DANIA BEACH CITY COMMISSION
TUESDAY, DECEMBER 10, 2019 - 7:00 P.M.
1. Call to Order/Roll Call
Mayor Lewellen called the meeting to order at 7:06 p.m.

2. Moment of Silence and Pledge of Allegiance
Mayor Lewellen called for a moment of silence after the Pledge of Allegiance to the United
States Flag.
3. Presentations and Special Event Approvals
Mayor Lewellen introduced Rabbi Eli Eckstein, who spoke about a Chabad Center which is a
Jewish outreach organization to make the world a better place, and noted they will be opening up
a Chabad Center in Dania Beach. He also noted a public Menorah lighting would be held in
front of City Hall on Monday, December 23rd,the second day of Hanukkah.
3.1 Presentation on social media, website updating and graphic design services by Multi-
Media Marketing Associates, Inc.
Jose Luya, President and CEO of Multi-Media Marketing Associates, and Sonja Jange, Multi-
Media Marketing Associates, gave a PowerPoint presentation which is attached to and
incorporated into these minutes.
3.2 Dania Beach Chamber of Commerce update by Randie Shane
Ms. Shane was unable to attend the meeting.
3.3 Update on The Place at Dania Beach by Eddie Rojas, Building Official, C.A.P.
Government
Carlos Penin, President of C.A.P. Government, introduced Mr. Rojas, who gave an update on
C.A.P.'s third party review, requested by City Manager Garcia, of the two water loss incidents
that occurred at The Place at Dania Beach.
Commissioner James questioned the time frame for the fact finding results.
Commissioner Brandimarte asked if City staff would be overseeing the inspection project.
City Manager Garcia indicated Assistant City Manager Sosa-Cruz and Marc LaFerrier, Director
of Community Development, would oversee C.A.P.'s review.
3.4 Opportunities for City-Wide Environmental Redevelopment - Michael R. Goldstein,
Esq.
This item was postponed until January.
3.5 Acknowledgment of Melaleuca Gardens Homeowner's Association for donating park
benches to Parks & Recreation- Eric Brown, Director of Parks &Recreation
Eric Brown, Parks & Recreation Director, presented a Certificate of Recognition to members of
the homeowner's association.
3.6 Announcement of the tickets to go on sale for the 115 Anniversary Celebration -
Vice-Mayor Odman
Vice-Mayor Odman thanked staff and Tropical Acres for their efforts with the celebration and
announced that tickets would go on sale live at daniabeachl 15.com for the January 12th event.
3.7 Announcement of the winner of the City's Nickname Contest- Vice-Mayor Odman
This item was withdrawn.
4. Proclamations
There were no proclamations at this meeting.
5. Citizen Comments
Nancy Self, 5531 SW 44th Terrace, spoke on behalf of herself and her neighbors regarding a
proposed six-story hotel in Hollywood, which is 20 feet away from their neighborhood, and
asked for assistance in mitigating the negative impacts to the neighborhood.

Mayor Lewellen requested City Manager Garcia contact the City Manager of Hollywood
regarding this issue.
Vice-Mayor Odman noted there would be a workshop in February with the City of Hollywood.
Commissioner Harris added the meeting would be held on February 26th at the library on Stirling
Road.
Christine Musial, 5414 SW 44 Terrace, reported on receiving assistance with traffic problems on
54 Court, from 441 to 40th, and requested assistance with the proposed kosher hotel in
Hollywood.
Marge Perry, 5521 SW 44 Terrace, commented on the proposed kosher hotel in Hollywood and
the lack of follow-through after she first came to the Commission about it several months ago.
Linda Wilson, Friends of the Dania Beach Library, acknowledged Melaleuca Gardens'
contribution to the library, and commented on vacancies on the Creative Arts Council Advisory
Board.
6. Public Safety Reports
Captain Daniel Marks, BSO Chief of Police, commented on Deputy Matt Griffith, and reported
on a recent incident in the parking garage involving a juvenile. He noted Deputy Brittany
Armstrong was recognized as the Deputy of the Year by the Chamber of Commerce, and warned
of holiday thefts.
Captain Sergio Pellecer, BSO District Fire Chief, reported on the push-in ceremony held earlier
today and the recent toy program event. He presented a certificate of recognition to Lieutenant
Joshua Comblit for Firefighter of the Year.

Commissioner James motioned to adopt the Consent Agenda, with the exception of Item
#7.7 and #7.8; seconded by Commissioner Harris. The motion carried unanimously.

