HomeMy WebLinkAboutR-2020-012 City Approving the Site Plan Modification (SP-64-07MOD), Submitted by MSG Port 95, LLC, for Property Located at 2650-2694 SW 36th Street in the City of Dania Beach, Florida RESOLUTION NO. 2020-012 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA, APPROVING THE SITE PLAN MODIFICATION (SP-64- 07MOD), SUBMITTED BY MSG PORT 95, LLC, FOR PROPERTY LOCATED AT 2650-2694 SW 36TH STREET IN THE CITY OF DANIA BEACH, FLORIDA, AS LEGALLY DESCRIBED IN EXHIBIT "A," A COPY OF WHICH IS ATTACHED TO THIS RESOLUTION; PROVIDING FOR CONFLICTS; FURTHER, PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, Chapter 28, "Land Development Code" (the "LDC"), Part 6, entitled "Development Review Procedures and Requirements," Article 635, entitled "Site Plans" of the City Code of Ordinances (the "City Code") provides that Site Plan approval is required as a condition to the issuance of a building permit; and WHEREAS, the City of Dania Beach (the "City") Commission passed and adopted Resolution No. 2013-099, approving a Site Plan (SP-64-07) submitted by Bridge Development Partners, LLC, representing the property owner Bridge Port 95, LLC, for property legally described in Exhibit"A" (the "Property"); and WHEREAS, the MSG Port 95, LLC (the "Applicant") has requested Site Plan Modification (SP-64-07MOD) to permit changes to the parking, loading and retention areas on the Property, as described in Exhibit`B;" and WHEREAS, the City Commission conducted a duly noticed public hearing in accordance with Article 610 of the LDC; and WHEREAS, the City Commission finds that the approval of the revised Site Plan Modification (SP-64-07MOD) is consistent with the City's Land Development Code and Comprehensive Plan; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF DANIA BEACH,FLORIDA: Section 1. That the foregoing "WHEREAS" clauses are ratified and confirmed as being true and correct, and they are made a part of and incorporated into this Resolution by this reference. Section 2. That pursuant to Chapter 28 "Land Development Regulations," Part 6 "Development Review Procedures and Requirements," Article 635 "Site Plans," the following Site Plan Modification (SP-64-07MOD), attached as Exhibit `B," which is made a part of and incorporated into this Resolution by this reference, is approved subject to compliance with the following conditions from the original Site Plan (SP-64-07), approved via Resolution No. 2013- 099: Conditions of Approval 1. Per Sec. 275-80: A) Minimum scale shall be equivalent to the site plan (please verify) D) Show existing canopy on adjacent properties within 25 feet of the landscape areas to be modified H) Clearly indicate in the Landscape Calculations which trees "to-remain" will be contributing to each requirement I) Provide a plant schedule which shows species/sizes/spacing for all new groundcover, shrubs, and trees associated with the Parcel 7 addition and parking area revisions. Please also indicate if the proposed Canopy species are Category 1 or Category 2 installations. (Landscaping) 2. Staff will be scheduling a verification inspection in the next couple weeks to verify information provided in the updated TD sheets as relates to existing tree resources which will be removed, relocated, or preserved on-site. Please contact Ryan St. George by phone or email if you wish to be in attendance (Landscaping). 3. Show all existing trees (and existing conditions in general) in lightweight, dashed, or "greyed" lines/text and all proposed trees/changes in bold(Landscaping). 4. Remove the tree mitigation note from the bottom of sheet L-2.3 since this note appears to apply to the original development and would not apply to this new site plan modification (Landscaping). 5. Per Section 825-100(A)(5) requirements, all canopy proposed to be removed as part of new or amended developments requires an additional 50% tree replacement. Please include this information at the end of your tree disposition table (sheet TD-2.2) and incorporate the calculations in your landscape table (sheet L-3.3) (Landscaping). 6. Please add the relocated gumbo limbo symbols on the west side of the property to the tree revisions legend(Landscaping). 7. Sheet L-1.2 and L-1.3. Some trees in the SE corner of the development (on both sides of the retention area) are identified with a dashed tree symbol not identified in the tree legend. Some have existing tree tags while others do not. Please clarify (Landscaping). 8. Sheet L-1.3; provide additional information regarding the three trees to be provided by the County (i.e. species, size, when, why, etc.) (Landscaping). 