Call to Order/Roll Call Mayor Lewellen called the meeting to order at 7:05 p.m. Present: Mayor: Lori Lewellen Vice-Mayor: Lauren Odman Commissioners: Chickie Brandimarte Bill Harris Tamara James City Manager: Ana M. Garcia, ICMA-CM City Attorney: Thomas Ansbro City Clerk: Thomas Schneider 2. Moment of Silence and Pledge of Allegiance Mayor Lewellen called for a moment of silence after the Pledge of Allegiance to the United States Flag. 3. Presentations and Special Event Approvals 3.1 Presentation on Olsen Middle School Magnet Program by Principal Valerie Harris Michael Fridell, Magnet Coordinator, distributed information to the Commission and provided an overview of Olsen's Magnet Program. 3.2 Special presentation from the 2019 U.S. Conference of Mayors - Commissioner Harris Commissioner Harris presented a short video shown at the recent U.S. Conference of Mayors, and shared his thoughts on the video. 4. Proclamations 4.1 St. Ruth Missionary Baptist Church 11 Ith Anniversary - Mayor Lewellen Mayor Lewellen read the St. Ruth Missionary Baptist Church I I Ith Anniversary Proclamation and presented it to Albert Jones. 5. Citizen Comments Vivek Golikgri, 301 SE 3rd Street, spoke about the need for enhanced security in transit areas that are vulnerable, such as bus stops. Terrance McElroy, Lighthouse Community Church, commented on the video presented by Commissioner Harris. He provided an update on the church's Adopt a School Mentoring/Tutoring Program and the need for volunteers to mentor. Shawn DeRosa, 408 SE 5 h Street, spoke of repeat violators of noise violations and vacation rental properties. He felt we should all get together to diligently enforce our noise ordinance. Vice-Mayor Odman asked that Mr. DeRosa continue sending emails regarding violations. Gunnar Magliucca, 317 SE 4 Terrace, commented on the City Center Redevelopment project and his dislike for it. 6. Public Safety Reports Captain Daniel Marks, BSO Chief of Police, spoke of the success of the kids fishing event held on August 9t'. He reported on incidents occurring sporadically in other locales where a group is going to homes pretending to be government officials and robbing the homes. He advised residents to call BSO immediately if this ever occurs in Dania Beach. Captain Sergio Pellecer, BSO District Fire Chief, reported on activities during his first month as Chief in Dania Beach. 7. The motion carried unanimously. 7.3 RESOLUTION#2019-086 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA, AUTHORIZING THE PROPER CITY OFFICIALS TO EXECUTE A ONE (1) YEAR RENEWAL OF THE Minutes of Regular Meeting 4 Dania Beach City Commission Tuesday,August 27,2019—7:00 p.m. EXISTING AGREEMENT WITH BEACH RAKER, LLC, FOR BEACH CLEANING SERVICES WHICH SERVICES SHALL NOT EXCEED THE ANNUAL AMOUNT OF ONE HUNDRED SIX THOUSAND ONE HUNDRED FORTY TWO DOLLARS AND FORTY CENTS ($106,142.40); PROVIDING FOR CONFLICTS; FURTHER,PROVIDING FOR AN EFFECTIVE DATE. City Attorney Ansbro read the title of Resolution#2019-086. Vice-Mayor Odman noted she had asked the City Manager some time ago if actual raking is best practice. Eric Brown, Director of Parks and Recreation, explained the practices Beach Raker performs, which are safe. With the small amount of moss and seaweed we have, they are making sure no plastic or glass is in the seaweed that is buried. Vice-Mayor Odman requested we keep our eye on what the other cities are doing because the industry is changing quickly. Commissioner James motioned to adopt Resolution #2019-086; seconded by Vice-Mayor Odman. The motion carried unanimously. 8. Bids and Requests for Proposals 8.1 RESOLUTION#2019-094 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF DANIA BEACH,FLORIDA,RELATED TO REQUEST FOR PROPOSALS (RFP NO. 19-006) CITY CENTER REDEVELOPMENT OPPORTUNITY PUBLIC PRIVATE PARTNERSHIP; AUTHORIZING THE CITY MANAGER TO ESTABLISH A NEGOTIATING TEAM TO ENTER INTO NEGOTIATIONS FOR A DEVELOPMENT AGREEMENT WITH ARMADA HOFFLER PROPERTIES/CAPITAL GROUP (DANIA BEACH CITY CENTER LLC) IN FURTHERANCE OF THE CITY CENTER REDEVELOPMENT PROJECT; PROVIDING FOR CONFLICTS; FURTHER,PROVIDING FOR AN EFFECTIVE DATE. City Attorney Ansbro read the title of Resolution#2019-094. Kevin Greiner, FIU Metropolitan Center, and Ken Krasnow, Collier's International, members of the RFP evaluation committee, provided an overview regarding the selection process which is attached to and incorporated into these minutes. Vice-Mayor