A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF DANIA
BEACH, FLORIDA, APPROVING THE MONUMENT SIGN VARIANCE
REQUEST(VA-168-19),SUBMITTED BY RICHARD COKER ON BEHALF OF
MSG I-595, LLC AND MSG MARINA MILE, LLC FOR PROPERTY
GENERALLY LOCATED ON THE WEST SIDE OF SOUTHWEST 26Tx
TERRACE AND SOUTH OF I-595 WITHIN THE CITY OF DANIA BEACH,
FLORIDA,AS LEGALLY DESCRIBED IN EXHIBITS"A"AND`B,"COPIES OF

CONFLICTS; FURTHER, PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, pursuant to Chapter 28, the Land Development Code ("LDC") Part 6
"Development Review Procedures And Requirements,"Article 625,"Variances"of the City Code of
Ordinances(the"City Code"),Richard Coker on behalf of MSG I-595,LLC and MSG Marina Mile,
LLC (the "Applicant"), has applied to the City of Dania Beach (the "City") for approval of a
Variance request (VA-168-19), for property legally described in Exhibits "A" and "B" and
incorporated by this reference; and
WHEREAS, LDC Section 625-40 states that the City Commission may grant a Variance
based on its determination that the Applicant has demonstrated that the criteria identified in the City
Code have been satisfied; and
WHEREAS,the Applicant has requested a Variance (VA-168-19) to permit a monument
sign to be located zero (0) feet from an interior property line, where pursuant to LDC Section
505.40(K)(6)the minimum setback from an interior property line is fifty(50) feet; and
WHEREAS, the City Commission conducted a duly noticed public hearing in accordance
with Article 610 of the LDC; and
WHEREAS,the City Commission finds that the approval of the proposed Variance (VA-
168-19), will protect the public health, safety, and welfare of the residents of the City, and furthers
the purpose, goals, objectives, and policies of the Comprehensive Plan;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE
CITY OF DANIA BEACH, FLORIDA:
Section 1. That the foregoing"WHEREAS"clauses are ratified and confirmed as being
true and correct and they are made a part of and incorporated into this Resolution by reference.
Section 2. That pursuant to Chapter 28"Land Development Code,"Part 6"Development
Review Procedures and Requirements,"Article 635"Variances,"Variance application(VA-168-19)
is approved with the following condition:
1. A recorded sign easement must be provided prior to issuance of a building permit.
Section 3. That pursuant to LDC Section 625-50"Expiration of Variances,"the Variance
(VA-168-19)approval shall automatically expire and become null and void unless the Applicant files
a complete building permit application with construction drawings for the improvements shown on
the Site Plan, within eighteen(18)months from the date of this Resolution.
Section 4. That the issuance of a development permit by a municipality does not in any
way create any right on the part of an Applicant to obtain a permit from a state or federal agency,and
does not create any liability on the part of the municipality for issuance of the permit if the Applicant
fails to obtain requisite approvals or does not fulfill the obligations imposed by a state or federal
agency, or undertakes actions that result in a violation of state or federal law.
Section 5. That all resolutions or parts of resolutions in conflict with this Resolution are
repealed to the extent of such conflict.
Section 6. That this Resolution shall be in force and take effect immediately upon its
passage and adoption.

MSG I-595 LLC is the owner and developer of the I-595 Business Center which consists of an
industrial/warehouse building approved 150,000 sf on a 7.59 ac parcel of land. The I-595
Business Center project recently received a Certificate of Occupancy. The I-595 Business
Center property is located on SW 30`b Avenue directly south of 1-595.
MSG Marina Mile LLC is the owner and developer of the Marina Mile project which consists of
an industrial/warehouse building of 189,904 sf on a 13.87 ac parcel of land. The Marina Mile
project is located directly south of the I-595 Business Center property so that the south property
line of the I-595 Business Center property is conterminous with the north property line of the
Marina Mile property.
MSG I-595 LLC and MSG Marina Mile LLC have the same equitable ownership and will be
managed by a common management group.
The two projects share an access drive from SW 30a' Avenue pursuant to a recorded access
easement. The property line between the properties runs in the middle of the access drive and in
fact runs through the middle of the landscaped median in the access drive.
A monument sign to serve both projects is planned to be located within the median of the access
drive. The monument sign meets all of the requirements of the City Code except, because it
straddles the property line between the two properties, it does not meet the setback requirements
from internal property lines. Sec. 505.40(K)(6) of the Land Development Code provides as
follows:
The minimum setback from an interior property line is twenty (20)percent of the
length of the street frontage of the lot upon which the sign is erected, or fifty(50)
fee, whichever is less.
In this case, the required setback is 50 feet. We are requesting a variance from this code section
to permit the common signage to be placed on the property line between the two properties that
will be served by the monument sign.
The requirements for the granting of a variance set forth in Sec. 625-40 of the City Code are
addressed as follows:
1. That the requested variance maintains the basic intent and purpose of the subject
regulations,particularly as it affects the stability and appearance of the city;
The two properties share common ownership and common management as well as a common
access drive. The proposed monument sign is located within the common access drive and has
the appearance of the entrance sign into an industrial park. As such, the monument sign is
consistent with the purpose and intent of the regulations.
2. That the requested variance is otherwise compatible with the surrounding land uses
and would not be detrimental to the community;
The proposed is located in the median of a shared access drive between the two properties and
is compatible with the industrial development use of the property.
3. That the requested variance is consistent with, and in fill-therance of, the goals,
objectives and policies of the adopted Comprehensive Plan, as amended from time to
time, and all other similar plans adopted by the city;
The proposed monument sign is consistent with the goals, objectives and policies of the
Comprehensive Plan in that it promotes unified development patterns and a common signage
plan,
4. That the plight of the petitioner is due to unique circumstances of the property or
petitioner which would render conformity with the strict requirements of the subject
regulations unnecessari4y burdensome; and
The variance is necessary because of the unique conditions of the properties with the property
line located in the middle of a common access drive and access easement.
5. That the variance requested is the minimum variance that is necessary to afford relief
to the petitioner, while preserving the character, health, safety and welfare of the
comminity.
This is the minimum variance necessary to accomplish the purpose of providing common
signage between two related properties within a common access drive.
