HomeMy WebLinkAboutO-2019-010 City Approving the Development of Regional Impact Abandonmend ORDINANCE NO. 2019-010 AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA, APPROVING THE DEVELOPMENT OF REGIONAL IMPACT ABANDONMENT REQUEST (OT-85-18) SUBMITTED BY JOHN D. VOIGT, ESQ. ON BEHALF OF THE DESIGN CENTER OF THE AMERICAS FOR PROPERTY LOCATED AT 1855 GRIFFIN ROAD, IN THE CITY OF DANIA BEACH, FLORIDA, AS LEGALLY DESCRIBED IN EXHIBIT "A;" PROVIDING FOR CONFLICTS; AND FURTHER, PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, pursuant to the City Code of Ordinances, Chapter 28 "Land Development Code" (the "LDC"), Part 6 "Development Review Procedures and Requirements," and Florida Statutes Section 380.6(11), John D. Voigt, Esq., on behalf of the Design Center of the Americas (the "Applicant"), has applied to the City of Dania Beach (the "City") for approval to abandon a Development of Regional Impact ("DRI") for the property located at 1855 Griffin Road (the "Property"), as legally described in Exhibit"A;"and WHEREAS, City Ordinance No. 20 was adopted September 13, 1983 creating the DCOTA DRI; and WHEREAS, pursuant to Florida Statutes Section 380.6(11), the City may abandon a DRI Development Order for an existing DRI upon request and showing that all required mitigation related to the amount of development which existed on the date of abandonment has been completed or will be completed under an existing permit or equivalent authorization issued by a government agency; and WHEREAS, the Applicant has provided sufficient justification demonstrating compliance with the mitigation and the ongoing requirements of this section of the Florida Statutes; and WHEREAS, public notice was provided in accordance with Article 610 of the LDC; and WHEREAS, the City Commission finds that approval of the requested DRI Abandonment(OT-85-18) is consistent with the LDC and Comprehensive Plan. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF DANIA BEACH,FLORIDA: Section 1. That the foregoing "WHEREAS" clauses are ratified and confirmed as being true and correct and they are made a specific part of this Ordinance. Section 2. That pursuant to Chapter 28, the "Land Development Code," Part 6 "Development Review Procedures and Requirements," and Florida Statute 380.06(11), the DRI Abandonment(OT-85-18)request, a copy of which is attached and made a part of this Ordinance as Exhibit`B" is approved subject to the following conditions: 1. All requirements of Florida Statute Section 380.06(11)(b), including required mitigation as determined by the City, as follows: A. The City will withhold issuance of the respective Certificate of Occupancy (the "CO")until the Applicant provides the City with a signed receipt or other documentary evidence indicating that the amount set forth below relating to the specific development approved by the Certificate of Occupancy has been paid to Florida Department of Transportation (FDOT) as provided below: (1) Phase 3 Office Building(120,000 square feet) -$45,640.60; (2) Phase 4 Wholesale Showroom (190,889 square feet) -$27,711 .35. B. That, prior to the issuance of any building permit for the additional 200,000 square feet of office floor area associated with the December 14, 20 11,N OPC, the City will consult with the appropriate water supplier to ensure that adequate water supplies that will serve the new development will be available no later than the anticipated date of the Certificate of Occupancy. Any determination that adequate water supplies will be available will require the demonstration that a consumptive use permit has been issued to the City with sufficient allocation available to serve the new development, given all other existing commitments for that allocation. The "sufficiency allocation" in the consumptive use permit shall be defined consistent with the permit's limiting conditions, as they exist at the time of the building permit issuance. Permitted projects may be issued a Certificate of Occupancy only upon demonstration by the City that adequate water supply exists within the City's current legal allocation. C. That, prior to the issuance of any building permit for the additional 200,000 square feet of office floor area associated with the December 14, 2011, NOPC, the developer will remove and replace sixty (60) feet of sidewalk on Griffin Road (SR 818), commencing 320 feet west of the cross walk and continuing west for sixty (60). The sidewalk shall be six (6) inches thick with a maximum cross slope of two (2)percent running slope to match the roadway slope. Pedestrian access to and from all buildings on site and connection to the roadway sidewalk are to be addressed as required by American Disability Act (ADA). 