City Attorney Ansbro read the title of Resolution#2019-156.
Commissioner James asked how much was spent before and what the total amount is now.
Marc LaFerrier, Director of Community Development, explained the original scope did not
include this level of landscape design. He itemized the expenditures to date, including a prior
Change Order.
Commissioner James confirmed we are close to $344,000.00 for the project.
Director of Community Development LaFerrier noted the work is due to be completed by the
first of the year and he does not see a reason for another Change Order.
Commissioner James motioned to adopt Resolution #2019-156; seconded by Commissioner
Harris. The motion carried unanimously.
7.8 ORDINANCE #2020-001
AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA, AMENDING
CHAPTER 18, ENTITLED "PENSIONS AND RETIREMENT", ARTICLE IV, ENTITLED POLICEMEN AND
FIREMEN", SECTION 18-42, ENTITLED "BENEFIT AMOUNTS AND ELIGIBILITY" OF THE CITY CODE
OF ORDINANCES RELATING TO THE POLICE AND FIREFIGHTERS' RETIREMENT SYSTEM;
AMENDING THE ORDINANCE IN ORDER TO BE IN COMPLIANCE WITH CHAPTER 2019-21, LAWS OF

City Attorney Ansbro read the title of Ordinance #2020-001 and gave a brief overview of the
code amendment.
Commissioner Harris motioned to adopt Ordinance #2020-001, on first reading; seconded
by Vice-Mayor Odman. The motion carried unanimously.

City Attorney Ansbro read the title of Ordinance #2019-025.
Corinne Lajoie, Planning & Zoning Manager, noted the effective date of the ordinance was
changed since first reading.
Commissioner James noted she had a lot of concerns about the ordinance on first reading and
there were no changes made for second reading.
Marc LaFerrier, Director of Community Development, explained staff had not had an
opportunity to meet with the Commission; moving the ordinance forward will allow the
Commission to add language.
Commissioner James said no one reached out to her about the changes she was seeking. She
would like to sit down with staff and discuss it.
Director of Community Development LaFerrier felt the ordinance could be amended tonight by
adding the language "or other body as approved by the City Commission" wherever CACAB is
referenced. He noted there will be some time before funds would be expended, and explained
the process of a plan being implemented, which would ultimately come before the Commission.
Commissioner James commented this is a total disregard of the conversation she had at the last
meeting. She knows the CACAB is going through a transition. They have great ideas, but she
wants to make sure City staff is a part of the process.
Director of Community Development LaFerrier reiterated the language he recommended could
be added to the motion.
Commissioner Harris asked if the 60 days effective date could be changed to 90 days.
Vice-Mayor Odman noted the developers have been involved in this discussion and they thought
this was a fair ordinance. She agreed the additional language should be added wherever CACAB
is referenced, as she does not want to stall the process if there is a lack of quorum at the Board's
meetings.

Discussion ensued about the Board.
Mayor Lewellen opened the Public Hearing.
Linda Wilson, Friends of the Dania Beach Library, and member of the CACAB, noted the
CACAB had asked for some time that an art fee be charged. She added she is disappointed with
the 60-day delay. She spoke of the recent membership issues with the CACAB and the mission
of the Board. She complained about the atrium art gallery floor plan having to be changed due to
the holiday decorations being placed near the elevator.
Jorge Palacios, 218 NW I St Avenue, commented NW 1st Avenue is being ignored and we should
concentrate on it as it is where we will bring everyone into downtown.
Seeing as there was no one else to speak in favor or opposition, Mayor Lewellen closed the
Public Hearing.
Mayor Lewellen clarified the effective date of implementation of the ordinance.
Vice-Mayor Odman motioned to adopt Ordinance #2019-025, on second reading, as
amended to include the language recommended by Community Development Director
LaFerrier; seconded by Commissioner James. The motion carried on the following 5-0

Corinne Lajoie, Planning & Zoning Manager, gave an overview of the site plan and alternate
parking standard requests for Spirit Airlines.
Commissioner James questioned whether they would be using the City seal or logo.
Planning & Zoning Manager Lajoie said the logo.
Commissioner James asked if the design standards for the logo would be given to the developer.
Planning &Zoning Manager Lajoie responded in the affirmative.
Mayor Lewellen opened the Public Hearing.
Dennis Mele, Greenspoon Marder, representing the applicant, thanked the Commission and staff

