DANIA BEACH CITY COMMISSION
TUESDAY, JANUARY 28, 2020 - 7:00 P.M.
1. Call to Order/Roll Call
Mayor Lewellen called the meeting to order at 7:00 p.m.

2. Moment of Silence and Pledge of Allegiance
Mayor Lewellen called for a moment of silence after the Pledge of Allegiance to the United
States Flag.
Vice-Mayor Odman requested a point of personal privilege to address comments made at the
January 14, 2020 Commission meeting regarding the Dania Beach Historical Society and
Museum, and the City's 115'' Anniversary celebration. Her statement and exhibits referenced
throughout her statement are attached to and incorporated into these minutes.
Commissioner Brandimarte commented in response to Vice-Mayor Odman.
3. Presentations and Special Event Approvals
3.1 Special Event request from the City of Dania Beach Community Redevelopment
Agency for Dania After Dark Superbowl Edition to be held on SW 1st Avenue
between Dania Beach Boulevard and SW 1st Street, on February 1, 2020 from 4:00
p.m. to 10:00 p.m. The applicant is also requesting road closures on SW 1st Avenue,
and BSO Police and Fire Services. (Parks &Recreation)
Commissioner James motioned to approve the Special Event request for the Dania After
Dark Superbowl Edition event; seconded by Commissioner Brandimarte. The motion
carried unanimously.
3.2 Special Event request from the South Florida Regional Transportation Authority (Tri-
Rail) to have their annual "Rail Fun Day" to be held at 500 Gulf Stream Way on
February 8, 2020 from 11:00 a.m. - 3:00 p.m. (Community Development)
Commissioner James motioned to approve the Special Event request for the annual Rail
Fun Day; seconded by Commissioner Harris. The motion carried unanimously.
4. Proclamations
There were no proclamations at this meeting.
5. Citizen Comments
Linda Wilson, President of the Friends of the Dania Beach Library, spoke of the recent vintage
motorcycle show, the upcoming Arts & Seafood Celebration, DAD Art in the Hall event this
Saturday, and Art Zero Empty Spaces. She questioned the status of Honor the Legacy Project.
Joyce L. Davis, 500 NE 2nd Street, thanked the community for the support and success of the
Pearl Giriz Program.
Emmanuel George, 17 NE 2nd Avenue, responded to Vice-Mayor Odman's comments.
Steven Jones, 4930 SW 29 Way, spoke of Broward County bonds that were to go to public
schools since 2014, and questioned if the City pursued any funds for schools in Dania Beach.
Mayor Lewellen asked City Attorney Ansbro if there are any rules addressing whether the public
can say anything during public comments.
City Attorney Ansbro read aloud subsection 9.3, Personal and Slanderous Remarks, of
Resolution No. 28-85, Rules of Procedure for City Commission Meetings.
Benita McKnight, 1360 NW 2nd Terrace, commented on remarks made by Vice-Mayor Odman
and Mr. George, and asked that the two make it work.
Jose Armand, 50 SE 3rd Avenue, #3, commented about the CACAB and the Dania Beach
Historical Society. He asked to be included in any future discussions about a cultural arts center.
Gloria Fernandez, 3831 SW 56 Street, expressed concerns about traffic in her neighborhood and
future development projects making it worse.
6. Public Safety Reports

Dania Beach City Commission
Tuesday,January 28,2020—7:00 p.m.
Captain Daniel Marks, BSO Chief of Police, gave an update of the security and safety
improvements that have been made to City Hall. He noted he would provide a detailed memo to
the City Manager for distribution to the Commission.
Captain Sergio Pellecer, BSO District Fire Chief, reported that on February 20th, training would
be available for city staff on Stop the Bleed kits. He spoke of the Fire Chief Association meeting
he attended last week.

7.4 RESOLUTION 42020-010

AUTHORIZING THE PROPER CITY OFFICIALS TO EXECUTE AN AGREEMENT WITH THE CORRADINO
GROUP FOR A COMPREHENSIVE TRANSPORTATION/TRANSIT ANALYSIS UTILIZING THE LEE
COUNTY CONTRACT #160427/ANB C-7770 FOR FISCAL YEAR 2019-2020, IN AN AMOUNT NOT TO

Dania Beach City Commission
Tuesday,January 28,2020—7:00 p.m.
Commissioner James noted the only issue she has is that the funding is coming from
Commission contingency.
City Manager Garcia explained City wide assessments were conducted, and we want to make
sure we take advantage of the penny sales tax with ready-to-go projects. She noted to date, we
have lost revenue from Broward County for our bus route and stressed the importance of a transit
study. This came after the budget process, and Commission contingency was funded for things
such as this.
Commissioner James said every department has funding for professional services, and
questioned the balance in Commission contingency. She added this is not something the
Commission planned for, and questioned what they are going to do when they have a priority
they wish to undertake.
City Manager Garcia responded the only place we can tap into for such an important matter is
the Commission contingency. She noted we cut the City budget this year to balance it.
Frank DiPaolo, Director of Finance, said currently there is $42,899.00 in the account; after this
transfer, $8,000 would be remaining.
Commissioner James said this is a concern of hers as the contingency would be wiped out; we
have different funding mechanisms.
City Manager Garcia noted we cut nearly $2 million to balance this budget. In order to tap into
the penny tax, you are either ready or not. Master plans have never come forward in the City as
the City has been reactive rather than proactive; this is an investment. We have lost money
because our City it not meeting standards in bus ridership.
Commissioner James felt it is not right to wipe out the Commission's contingency.
Commissioner Harris noted as a member of the MPO, there may be a funding mechanism that
would pay for all or a part of this study. There is a Board meeting on February 12th and we will
know at that time how much money will come from the County to alleviate the financial burden.
City Manager Garcia said our goal would be to get reimbursed; if we wait 90 days, it could push
us out of the game plan.
Commissioner Harris explained how the sales tax would be distributed from the State to the
County, and then to the cities.
City Manager Garcia noted it would be a priority to seek reimbursement.
Vice-Mayor Odman agreed it is unfair for the Commission to wipe out the Commission
contingency, but it is an important project. She questioned if there was funding anywhere else.