2 ORDINANCE#2019-010 2. All development following the DRI Abandonment must be fully consistent with the City's current Comprehensive Plan and applicable zoning. Section 3. That the issuance of a development permit by a municipality does not in any way create any right on the part of an Applicant to obtain a permit from a state or federal agency, and does not create any liability on the part of the municipality for issuance of the permit if the Applicant fails to obtain requisite approvals or does not fulfill the obligations imposed by a state or federal agency, or undertake actions that result in a violation of state or federal law. Section 4. That all ordinances or parts of ordinances in conflict with this Ordinance are repealed to the extent of such conflict. Section 5. That this Ordinance shall be in force and take effect immediately upon the recording by the City of a Notice of Abandonment pursuant to Florida Statute Section 28.222 with the Clerk of the Circuit Court of Broward County. The tenant has had to hire a new contractor to substitute the old contractor and finish the work and have the necessary inspections to get the C.O. Once this is completed, they have the necessary floor plan to obtain the Business Tax Receipt. They are hopeful that this will be completed well in advance of the July 30 city commission meeting date. In the meantime, code enforcement advises us that it is not an actual violation but a warning only that was issued on June 25. Attached is a copy of that printout. My reading of Section 680-40 of the city code indicates the matter may not be scheduled for a public hearing if there is any delinquent financial payment due to the city or a lien on the property, neither of which is the case here. In 680-40(B) it states that if the"applicant or property owner has been cited for any code violations that have not been placed into compliance"then the matter may not be scheduled for a hearing. I would suggest that if only a warning was issued then there has been no code citation that should prohibit the scheduling for the city commission. Obviously, we would agree that any approval it would be contingent upon and not effective until the code matter was fully resolved to the city's satisfaction. The unfortunate reality of the situation is that when you have numerous tenants, something like this could arise at any time when it is not the act or fault of the owner, but it is merely the owner's responsibility. Lajoie: On behalf of the Design Center of the Americas, LLC, we are requesting to abandon the Design Center of the Americas DRI. Included in the application package is a revision to the current biennial monitoring report, which includes the status of each of the conditions of the DRI (Exhibit G) , as well as a sketch of what approved buildings have been completed with the square footage of each. Also included is a traffic statement provided in response to staff comments. Chapter 380. 06, Florida Statutes, placed the responsibility on the developer of an approved development of regional impact (DRI) for submitting a biennial report to the local government, the regional planning agency, the Department of Economic Opportunity, and to all affected permit agencies. On April 9, 2018, Florida' s Governor signed into a law a bill that significantly amended Chapter 380 . 06, Florida Statutes, and removed the requirements for monitoring reports to be submitted to the Department of Economic Opportunity or the Ms . Corinne Lajoie, AICP, LEED GA May 2, 2019 Page 2 regional planning agency. As you are aware, all DRI enforcement has been shifted only to the local government. As a result, both Broward County and the State of Florida are no longer involved in this process. Therefore, we are submitting the updated report to the City of Dania Beach for consideration with an application to abandon the Design Center of the Americas DRI under the City of Dania Beach' s application requirements. The report mirrors the format of the State-required reports in the past. The last report monitoring period was December 1, 2012 through November 23, 2015. This report begins on November 24, 2015 and goes through November 16, 2018. This report and supporting documentation has been revised since the first submittal to include more details in response to the staff comments received at the DRC meeting. We are resubmitting the application package with the understanding that this will now be reviewed by outside counsel in addition to the regular staff review. Further,the Applicant will provide a fence around the lake, or otherwise secure the lake area by securing the Design Center Site; widen the top of the embankment to a minimum of 8 feet, or construct all lake slopes to no steeper than 4-feet horizontal to 1-foot vertical. The surface water management system was determined to be satisfactory by Broward County on July 2, 2001. A protective fence has been installed to secure the lake area against possible trespass. C. The Applicant shall revise the complex source air quality permit to incorporate accurate traffic conditions and submit it to the Broward County Environmental Quality Control Board and the