Corinne Lajoie, Planning & Zoning Manager, gave a presentation on the Bryan Road
Development Design Guidelines and site plan requests.
Mayor Lewellen opened the Public Hearing.
Attorney Stephanie Toothaker, representing the applicant, requested language be added to
condition #27 and #28 that they will do their best effort in meeting those conditions in order to
give the developer flexibility regarding the South Florida Water Management District.
Marc LaFerrier, Director of Community Development, explained#27 speaks to an approval from
the South Florida Water Management District; regarding#28, a pedestrian cross access easement
at the south end may not be possible. As to Ms. Toothaker's request, amending those two items
would be acceptable.
Seeing as there was no one else to speak in favor or opposition, Mayor Lewellen closed the
Public Hearing.
Commissioner James motioned to adopt Resolution #2019-158, as amended; seconded by
Commissioner Harris. The motion carried on the following 5-0 Roll Call vote:

11.1 Commissioner Brandimarte
Commissioner Brandimarte spoke of the art in the atrium and questioned whether there could be
a wall for less expensive art; prices should be brought within reach. The artists are getting the
gallery for free and they are not local artists.
Commissioner Brandimarte noted the Lifetime Channel has been filming in Dania Beach; she
will provide the dates that the segment will be aired to the City Manager to disseminate.
11.2 Commissioner Harris
Commissioner Harris noted there will be a joint workshop with Hollywood at the library on
Stirling Road.

Commissioner Harris commented on the sea level rise initiative program by the County; seawalls
will be required to be raised by 2030.
Commissioner Harris noted a trip for Broward Days in Tallahassee is planned, and spoke of the
topics that will be covered.
Commissioner Harris thanked everyone who participated in helping distribute food for
Thanksgiving at St. Maurice Church.
Commissioner Harris listed the numerous events scheduled for December 14th
11.3 Commissioner James
Commissioner James commented on the Tamara James Foundation's 14th Annual Food Drive in
Dania Beach. She thanked City and CRA staff and all the businesses for their involvement.
Commissioner James noted Rabbi Eckstein called her a month ago; this is a start of something
great, including the Menorah ceremony at City Hall.
Commissioner James also noted her son won the PAL Youth Championship Super Bowl and she
will bring the champions to a Commission meeting.
11.4 Vice-Mayor Odman
Vice-Mayor Odman spoke of the tree lighting ceremony and thanked Parks & Recreation for
their hard work.
Vice-Mayor Odman noted a Menorah lighting is special and invited everyone to attend.
Vice-Mayor Odman reminded everyone to get their tickets to the 115th Anniversary celebration.
11.5 Mayor Lewellen
Mayor Lewellen spoke of the Thanksgiving Day event at St. Maurice's Church.
Mayor Lewellen also spoke of the tree lighting event at City Hall.
Mayor Lewellen noted she is glad to see we will be doing the Menorah lighting on December
23`d at 6:00 p.m.
Mayor Lewellen thanked City staff for their hard work and efforts.

City Manager Garcia spoke of her tenure as City Manager, and reported on a public auction
hosted by Public Services and our First Annual Winter Camp with the Parks and Recreation
Department.
City Manager Garcia referenced her Manager's Report and spoke of the attached memos which
were included in the agenda packet; we have a remarkable team.
City Manager Garcia reported she received a letter today from Waste Management regarding
complaints she has received about bulk waste and illegal dumping. We may have an opportunity
to have two bulk pick-ups per month; she will report back to the Commission.
City Manager Garcia noted she would like the Commission to schedule a workshop on January
81h or 9t'to discuss financing options for the Parks Master Plan.
A brief discussion ensued.
The Commission consensus was to schedule the workshop on Thursday, January 9, 2020 at 2:30
p.m. pending confirmation of Commissioner Brandimarte's availability.

Comments by Dania Beach citizens or interested parties that are not part of the regular printed agenda may be made during each
Commission meeting during the period set aside for"Citizen Comments." A thirty(30)minute"Citizen Comments"period shall
be designated on the agenda for citizens and interested persons to speak on matters not scheduled on that day's agenda. Each
speaker shall be limited to 3 minutes for his or her comments. Persons desiring to speak during the citizen comment period shall
inform the City Clerk immediately prior to the beginning of the meeting of their intention to speak. If more than 10 speakers
express a desire to speak, the Commission shall determine on a meeting by meeting basis whether to(a)extend the time allotted
for citizen comments to accommodate all speakers,or(b)whether to limit the number of speakers or amount of time per speaker.
A speaker's time shall not be transferable to another speaker.