Director of Finance DiPaolo responded he has looked everywhere. The funds can come from the
Commission contingency or the General Fund, and once reimbursed, credited back.
City Manager Garcia thought maybe we could find funding for half of the cost from the unfilled
employee positions.
Commissioner Brandimarte asked if City Manager Garcia was comfortable with leaving only
$8,000.00 in Commission contingency.
City Manager Garcia said yes; this is a good investment.
Commissioner Brandimarte asked to have dialogue next time before it is put on the agenda.
Commissioner James said protocol is lacking in a lot of areas; we need to have it and follow it.

PART 2, "SITE DEVELOPMENT REGULATIONS," ARTICLE 205, "TABULAR SUMMARY OF SITE
DEVELOPMENT STANDARDS FOR ALL ZONING DISTRICTS," SECTION 205-10(B) "PRD-1 AND

City Attorney Ansbro read the title of Ordinance #2020-003.
Corinne Lajoie, Planning &Zoning Manager, gave an overview of the text amendment.
Mayor Lewellen opened the Public Hearing.
Kurt Larsen, 5810 SW 36t' Terrace, spoke about flooding and new developments making
existing situations worse. He provided each Commissioner with a copy of "Challenges in
Forecasting Flooding, which is attached to and incorporated into these minutes.
Vice-Mayor Odman requested a response from staff.
Planning & Zoning Manager Lajoie noted this is a text amendment that is increasing setbacks
that would create more impervious area, which would help with flooding.
Commissioner James said she is concerned about the flooding, and questioned how they would
be able to keep the water on their property and what happens when the water is so great that the
entire thing is flooded.
Planning & Zoning Manager Lajoie explained the way that new development projects retain their
onsite drainage is through driveways and retention areas. New projects are being engineered to
accommodate flooding; drainage systems for neighboring sites that are not new may not be
working sufficiently as they are older systems.
Marc LaFerrier, Director of Community Development, addressed development in Hollywood
directly east of Mr. Larsen's property. The South Florida Management District designs large
scale projects, not the City of Dania Beach. All surface water management approvals go through
Broward County. Mr. Larsen's part of the City never received the storm water management
attention it required; the real solution is on a larger scale, which would be the SFWMD and the
County. He noted this particular amendment would expand the green areas, which addresses Mr.
Larsen's concern.
Steve Goldberg, 4010 SW 54 Court, questioned lowering the development height by five feet.
Director of Community Development LaFerrier responded the five feet reduction is minimal and
would not change the living space of a unit. The height of the townhouse needs to accommodate
the height of a two story home.

Corinne Lajoie, Planning & Zoning Manager, gave a presentation on the rezoning and flexibility
units allocation request.
Mayor Lewellen opened the Public Hearing.
Dennis Mele, Greenspoon Marder, representing the applicant, spoke of two neighborhood
meetings held, and addressed the drainage and water concerns raised earlier. He gave a brief
presentation on the proposed installation of cul-de-sacs and a gate to mitigate cut-through traffic
in the neighborhood.
Commissioner James asked who would manage the key fobs.
Attorney Mele responded on-site management would be responsible; the developer has
volunteered to do so.

Commissioner James questioned how it would work if homes were turned into vacation rentals
and whether they would have access to the key fob.
Attorney Mele addressed the program and noted it is voluntary, not regulated.
Commissioner James asked if the street lights could be solar.
Attorney Mele said they would look into it.
Commissioner Harris confirmed the amount of green space and ADA sidewalks.
Mayor Lewellen asked if these are for purchase or rent.
Attorney Mele responded they are rentals.
Mayor Lewellen asked if the apartments could have the same restrictions similar to a HOA.
Attorney Mele noted every apartment would have a minimal lease term of six months; they could
not be sublet without the approval of the property owner.
Commissioner Harris questioned how guests or family members who wanted to visit would be
handled.
Attorney Mele responded the community is gated; access would be granted from security.
Robert Banks, 3831 SW 56 Street, asked for clarification regarding the 275 units getting the
fobs, which would create a heavier flow of traffic. His biggest concern about the density is this
may set a precedent for more multi-family developments along 40th Avenue.
Marjorie Perry, 5521 SW 44 Terrace, thanked the Commission and staff for the signs and BSO
for patrolling and ticketing when able. She spoke in opposition to the project, and submitted a
petition of area residents opposing the closing of SW 54th Court at SW 40th Avenue, which is
attached to and incorporated into these minutes.
Michael Paesani, 5510 SW 44th Terrace, commented on 254 fobs and 100 new units approved for
54th Avenue not being suitable. He favored the design and requested more citizen input before
finalizing the project.
Attorney Mele clarified most people will come in and out from State Road 441. The answer
about key fob issuance will be at the February 1 lth meeting.
Laurie Ann Groover, 5451 SW 44th Avenue, said the plan on paper looks beautiful, but in reality
a development of this magnitude is too large for their neighborhood. There will over 500
additional cars. She is not opposed entirely to the project, but it needs to be reduced in
magnitude.

