(D/B/A Expose Yourself USA) for the fabrication & installation of the City Welcome Sign at SW Corner RESOLUTION NO. 2019-156 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA, AUTHORIZING AN APPROPRIATION OF FUNDS RELATING TO A CHANGE ORDER WITH TIGO INC. (D/B/A EXPOSE YOURSELF USA) FOR THE FABRICATION AND INSTALLATION OF THE CITY WELCOME SIGN AT THE SOUTHWEST CORNER OF THE INTERSECTION OF GRIFFIN ROAD AND U.S. HIGHWAY 1, IN AN AMOUNT NOT TO EXCEED ONE HUNDRED THOUSAND DOLLARS ($100,000.00) PERTAINING TO ASSOCIATED LANDSCAPING; PROVIDING FOR CONFLICTS; FURTHER, PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the Charter of the City of Dania Beach, Part III, Article 3, Section 4, Subsection 0), authorizes the City Manager to purchase supplies, services, equipment and materials for the City government in amounts in excess of the established monetary threshold without competitive bidding and without advertisement for bids if she is authorized to do so in advance by a resolution adopted by the City Commission; and WHEREAS, on January 8, 2019, the City Commission approved Resolution No. 2019-009 for the City to enter into an agreement with Tigo Inc. (d/b/a Expose Yourself USA), for the fabrication and installation of the City's Welcome Sign at the southwest corner of the intersection of Griffin Road and US Highway 1, in the amount of One Hundred Forty-Five Thousand Five Hundred Dollars ($145,500.00); and WHEREAS, funds in the amount of Two Hundred Fifty Thousand Dollars ($250,000.00) will be reimbursed by Broward County to the City in accordance with provisions of the Broward County/Dania Beach Airport Interlocal Agreement approved on November 13, 2018; and WHEREAS, on September 23, 2019,the City Commission approved Resolution No. 2019- 108 for a change order in the amount of Fourteen Thousand Dollars ($14,000.00) necessary for additional services related to increasing the concrete slab to allow for landscaping around the base and additional front-lit lighting to the sign, which was not included in the original contract scope of services; and WHEREAS, on September 23, 2019, the City Commission approved Resolution No. 2019- 112 for funding for the design and installation of the entranceway sign landscaping in the amount of Seventy-Five Thousand Dollars ($75,000.00); and WHEREAS, a change order with Tigo, Inc. in the total amount of One Hundred Thousand Dollars ($100,000.00) is necessary for additional services related to landscaping, irrigation and related improvements which were not included in the original contract scope of services; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA: Section 1. That the above "WHEREAS" clauses are ratified and confirmed as being true and correct, and they are made a part of and incorporated into this Resolution by this reference. Section 2. That the City Commission approves a change order with Tigo Inc. (d)b/a Expose Yourself USA) needed for additional work in an amount not to exceed One Hundred Thousand Dollars ($100,000.00)pertaining to associated landscaping. Section 3. That the initial contract for the fabrication and installation of the City Welcome Sign was approved by the City Commission on January 8, 2019, in the amount of One Hundred Forty-Five Thousand Five Hundred Dollars ($145,500.00) and amended and increased by an amount of Fourteen Thousand Dollars ($14,000.00) by the City Commission on September 23, 2019, and shall now be amended and increased by an amount of One Hundred Thousand Dollars ($100,000.00) resulting in a total current approved contract amount not to exceed Two Hundred Fifty-Nine Thousand Five Hundred Dollars ($259,500.00). Section 4. That the total funding necessary in the amount of Thirty Thousand Dollars ($30,000.00) shall be appropriated from the General Fund Account No. 001-15-01-515-31-10 to the Capital Projects City Entrance Sign Account No. 301-18-07-519-63-10 to cover the Twenty- Five Thousand Dollars ($25,000.00) Change Order and additional costs. Section 5. That all resolutions or parts of resolutions in conflict with this Resolution are repealed to the extent of such conflict. 2 RESOLUTION#2019-156 Section 6. That this Resolution shall become effective upon its passage and adoption. PASSED and ADOPTED on December 10, 2019.