Odman noted she attended the community charrette; the priorities displayed did not coincide with the priorities at the charrette. Mr. Greiner noted the list in the presentation was not in numerical priority order. Commissioner Brandimarte commented she has a problem with a 14-story building; there is more homework that needs to be done on this project. Minutes of Regular Meeting 5 Dania Beach City Commission Tuesday,August 27,2019—7:00 p.m. Commissioner James spoke of developments approved in the past and the conversations about the current City Hall. This has been a public process and no project will be voted on tonight. She asked if we decide to move forward, whether we will be able to put in place that local companies and workers will be utilized in the construction. Commissioner Harris agreed there is a lot of negotiation to be done, and questioned the demolition of the Nyberg-Swanson House and the Women's Club building. Mayor Lewellen addressed the issue of the presentations before the evaluation committee being held with the public not allowed to be present. The way the project was publicized made it sound like this is a done deal; we just received a $1.8 million grant for City Hall. Any decisions related to this project have to be out in the public eye. She noted the item on the agenda is to approve negotiating, but she is concerned water and roads issues will arise. Commissioner Brandimarte spoke of the details of this item that authorizes the City Manager to begin negotiations. Mr. Krasnow advised the Commission they have the steering wheel and ultimately control this process. Commissioner Brandimarte stated any committee formed would not represent the Commission decision-making. City Manager Garcia explained how she would never recommend anything that is not in the best interest of the City. This is very early in the process, and she envisions historic preservation. Commissioner Harris said we need to know how this project would fit into our strategic plan. This resolution is just for getting people to the table to communicate the City's vision. Rickelle Williams, CRA Executive Director, spoke of the evaluation committee and the selected vendor proposal. Mario Caprini, CEO and Richard A. Cohen, COO, Capital Group, gave a PowerPoint presentation which is attached to and incorporated in these minutes. Discussion ensued regarding overall development approach, alignment of goals of the City Charrette objectives, focus on Workforce Housing Model, and proposed development timeline.. Charlotte Sloboda, 2905 Lakeshore Drive, noted the developer has made it clear that the City is in control of this project. Carol Hemmis, 214 SW 6th Street, felt that we should not develop something so big that it does not feel like Dania Beach any longer. Commissioner Harris motioned to adopt Resolution #2019-094; seconded by Commissioner James. Public Hearings and Site Plans City Attorney Ansbro advised the remaining items, with the exception of item 9.2, were quasi- judicial hearings and swore-in those who would speak. He asked the Commission to disclose any communication they had on these matters. 9.1 ORDINANCE#2019-010 AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF DANIA BEACH,FLORIDA,APPROVING THE DEVELOPMENT OF REGIONAL IMPACT ABANDONMENT REQUEST (OT-85-18) SUBMITTED BY JOHN D. VOIGT, ESQ. ON BEHALF OF THE DESIGN CENTER OF THE AMERICAS FOR PROPERTY LOCATED AT 1855 GRIFFIN ROAD, IN THE CITY OF DANIA BEACH, FLORIDA, AS LEGALLY DESCRIBED IN EXHIBIT "A;" PROVIDING FOR CONFLICTS; AND FURTHER, PROVIDING FOR AN EFFECTIVE DATE. Because the Board makes a recommendation to the City Commission, the item would need to be continued until the September 23id Commission meeting in order for the Planning & Zoning Board to hear the item at their September meeting. City Attorney Ansbro read the title of Resolution 42019-096. Corinne Lajoie, Planning & Zoning Manager, gave an overview of the site plan modification and variance requests for the Tru Hotel. Commissioner Brandimarte questioned why spaces in the City parking garage were no longer needed. Nectaria Chakas, Lochrie and Chakas Law firm, representing the applicant, explained why the hotel no longer needed the parking. Commissioner James questioned how the Morrison Hotel is doing without the parking and asked why the Tru hotel has decided to make changes to their site plan. Marc LaFerrier, Director of Community Development, addressed hotel parking across the City. Mayor Lewellen opened the Public Hearing. Seeing as there was no one to speak in favor or opposition, she closed the Public Hearing. Commissioner Harris motioned to adopt Resolution #2019-096; seconded by Commissioner James. The motion carried unanimously. 