Susan Saver, 5551 SW 401h Avenue, noted 54th Street is very small and building this project of
such density and height is irresponsible. She asked if the existing sanitary sewer system would
be able to sustain the new development, and requested to see drainage plans and the reduction of
the density.
Christine Musial, 5414 SW 40 Terrace, felt like Hollywood and Dania Beach have thrown them
under the bus. She likes the cul-de-sac, but it would not be built for several years. She wants
rubberized strips on the road or something to calm traffic; the community on 54th Court needs
help.
Steven Goldberg, 4010 SW 54 Court, spoke in support of the project.
Kurt Larsen, 5810 SW 36th Terrace, expressed concern regarding the fill that will be used on site
and traffic on 40th Avenue.
Artie Fraser, 3911 SW 56 Street, spoke in support of the project. He noted a lot of the concerns
expressed are existing conditions and have nothing to do with the proposed development. The
developer seems dedicated to resolving the problems.
Mayor Lewellen noted the concerns voiced about the number of buildings and height.
Attorney Mele commented there are two rings of residential with parking in the middle; it is not
four buildings. They are preserving the setback on 54th as well as the trees, and the building is
only occupying a small percentage of the property, less than 25%. If the building was shorter, it
would have to be wider. Attorney Mele addressed the various concerns raised by the residents.
Commissioner James asked how long it would take to construct the cul-de-sacs.
Attorney Mele said the cul-de-sacs would be built by the time their building is open.
Commissioner James questioned if it could be put in writing that current residents' key fob
access would be grandfathered-in regardless of a change in management. She asked what the
compromise was other than the cul-de-sac.
John Lasko, 4160 NW 41St Street, noted the biggest issue at the meeting was the traffic, and
described the dialogue. He added they are thrilled with the cul-de-sacs.
Commissioner James asked who is in charge of pumping the lakes down.
Attorney Mele said the SFWMD is first responsible and then they give direction to others to
lower theirs.
Commissioner Brandimarte asked about the time estimate for installation of the cul-de-sacs.
Attorney Mele responded two years.

Vice-Mayor Odman questioned whether we are a 100% sure the special needs bus can get
through the cul-de-sac.
Attorney Mele explained fire trucks are able to navigate the cul-de-sac and so are school buses.
Commissioner Harris spoke about the neighborhood meetings and concerns expressed and
addressed. He felt the project is a win/win for everyone.
Dennis McGowan, 5551 SW 40a'Avenue, asked if the trees could be saved and relocated.
Attorney Mele addressed their tree disposition plan, which everyone has a chance to review.
Seeing as there was no one else to speak in favor or opposition, Mayor Lewellen closed the

Commissioner James requested one more community meeting be held before second reading of
the ordinance.
Attorney Mele agreed to do so.

11.2 Commissioner Harris
Commissioner Harris said 40"' Avenue is on the Project Ready list and should start as soon as
June. He described another project on Old Griffin Road from Federal Highway to west of Bryan
Road; it will be delayed because part of the seawall collapsed.
Commissioner Harris thanked the Commissioners, Chamber of Commerce, and everyone who
attended the opening of Cooper's Hawk at Dania Pointe. He thanked Human Resources Director
Milligan for the Job Fair and Commissioner James for the sports program, both held at Dania
Pointe.
Commissioner Harris addressed the bankruptcy of Lucky's Market and the space at Dania
Pointe; though the tenant is unknown at this time, there will be a brand new grocery store.
Commissioner Harris noted flood plain meetings around the County about flood insurance rates
are scheduled; anyone interested should check our website.
11.3 Commissioner James
Commissioner James spoke of attending the School Board meeting today where they discussed
the proposed Attucks-Bethune merger. She urged the Commission and community to be aware
of what is happening.
Commissioner James noted she saw new parks signs this morning at PJ Meli Park.
Commissioner James commented Dania After Dark is on Saturday; she was on the radio to
promote the City and CRA. She added it is going to be very special DAD and invited everyone
to attend. Two former and three current NFL players are coming to DAD.
Commissioner James noted the very successful sports clinic at Dania Pointe a couple weeks ago.
11.4 Vice-Mayor Odman
Vice-Mayor Odman had no comments.
11.5 Mayor Lewellen
Mayor Lewellen noted we are officially certified as a pet friendly city, which is an excellent
economic engine for the City.
Mayor Lewellen spoke of her attendance at the U.S. Conference of Mayors. She went to a
meeting of small cities that addressed grants for small cities, and another discussed economic
development(training for those who want to be entrepreneurs). She and other Mayors met at the
White House; while there, a bi-partisan bill was signed for funding for religious organizations'
security.

Mayor Lewellen addressed protocol for Keys to the City; they should be given in a public setting
and done through the City. We need to come up with a process and an actual protocol, where
Keys are given to residents of the City or former residents who have brought something back for
the City. We need to know who Keys to the City are going to. She felt Commissioner James
should notify the Commission of Keys to be given out.
Commissioner James said there was no notice given for the Keys for Spirit Airlines or for
Tropical Acres. All of a sudden there is protocol; she has not been given notice. She is asking
the City Attorney if it is legal for her to give a Key to the City.
Mayor Lewellen said all of those other keys were either on a program (Tropical Acres) or on an
agenda (Spirit Airlines and Gangrel's). Keys are given by the City and usually these things are
done through the City.
Commissioner James commented she is not saying who she is giving a Key to the City to.
City Attorney Ansbro recommended the Commission debate this and come up with a policy.
Vice-Mayor Odman said instead of debating this now, although it does make sense for the
Commission to have a policy, we should let Commissioner James give the Key, and then set a
date to come up with a policy or have a policy presented to us.
Mayor Lewellen noted we do not know who the Key is going to; we need to be transparent.
Commissioner Brandimarte felt we need a policy. She did not think it was right to give a key to
Spirit Airlines. We lost the magic when we gave out so many Keys years ago.
Mayor Lewellen said her concern is there is no transparency whatsoever; perhaps it could be
included on the program for Saturday night.
Commissioner James clarified she has not promised anyone a Key in return for showing up at
DAD. She has been excluded from all the discussions; transparency works both ways. She said
she does not want to use a vendor she feels is unethical.
Mayor Lewellen spoke of the MLK church service on Sunday.

