HomeMy WebLinkAboutR-2020-008 City Approving the Site Plan (SP-145-19), Variances (VA-157-19, VA-158-19, VA-159-19, VA-160-19, VA-161-19, and VA-175-19) & Design Variations (OT-172-19, OT-173-19, & OT-174-19) RESOLUTION NO. 2020-008 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA, APPROVING THE SITE PLAN (SP-145-19), VARIANCES (VA-157-19, VA-158-19, VA-159-19, VA-160-19, VA-161-19, and VA-175-19,) AND DESIGN VARIATIONS (OT-172-19, OT-173-19, & OT- 174-19) SUBMITTED BY LEIGH ROBINSON KERR & ASSOCIATES, INC., ON BEHALF OF COMERLAT HOSPITALITY 1, LLC FOR PROPERTY LOCATED AT 321 N. FEDERAL HIGHWAY IN THE CITY OF DANIA BEACH, FLORIDA, AS LEGALLY DESCRIBED IN EXHIBIT "A," A COPY OF WHICH IS ATTACHED TO THIS RESOLUTION; PROVIDING FOR CONFLICTS; FURTHER, PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the City Code of Ordinances, Chapter 28, entitled "Land Development Code" (the "LDC"), of Part 6, entitled "Development Review Procedures and Requirements," Article 635, entitled "Site Plans," states that Site Plan approval is required as a condition to the issuance of a building permit; and WHEREAS, Leigh Robinson Kerr & Associates, Inc., on behalf of Comerlat Hospitality 1, LLC (the "Applicant") is requesting approval of a Site Plan (SP-145-19) to permit the development of a hotel for property located at 321 N. Federal Highway in the City of Dania Beach, Florida(the "City") as legally described in Exhibit"A," a copy of which is made a part of and incorporated into this resolution by this reference; and WHEREAS, Chapter 28, Part 6 of the LDC, Article 625 "Variances," Section 625-40 states that the City Commission may grant a variance based on its determination that the petitioner has demonstrated that the necessary criteria identified in the LDC have been satisfied; and WHEREAS, the Applicant is requesting a Variance (VA-157-19) to provide a minimum access width dimension of twenty (20) feet, where LDC Section 265-150(E) requires twenty-five (25) feet; and WHEREAS, the Applicant is requesting a Variance (VA-158-19) to provide clearance between parking space and wall less than two and one-half(2.5) feet, where LDC Section 265- 140 requires a minimum two and one-half(2.5) feet; and WHEREAS, the Applicant is requesting a Variance (VA-159-19) to provide more than ten (10) percent of required parking as valet, where LDC Section 265-120 only allows up to ten (10)percent of required parking to be provided as valet; and WHEREAS, the Applicant is requesting a Variance (VA-160-19) to provide a western perimeter landscape buffer of zero (0) feet, where LDC Section 275-90 requires a minimum five (5) foot landscape buffer; and WHEREAS, the Applicant is requesting a Variance (VA-161-19) to provide wall signs on the north and south sides of the hotel and to provide for the north sign to be eighty-nine (89) square feet, where LDC Section 505-90(V) requires signs to be located on the frontage (east) and north wall signs to be a maximum fifty-six (56) square feet; and WHEREAS, the Applicant is requesting a Variance (VA-175-19) in order not to provide street trees and streetscape elements, where Section 307-20 requires street trees and streetscape elements to be installed; and WHEREAS, Chapter 28, Part 3, entitled, "Special Zoning Districts," of Subpart 1, entitled, "Community Redevelopment Area ("CRA") Form-Based Zoning District" of Article 301, entitled, "Legal and Administrative Provisions" of Section 301-50, entitled, "Variations In Design; Procedures For Review Of Design Variations," provides that the City Commission is authorized to approve design variations within certain districts, if they are consistent with the intent of that section in lieu of the variance process provided for in Article 625, entitled, "Variances,"of the LDC; and WHEREAS, the Applicant is requesting a Design Variation (OT-172-19) to provide an awning projecting five feet (5') and extending approximately fifty-seven linear feet (56' 10"), where LDC Section 311-209(E) requires an awning to project seven feet (7') and extend approximately one hundred, twenty feet (120') or eighty percent (80%) of the building frontage; and WHEREAS, the Applicant is requesting a Design Variation (OT-173-19) to allow no cornice, ornamentations, changes of material or color and other sculpting of