MINUTES OF REGULAR MEETING DANIA BEACH CITY COMMISSION MONDAY, OCTOBER 7, 2019 - 7:00 P.M. 1. Call to Order/Roll Call Mayor Lewellen called the meeting to order at 7:00 p.m. Present: Mayor: Lori Lewellen Vice-Mayor: Lauren Odman Commissioners: Chickie Brandimarte Bill Harris Tamara James City Manager: Ana M. Garcia, ICMA-CM City Attorney: Thomas Ansbro City Clerk: Thomas Schneider 2. Moment of Silence and Pledge of Allegiance Mayor Lewellen called for a moment of silence after the Pledge of Allegiance to the United States Flag. 3. Presentations and Special Event Approvals 3.1 Ocean Park at Dania Beach Update by Kenneth Krasnow, Vice Chairman, Colliers International Kenneth Krasnow, Vice Chairman, Colliers International, gave a PowerPoint presentation, which is attached to and incorporated into these minutes. 3.2 Dania Beach Chamber of Commerce update by Randie Shane Ms. Shane gave an update of her new office at City Hall, the Hollywood Chamber's event at the Gallery of Amazing things, and grand openings of several new businesses during October. 3.3 Special Event request from the City of Dania Beach Community Redevelopment Agency for Dania After Dark Events to be held on SW 1st Avenue between Dania Beach Boulevard and SW 1 st Street, on October 12, November 9, and December 14, 2019 and January 11, February 1, March 14, April 11, May 9, June 13, July 11, August 8, and September 12, 2020 from 5:00 p.m. to 10:00 p.m. The applicant is also requesting road closures on SW Ist Avenue, and BSO Police and Fire Services. Commissioner Harris motioned to approve the Special Event request for the Dania After Dark events; seconded by Vice-Mayor Odman. The motion carried unanimously. 4. Proclamations 4.1 Domestic Violence Awareness Month- Women in Distress Mayor Lewellen read the proclamation for Domestic Violence Awareness Month and presented it to Yimalisse Nazario, Prevention Specialist with Women in Distress. Ms. Nazario thanked the City for its ongoing support of their programs and its commitment to bringing awareness to this issue. 4.2 Breast Cancer Awareness Month- Mayor Lewellen Bobbie Grace, 110 NW 8th Avenue, invited everyone to participate in the Breast Cancer Awareness event to be held at the Casino on October 13th. Mayor Lewellen read the proclamation for Breast Cancer Awareness Month. 5. Citizen Comments Jeffrey Roberson, 106 SW 5th Court, expressed concerns about Saratoga Apartments' application process and the potential gentrification from south of Old Griffin Road to Bryan Road. Colynn Mae Jones, 22 NW 14th Avenue, commented she heard there are seven lanes of traffic planned for Bryan Road. She spoke on the rezoning of land next to Dania Beach Canal and Bryan Road and requested no entertainment be allowed. Pastor Gary Scott, St. Ruth Missionary Baptist Church, 145 NW 5th Avenue, introduced himself to the Commission. Bobbie Grace, 110 NW 8th Avenue, noted she had spoken to the County about the 115th Birthday celebration and they have money to provide assistance to us. Fred Beneby, 995 Village Trail, Port Orange, Florida, spoke of honoring Marvin Merritt, who witnessed the removal of bodies at the Liberia Community Hollywood Cemetery that were put into a common grave, which is now West Lawn Cemetery. Robert Mikes, 601 NW 7th Street, commented on the cemetery and buildings in the City. Michael Sartin, 746 SW 3rd Street, questioned why citizens cannot have access to the presentation technology in the Chamber. Minutes of Regular Meeting 2 Dania Beach City Commission Monday,October 7,2019—7:00 p.m. Jimmie Peterman, 717 SW 4 Terrace, spoke about naming the street in West Lawn Cemetery and using taxpayers' money. Elaine Buraty, 180 E Dania Beach Boulevard, Apt. 726, spoke about the safety of residents at The Place at Dania Beach since the flood on September 271h and asked for a point person. City Manager Garcia noted she met with a regional manager regarding reimbursement to the residents. It is important to get the facts during a time like this. Rebecca Salbert, 180 E Dania Beach Boulevard, #418, also spoke about the health and safety of citizens at The Place and the City's role in helping to evacuate the residents. Tyler Hines, 180 E Dania Beach Boulevard, spoke of the dangerous conditions in the building since the flood and the lack of competence exhibited by the building's staff. City Manager Garcia noted the Building Official