City Manager Garcia reported we are going to be working on videos for getting residents to
participate in the Census. She thanked the Commission for going out and getting information
and bringing it back to staff, it allows us to put forward initiatives.
City Manager Garcia spoke of the new entranceway sign and associated landscaping at Griffin
Road and US-1, and noted we need to pick a date for the ribbon cutting.
The Commission consensus was to hold the event on Monday, February 24, 2020, at 10:30 a.m.

(Comments by Vice-Mayor Odman —January 28, 2020 City Commission meeting)
Thank you Mayor Lewellen for granting me this point of privilege to address some
misinformation that was brought up at our previous Commission meeting on January
14th. I will try to succinctly cover the more egregious of the accusionation brought
forward by Mr. George and Mr. Jones and to hopefully bring forward all relevant
documents as it relates to those allegations.
I would like to preface this by saying that I have had, what I considered a friendship with
Mr. George since the summer of 2017. During that time, I proudly supported his creative
and historical ambitions both publicly and privately. I found him to be a respectable and
talented contributor to the South Broward creative community. So I suppose it is for this
reason, his claims were all the more shocking.
In March of 2019, City Manager Garcia and I made some minor cosmetic improvements
to the city hall atrium and chambers. In doing so, I had removed some older
photographs that had been hanging on our walls in the NW conference room. Quick to
not miss a thing, residents like Patricia Tyra and Rae Sandler spoke out in
disappointment that these meaningful historical photographs had been removed. I
responded with action and accountability to my residents and begin the reactivation of
the Dania Beach Historical Society. [I am submitting minutes for both the March 26
and May 14th meeting for entry into the public record. ]
Originally registered in 1977 by City Attorney Frank Adler as the Dania Historical
Society, Mayor Mc Elyay served as the unofficial city historian and the corporation's
president until it's dissolution in 1992. In the years following, several residents and other
past mayors have served as stewards of Dania Beach History. From personal archives
of photographs to published books, the Dania Beach Historical Society continued to
contribute at different points as both an informal and legally established entity. [I am
submitting both the initial 1977 Dania Historical Society Corporation information
and the book entitled, The History of Dania Beach, Florida wherein the Dania
Beach Historical Society is cited on page 16 and 28 for entry into the public
record.]
On February 13, March 13, and April 10, 2018- under the leadership of then Mayor
Tamara James, Mr. George came before the commission to request a quote "historical
site for NW Dania and Libera to preserve the history of these communities". While the
commission, at that time, never took action, Mr. George and I occasionally discussed
the worthwhile merits of his vision. During that same period, Mr. George also made a
point to meet with former Mayor, Anne Castro, to share his end goal to establish a
dedicated black historical site for South Broward. Mr. George has been consistent in
this message. At every opportunity, in those conversations I sought the participation of
Mr. George to be a part of the Dania Beach Historical Society and he remained

steadfast in his assertion that he would continue to focus on his sight for a Historical
Society that would remain dedicated to only the black community. Time after time, with
praise and respect for his vision, I clearly communicated on the public record and in
private conversation that my personal goal was to work on an inclusive Dania Beach
Historical Society and Museum that would seek to honor the rich black history of our city
along with every other race and ethnicity that laid roots within our municipal
boundaries.[I am submitting minutes from the February, March, and April 2018
meetings, the June 25, 2019 meeting, along with the document titled JA Ely
Historical Society for entry into the public record.]
Recently, on January 12, 2020 the City of Dania Beach held a brunch to honor our past
and present city officials. Mr. George expressed his frustration that neither he, nor any
other black families were invited to the event. More factually, no families were invited to
the event. At the suggestion of Commissioner James at the September 10, 2019
meeting, the commission agreed, without argument, to move forward with the more
inclusive structure where each attendee, with the exception of the elected honorees
were expected to pay for their tickets. [I am submitting minutes from the September
2019 meeting for entry into the public record.]
Mr. George has further claimed that the logo for the Dania Beach Historical Society and
Museum was created by his friend and business partner, Richard Dubose. Respectfully,
none of his original artwork was used or altered and he was compensated for his time.
The final logo was produced by a private company that was kind enough to donate their
time and artwork. [I am submitting written acknowledgment from Mr. Dubose
pertaining to the artwork and logo for entry into the public record.]
Some of the most confusing and disheartening deceptions presented by Mr. George
and Mr. Jones centered around the Dania Beach Historical Society Corporation and it's
funding. Misappropriation of tax payer money and solicited donations is something that I
as an elected official take very seriously. To make myself abundantly clear, any claim
that I personally profited from the Dania Beach Historical Society is a lie. All monies
collected for the Dania Beach Historical Society and Museum currently remain with the
City of Dania Beach. I ensured that now, and in the future, any funds for the Historical
Society could only be accessed by the treasurer. To that point, I am submitting a letter
of legal opinion from City Attorney Tom Ansboro. In it, he states that, quote " The
corporation proceeds from the ticket sales are being processed to be paid to the
corporation treasurer Linda Wilson and a bank account is being established for the
corporation by her. The Vice Mayor has no ability to access funds related to the
corporation and has not done so." [I am submitting the letter of legal opinion from
Tom Ansboro dated January 16, 2020 for entry into the public record]