architectural surfaces, no pitched roof overhang, and to allow a solid wall approximately forty-seven feet (47'3") in length, where LDC Section 525-30(C, D, & G) requires architectural ornamentations, pitched roofs and solid walls no more than twenty linear feet(20'); and WHEREAS, the Applicant is requesting a Design Variation (OT-174-19) to provide a solid wall on the north building elevation with zero percent (0%) window area, where Section 510-30 (D & H) requires a minimum of fifteen percent(15%) ; and 2 RESOLUTION#2020-008 WHEREAS, the City Commission conducted a duly noticed public hearing in accordance with Article 610 of the LDC; and WHEREAS, the City Commission finds that the approval of the Site Plan (SP-145-19), Variances (VA-157-19, VA-158-19, VA-159-19, VA-160-19, VA-161-19, and VA-175-19), and Design Variations (OT-172-19, OT-173-19, & OT-174-19) will protect the health, safety, and welfare of the residents of the City, and furthers the purpose, goals, objectives and policies of the Comprehensive Plan; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF DANIA BEACH,FLORIDA: Section 1. That the foregoing "WHEREAS" clauses are ratified and confirmed as being true and correct and they are made a specific part of this Resolution. Section 2. That pursuant to Chapter 28 "Land Development Code," Part 6 "Development Review Procedures and Requirements," Article 635 "Site Plan," the following Site Plan (SP-145-19), attached as Exhibit "B," which is made a part of and incorporated into this Resolution by reference is approved. Section 3. Pursuant to Chapter 28 "Land Development Code," Part 6 "Development Review Procedures and Requirements," Article 625 "Variances," the following Variance applications (VA-157-19, VA-158-19, VA-159-19, VA-160-19, VA-161-19, and VA-175-19) are approved consistent with the attached Site plan provided in Exhibit`B." Section 4. Pursuant to Part 3, entitled, "Special Zoning Districts," of Subpart 1, entitled, "Community Redevelopment Area ("CRA") Form-Based Zoning District" of Article 301, entitled, "Legal and Administrative Provisions" of Section 301-50, entitled, "Variations In Design; Procedures For Review Of Design Variations" the application for Design Variations (OT-172-19, OT-173-19, and OT-174-19) is approved consistent with the attached Site Plan provided in Exhibit`B." Section 5. That the approvals granted by this Resolution are subject to the Applicant's compliance with the following conditions: 1. A Traffic Impact Study was provided. Traffic Statement estimate — Trip Generation Rate(s) Report - gross peak hour trip, based on the latest ITE Manual (loth edition or latest only). The Traffic Impact Study shall be prepared using the roadway level of service standards and trip generation rates. A traffic study shall be prepared in accordance with methods outlined in Transportation Impact Analysis for Site Development, latest editions of the following: An ITE Recommended Practice (RP-020D) published by the 3 RESOLUTION#2020-008 Institute of Transportation Engineers, 2010; the 2014 FDOT Transportation Site Impact Handbook; 2013 FDOT Quality/Level of Service Handbook; the 2014 Broward County Comprehensive Plan — Transportation Element; the City of Dania Beach Land Development Code and other related published literatures. Also, provide an analysis and conclusion that this development will not deteriorate the level of service on adjacent roads; if that's the case otherwise provide mitigation measures. It must be approved by the Deputy Director/City Engineer of the Public Works Department. Please provide copy of proof from PWD of its approval (Engineering). 2. Show in Site plan dimensions matching survey along property lines. A sight distance at intersections is pending to be shown distances based on speed and number of lanes within distances as per FDOT IDEX No. 546 Tables, also at driveway show sight triangle of 25'on ROW line. FDOT Index 546 was not found in Civil Drawings showing minimum distances as per as speed of the road within Passenger Vehicle/SU/Vehicle/Combination Vehicle tables e.g. Number of lanes, Divided /Undivided and ways. Flared, etc. (Engineering) 3. Show dimensions of sidewalks, swales, pavement improvements and other areas along the property on the ROW. Pending to be provided FDOT Permit