would close the building down if it is deemed necessary. Mayor Lewellen asked for a report from the City Manager. Jorge Palacios, 218 NW lst Avenue, commented on development along US-1 to accommodate parking concerns. Gail Tysenn, 919 H Nautilus Isle, expressed disappointment with the Dania Beach Grill being closed down. 6. Public Safety Reports 6.1 Special recognition presentation for the fishing excursion - Captain Marks, BSO Chief of Police Captain Daniel Marks, BSO Chief of Police, recognized the local businesses that made the first fishing excursion a success. He presented plaques to Bass Pro Shops, PDQ, Dusky Marine (not in attendance), Anglers Bait and Tackle and the Parks and Recreation Department, and noted their generosity and interest shows their dedication to the community, the youth and the City of Dania Beach. Captain Marks noted National Prescription Drug Take Back Day would be held on Saturday, October 261h at Walmart, 401 E Sheridan Street. He also noted National Night Out at CW Thomas Park would be held on October 31 st Captain Sergio Pellecer, BSO District Fire Chief, spoke of Stop the Bleed kits that are being distributed in the schools in the City, which were received via a grant from the State and School Minutes of Regular Meeting 3 Dania Beach City Commission Monday,October 7,2019—7:00 p.m. Board. One kit will be located inside of City Hall. He confirmed training was completed last year and refresher courses are available upon request. 7. Commissioner Harris motioned to adopt the Consent Agenda, with the exception of Item #7.7; seconded by Vice-Mayor Odman. The motion carried unanimously. 7.7 RESOLUTION#2019-121 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA, AUTHORIZING THE RECLASSIFICATION OF THREE (3) EMPLOYEE POSITIONS WITHIN THE PUBLIC SERVICES DEPARTMENT; PROVIDING FOR CONFLICTS; FURTHER, PROVIDING FOR AN EFFECTIVE DATE. City Attorney Ansbro read the title of Resolution#2019-121. Commissioner James felt this reclassification should have come before the budget was approved. Minutes of Regular Meeting 5 Dania Beach City Commission Monday,October 7,2019—7:00 p.m. City Manager Garcia explained that the positions were evaluated after the new Director of Public Services took over. Management staff would like to see how the three employees develop and evolve. Rather than promote one employee, staff would like to see how they grow. Their pay is not being reduced and there is no demotion; it is putting the right people in the right position to see who emerges in the future as the next leader. Commissioner James asked if changing the position of Superintendent to a Manager is a demotion. City Manager Garcia responded no, because the individual was already promoted; all three individuals have been promoted. Commissioner James felt with changing a Superintendent to a Manager, it does not seem like the positions are equal. City Manager Garcia explained rather than putting four divisions under a Superintendent, they are putting two divisions under each manager to avoid having someone with four divisions and someone else with two divisions. Each manager will have two divisions, allowing them to grow and be put in a position for success and not failure. As the three managers rise within the respective positions, the Superintendent position will be brought forward for one of the three individuals. She confirmed the Superintendent position was in the budget, but was not filled, and was being shelved. She noted all three individuals had been promoted as managers this year. Commissioner James questioned the reclassification verbiage from Superintendent to Manager. City Manager Garcia replied it was put into the budget three months ago; after more assessment, staff would like to promote these three individuals and leave the Superintendent position open for a later time when it is earned. Commissioner James asked that these type of things be done at budget time as they are confusing. Commissioner Harris motioned to adopt Resolution #2019-121; seconded by Vice-Mayor Odman. The motion carried unanimously. 