RESOLUTION NO. 2019-149 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA, APPROVING THE SITE PLAN (SP-117-19) SUBMITTED BY CPH, INC. ON BEHALF OF PANDA EXPRESS, INC., FOR PROPERTY LOCATED AT 121 S. POINTE DRIVE, IN THE CITY OF DANIA BEACH, FLORIDA,AS LEGALLY DESCRIBED IN EXHIBIT"A,"A COPY OF WHICH IS ATTACHED TO THIS RESOLUTION; PROVIDING FOR CONFLICTS; FURTHER, PROVIDING FOR AN EFFECTIVE DATE. WHEREAS,the City Code of Ordinances,Chapter 28,entitled"Land Development Code" (the"LDC"),of Part 6,entitled"Development Review Procedures and Requirements,"Article 635, entitled "Site Plans," states that Site Plan approval is required as a condition to the issuance of a building permit; and WHEREAS, CPH, Inc., on behalf of Panda Express, Inc. (the"Applicant"),has requested Site Plan(SP-117-19)approval to permit the construction of 2600 square foot restaurant,operating as Panda Express on property located at 121 S Pointe Drive in the City of Dania Beach,Florida(the "City"), as legally described in Exhibit"A;" and WHEREAS, the City Commission conducted a duly noticed public hearing in accordance with Article 610 of the LDC; and WHEREAS,the City Commission finds that the approval of the proposed Site Plan(SP-117- 19) is consistent with the City's Land Development Code and Comprehensive Plan. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF DANIA BEACH,FLORIDA: Section 1. That the foregoing"WHEREAS"clauses are ratified and confirmed as being true and correct,and they are made a part of and incorporated into this Resolution by this reference. Section 2. Pursuant to Chapter 28 "Land Development Code," Part 6 "Development Review Procedures and Requirements,"Article 635"Site Plan,"the Site Plan(SP-117-19),attached as Exhibit `B" which is made a part of and incorporated into this Resolution by reference, is approved. Section 3. The approvals granted by this Resolution are subject to the Applicant's compliance with the following conditions: 1. A Traffic generation Statement was provided,please add number of AM and PM Peak hours specific for Panda Express. Clarify in Table remaining hours after or before this statement. Please, make sure that ITE used is the latest loth Edition. It needs to be reviewed and approved by Public Services (Engineer). 2. A complete grading & drainage Plan was provided. Please, provide copy of Drainage Calculations to support proposed grading and drainage connections.For 100 and 25 Year-3 day, 10 Year — 1 Day storm peak stages, including FEMA Flood Zone and Miami Dade County Flood Criteria,e.g.Proposed FFE Criteria elevation,Proposed Minimum Perimeter Elevation,Proposed Minimum Crown of the Road Elevation,Zero Discharge.Missing FFE on Site Plan. Pending to be identified Boundaries Lines of the "Leased Parcel". Please, provide copy of the following:Response from Mr.Kevin Roberson about letter dated August 15th,2019 from Mrs.Nicole Lebron.Please,clarify if"Terry's Outparcel"and"Hotel Area" Post development is lower than Pre-Development?Ratify that"Pre Development"with"Post Development"for Panda Express are satisfied.Also provide 10 Year—24 Hr.for Minimum Crown of the Road Elevation. Identified, in PGD plan Elevation of Dry Pond DRA 5 Elevation and how short in area of the required storage volume compare with before new development. Verify, length of Exfiltration Trench required 89.37' provided 86' of perforated pipe. Provide copy of Permitted & proposed Quantities documentation (Engineering). 3. For ease of review,please reply in writing to each line comment,reference page number and backup age number and backup documents provided. Additional comments may apply. Additional comments may apply(Engineering). 4. Repeat comment: tree 1109 in the Tree Table is listed as a green Buttonwood; however, an onsite inspection revealed it is a live oak. Update accordingly(Landscaping). 5. Per Sec. 275-80(M)(2), the irrigation plan must show the location of both existing and proposed trees to ensure proper coverage. Include the location of proposed trees on the irrigation plan (Landscaping). 6. Please note that a tree removal permit will be required prior to the removal of any existing trees form the site (Landscaping). 7. SIGNS: Per Section 635-50(S) Provide copy of all signs for compliance review. MONUMENT SIGN -No details provided (Planning). 8. The proximity to the airport will be required FAA review and approval. The approval letter issued by Broward County Aviation Department was conditioned on the applicant receiving approval from FAA, which is required prior to issuance of a building permit(Planning). 9. RAC TRAFFIC IMPACT MITIGATION: Provide an analysis, signed and sealed by a certified engineer,identifying the amount of CRA mitigation for traffic impact due based on resolution No.2014-049 which established a rate of$21.26 per p.m.peak hour trip.2nd time requested. 2 RESOLUTION#2019-149 Based on the Traffic Generation Statement prepared by Kimley Horn dated July 3, 2019, this project will generate 39 PM peak hour trips. Therefore the applicant must pay $829.14 (39 trips X $21.26)prior to issuance of a building permit(Planning). 10. Survey shows several easements running through the property, including: #8, easement for ingress/egress;#9,easement agreement by and between Palmetto Hospitality;#10,easement in favor of FPL;#12,sewer easement in favor of the City;
,water easement in favor of the City. Confirm building is not encroaching in these easements (Planning). 11. Applicant must pay remaining application fee balance of $750 ($1,000 + $130 ($5.00:100s.f.) + $5,000 + $1,120 = $6,250 - $5,500 = $750) (Planning). Section 4. That such application must be reviewed by Broward County Aviation Department. Pursuant to LDC Section 635-100 "Expiration of Site Plans,"the Site Plan (SP-117-19) shall automatically expire and become null and void unless the Applicant files a complete building permit application with construction drawings for the improvements shown on the Site Plan, within eighteen(18) months from the date of this Resolution. Section 6. That the issuance of a development permit by a municipality does not in any way create any right on the part of an Applicant to obtain a permit from a state or federal agency,and does not create any liability on the part of the municipality for issuance of the permit if the Applicant fails to obtain requisite approvals or does not fulfill the obligations imposed by a state or federal agency, or undertakes actions that result in a violation of state or federal law.