SFRPC, within 90 days of the date of issuance of the development order, for review and approval. In the event that air quality is projected to exceed State standards, the Applicant will prepare and submit, within 90 additional days, a management plan for project traffic, including, but not limited to, modified site design, parking restrictions and fees, car and van-pooling programs, and use of mass transit,to the SFRPC and the Broward County Environmental Quality Control Board for review and approval. The Applicant shall, in the event potentially significant historical or archaeological artifacts are discovered, delay construction until State and local historical preservation officials can survey the discovery. Potentially significant historical or archaeological artifacts have not been discovered on the project site. If the DRI is abandoned, development will follow the City's Land Development Code in accordance with historical or archaeological artifacts,should any be located. E. The Applicant shall implement all construction practices identified in the DRI Assessment to prevent wind and water erosion. Wind and water erosion is being prevented to the maximum extent possible through best management practices. If the DRI is abandoned, development will follow the City's Land Development Code and Florida Building Code in regards to prevention of wind and water erosion. F. The Applicant shall ensure regular sweeping of parking lots, roads, and other impervious + surfaces to reduce pollutant accumulations, and ensure that drainage trenches and water control structures are maintained and regularly cleaned of debris. The Applicant will incorporate these programs as requirements in all lease and sale agreements, where the tenant or purchaser is acquiring ownership or control over the applicable areas or structure. Regular sweeping of the impervious surfaces and maintenance of the drainage areas is being continued by DCOTA General Manager Brad Shepherd,where feasible. G.The Applicant shall permit irrigation only with non-potable water obtained; from the on-site land. Site irrigation water is being supplied by the on-site project lake. Irrigation is serviced through a contract with Superior Landscaping. H. The Applicant shall develop, in conjunction with the Broward County Environmental Quality Control Board, and implement an on-going water quality monitoring and maintenance program for the on-site lake. The Applicant will incorporate continuation of this program as a requirement in all lease and sale agreements in which the purchaser or lessee is obtaining control or responsibility for the lake. In December 2001, the Broward County Department of Planning and Environmental Protection and the City of Dania Beach determined that the permitting system satisfied Condition H. r I. The Applicant shall implement all energy conservation measures as proposed in the ADA. Further, the Applicant will evaluate all of the energy conservation measures listed on Pages 40 through 45 of the DRI Assessment and submit the analysis to the Broward County Energy Office 18 JO for review and comment and to the City and SFRPC for review and approval within 120 days of the issuance of the development order and implement the energy conservation measures determined to be feasible. These analyses have been submitted and feasible energy conservation measures are being implemented. In addition, note the following: • White rooftops were installed within the past 3 years in buildings A and B. • The tenant leases do not include electricity in the rent• which encourages energy conservation. • The tenant leases require window blinds to be kept closed to save on air conditioning. J. The Applicant shall remove all billboards on the project site visible from 1-95 prior to the issuance of any certificate of occupancy for Phase I development, except where said removal would constitute a breach of a lease agreement in existence on July 11, 1983, between the Applicant and a billboard site lessee. Application of the exception shall only be after review and approval of the existing lease agreement by the City Attorney and shall only apply until the billboard can be removed under the lease agreement. All billboards, visible from 1-95, which were not covered by standing lease agreements, were removed from the project site prior to the issuance of Certificates of Occupancy for Phase I. f K. The Applicant shall develop and submit to the SFRPC within one year of the date of issuance of the development order, or prior to certificate of occupancy is issued, whichever occurs first, for review and approval, the Design Center lease agreement that restricts project tenants in the design showrooms to wholesale uses only, as proposed in the ADA, and established, where applicable to areas leased, the responsibility for maintenance of the on-site lake, drainage greenbelts, and landscaping, pollutant-retardant structures, parking lots and security, and