10. Discussion and Possible Action 10.1 Pet Friendly City- Mayor Lewellen Mayor Lewellen spoke of the steps and requirements to become certified as a pet friendly City and the exposure it brings for future residents and travelers who come to our hotels and restaurants. Commissioner James asked what kind of pets would be included. Candido Sosa-Cruz, Assistant City Manager, explained how businesses and hotels would provide pet accommodations that are open and inviting to pet owners. The certification is a new way to promote and attract people to the City at no cost. Minutes of Regular Meeting 9 Dania Beach City Commission Tuesday,August 27,2019—7:00 p.m. Commissioner Brandimarte noted tourists rated AirBnb as number 1 and pet friendly as number 2 for desired preferences. The Commission consensus was to move forward with this item. 10.2 Citywide reduction of glyphosate based fertilizer-Vice-Mayor Odman Vice-Mayor Odman spoke of research she has done on impaired bodies of water, particularly the Dania Beach Cutoff Canal. Florida Statute 403.067 requires we follow best practices, and she questioned if the City could change from using glyphosate fertilizer to a non-glyphosate fertilizer. The Commission consensus was to move forward with having Public Services work with the City Manager in requiring that our landscape company use only non-glyphosate fertilizer. 10.3 Air BNB Affidavit - Commissioner James Commissioner James noted we are trying to add a layer of protection when it comes to Air BNBs and sexual offenders in order to heighten security of our residential neighborhoods. Marc LaFerrier, Director of Community Development, explained staff thinks it will take a code amendment to establish an affidavit after having researched other cities that have followed suit; this could be brought back to the Commission in 30-45 days. City Manager Garcia noted we are proposing to put together a brochure to inform Air BNB renters of what our exceptions are, and the consequences of not abiding by them to ensure the quality of life for our residents. Commissioner Harris asked if signing the affidavit would be mandatory when renting a short term rental. Community Development Director LaFerrier stated they would register with the police department, following state law. The host of the short term rental would require the disclosure of information. Commissioner Brandimarte asked if we could force the owner of the property to frame this as a set of rules. City Attorney Ansbro responded the requirement of posting rules is already in effect in our code of ordinances. City Manager Garcia noted we also need to put it in Spanish as well as English. Appointments 12.1 Complete Count Advisory Committee—no appointments Commissioner James asked if a member could work for the City. Marc LaFerrier, Director of Community Development, noted it is a participatory committee and there are no restrictions on those who may be appointed. It would operate on best practices. Commissioner James asked something be brought back with structure, such as meeting times. Director of Community Development LaFerrier explained they would not meet more than once or twice per month. He will prepare some information for the Commission to give to their prospective appointees. Commissioner Harris appointed Patrick Ferrante to the Marine Advisory Board to replace Joe White. Commissioner James motioned to approve the appointments; seconded by Commissioner Harris. The motion carried unanimously. Administrative Reports 13.1 City Manager City Manager Garcia reported we will be getting a substation for BSO EMS at Dania Pointe as well as a substation for BSO Police; the completion date is Fall of next year. She also-reported we have been able to secure a fire truck from BSO that we will not have to pay towards for a year, and have been awarded a $1.8 million grant from FEMA to harden City Hall. She noted the Emergency Operations team will meet Wednesday morning regarding Hurricane Dorian. 13.2 City Attorney City Attorney Ansbro reported Priloux has moved out from across the street from City Hall and commented on the code fines they accrued.