prior to issuance of Building Permit. (Engineering) 4. The 1.5 multiplier required by Sec. 825-100(A)(5) was removed from the invasive species canopy mitigation correctly, however, it was also removed from the canopy mitigation of non-invasive species such as the live oak and the gumbo limbo. Add the required 1.5 multiplier to the non-invasive species. (Landscape) 5. Comment not addressed: On sheet L-2, provide the canopy (in SF) for every existing tree on site. Add an additional column for canopy(SF)to be removed. (Landscape) 6. Comment not addressed: The proposed plan does not appear to satisfy Sec. 307 streetscape requirements. Street trees are required per Sec. 307-20 and the Community Redevelopment Plan referenced therein. Provide a variance for this code section if it cannot be obtained on-site. (Landscape) 7. The tree replacement price for the Category II invasive palms must include the 2.7 installation multiplier. The total mitigation for the Category lI invasive species should be $15,795.00 ($5,850.00 x 2.7). (Landscape) 8. Repeat comment: The note was not added to the plan. Provide a note that root barrier will be installed for any tree or palm planted within 10 feet of any sidewalk, hardscape, or parking area per Sec. 275-190(0). (Landscape) 9. There is no VUA buffer provided on the western perimeter of the site. A VUA perimeter landscape buffer is required per Sec. 275-90(C) and shall be a minimum of 5 feet wide with 1 tree every 40 linear feet and a continuous hedge. Provide a variance for this code section. (Landscape) 4 RESOLUTION#2020-008 10. Four CSG10 (Orange Geiger) trees are proposed on the north property line, however, these trees are no included on the Master Plant List on sheet L-3. Clarify what species these trees are. (Landscape) 11. APPLICATION: Payment missing for 1 Variance and 3 Design Variations (Zoning) 12. Must submit application, application fee, justification statement based on criteria identified in the LDC, and any other documentation necessary for all Variances, Special Exceptions, Waivers, Design Variations, etc needed for the project at time of Site Plan Submittal. Failure to do so will result in delay of the project. 2nd time requested. (Zoning) 13. Per Section 505-90(V) No sign is permitted on the south or north elevation. Remove or request a variance. A variance request requires submittal of an application, an application fee of $2,000 for each requested variance, and a written justification statement addressing the variance criteria identified in Sec. 625-40 of the City's LDR's. Must be addressed with next submittal. VARIANCE—VA-161-19 (Zoning) 14. Per Section 505-90(C) must identify cumulative sign area and deduct proposed s.£ of each proposed sign. Identify if tabular form. Revise Cumulative Sign Area table to identify maximum permitted. (Zoning) 15. The proximity to the airport will be required FAA/BCAD review and approval. Contact William Castillo, Airport Planner with Broward County Aviation Department, located at 2200 SW 45 Street, Suite 101, Dania Beach, FL 33315, (954) 359-6100. 2nd time requested. (Zoning) 16. PARKING: Applicant is proposing: (Zoning) a. Alternative Park Standard=reducing to 72 parking spaces required. b. Transportation Demand Management (TDM) Strategies = less 10% = 65 parking spaces required c. Per Section 265-91(C), to utilize the TDM parking reduction the applicant "shall provide details of the TDM strategies which are being proposed along with the respective parking reduction for each strategy." The information shall detail: i. Cost ii. Schedule iii. Monitoring plan iv. Identify a TDM coordinate who will be responsible for the TDM program; v. Other specifics of the respective strategy, as requested by the City. d. Identify on site plan location of"priority employee parking' on site plan. e. Payment in Lieu= $45,500 (7 X 6,500) 17. Per Section 265-150(E) minimum access width dimension at street for 2-way movement is 25'. Revise accordingly. VARIANCE — VA-157-19 payment of$2,000 due with next submittal. (Zoning) 5 RESOLUTION#2020-008 18. Per Section 265-120 Maximum of 10% (8.4 spaces) of required parking can be valet; 11 valet spaces are proposed. VARIANCE VA-159-19 (Zoning) 19. Per Section 265-14(C) "The clearance between a parking space and wall or other solid obstruction