Plan") and authorized the advancement of a public private partnership development initiative for the City Hall/City Center redevelopment project(the "Project"); and WHEREAS, on December 11, 2018, in advancement of the Action Plan, the City Commission adopted Resolution No. 2018-180 to enter into a tri-party "piggyback" agreement with the Dania Beach Community Redevelopment Agency and Colliers International South Florida for Real Estate Brokerage and Lease Management Services related to the Project; and WHEREAS, City and CRA staff worked with Colliers International South Florida to prepare a Request for Proposal related to the Project; and WHEREAS, on March 12, 2019, the City Commission adopted Resolution No. 2019- 023 authorizing a bid advertisement for a public private partnership for the Project consisting of a mixed-use development with public and private facilities and on March 12, 2019, the CRA Board adopted Resolution 2019-CRA-005 supporting the bid advertisement for the Project; and WHEREAS, the City posted and advertised Request for Proposals ("RFP") No. 19-006 "City Center Redevelopment Opportunity Public Private Partnership" on the City of Dania Beach's website, Demand Star and in the Sun-Sentinel newspaper on March 15, 2019; and WHEREAS, the CRA also advertised the RFP with the South Florida Business Journal, Florida Redevelopment Association, Sun-Sentinel, Florida Trend and the International Council of Shopping Centers; and WHEREAS, a non-mandatory pre-bid meeting was held on Thursday, May 16, 2019 at 2:00 p.m. at City Hall; and WHEREAS, the bid opening was held on Thursday, June 13, 2019 at 2:30 p.m. at City Hall; and WHEREAS,three (3) bidders submitted their respective bids; and WHEREAS, the three (3) bidders that submitted proposals were Armada Hoffler Properties/Capital Group (Dania Beach City Center LLC to be formed); OHL Infrastructure, Inc. (Dania Beach Development Partners); and New Urban Communities; and WHEREAS,the Evaluation Committee held an initial review meeting on Thursday, June 27, 2019 at 9:30 a.m. at City Hall to evaluate the three proposals received; and WHEREAS, the Evaluation Committee requested supplementary information from all three (3) bidders on Monday, July 15, 2019 and all three (3) bidders submitted the requested supplementary information to the City Clerk on Monday, July 29, 2019; and WHEREAS, the Evaluation Committee held a secondary review meeting on Friday, August 2, 2019 at 9:30 a.m. at City Hall to review the proposals and listen to oral presentations from each bidder; and WHEREAS, the Evaluation Committee held a final review meeting on Wednesday, August 7, 2019 at 1:00 p.m. at City Hall to score and rank the three (3)proposals received; and WHEREAS, the Evaluation Committee consisted of James Brady (Saul Ewing Amstein and Lehr), Kevin Greiner (Florida International University Metropolitan Center), Ken Krasnow (Colliers International South Florida), Marc LaFerrier (City of Dania Beach), Nicki Satterfield (City of Dania Beach) and Rickelle Williams (Dania Beach Community Redevelopment Agency); and WHEREAS, the proposals were evaluated by each of the six (6) Evaluation Committee members out of one hundred (100) maximum points based on the following criteria: 20 points-Firm Experience and Team 10 points- Similar Past Projects 30 points-Financial Ability 20 points- Conceptual Plan/Timeline 20 points- Deal Structure WHEREAS, all three (3)bidders were found to be responsible and responsive; and 2 RESOLUTION#2019-094 WHEREAS, the bidders ranked as follows based on total points and average scores: Rank#1: Armada Hoffler Properties/Capital Group (Dania Beach City Center LLC to be formed) Total Points: 552 out of 600 Rank#2: OHL Infrastructure, Inc. (Dania Beach Development Partners) Total Points: 526 out of 600 Rank#3: New Urban Communities Total Points: 497 out of 600; and WHEREAS, based on the final rankings resulting from the solicitation process, the Evaluation Committee has made a recommendation for award to the City Manager, who further recommends to the City Commission to enter into negotiations with the highest ranked firm, Armada Hoffler Properties/Capital Group (Dania Beach City Center LLC to be formed), for a developer agreement for the Project subject to subsequent approval by the City Commission; and WHEREAS, if the recommendation is accepted by the City Commission, the City Manager will establish a negotiating team that will consist o£ • City Manager • Assistant City Manager • City Attorney and a legal designee • Finance Director and a financial designee • Community Development Director • CRA Executive Director and a designee; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA: Section 1. That the above "Whereas" clauses are ratified and confirmed as being true and correct, and they are made a part of and incorporated into this Resolution by this reference. Section 2. That the City Commission of the City of Dania Beach, Florida authorizes the City Manager and the negotiation team to enter into negotiations for an agreement with Armada Hoffler Properties/Capital Group (Dania Beach City Center LLC to be formed) for the Project relating to RFP No. 19-006 "City Center Redevelopment Opportunity Public Private Partnership" and that any such negotiated agreement is subject to approval by the City Commission. 3 RESOLUTION#2019-094 Section 3. That funding for the related professional services will be appropriated from the City's General Reserves Account No. 00 1-27 1-00-00 to the General Fund City Manager Professional Services Account No. 001-12-01-512-31-10 in the amount of Seventy Five Thousand Dollars ($75,000.00) and all services will be procured in accordance with the City's Procurement Policy. Any remaining available funds in Fiscal Year 2018-2019 will automatically roll forward for the Fiscal Year 2019-2020 budget. Section 4. That if the negotiation team is unable to reach a satisfactory developer agreement with the top ranked firm, the City negotiating team, upon notification to the City Commission by the City Manager, can proceed to negotiate with the other proposers in ranking order. Section 5. That all resolutions or parts of resolutions in conflict with this Resolution are repealed to the extent of such conflict. Section 6. That this Resolution shall be in full force and take effect immediately upon its passage and adoption. PASSED AND ADOPTED on August 27, 2019.