I asked the City Attorney to also obtain an independent review of the matter as it
pertained to any ethics violations or conflict of interest. It was determined by attorney
Robert Meyers, one of the leading experts in the field of florida governance and ethics
that in his legal opinion there was no ethical violation or conflict of interest. Mr. Meyers
did suggest that I file a report of charitable funding funding activities. Which I did in fact
file that form prior to the Dania Beach 115th event. [I am submitting letters of legal
opinion from attorney Robert Meyers dated December 11, 2019 and January 15,
2020. 1 am also including the fundraising disclosure form dated December 20,
2019 for entry into the public record.]
It is important to note that my title as President Director, is a placeholder that was
necessary to establish the legal paperwork to file a corporation in Florida. Each
additional member of the corporate board, Clare Frost as Vice President Director, and
Linda Wilson as Treasurer were informed when they accepted the position as a
corporate officer that they would be holding the position only until the time of the first
election when the elected board would then put into place. There was no objection to
this by either member and this was all done under the advice and guidance of City
Attorney Ansboro.
believe that any step off the path of progress presents us the opportunity to examine
our process. As my colleagues have also gone above and beyond to serve our
community as President and Directors of their own private corporations that receive
periodic money and resources from the city, it seems like a serendipitous time to
scrutinize how those dollars were spent to be sure that we, as elected officials, are
aligned with best practices and are being sensible of the taxpayer dollars. With that in
mind, I will be calling for a public workshop to provide an opportunity for the residents to
sit with us as we discuss and examine how we can collectively do better while moving
forward.
In conclusion, I want to thank my colleagues through the Mayor for this time to address
the rumors and unfounded speculation that were shared thousands of times over the
past 14 days. I made over a half dozen attempts to contact Mr. George directly and
through our mutual collegues in the hopes we could turn a story that became quickly
divisive into something meaningful, but despite my numerous efforts to reach out he did
not respond. Watching my integrity, character, and record of public service being
attacked for facebook likes was difficult. Having my family's safety come under attack
was terrifying.

And yet, I do not worship at the altar of ash. There are no bridges that have been
burned from my end. I welcome Mr. George and Mr. Jones to attend the first board
meeting of the Dania Beach Historical Society and Museum in February. I continue to
extend, as I always have for the past three years, any help or resources I can to assist
Mr. George in the realization on his vision for the J.A .Ely historical society. Ultimately,
history belongs to no one person; there is no one who can gatekeep the past. Dania
Beach history belongs to every single person who lived it...collectively. It is my hope that
Mr. George and any resident with interests in our city's history will join me on this
journey to honor and preserve the past together. Without ego. Without Hate. Without
division.
Mayor Lewellen read the Child Abuse Prevention and Volunteer Appreciation Month
Proclamation and presented it to Adena Wilson, Guardian ad Litem Program.
Ms. Wilson thanked the Commission and asked people to get involved to help a child.
5. Citizen Comments
Craig Valentine, Gangrel's Wrestling Asylum, 1982 Tigertail Boulevard, noted they are planning
their second season events at Dania Beach Casino, in particular, the Breast Cancer Awareness
event. Another benefit they are having is on July 27th at the Hard Rock Hotel and Casino.
Commissioner Brandimarte spoke of a meeting she has scheduled for tomorrow regarding the
Breast Cancer Awareness event.
Patricia Tyra, 2912 SW 54th Street, urged the City to not remove the historical photographs from
City Hall.
Rae Sandler, 1433 NW 8 Street, felt our historical photos should remain accessible to the public
at City Hall or be divided between the library here and the one out west.
Vice-Mayor Odman noted the photos would be relocated from the NW Conference Room to an
appropriate place to display them; within City Hall, we will have digitalized images of the
photographs.
6. Public Safety Reports
Captain Daniel Marks, BSO Chief of Police, reported on follow-up of traffic complaints and
gave statistics on calls made to the 100 block of SW 5th Court. He also addressed recent
homeless outreach activity and the upcoming Arts & Seafood Celebration.
Sean Brown,Battalion Chief, BSO Fire Rescue, introduced himself to City Manager Garcia.
Commissioner Brandimarte questioned inspections for fire extinguishers in Airbnbs.
Chief Brown responded they do not have the right to enter the premises according to state law;
their hands are tied.
Assistant Chief Gregory Holness, BSO Fire Rescue, commented Dania Beach is not the only city
having a problem with Airbnbs; these are residential homes and fall under Federal fair housing
law. He addressed calls made to traffic accidents on the I-95 corridor on Griffin and Stirling
Roads on and off ramps.

Eileen Kevles Snyder, Estates of Fort Lauderdale, spoke about Airbnbs in the Estates of Fort
Lauderdale and asked if there could be a moratorium placed on them.
Craig Valentine, Gangrel's Wrestling Asylum, noted Daniel Puder selected Gangrel's to wrestle
at a competition on June 61h at the African American Cultural Research Center in Miami; Dania
Beach will be represented.
Jose Armand, 50 SE 3 Avenue, proposed Dania Beach join other cities in celebrating National
Hispanic Month in October.

Charlotte Newbury, 1314 SE 5th Court, addressed issues with trees on the north side of the Sleep
Inn, and requested they be removed and no trees planted to replace them.
Karena Pinzon, 1318 SE 51h Court, also spoke of problems with the Sleep Inn property.
Randall Wright, 4391 SW 34th Lane, spoke of problems with windows and doors installed
through the BCAD mitigation of his home. He requested the County Commission hire a firm to
review that installations were done to code.
Patricia Chukerman, 545 SE 41h Court, noted there is an unlicensed Airbnb across the street from
her house. The address is 530 SE 4th Court.
Discussion ensued on legislation and City Codes pertaining to the issue.
Tom McManus, 565 SE 41h Court, also spoke of the problems with the Airbnb at 530 SE 4"
Court.
Emmanuel George, 17 NE 2nd Avenue, #106, requested a historical site for Dania Beach's Black
History.
Commissioner Grace requested he show his video on Black History at the next Commission

3.1 Special Event Request from Marine Industries Association of South Florida for their
"22nd Annual Plywood Regatta" to be held on April 1415, 2018, at the north end of
the Marina from 8:00 a.m. 6:00 p.m. on Saturday and from 8:00 a.m. 4: 00 p.m. on
Sunday. The applicant is requesting waiver of parking fees for volunteers.
Commissioner Grace motioned to approve the Special Event request for the 22nd Annual
Plywood Regatta; seconded by Commissioner Salvino. The motion carried unanimously.