shall be a minimum of 2.5"'. Parking spaces #49, 54, & 56 do not meet code. Revise accordingly. VARIANCE—VA-158-19 (Zoning) 20. HEIGHT: Per Figure 303-10, 4-stories permitted by right. The applicant is proposing Sustainable Building Practices incentive to earn the additional 2-stories. Must meet all of the requirements of Section 305-50 prior to issuance of a building permit. (Zoning) 21. RAC TRAFFIC IMPACT MITIGATION: Provide an analysis, signed and sealed by a certified engineer, identifying the amount of CRA mitigation for traffic impact due based on resolution No. 2014-049 which established a rate of$21.26 per p.m. peak hour trip. Per The Traffic Impact Statement prepared by Pillar Consultants, Inc. dated 9-25-19 the PM peak # of trips is 53, therefore the applicant must pay $1,126.79 (53 X $21.26) prior to issuance of a building permit. (Zoning) 22. Must provide latest revised set of plans on disk prior to going to public hearing. (Zoning) 23. For the purpose of evaluating flood and roadway conditions and mitigation related to the future development project, all topographic information will include LIDAR spot elevations within 150' of the subject property boundaries. (Zoning) 24. The applicant is encouraged to contact neighbors adjacent to, as well as condominiums and neighborhood associations to advise of this property. Please provide acknowledgement and/or documentation of any public outreach as a separate document to be added to the file. (Zoning) 25. Applicant must obtain a statement from the City Engineer saying that the traffic study/statement submitted by the applicant is complete and accepted prior to public hearing. (Zoning) 26. Applicant must obtain statement from the City Engineer, stating that adequate water supply exists for this project prior to issuance of a building permit. (Zoning) 27. Per 0-2017-022, for properties over an acre in size, the applicant must obtain and post property signs in accordance with the NEW City requirements. Please see the end of this document for guidelines. (Zoning) 28. Per 0-2017-027 & 0-2018-019, commercial properties under construction are required to provide security to fencing with screening showing project rendering covering at least 75% of the length of the fence along an arterial or state right-of-way & 25% for local roads and must include name and intended use of the project, project rendering, project website address, and owner or agent, the telephone number for the owner or agent, and the name and an emergency contact telephone number of the general contractor. Use of 6 RESOLUTION#2020-008 City logo/seal requires City Commission approval. Provide screen detail with next submittal. 2nd time requested. (Zoning) 29. Per Section 290-40, identify dimension of dumpster enclosure, minimum is 10' X 10'; 10' X 9"'provided. Revise accordingly. 2nd time requested. (Zoning) 30. Building footprint (6,785) + pervious surface area (5,420) + impervious surface area (21,900) = total site area of 34,094 (34,105). Clarify numbers provided in the Site Development Data table. 2nd time requested. (Zoning) Section 6. That such application must be reviewed by Broward County Aviation Department. That pursuant to LDC Section 635-100 "Expiration of Site Plans," Section 625-50 "Expiration of Variances," the Site Plan (SP-145-19), Variances (VA-157-19, VA-158- 19, VA-159-19, VA-160-19, VA-161-19, and VA-175-19), and Design Variations (OT-172-19, OT-173-19, and OT-174-19) approvals shall automatically expire and become null and void unless the Applicant commences with construction of the improvements shown on the Site Plan, within eighteen (18)months from the date of this Resolution. Section 8. That the issuance of a development order by a municipality does not in any way create any right on the part of an Applicant to obtain a permit from a state or federal agency, and does not create any liability on the part of the municipality for issuance of the development order if the Applicant fails to obtain requisite approvals or does not fulfill the obligations imposed by a state or federal agency, or undertakes actions that result in a violation of state or federal law. Section 9. That all resolutions or parts of resolutions in conflict with this Resolution are repealed to the extent of such conflict. Section 10.
