AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF DANIA
BEACH, FLORIDA, AUTHORIZING BY VOLUNTARY PETITION THE
ANNEXATION OF LAND (22,425 SQUARE FEET, LOCATED BETWEEN
ANGLERS AVENUE ALSO KNOWN AS RAVENSWOOD ROAD AND SW
22ND AVENUE, SW 42 ND STREET, AND SW 39TH STREET), WHICH REAL
PROPERTY IS OWNED BY SMS OF SOUTH FLORIDA, INC., A FLORIDA
CORPORATION, INTO THE CORPORATE LIMITS OF THE CITY OF
DANIA BEACH, FLORIDA, PURSUANT TO SECTION 171.044, FLORIDA
STATUTES, AND PROVIDING A LEGAL DESCRIPTION OF THE
PROPERTY SUBJECT TO THE VOLUNTARY ANNEXATION; PROVIDING
FOR PUBLICATION OF NOTICE; PROVIDING FOR FILINGS WITH THE
APPROPRIATE GOVERNMENTAL AGENCIES; PROVIDING FOR
SEVERABILITY; PROVIDING FOR CONFLICTS; FURTHER, PROVIDING
FOR AN EFFECTIVE DATE.
WHEREAS, per Section 171.044, Florida Statutes, an application for a voluntary
annexation of a parcel of land presently located within unincorporated Broward County (22,425
square feet, located between Anglers Avenue also known as Ravenswood Road and SW 22 nd
Avenue, SW 42nd Street, and SW 39h Street) has been filed with the City of Dania Beach (See
Attachment "A") by the Applicant/Owner, SMS of South Florida, Inc., A Florida Corporation;
and
WHEREAS, the City has determined that all owners of the subject property have
executed the petition for voluntary annexation (See Attachment "B"); and
WHEREAS, the City has determined that the subject property is contiguous to the City
of Dania Beach, is reasonably compact, and that its annexation would not create an enclave; and
WHEREAS, the City has determined that it is able to provide certain essential services,
such as police and fire protection, for the subject property (See Attachment "C"); and
WHEREAS, the City has determined that the application is in compliance with the
pertinent annexation requirements of Chapter 171, Florida Statutes; and
WHEREAS, the affected property owner and governmental jurisdictions have been
notified according to the laws of annexation;
NOW THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE
CITY OF DANIA BEACH, FLORIDA, THAT:
Section 1. The City Commission of the City of Dania Beach, Florida, annexes
pursuant to a voluntary annexation petition a parcel of land legally described below, a map of
which is shown on Attachment "A", incorporated into this Ordinance.
LEGAL DESCRIPTION OF TRACT TO BE ANNEXED
2161 SW 42 nd Street and 2181 SW 42 Street, Dania Beach, and SW 22 d Avenue,
Unincorporated Broward, Florida 33312
Issuing Office File Number; Lehmkuhl D, in Plat Book 30, Page 3 1, of the Public
Records of Broward County, Florida. Parcel 2 and 3, Lots 6 and 7, Block 1,
"Ravenswood Park," according to the Plat thereof, as recorded in Plat Book 30,
Page 3 1, of the Public Records of Broward County, Florida.
Section 2. The subject parcel to be annexed shall maintain its present Broward
County land use and zoning classification until such time as the City amends its Comprehensive
Plan and Future Land Use Map to include the annexed territory.
Section 3. Subsequent to the effective date of this annexation, any resident in the area
to be annexed by this ordinance into the City of Dania beach, shall be deemed to have met any
residency requirements for candidacy for municipal office.
Section 4. Nothing in this ordinance shall be construed to affect or abrogate the rights
of parties to any contract, whether the same be between Broward County and a third party or
between nongovernmental entities, which contracts are in effect prior to the effective date of the
annexation.
Section 5. Within seven (7) days after the adoption of this Ordinance, the City Clerk
shall file a certified copy of this Ordinance with the Broward County Clerk of the Court, with the
Broward County Administrator, and with the Florida Department of State.
Section 6. All ordinances or parts of ordinances and all resolutions or parts of
resolutions in conflict with this Ordinance, are repealed to the extent of such conflict.
Section 7. If any section, clause, or provision of this Ordinance is for any reason held
invalid or unconstitutional by a court of competent jurisdiction, the holding shall not affect the
validity of the remaining portions of this Ordinance.

Dear Ms. Garcia:
Pursuant to our earlier conversations with you and your city staff, we represent
Academy Express LLC and Franmar Properties of South Florida, LLC relative to certain
properties owned by Franmar Properties of South Florida, LLC ("Owner") in unincorporated
Broward County. The Owner is preparing to improve these properties and desires to
undertake a petition for voluntary annexation to the City of Dania Beach. Contiguous parcels
acquired by the Owner simultaneous with the subject properties are already in the City of
Dania Beach and will be going through a rezoning in the near future. Once the subject
properties have been annexed the Owner will file an application for their rezoning as well.
We wish to thank you and acknowledge the gracious welcome that you and the City
have provided to our clients. We look forward to being corporate citizens of the City of Dania
Beach.

Franmar Properties of South Florida, LLC, a Florida limited liability company hereinafter ("Owner) being the sole
owner of the following described real property located within Broward County, Florida, and pursuant to Florida
Statutes Section 171.044 hereby consents and agrees to the annexation of such property by the City of Dania
Beach, Florida and further requests the City of Dania Beach to forthwith undertake annexation proceedings to
annex the said real property described as:

Legal Description: See Exhibit "A" ("Unincorporated Property")
Owner is the sole owner of adjoining property within the City of Dania Beach ("Dania Property") and seeks
annexation of the Unincorporated Property in order to join them for future development. Annexation will allow
for consistent development criteria which we believe will benefit both Owner and the City of Dania Beach.
Information from the Broward County Property Appraiser for the Unincorporated Property is attached as Exhibit
"A". No part of the Unincorporated Property is included within the boundaries of another municipality.
