DANIA BEACH CITY COMMISSION
TUESDAY, SEPTEMBER 10, 2019 - 7:00 P.M.
1. Call to Order/Roll Call
Mayor Lewellen called the meeting to order at 7:00 p.m.
Present:

2. Moment of Silence and Pledge of Allegiance
Mayor Lewellen called for a moment of silence after the Pledge of Allegiance to the United
States Flag.
3. Presentations and Special Event Approvals
3.1 Dania Beach Chamber of Commerce update by Randie Shane
Ms. Shane was unable to attend the meeting.
3.2 West Lawn Cemetery Rededication- Requested by Commissioner James
Commissioner James noted she had provided a draft program for the rededication for the
Commission to review. She gave a brief history of the cemetery and the background for the
rededication, and noted we need to choose a date since the original date was cancelled.
Mayor Lewellen commented the entire Commission should attend and questioned naming a
street in the cemetery; she felt we should follow City policy. She also expressed concern about
the invitation list; there were people who felt excluded.
Discussion ensued regarding how the street renaming policy would apply.
Attorney Gougelman explained the street renaming policy is vague. He suggested holding a
public hearing and passing a resolution to make sure we are in compliance with the policy. The
City would be the applicant, signing the application.
Commissioner Brandimarte suggested voting on a motion.
Commissioner James explained how this could be accomplished through a consensus and then
holding a public hearing.
Mayor Lewellen noted her concern that she just received this information; she would like time to
digest it.
Commissioner Harris felt we should go through the proper channels.
Jimmy Peterman, 717 SW 4d' Terrace, spoke of the community he lives in not knowing anything
about a street being renamed in the cemetery. Additionally, the person whose name was chosen
lived in Hollywood.
Derrick Hankerson, 746 SW 3rd Street, spoke in favor of opening up the renaming process to the
public.
A brief discussion ensued.
Attorney Gougelman further explained the process for the street renaming application, whereby
the City would be the applicant, and the required public hearing. He suggested the event perhaps
should be held in October to allow time for the process.
The Commission consensus was to hold the rededication on September 27, 2019 at 10:00 a.m.
4. Proclamations
There were no proclamations at this meeting.
5. Citizen Comments
Craig Valentine, 1982 Tigertail Boulevard, gave an update on the second annual cancer event to
be held in October and the MLK event.
Michael Sartin, 746 SW 3rd Street, spoke of the car charging station in the City parking garage,
median income in Dania Beach and attracting high wage jobs, as well as street renaming.
Ronald Koeniq, 360 SE 6 Street, spoke of the noise and trash problems created from an Airbnb
in his neighborhood.

the opening of Saratoga Apartments and the waiting list opening up for seniors on September h
6. Public Safety Reports
Captain Daniel Marks, BSO Chief of Police, reported on recent criminal activity in the City and
on commercial vehicle enforcement statistics. He also reported on the BSO homeless outreach
program.
Captain Sergio Pellecer, BSO District Fire Chief, reported on City relief efforts undertaken for
Hurricane Dorian victims in the Bahamas.

9.1 ORDINANCE#2019-011

Attorney Gougelman read the title of Ordinance#2019-011.
Mayor Lewellen opened the Public Hearing. Seeing as there was no one to speak in favor or
opposition, she closed the Public Hearing.
Vice-Mayor Odman said she spoke with Assistant City Manager Sosa-Cruz, and there is a back
order of paper straws and budget readjustments are needed; we should give businesses time to
make adjustments.
City Clerk Schneider noted the citywide ban would take effect January 1, 2020; until that time,
Code Compliance will enforce the existing prohibition.
Commissioner James motioned to adopt Ordinance #2019-011, on second reading;
seconded by Vice-Mayor Odman. The motion carried unanimously.
9.2 ORDINANCE#2019-012
AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA, AMENDING
CHAPTER 27 OF THE CITY CODE OF ORDINANCES BY ADDING ARTICLE V TO CHAPTER 27, SUCH
ARTICLE TO BE ENTITLED "STORMWATER REGULATIONS"RELATING TO THE NATIONAL
POLLUTION DISCHARGE ELIMINATION SYSTEM STORMWATER PROGRAM ("NPDES"); PROVIDING
FOR STORMWATER PLAN REQUIREMENTS ILLICIT DISCHARGE DETECTION AND ELIMINATION

Attorney Gougelman read the title of Ordinance #2019-012.
Vice-Mayor Odman noted she saw language in the ordinance about fertilizer, but she did not see
anything about glyphosate based fertilizer, which she had requested.
Fernando Rodriguez, Director of Public Services, explained the provisions related to fertilizer
and the weed killer Roundup. He noted the City's landscaper abides by Article 5 in the
ordinance; they will fade out Roundup and begin implementing the Cheetah Pro fertilizer.

Vice-Mayor Odman commented though the new implemented fertilizer may not be as medically
harmful as Roundup, in terms of the best of best practices, even small amounts of Cheetah Pro
glyphosate still are not acceptable; she would rather not use any of it. Even if the Cheetah Pro is
an improvement, she wants to sit down with Public Services Director Rodriguez and talk it out to
become more familiar with it.
Commissioner Brandimarte questioned the organic fertilizer used by the PATCH.
Vice-Mayor Odman explained we do not know what is being used on property around the
PATCH.

