RESOLUTION NO. 2019-096 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA, APPROVING THE SITE PLAN MODIFICATION (SP-02- 17MOD) AND VARIANCE (VA-123-19), SUBMITTED BY DANIA AIRPORT HOTELS, LLC FOR PROPERTIES GENERALLY LOCATED ON THE EAST SIDE OF NORTH FEDERAL HIGHWAY BETWEEN NW 1st STREET AND EAST DANIA BEACH BOULEVARD AND ON THE EAST SIDE OF NE 1" COURT BETWEEN NE 1st STREET AND EAST DANIA BEACH BOULEVARD IN THE CITY OF DANIA BEACH, FLORIDA AS LEGALLY DESCRIBED IN EXHIBIT "A," A COPY OF WHICH IS ATTACHED TO THIS RESOLUTION; PROVIDING FOR CONDITIONS; PROVIDING FOR CONFLICTS; FURTHER, PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, pursuant to the City Code of Ordinances, Chapter 28, entitled "Land Development Code" (the "LDC"), of Part 6, entitled "Development Review Procedures and Requirements," Article 635, entitled "Site Plans," Dania Airport Hotels, LLC (the "Applicant") has applied to the City of Dania Beach (the "City"), for a Site Plan Modification (SP-02- 17MOD) approval for property legally described in Exhibit"A" (the "subject property"); and WHEREAS, Part 6 of the LDC, Article 635 "Site Plans" states that Site Plan approval is required as a condition to the issuance of a building permit; and WHEREAS, the City Commission adopted Resolution No. 2017-135 on October 24, 2017 approving the Site Plan for a hotel and offsite parking lot for the subject property; and WHEREAS, the Applicant has requested Site Plan Modification (SP-02-17MOD) approval to, modify/reconfigure the access and layout of the off-site parking lot, reduce the amount of required parking spaces for the subject property from ninety-six (96)to seventy-eight (78)parking spaces, and eliminate the need for eighteen(18)parking spaces in the City's parking garage; and WHEREAS, Chapter 28, Part 6 of the LDC, Article 625, entitled "Variances," Section 625-40 states that the City Commission may grant a variance based on its determination that the petitioner has demonstrated that the necessary criteria identified in the LDC have been satisfied; and WHEREAS, the Applicant has requested a Variance to provide seventy-eight (78) parking spaces, where Section 265-50 of the LDC requires ninety-six (96) parking spaces for the Project(VA-123-19); WHEREAS, the City Commission conducted a duly noticed public hearing in accordance with Article 610 of the LDC; and WHEREAS, the City Commission finds that the approval of the proposed Site Plan Modification (SP-02-17MOD) and Variance (VA-123-19) will protect the public health, safety, and welfare of the residents of the City, and furthers the purpose, goals, objectives and policies of the Comprehensive Plan. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF DANIA BEACH,FLORIDA: Section 1. That the foregoing "WHEREAS" clauses are ratified and confirmed as being true and correct, and they are made a part of and incorporated into this Resolution by reference. Section 2. That pursuant to Chapter 28, "Land Development Code," Part 6 "Development Review Procedures and Requirements," Article 635 "Site Plan," the application for Site Plan Modification (SP-02-17MOD) approval, attached as Exhibit `B" which is made a part of and incorporated into this Resolution by reference is approved subject to the following condition from the original Site Plan(SP-02-17), approved via Resolution No. 2017-135: 1. Revise the photometric plan to provide no more than 0.5 foot candle light spillage at property line abutting residential. Revision needed prior to issuance of a building permit. Section 3. That pursuant to Chapter 28, "Land Development Code", Part 6 "Development review Procedures and Requirements," Article 625 "Variances," the Variance application (VA-123-19) is approved consistent with the Site Plan Modification provided in Exhibit `B" and eliminates the need for Applicant to provide eighteen (18) parking spaces in the City's parking garage. Section 4. That pursuant to LDC Section 635-100 "Expiration of Site Plans,"the Site Plan Modification (SP-02-17MOD) shall automatically expire and become null and void unless the Applicant files a complete building permit application with construction drawings for the improvements shown on the Site Plan, within eighteen (18) months from the date of this Resolution. Section 5. That the issuance of a development permit by a municipality does not in any way create any right on the part of an Applicant to obtain a permit from a state or federal agency, and does not create any liability on the part of the municipality for issuance of the permit 2 RESOLUTION#2019-096 if the Applicant fails to obtain requisite approvals or does not fulfill the obligations imposed by a state or federal agency, or undertakes actions that result in a violation of state or federal law. Section 6. That all resolutions or parts of resolutions in conflict with this Resolution are repealed to the extent of such conflict. Section 7. Due to the modern conveniences of Uber/Lyft,the hotel industry