8. Bids and Requests for Proposals 8.1 RESOLUTION#2019-124 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA, AUTHORIZING THE PROPER CITY OFFICIALS TO AWARD INVITATION TO BID ("ITB") NO. 19-010 FOR BUILDING CODE SERVICES TO C.A.P. GOVERNMENT INC.; PROVIDING FOR CONFLICTS; FURTHER PROVIDING FOR AN EFFECTIVE DATE. City Attorney Ansbro read the title of Resolution 42019-124. Minutes of Regular Meeting 6 Dania Beach City Commission Monday,October 7,2019—7:00 p.m. Marc LaFerrier, Director of Community Development, gave the background of this bid process. Commissioner Harris motioned to adopt Resolution #2019-124; seconded by Vice-Mayor Odman. The motion carried unanimously. 9. Public Hearings and Site Plans 9.1 RESOLUTION#2019-125 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA, PROVIDING THAT A PORTION OF AN ACCESS ROAD LOCATED IN THE CITY'S WEST LAWN CEMETERY BE NAMED AS"MARVIN MERRITT WAY";PROVIDING FOR CONFLICTS;FURTHER,PROVIDING FOR AN EFFECTIVE DATE. City Attorney Ansbro read the title of Resolution#2019-125. Mayor Lewellen opened the Public Hearing. Fred Beneby, 955 Village Trail, Port Orange, Florida, spoke about Hollywood and Dania Beach being intertwined, Marvin Merritt and Dania Redbirds of 1965. He noted many of us are part of this community even though some may have not been from Dania Beach, and thanked the Commission for the street naming. Bobbie Grace, 110 NW 8n' Avenue, thanked Mr. Beneby and spoke of the historical connection of Hollywood and Dania Beach. She felt this naming is the right thing to do. Derrick Hankerson, 746 SW 3 Street, expressed confusion over why we are here if everything was done properly in 1985. He noted we have not solved our issue of race in this country; a lot of the reason is because we do not talk about it. He does not want to have to do this again in 20 years. Jimmie Peterman, 717 SW 4 h Terrace, spoke about Marvin Merritt and naming a street after him. He questioned where Mr. Merritt's family is. Jorge Palacios, 218 NW 1"Avenue, spoke in favor of the naming. Seeing as there was no one else to speak in favor or opposition, Mayor Lewellen closed the Public Hearing. Commissioner James commented on the ties between Dania Beach and Hollywood. She expressed her full support for the street naming. Vice-Mayor Odman spoke of the strange racial history the City has. She sees this street naming as an opportunity to do something good and that is healing. Minutes of Regular Meeting 7 Dania Beach City Commission Monday,October 7,2019—7:00 p.m. Commissioner James motioned to adopt Resolution #2019-125; seconded by Vice-Mayor Odman. The motion carried on the following 5-0 Roll Call vote: Commissioner Brandimarte Yes Vice-Mayor Odman Yes Commissioner Harris Yes Mayor Lewellen Yes Commissioner James Yes City Attorney Ansbro advised items 9.2, 9.3, 9.9 and 9.10 were quasi-judicial hearings and swore-in those who would speak. He asked the Commission to disclose any communication they had on these matters. 9.2 ORDINANCE#2019-014 DENIED AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA APPROVING THE RIGHT-OF-WAY VACATION REQUEST (VC-87-19) SUBMITTED BY LARRY L. ADAIR, P.A. ON BEHALF OF THE PROPERTY OWNER, 800 MARINE TECHNICAL CENTER, INC. (SECOND READING) City Attorney Ansbro read the title of Ordinance #2019-014 and Resolution #2019-126 as they are related to the same property. Corinne Lajoie, Planning & Zoning Manager, gave a presentation on the vacation request, site plan and variance requests. Vice-Mayor Odman asked about trees on the property. Planning & Zoning Manager Lajoie noted there would be tree landscaping requirements for a parking lot. Commissioner James asked about access to the property. Planning &Zoning Manager Lajoie explained ingress/egress of the property. Mayor Lewellen opened the Public Hearings. Bobbie Grace, 110 NW 8th Avenue, voiced opposition to this development. Robert Mikes, 601 NW 7th Street, spoke in opposition to this development due to traffic and right-of-way concerns. Minutes of Regular Meeting 8 Dania Beach City Commission Monday,October 7,2019—7:00 p.m. Mayor Lewellen confirmed the potential development of this property is greatly reduced by the overhead power lines, and questioned what type of business could go there. Planning& Zoning Manager Lajoie responded parking or storage. Larry Adair, representing the applicant, addressed the deed restrictions on the property, which used to be owned by FPL; the building; scrub brush removal and the long-term storage nature of the business. Commissioner Harris questioned the recommended approval of the Planning & Zoning Board and of staff, and whether there were any code violations. Planning & Zoning Manager