Vice-Mayor Odman motioned to continue Ordinance #2019-012, on second reading, until
September 23, 2019 at 7:00 p.m.; seconded by Commissioner James. The motion carried
unanimously.
9.3 ORDINANCE #2019-013

Corinne Lajoie, Planning & Zoning Manager, noted the applicant requested to continue this item

Mayor Lewellen opened the Public Hearing. Seeing as there was no one to speak in favor or
opposition, she closed the Public Hearing.
Vice-Mayor Odman motioned to continue Ordinance #2019-015, on first reading, until
September 23, 2019 at 7:00 p.m.; seconded by Commissioner James. The motion carried
unanimously.
10. Discussion and Possible Action
10.1 Hurricane relief for the Bahamas - Mayor Lewellen
Mayor Lewellen noted the Bahamas relief is going to be an ongoing effort and she would like to
do it again. The next time it could be planned better and we could have flyers with our logo on
them.
Commissioner James felt all of the Commission should have input before a decision is made
regarding providing relief. She noted the problem is not going to be the goods, but will be
money and construction. She suggests it not be goods; perhaps we could team up with a non-
profit to raise and send funds.
Mayor Lewellen suggested we do something in three months, and assess what the needs will be
prior to that time.
City Manager Garcia noted Russell Benford, Sr. Vice-President of Government Relations for
Royal Caribbean, gave her the contact to send the relief supplies to. She recommended
continuing to work with Mr. Benford and as many non-profit agencies within the City in order to
provide a true team effort.
The Commission consensus was to move forward with plans to provide future relief efforts for
the Bahamas.
10.2 Move Tuesday, October 22, 2019 City Commission meeting to Tuesday, October 29,
2019 - City Manager Garcia
City Manager Garcia noted Commissioner Harris would be representing Dania Beach and the
Broward League of Cities as the Delegation from the Florida League of Cities travels to
Washington, D.C. from October 22-24 to meet with Senators and Representatives to discuss key

topics affecting Florida, such as short-term rentals and affordable housing. She also noted she
would be attending the ICMA Annual Conference from October 19-23.
Commissioner James noted she would not be available on October 29th
The Commission consensus was to move the October 22, 2019 City Commission meeting to
Monday, October 28, 2019.
11. Commission Comments
11.1 Commissioner Brandimarte
Commissioner Brandimarte spoke of the recent hurricane, and noted her Seniors Club did not
meet that week. There were containers staged at I.T. Parker the day of the canceled meeting; this
should not be done again without notice given.
11.2 Commissioner Harris
Commissioner Harris spoke of the Broward MPO Cost Feasible Plan; projects have to be
submitted by October and the County sales tax meetings are soon to come. He also spoke of
market rental rates in the Tri-County area and Broward County being the highest.
Commissioner Harris asked when the entranceway sign at Griffin Road and US-1 would be
completed.
Marc LaFerrier, Community Development Director, said the sign is in fabrication and gave the
timeline for permitting and installation. He felt it should be completed around Thanksgiving,
and noted EDSA would provide the landscaping plan.
Commissioner Harris questioned the length of time it has taken Popeye's to open.
Community Development Director LaFerrier responded he spoke to the most recent contractor
and it would be 60-90 days before the opening.
Bobbie H. Grace, 110 NW 8t'Avenue, addressed item 3.2, West Lawn Cemetery Rededication.
11.3 Commissioner James
Commissioner James noted she has 50 complimentary tickets for the University of Miami game
this Saturday, which are being made available to 40 children through the Parks & Recreation
Department.

Commissioner James also noted she has heard from people who are upset they will not be invited
to the City's 115th Anniversary celebration at Tropical Acres.
City Manager Garcia felt the Commission should invite advisory board members and then open
up a few tables for people to pay if they would like to attend.
Commissioner James referenced a past anniversary event where tickets were purchased versus
invitation only in order to make the process fair.
Mayor Lewellen agreed with Commissioner James.
City Manager Garcia felt it was important we meet with Tropical Acres to get a number from
them for the available seating and coming back to open it up to the public.
Mayor Lewellen said we need to confirm from Tropical Acres and then figure out where we go
from there.
Commissioner James suggested creating a City Commission budget line item for $10,000.00 just
as the CRA did for the 115th Anniversary.
Commissioner James noted she has been working on a STEM Program at the FAU facility, and
they want to give the Commission a boat ride and tour of their facilities on October 10. She
applied for a grant with FAU as co-applicant for a STEM program in our City.
Commissioner Harris commented it would be a wonderful opportunity to show our charity by
charging $10.00 for a ticket to the Tropical Acres event and donating the proceeds to hurricane
relief.
Mayor Lewellen felt the proceeds from the tickets sales should be used for a Dania Beach cause,
specifically for a scholarship or Dania Beach event.
Vice-Mayor Odman felt the Historical Society could benefit from being tied into the anniversary
celebration ticket sales proceeds.
Commissioner James commended City Manager Garcia, Assistant City Manager Sosa-Cruz and
staff for their leadership and dedication during the hurricane preparation.
11.4 Vice-Mayor Odman
Vice-Mayor Odman recognized the City team that came together for hurricane preparations, and
noted there are 20 days left for entering into the Rename the City contest.
11.5 Mayor Lewellen
Mayor Lewellen thanked City staff for their hard work during preparation for the hurricane.

Vice-Mayor Odman appointed Craig Valentine to replace Alexis Guillen.
Commissioner James motioned to approve the appointments; seconded by Commissioner
Brandimarte. The motion carried unanimously.
13. Administrative Reports
13.1 City Manager
City Manager Garcia addressed preparations made for Hurricane Dorian; elected officials,
residents and City administration teamed up and executed the preparations in a proactive manner.
She noted the partnership with the Casino for sandbag distribution; the preparedness was a
defining moment for the City.
13.2 City Attorney
Attorney Gougelman had no comments.