has experienced fewer guests traveling with a vehicle which requires parking. In addition, because this is a limited service hotel,the number of employees that would be working at any given time would not be nearly as much as a full service hotel or resort. In addition, although the retail uses proposed as part of this project are open to the public,the primary uses are expected to the guests of the hotel or people who are able to walk from the nearby neighborhoods or other hotels/businesses. As such,we are requesting that the retail component be treated as accessory to the hotel and not require parking. (2) That the requested variance is otherwise compatible with the surrounding land uses and would not be detrimental to the community; Applicant Response: The requested variance is compatible with surrounding land uses. There are other hotels and commercial establishments in the area and the parking variance would not be detrimental to those uses. (3) That the requested variance is consistent with, and in furtherance of, the goals, objectives and policies of the adopted Comprehensive Plan, as amended from time to time, and all other similar plans adopted by the city; Applicant Response: Certain concessions were made by the developer to give up the 18 parking spaces committed to the project in the CRA parking garage. In an effort to satisfy the City and to free up the spaces in the CRA garage,the owner has agreed to process this variance and if approved,the 18 parking spaces reserved in the CRA garage for this project,would not longer be needed. In addition, as noted above,the owner does not need the extra 18 parking spaces, because guests are using Uber/Lyft services rather than renting or using their vehicle to travel to and from the hotel and therefore,the extra parking is not needed. (4) That the plight of the petitioner is due to unique circumstances of the property or petitioner which would render conformity with the strict requirements of the subject regulations unnecessarily burdensome; and Applicant Response: The proposed project is located in an urban setting, and the hotel simply does not need the amount of parking required by the City's code. (5) That the variance requested is the minimum variance that is necessary to afford relief to the petitioner, while preserving the character, health, safety and welfare of the community. Applicant Response: The reduction in the parking is the minimum variance needed to afford relief to the petitioner,while at the same time, preserve the character, health,safety and welfare of the community. The approval of this variance will result in more parking in the CRA parking garage, and will mitigate the need for unused parking. The proposed parking ratio for the hotel equates to 0.68 spaces per hotel room which results in a parking requirement of 78 spaces for this project. The total reduction is 18 parking spaces (the amount reserved in the CRA parking garage, and would be released for other projects should this variance be approved). I will go ahead and revise the Resolution to add the parking variance, but when I spoke to Marc(cc'd) awhile back, I mentioned that there is a code provision that allows him to approve an Alternative Parking Standard rather than asking for a variance. The developer is processing this amendment at the City's request and agreeing to go give up the 18 spaces in the garage so the city can use those for another project. When I spoke to Marc he was willing to do this if that is what the code allowed him to do. Attached is the code section....we used this on the Herc Rentals parking reduction as well, so there is a precedent. Table 1 below documents the parking requirements per City of Dania Beach Land Development Regulations. As indicated in the subject table, the Tru by Hilton requires 96 parking spaces. Since 78 parking spaces are provided, a parking reduction study is required. The purpose of this parking reduction study is to demonstrate that the 78 parking spaces provided for the project are adequate to comfortably accommodate the peak parking demands of the subject lodging facility. Additionally, the Institute of Transportation Engineers (ITE) recommends a parking rate of 0.72 parking spaces per room for business hotels. This rate accommodates the parking needs of any restaurant and retail space within the hotel premises. Based on the above, Traf Tech Engineering, Inc. recommends a parking rate of 0.72 parking spaces per hotel room for the Tru by Hilton Hotel. With a parking rate of 0.72, the parking needs would be 83 parking spaces. Since 78 parking spaces are provided (12 on site and 66 at the satellite parking lot), the subject hotel will have a shortfall of five (5) parking spaces. However, since the satellite parking lot is for valet use only, the peak parking demand of 78 parking spaces can be accommodated by the valet operator (valet parking lots can accommodate significantly more vehicles than marked parking spaces).