Lajoie replied the board approved the vacation of right-of-way only and not the site plan; there are no code violations or liens. Commissioner James expressed concern with residents having to share the narrow road with a business. Mr. Adair stated the business would be for long-term storage for RVs and trailers. Commissioner Brandimarte questioned long-term storage and noted her concern with RVs on the road. Vice-Mayor Odman asked Mr. Adair if he understood the Commission's concerns. Mr. Adair addressed the narrow roads. Vice-Mayor Odman agreed that narrow roads are the issue, and confirmed where Fire Rescue could come in from. Francesco Madonna, Architect, explained they met the width requirements for fire truck access. Seeing as there was no one else to speak in favor or opposition, Mayor Lewellen closed the Public Hearings. Commissioner James motioned to deny Ordinance #2019-014, on second reading; seconded by Vice-Mayor Odman. Attorney Toothaker addressed discussion regarding the setback; those details have not been completed flushed out. She also addressed the master plan, and noted more information would be available at the time of second reading. Commissioner James asked about the 22-foot setback and how it affects the project. Attorney Toothaker responded the site plan still has to go through the approval process and described proposed setbacks. Marc LaFerrier, Director of Community Development, explained this is a pretty important moment for this roadway configuration. He mentioned the disagreements between parties on the widening of this street. Commissioner James questioned financial responsibility of expanding the roadway due to the size of Dania Pointe. Director of Community Development LaFerrier stated the decision is critical in order to get this right. Minutes of Regular Meeting 12 Dania Beach City Commission Monday,October 7,2019—7:00 p.m. Commissioner James said she needs to see this all together; she does not think a freeway needs to go where Bryan Road is. We also need to be concerned about our residents who are directly affected. Mayor Lewellen noted expanding the roadway coming from Old Griffin would be problematic. She asked if there are any plans for 1st and Old Griffin, and how much more detail we would have by second reading. Director of Community Development LaFerrier said we do not want to put a building where the road should go; we are not telling the applicants to build the roadway. Commissioner Harris spoke on the LTRP with MPO restructuring Bryan and Old Griffin Road out to 2045. Commissioner James asked when the Broward MPO made the request, Director of Community Development LaFerrier explained the master planning that had been previously requested. We are at the point where we need to let Tropical Acres know what our intention is. There are still several different ways of salvaging this celebration if the Commission is interested. She felt $3,000.00 would pay for something nice. Mayor Lewellen said she does not like to turn away anything that is offered for free. Commission Harris agreed; we could charge $10-15.00 for a champagne brunch with the proceeds going to the Historical Society. Vice-Mayor Odman noted she still wants to have the event in November. Commissioner Brandimarte felt we should be celebrating at Dania After Dark, not Tropical Acres which would limit the number able to attend. Commissioner James asked if a date was selected. The Commission consensus was to move forward with a 115th Birthday celebration, with $3,000.00 allocated for the event, pending the date and time. 10.3 Food truck ordinance - Commissioner James Commissioner James asked the Commission if they want to revisit this matter. Vice-Mayor Odman said she wants this and it sounds like we need to do some work it. Marc LaFerrier, Director of Community Development, noted the last time this was discussed, there were concerns with the brick and mortar businesses and the fact that food trucks move about. Also, there was discussion of management of food trucks at City events and parks, which could be handled as a special event request. Vice-Mayor Odman felt there is a need to address trucks on private property, particularly the times they are allowed to be there. Commissioner James requested that Vice-Mayor Odman meet with Director of Community Development LaFerrier and bring the matter back to the Commission. 11.