require flow restrictors in project lavatories, showers and commodes. Applicant will incorporate these programs as requirements in all lease and sale agreements, where the tenant or purchaser is acquiring ownership or control over the applicable areas or structures. The model lease agreement has been submitted,and has been incorporated into lease and/or sales agreements. L. The Applicant shall conduct, subsequent to approval by the SFRPC, and within six months after occupancy of the first 250,000 square feet of Design Center showroom area, a traffic monitoring program to determine average daily peak hour trips generated by the Design Center. If the SFRPC determines, upon review of the results of the monitoring program, that the resultant peak hour trips volumes are more than ten percent (109,o) above the volumes presented in the ADA, the Applicant will prepare and submit a revised transportation analysis including recommendations for improvements necessary to maintain acceptable levels of service on the roadway system and specified funding sources, to the SFRPC, Broward County, Florida Department of Transportation, and the City, for DRI review and approval by the SFRPC and City. Said monitoring program was completed and submitted, as required. 19 M. There shall be installed, with Broward County's approval, a traffic signal, loop detector, and control boxes at the main project exit on Griffin Road prior to the issuance of any Phase I certificate of occupancy. It is the City`s understanding that said improvements are included in and are part of the County's road improvements project for Griffin Road. However, if said improvement has not been installed by the County at the time the Applicant is seeking a certificate of occupancy for Phase I, then the applicant shall pay for same or demonstrate that the County will pay for or install same within a year. These improvements have been installed. See the 3 images below with descriptions. Upon notification 40 by the City that adequate right-of-way is available, the Applicant will construct according to City i specifications, or provide a bond, letter of credit, other acceptable guarantee thereto for the construction of Northwest 2nd Street from the project to Bryan Road, including necessary signage at the intersection of Bryan Road and Northwest 2"d Street, such construction to be completed as a part of the application for the issuance of building permits for Phase III of the project. In the event the City is unable to secure necessary right-of-way, pursuant to condition "V" below, the Applicant will prepare an alternative traffic plan, including recommendations for alternative improvements necessary to maintain acceptable levels of service on the roadway system and specified funding sources, and submit the plan for review and approval to the SFRPC, Broward County, and City prior to the issuance of a building permit for Phase III 00 development. The Applicant shall give the City six (6) months' notice prior to its making the of application for the building permit for Phase III to permit the City time to condemn said right- of-way in the event the Applicant has not already acquired same for the City. The City in turn will not proceed with any action to acquire said right-of-way without first receiving notice from the Applicant unless such earlier action is intended to be without the Applicant's financial participation. This condition has been deleted and replaced with the following condition as a result of approval of City of Dania Beach Ordinance No. 47-91: The Applicant shall pay the following Oamounts to the Florida Department of Transportation r ("FDOT") at the times indicated below as a fair share assessment for improvements to the intersections of 1-95 and Stirling Road and 1-95 and Griffin Road: (1) Prior to the issuance of a certificate of occupancy by the City for the Phase 3 Wholesale Showroom (260,000 square feet) -$37,493.46; (2) Prior to the issuance of a certificate of occupancy by the City for the Phase 3 Office Building(120,000 square feet) -$45,640.60; (3) Prior to the issuance of a certificate of occupancy by the City for the Phase 4 Wholesale Showroom (190,889 square feet) -$27,711.35. The Applicant has paid FDOT the required $37,493.46 described in Item N(I). The contributions described in Items N(2)and N(3) are not yet due (not constructed). 