9. The submitted Landscape Calculations table indicates intermediate tree, small tree, and palm tree percentages all exceed the maximum percentage allowed. Refer to Sec. 275-190 (D), (E), (F), and (G), and revise the calculations or plantings accordingly. Include percentages for each category as a component of the revised plan. Also, revise the "Percent required" section of the table to clearly indicate the shade tree percentage requirement is a minimum requirement, while the other tree percentage requirements are maximum requirements. A variance will be required for all categories which do not meet requirements (Landscaping). 2 RESOLUTION#2020-012 10. Existing and proposed buffer trees may not meet the minimum size requirements in Sec. 275-120 (16 ft. height). Please update/revise if necessary (Landscaping). 11. Provide the width of perimeterNUA buffers, clearly indicated on plans (Landscaping) 12. In your next submittal, please sequence your Disposition sheets prior to your Landscape sheets (i.e. existing site information before proposed site information) (Landscaping). 13. Include the City of Dania Beach Standard Landscape Notes (attached) labeled as such in the revised submittal (Landscaping). 14. Identify use of new truck pads (Zoning). 15. Provide a recorded copy of the unity of title prior to issuance of a building permit (Engineering). 16. Provide conceptual preliminary drainage analysis and grading plans and statement of proposed drainage systems and methods; including existing drainage system to remain. Existing drainage system provided on site. A revised drainage analysis must be provided prior to issuance of a building permit (Engineering). 17. Show sight-visibility triangle at all proposed driveways and/or ingress-egress, including on landscape plan. Missing on northwest driveway measurement of sign distance FDOT index 546 coming from east to west and/or on north/east driveway a new 25' — 30' sight visibility triangle for the newly added parking area(Engineering). 18. Identify pavement, marking and width of driveways aisles on some areas and clearly identify in driveways. Identified in Site Plan SP-1, missing signage of new signs such as stop sign, fire hydrants, etc., for newly relocated fire hydrant, added parking and loading areas (Engineering). 19. Provide Maintenance of Traffic (MOT) plan by a licensed Professional Engineer in the State of Florida (if applicable). Provide approval of BCTED. Collins Road is a local roadway. A Maintenance of Traffic must be submitted prior to issuance of a building permit(Engineering). 20. Provide the following civil engineering drawings, signed and sealed by a Florida registered civil engineer. Paving, Grading and Drainage Plans, including the sizes and dimensions of all storm-water infrastructures. Please be advised that all storm drains shall be constructed with RCP piping in the City ROW. Provide drainage structures tables. Existing drainage systems provided on site. A revised Drainage Analysis will be provided. An updated Drainage Calculations was not provided. Existing roof drainage by scuppers into site drainage system(Engineering). 21. Provide drawing file (dwg or dgn) disk of the approved site plan in Florida State Plane Coordinate (NAD 83). This should be addressed as part of the final submittal. Pending to be provided a modified Site Plan(Engineering). 3 RESOLUTION#2020-012 22. Contractor shall provide, before issuance of a C.O., to the Engineer and City of Dania Beach a CD and hard copies of "as-Built" drawings of the project giving information on elevations horizontal and vertical dimensions of paving and drainage, water and sewer connections signed and sealed by a certified registered surveyor(Engineering). Section 3. That pursuant to Section 635-100 "Expiration of Site Plans" of the Land Development Code, Site Plan Modification (SP-64-07MOD) approval shall automatically expire and become null and void unless the Applicant files a complete building permit application with construction drawings for the improvements shown on the Site Plan, within eighteen(18) months from the date of this Resolution. Section 4. Such application must be reviewed by the Broward County Aviation Department; the point of contact is William Castillo, Airport Planner, located at 220 SW 45 Street, Suite 101, Dania Beach, Florida 33312, (954)359-6100. Section 5. That the issuance of a development permit by a municipality does not in any way create any right on the part of an Applicant to obtain a permit from a state or federal agency, and does not create any liability on the part of the municipality for issuance of the permit if the Applicant fails to obtain requisite approvals or does not fulfill the obligations imposed by a state or federal agency, or undertakes actions that result in a violation of state or federal law. Section 6. That all resolutions or parts of resolutions in conflict with this Resolution are repealed to the extent of such conflict. Section 7. That this Resolution shall be in force and take effect immediately upon its passage and adoption. PASSED AND ADOPTED on January 28, 2020.