Emmanuel George, 17 NE 2nd Avenue, Apt. 106, requested a historical site for Dania Beach, and
suggested we partner with the City of Hollywood.

site in Dania Beach to preserve our history.
6. Public Safety Reports
Captain Daniel Marks, BSO Chief of Police, reported on recent criminal activity in the City, Get
to Know BSO events on April 181h and May 171h, and the recent Shred-a-thon and Operation
Medicine Cabinet. The Law Enforcement Special Olympics sports run will be held April 251h
Commissioner Grace questioned how the BSO Substation works because residents have come
there and the door is locked; there is no phone number to contact someone. She thought
someone was supposed to be stationed there.
Captain Marks responded both stations are 24/7; if someone is not present due to a high volume
of calls for service, there are call boxes to reach downtown dispatch and a deputy will be right
there.
Commissioner Salvino said he has noticed lately that BSO is responding often to the Motel 6 on
Dania Beach Boulevard. He questioned whether the Nuisance Abatement Board could do
something about the situation.
City Attorney Ansbro reviewed the statute for use of the Nuisance Abatement Board; he will
meet with Captain Marks to see if the problem warrants bringing back the Board.
Sean Brown, Battalion Chief, BSO Fire Rescue, spoke of the Sound the Alarm initiative and
noted it is scheduled for April 28 from 10:00 a.m. to noon. He also noted they are looking for
volunteers and gave contact information.

Dania Beach City Commission
Tuesday, April 10, 2018—7:00 p.m.
Michael Sartin, 746 SW 3`d Street, spoke of the balkanization of the beach.
Bobbie Grace, 110 NW 81h Avenue, noted she did not get a consensus whether they could use the
City logo for the Breast Cancer event or whether the City would donate.
Commissioner James motioned to allow use of the City approved logo design to be used for
the breast Cancer Awareness event pending approval from CRA staff; seconded by
Commissioner Brandimarte. The motion carried unanimously.
Commissioner Harris recommended collaborating and putting together a sponsorship package.
Ms. Grace said the City is turning 115 years old; she hopes the Commission will take the lead
just as they did for the 1101h anniversary and put together something spectacular for City staff
and residents.
Commissioner Brandimarte noted Ms. Grace asked for a $5,000.00 donation; she deserves an
answer.
Commissioner James questioned if we have money available.
Mayor Lewellen felt this could wait until budget time.
Commissioner Brandimarte moved to approve a $5,000.00 donation to the Cancer Society
and Ms. Grace; seconded by Commissioner James. The motion carried unanimously.
Emmanuel George, 17 NE 2nd Avenue, advocated for a J.A. Ely Historical Society to honor
black history in Dania Beach and South Broward.
Commissioner Brandimarte noted we may have come up with a place; Commissioner Harris will
be meeting with the City Manager about this.
Vice-Mayor Odman commented she and Mr. George have talked about a historical society and
she is going to make sure we represent all parts of the City's history properly. She hopes he is a
part of whatever it is we come up with.
6. Public Safety Reports
Captain Daniel Marks, BSO Chief of Police, reported on a recent investigation into gas pump
skimmers and area checks for criminal activity. He spoke about BSO taking a group of teens for
a tour of the downtown jail on Thursday, June 27th.
Sean Brown, Battalion Chief, BSO Fire Rescue; commented on the Summer Sizzle event on July
l 7-20 at Coral Springs Fire Academy.

10. Discussion and Possible Action
10.1 Dania Beach 115th Anniversary -Mayor Lewellen
Mayor Lewellen noted she has several people lined up who will donate either money or in-kind.
She felt we need to have a committee whose membership would consist of a person from each
department and the chair of each advisory board or a designee.
Vice-Mayor Odman spoke of a gala and a beach component; she questioned whether it would
make more sense to just do something on the beach.
Mayor Lewellen suggested doing an all-day event, including having an agenda. It could be one
major day event instead of having a gala the night before.
Vice-Mayor Odman liked the idea of having each of the advisory boards contributing and adding
insight. She suggested including the new historical society, and perhaps running the renaming of
the City's nickname contest, with the winning name announced at the party.
The Commission consensus was to form a committee made up of a member from each
department and the chairs of the advisory boards or designees.
Mayor Lewellen spoke of sponsorships and in addition, putting aside an amount not-to-exceed
$20,000.00 to use for this event.
Commissioner James questioned if we have that kind of money for the event and felt $20,000.00
seed money is excessive. The budget year has already been discussed and is expected to be tight.
Vice-Mayor Odman stated this would be a day-long festival; she understands Commissioner
James' concern, but this would benefit the entire City. She suggested the amount be set at
$10,000.00.
Mayor Lewellen explained she never said the event would be completely free; it is a not to
exceed number. She felt we would not use the full amount, and spoke of reserving entertainment
and the possibility of needing the money now; whatever is left over would be returned to the
General Fund. This would be a one-time expense for a full benefit to the entire City.
Commissioner Harris questioned incorporating the celebration with Dania After Dark (DAD)
and making that event bigger. He felt $10-15,000.00 is a reasonable amount and we should
include our contacts with the County for an additional donation. The last time the City
celebrated an anniversary, we incorporated it into the Broward County 100t'year anniversary.
Commissioner Brandimarte agreed with incorporating the celebration into a Dania After Dark
event and suggested shuttling people to the beach.
Mayor Lewellen noted she was okay with the $15,000.00 amount.