0.The Applicant shall develop a re-striping and signage plan for the intersection of Stirling Road and U.S. 1 to improve intersection capacity and levels of service as discussed on pages 34 and 35 of the DRI Assessment, submit the plan for review and approval to the Broward County Traffic Engineering Division, and implement the improvements prior to the issuance of building permits for Phase III development. This condition has been deleted as a result of adoption of City of Dania Beach Ordinance No. 47-91. P. The Applicant shall conduct traffic counts and signalization warrant analyses for the intersection of Bryan Road and Northwest 2nd Street, and U.S. 1 and Northeast 1st Street at the 22 to completion of the project Phases II and IV, submit the analyses to the City and Broward County Traffic Engineering Division for review and approval, and, if deemed necessary or desirable by the County or the City, install recommended signalization. The Applicant shall work with the Broward County Mass Transit Division to identify the appropriate timing and level of transit service to be provided to this development and, when needed, provide bus shelters on-site or along Griffin Road adjacent to the project. BCT Route 4 runs along Griffin Road, and a stop is located adjacent to the project. This Route also connects to the Tri-Rail station just west of 1-95. The schedule times are published online and in multiple printed sources.The developer has cooperated with BCT. The Applicant shall promote car-pdoling by working with Broward County Transportation 10 Planning Division to involve project tenants and their employees in car-pool computer matching yo1 programs. Car-pool computer matching programs are operated through South Florida Commuter Services and this service is made aware to the tenants and employees. With the proliferation of Uber, Lyft,and other ride-sharing services,the demand for carpooling has diminished. The V40 DCOTA facility operates valet parking for guests and makes this service available for free to �O any registered car-pool. to S. The Applicant shall modify the site plan to permit only inbound traffic at the project's west entrance on Griffin Road and revise the parking plan to restrict turning movements for at least 100 feet from Griffin Road within the project. These modifications have been made. As shown in the aerial image below,the inbound-only turn at the western entrance is designed to restrict turning movements for at least 100 feet from Griffin Road within the project. 24 to t T. The Applicant shall revise the Application for Development Approval to reflect necessary site plan access and parking modifications at the hotel entrance on Griffin Road, consolidate all original and supplemental information submitted to the SFRPC, into the revised Application for Development Approval, and submit the document to the SFRPC, City, the Broward County Office of Planning, the County Traffic Epgineering Divisions, the County Environmental Quality Control Board, and the State land planning agency within 180 days from the date of issuance of the development order. The CADA, including the subject revisions, has been completed and submitted to the appropriate agencies. U. The City will withhold issuance of any certificates of occupancy for the project development until all billboards on the project site visible from 1-95 have been removed except where there is a valid lease agreement that would prohibit the removal of a billboard at the time of the issuance of the certificate of occupancy. The billboard shall be removed as soon thereafter as permissible under the lease agreement. This is not applicable to the City to enforce since the applicant complied with the request. V. The City will obtain the necessary right-of-way for the extension of Northwest 2"d Street from the Property to Bryan Road upon receipt of notice to do same, which shall be due from the Applicant to the City six months prior to its application for a building permit for Phase III of the project. The City has a right to make an earlier acquisition of said right-of-way if it is not desirous of being reimbursed for such acquisition by the Applicant. Condition V has been deleted and replaced with the following condition as a result of adoption of City of Dania Beach Ordinance No.47-91: 25 +fO 4sA The City will withhold issuance of the respective certificate of occupancy until the Applicant 110 provides the City with a signed receipt or other documentary evidence indicating that the amount set forth below relating to the specific development approved by that certificate of occupancy has been paid to MOT as provided below: (1) Phase 3 Wholesale Showroom (260,000 square feet) -$37,493.46; (2) Phase 3 Office Building (120,000 square feet) -$45,640.60; + (3) Phase 4 Wholesale Showroom (190,889 square feet) -$27,711.35. The City will withhold issuance of any certificates of occupancy for the project development until the terms of the condition "M"above are met. To the best of the applicant's knowledge,the City is complying with this condition. Z. In the event the City is unable to obtain necessary right-of-way for the extension of Northwest 2"d Street from the Property to Bryan Road, the City will withhold issuance of Phase III building permits until a revised traffic access plan and recommendations for alternative improvements necessary to establish acceptable levels of service on the roadway system, r including specification of funding sources, has been reviewed and approved