J.A. Ely Historical Society
The J.A. Ely Historical Society would be a Historical Society dedicated to historic black
communities in South Broward which would include NW Dania beach(Danie, Liberia,
Hallandale, and Carver Ranches). The goal would be to have this Historical Society on J.A. Ely
Blvd and would serve as a place for one to see the Historic significance of these neighborhoods
as well as offer as a resource center to the community this building is in. There is a few possible
locations this place can be on the J.A. Ely corridor,there is an empty lot across from King Store
that is owned by a bank that the city can acquire,this land is for commercial and residential
usage and can be home to the historical society as well as a key area for small business
development. Many people especially millennials and Generation Z do not know the
contributions that J.A. Ely has provided for Broward County, many people do not even know
who J.A. Ely was. J.A. Ely was the first black principal in Broward County History when he
was the principal at a negro colored school which would then be later named Dillard High
School. Dillard was named after James Dillard who was a white philanthropist centered around
black education. Shortly after J.A. Ely went on to become the Principal of Attucks High School.
Mr. Ely also was the first black person to organize a PTA meeting, was the first black probation
officer in Broward County as well as the first black person to serve jury duty with an all white
jury.
The Historical Society can be anywhere from 3,000 to 5,000 SQ ft with several rooms serving
different purposes. Which would include:
• A room dedicated to J.A. Ely, history as to who he was, his accomplishments in Dillard
and Attucks.
• A room dedicated to Attucks High School honoring its inception from 1936 when it was
a grade school that only went to 1 lth grade to its first graduation class from 1952-1968.
This room can also recreate how the classrooms looked back during Attucks Renaissance
days.
• A historic Liberia room with archive photos of Liberia as well as artifacts of the area.
• A historic Danie room with archive photos and artifacts
• A historic Hallandale with archive photos and artifacts
• A historic Carver Ranches with archive photos and artifacts.
• Each room would host archive pictures showcasing the community, old buildings that
used to be there as well as photos showcasing Pioneers, elders and education(Attucks)
• Additional rooms would also include an art gallery, a room dedicated specifically to teach .
the local community how to code, and S.T.E.A.M.. and an area for the youth.
Many perks from having this history society would include employment.
- a place to give these marginalized areas a chance to get into the coding and tech industry.
Event spaces ex. Juneteenth and art exhibits, film screenings, etc.
Classroom space for summer programs
Will also be a boost to the city's cultural tourism economy due to the increase in demand
for out of towners to get a real home-grown feeling to this city.
The budget from this would come from the city of Dania beach and also possibly getting support
from the city of Hollywood since the city of Hollywood has partnered with Dania on several
events in the past. Ex. Henry Graham and his work on building college gardens/liberty heights,
Tamara James day, as well as the name J.A. Ely Blvd was a joint venture the city of Hollywood
and Dania had together.
Commissioner James also noted she has heard from people who are upset they will not be invited
to the City's 115th Anniversary celebration at Tropical Acres.
City Manager Garcia felt the Commission should invite advisory board members and then open
up a few tables for people to pay if they would like to attend.
Commissioner James referenced a past anniversary event where tickets were purchased versus
"'>invitation only in order to make the process fair.
Mayor Lewellen agreed with Commissioner James.
City Manager Garcia felt it was important we meet with Tropical Acres to get a number from
them for the available seating and coming back to open it up to the public.
Mayor Lewellen said we need to confirm from Tropical Acres and then figure out where we go
from there.
Commissioner James suggested creating a City Commission budget line item for $10,000.00 just
as the CRA did for the 115th Anniversary.
Commissioner James noted she has been working on a STEM Program at the FAU facility, and
they want to give the Commission a boat ride and tour of their facilities on October 10. She
applied for a grant with FAU as co-applicant for a STEM program in our City.
Commissioner Harris commented it would be a wonderful opportunity to show our charity by
charging $10.00 for a ticket to the Tropical Acres event and donating the proceeds to hurricane
relief.
Mayor Lewellen felt the proceeds from the tickets sales should be used for a Dania Beach cause,
specifically for a scholarship or Dania Beach event.
Vice-Mayor Odman felt the Historical Society could benefit from being tied into the anniversary
celebration ticket sales proceeds.
Commissioner James commended City Manager Garcia, Assistant City Manager Sosa-Cruz and
staff for their leadership and dedication during the hurricane preparation.
11.4 Vice-Mayor Odman
Vice-Mayor Odman recognized the City team that came together for hurricane preparations, and
noted there are 20 days left for entering into the Rename the City contest.
11.5 Mayor Lewellen
Mayor Lewellen thanked City staff for their hard work during preparation for the hurricane.

Good afternoon, as you may be aware,Tom is currently out of the office due to a death in his family. He dictated the
following email to me today for distribution to the Commission. Thank you.
ON BEHALF OF TOM ANSBRO:
Consistent with City Commission discussions over the past number of months, I provided Vice Mayor Lauren Odman
legal guidance and assistance in the creation of a Dania Beach Historical Society and Museum non-profit Florida
corporation. Unanimous City Commission support was consistent with the intent to create the corporation and to use
ticket sales as discussed below to provide initial funding for the corporation. I obtained an independent ethical opinion
from outside counsel to confirm that no conflict of interest would arise if the Vice Mayor, as an elected official,were to
serve as an officer of the non-profit corporation to be created. A copy of that opinion addressing that matter and
related matters is attached; also attached is a copy of a confirmation ethical opinion provided yesterday as to the
absence of a conflict of interest.
I enlisted the aid of Tim Ryan's office to help to incorporate the Society as a non-profit corporation under Florida law.
Proceeds from ticket sales for the 115th Birthday Celebration were processed through the City while the corporation was
being created.
The Vice Mayor had also requested Marc La Ferrier to serve as a "placeholder"vice president for the corporation while
she tried to find a person who would agree to serve in that capacity as a full time corporate officer. Again,the opinion
first mentioned above addressed Marc's temporary service. Marc was recently replaced as a corporate officer and Clare
Frost was appointed to service as vice president. The corporation records were amended to confirm that.
The corporation proceeds from the ticket sales are being processed to be paid to the corporation treasurer Linda Wilson
and a bank account is being established for the corporation by her. The Vice Mayor has no ability to access funds
related to the corporation and has not done so.

Let me do my best to answer your questions. Feel free to call me to follow up.
It is not a conflict of interest per se for an elected official and a city employee to serve as officers of a nonprofit
organization. If they will be receiving compensation from the nonprofit, it could complicate matters, especially if the
organizations plans on seeking grant money from the City.
State law allows elected officials to solicit contributions on behalf on nonprofits, provided they or their family members
will not receive a personal benefit from such solicitations. This goes back to the question of whether or not their
positions with the nonprofits are compensated. Under the Broward ethics ordinance, the Vice-Mayor most likely would
have to report the solicitation efforts at last night's Commission meeting unless she is considered an employee of the
nonprofit. In my opinion, an officer of a nonprofit is not an employee,which means the Vice Mayor would have to
report the charitable fundraising activities.
An organization that is seeking 501(c)(3)status can solicit donations and while they are in this transitional phase may
solicit donations and the donations would be tax deductible provided the organization has submitted Form 990. Even if
Form 990 has been not been filed,the organization can still request donations, but the donor would not be entitled to a
tax deduction.

Robert, a Florida non-profit corporation was recently created for a Dania Beach Historical Society with a plan to open a
museum. It is not a 501 (c)(3) but I believe such a filing is being pursued. One of our Commissioners is identified as the
corporation President and one of our Department Directors(Community Development) is listed as the Vice-President.
My questions concern whether such persons may serve as officers and if allowable,the laws applicable to avoid
conflicts,ethical concerns. I do not know if you would know the answer as to donations but can the entity receive them
before qualifying as a 501(c)(3)?The Vice-Mayor announced at last night's Commission meeting that$20.00 tickets are

available to attend a 1151h City Birthday event at a local restaurant in January and that proceeds will go to the entity
(restaurant is proving brunch). Comments?

Challenges in forecasting Flooding
A fundamental problem in forecasting flooding has been the absence of adequate flow
records. In his last article for the American Society of Civil Engineers, Professor Ven Te
Chow of the University of Illinois reminded fellow engineers that in order to adequately
predict a 100 year recurrence interval flow event, one would need 1000 years of
hydrograph records (Chow and Takase, 1977). In most instances, project floods are based
upon inadequate flow data, extrapolated well beyond the range of scientific certainty and
subject to all kinds of flow adjustments, as discussed later.
Common factors affecting accuracy of flood predictions
Factor Description
Antecedent moisture How much rain has already been absorbed by the ground,
season-to-date. The more saturated the ground surface,the
greater the runoff from any given storm. Landscape watering
can also lead to increased levels of antecedent moisture.
Localized cells of intense Very intense bursts of moisture in upland areas can cause
precipitation localized flooding and destructive debris flows which clog
drainage inlets, culverts, etc,which then leads to flooding
Duration of storm events The longer storms stall over any given area, the greater the
flooding
Changes in vegetation Changes in land use(such as grazing)and vegetation will
within the watershed lead to changes in the time-to-concentration of runoff to local
creeks and rivers.
Development of the The more hardened surfaces,such as roofs,walkways,
watershed pavements and lined storm drainage channels,the greater the
peak runoff. A 400%increase is not unusual,commonly
leading to down cutting of unimproved channels
Unnatural constriction of The placement of hardened improvements in channels, such
flow as culverts,rip rap,retaining walls,or;natural impediments to
flow, such as landslides, eroded soil,trees,organic debris and
natural storm-laden debris,invariably cause localized
hydraulic choking of channels,leading to tail water
inundation of previously un-flooded areas
Changes in weather Frequency and probability-based flood flow assessments are
patterns based upon the assumption that weather patterns are
essentially unchanging. Data collected since 1849 would
suggest otherwise,weather patterns are always changing.
Mistakes in flood plain Whatever can go wrong in routing floods via use of planned
management releases from Mood control reservoirs, eventually will.
Failure of flood control Despite the best intentions, infrastructure elements, such as
infrastructure levees, dam spillways and conduits,can fail, most often
during peak usage. Levees are particularly sensitive to
duration of flood flow
Accuracy of topographic The accuracy of topographic information within the
information watershed being studied will exert keen influence on the areas
predicted for inundation
Accuracy of channel Channel hydraulics assessments are dependent upon estimates
roughness estimates of channel roughness, which are highly variable in
unimproved channels, and subject to change, depending on
frequency and depth of flows
Accuracy of input Flour assessments are only as good as the estimates of
hydrology precipitation upon which they are based. An array of
antecedent moisture levels needs to be evaluated in order to
make conservative predictions of floe.
Accuracy of the A wide array of computational models exists,the most
computational commonly employed being HEC-2,developed by the Army
methodology chosen Corps of Engineers. However, flow predictions are built
upon the detail and accuracy of input information, such as the
number of channel cross sections.

Comments by Dania Beach citizens or interested parties that are not part of the regular printed agenda may be made during each
Commission meeting during the period set aside for"Citizen Comments." A thirty(30)minute"Citizen Comments"period shall
be designated on the agenda for citizens and interested persons to speak on matters not scheduled on that day's agenda. Each
speaker shall be limited to 3 minutes for his or her comments. Persons desiring to speak during the citizen comment period shall
inform the City Clerk immediately prior to the beginning of the meeting of their intention to speak. If more than 10 speakers
express a desire to speak,the Commission shall determine on a meeting by meeting basis whether to(a)extend the time allotted
for citizen comments to accommodate all speakers,or(b)whether to limit the number of speakers or amount of time per speaker.
A speaker's time shall not be transferable to another speaker.