by the SFRPC, Broward County and the City. The City will withhold issuance of any Phase ill and Phase IV certificates of occupancy until Northwest 2"d Street is completed as a 2-lane road between the Property and Bryan Road or until alternative improvements, as approved by the SFRPC, Broward County and City, pursuant to Condition 'T' above,are constructed; This condition has been deleted as a result of adoption of City of Dania Beach Ordinance No. 47-91. The City will review the results of the traffic analyses conducted pursuant to Condition "L", above, and consistent with the SFRPC's comments, modify the development order for consistency with the recommended transportation improvements. The procedure includes an application for this action through the City of Dania Beach. In a recent set of comments from the City's Development Review Committee (DRC), the committee requested a traffic statement that indicates the current status (existing conditions) of vehicle counts in and out of the DCOTA site, as well as the estimates if full tenant/hotel guest occupancy of the current buildings were achieved. This Traffic Statement addresses these issues. The Design Center of the Americas (DCOTA, is a major showroom center serving the design community with the finest campus amenities and showrooms in the industry attracting world-class designers, architects, decorators, dealers and their clients. The DCOTA consists of one four-story office building of approximately 60,000 square feet (1815 Building) and three showroom/commercial buildings totaling about 777,330 square feet.' An existing hotel is currently under re-construction and will have 245 rooms. This hotel has been closed for reconstruction for almost a year, but is expected to be completed by the end of 2019. DCOTA showrooms are open to-the-trade, Monday through Friday from 9:00 AM to 5:00 PM. The City Engineer was concerned that the June 2018 data may be dated, although it was obtained less than one year ago. As such, the 2018 intersection volumes were adjusted through the application of a growth factor to estimate 2019 volumes For purposes of this analysis, the intersection were adjusted to reflect estimated 2019 volumes by applying an annual growth rate of 0.82%. This rate was determined based on five-year volume information obtained at FDOT stations within the study area (see Table 1). The ITE trip rates associated with occupied hotel rooms were applied to the 245-room hotel. As shown in the table, the total AM peak-hour volume is estimated to be 1,331 vehicle trips (1,234 inbound and 127 outbound) and the PM peak-hour volume is 1,181 vehicle trips (125 inbound and 1,065 outbound). In these cases, the trip generation estimates include the hotel in the internalization mix, but no pass-by trips are applied. The internalization matrices are provided in Appendix D. In general, Broward County commute times are longer than the typical Florida resident. In Broward County,only 7.5%of employed residents can reach work within 10 minutes,which is lower than the comparable state figure. In fact,55.4%of Broward residents can travel to work within 30 minutes, compared with 60.1%of Florida residents. More than 8%of Broward residents have commute times greater than 60 minutes. Level of service is a measure that describes the quality of traffic service along a given roadway segment.A large component in evaluating a roadway's LOS is the volume of cars compared to the design capacity of the roadway.As this ratio approaches 1.0,congestion increases and travel speeds decrease, resulting in diminished levels of service.Additional factors,such as the number of lanes, travel speed, and density of traffic contribute,to formulating LOS scores,which are based on a scale of"A" (free-flow)to"F" (failing with significant delays). In the 2017 LOS map, roadway segments with scores of"D"or worse are primarily found east of 1-95 and south of 1-595.Severely congested roadways that extend across the county become more congested closer to Miami, particularly around Hollywood. Chaptek 380.06, Florida Statutes, placed the responsibility on the developer of an approved development of regional impact (DRI) for submitting a biennial report to the local government, the regional planning agency, the Department of Economic Opportunity, and to all affected permit agencies . On April 9, 2018, Florida' s Governor signed into a law a bill that significantly amended Chapter 380 . 06, Florida Statutes, and removed the requirements for monitoring reports to be submitted to the Department of Economic Opportunity or the regional planning agency. As a result, both Broward County and the State of Florida are no longer involved in this process . The report mirrors the format of the State-required reports in the past. The last report monitoring period was December 1, 2012 through November 23, 2015 . This report begins on November 24, 2015 and goes through November 16, 2018 .
