RESOLUTION NO. 2020-017 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA, APPROVING THE SITE PLAN (SP-132-19) SUBMITTED BY LEIGH ROBINSON KERR & ASSOCIATES, INC. AND GREENSPOON MARDER, ON BEHALF OF BEJL 4200 REAL ESTATE, LLC, FOR PROPERTIES GENERALLY LOCATED AT 4200 S.W. 50 COURT IN THE CITY OF DANIA BEACH, FLORIDA, AS LEGALLY DESCRIBED IN EXHIBIT "A," A COPY OF WHICH IS ATTACHED TO THIS RESOLUTION; PROVIDING FOR CONFLICTS; FURTHER, PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the City Code of Ordinances, Chapter 28, entitled, "Land Development Code" ("LDC") of Part 6, entitled, "Development Review Procedures and Requirements," of Article 635, entitled, "Site Plans" of Section 635-20(A), provides that site plan approval is a condition to the issuance of a building permit; and WHEREAS, Leigh Robinson Kerr& Associates, Inc. and Greenspoon Marder, on behalf of BEJL 4200 Real Estate, LLC (the "Applicant") has requested Site Plan (SP-132-19) approval to permit the development of two hundred seventy-five (275) multi-family units generally located at 4200 S.W. 54th Court in the City of Dania Beach, Florida (the "City") as legally described in Exhibit"A;" and WHEREAS, the City Commission conducted a duly noticed public hearing in accordance with Article 610 of the LDC; and WHEREAS, the City Commission finds that the approval of the Site Plan (SP-132-19) is consistent with the City's Land Development Code and Comprehensive Plan; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF DANIA BEACH,FLORIDA: Section 1. That the foregoing "WHEREAS" clauses are ratified and confirmed as being true and correct and they are made a specific part of this Resolution. Section 2. That pursuant to Chapter 28 "Land Development Code," Part 6 "Development Review Procedures and Requirements," Article 635 "Site Plan," the following Site Plan (SP-132-19), attached as Exhibit`B" which is made a part of and incorporated into this Resolution by reference is approved. Section 3. That the approvals granted by this Resolution are subject to the Applicant's compliance with the following conditions: 1. Identify ROW lines and dimensions on the East side of the Project/Property along SW 54th Court(Engineering). 2. Provide in survey acreage and Type of Flood Zone- Base Flood Elevation on Notes (Engineering). 3. Provide a copy of final pre and post development storm-water management and drainage calculations and revised plans. The City specifically needs the following information: 10- year, 25-year, and 100-year 24-hour and 72-hour flood stage elevations. Provide Perimeter Berm and FFE elevations. Provide copies of all applicable permit and plan approvals from SFWMD and Broward County prior to issuance of a building permit (Engineering). 4. Water and Sewer—Utilities- Plan, including any existing water main, force mains, gravity, mains, etc. (Show all material & pipe sizes on the plan). Please be advised that all water- main on the ROW shall be constructed with DIP piping and/or previous approved material by Broward County(Engineering). 5. Use recommended spacing for Type I and Type II Hay bale barriers, and type III silt fences, from chart FDOT state drainage manual (Engineering). 6. Provide drawing file (dwg or dgn) disk of the approved site plan in Florida State Plane Coordinate (NAD 83). This should be addressed as part of the final submittal (Engineering). 7. Provide regulatory agencies' approval documentation (as applicable) as part of the final submittal, Broward County Surface Water License, Broward County Health Department Permit, etc. (Engineering). 8. Contractor shall provide, before issuance of C.O., to the Engineer and City of Dania Beach "a CD with As-Builts drawings of the project giving horizontal and vertical dimensions of connections signed and sealed by a registered surveyor (Engineering). 9. Police and Fire approve the double cul-de-sac design and are requesting knox box key switch and transponders for emergency access. (Fire). 10. Must provide recorded copy of roadway easement, including cul-de-sac improvements, identifying that maintenance of all improvements in the ROW will be the responsibility of the property owner. Recorded copy needed prior to issuance of a building permit. The cul-de-sac and gate improvements must be completed prior to issuance of a Certificate of Occupancy for the project(Planning). 11. The proximity to the airport will be required FAA/BCAD review and approval. Contact William Castillo, Airport Planner with Broward County Aviation Department, located at 2200 SW 45 Street, Suite 101, Dania Beach, FL 33315, (954) 359-6100. 2 RESOLUTION#2020-017 REVISED 2/11/2020 12. Per Resolution No. 2015-071, $1,364.00 per Multifamily Dwelling must be paid for Recreation and Open Space Impact Fee at time of building permit issuance. Therefore, the applicant must pay $375,100 (1,140 X 275)prior to issuance of a building permit. 13. For the purpose of evaluating flood and roadway conditions and mitigation related to the future development project, all topographic information will include LIDAR spot elevations within 150' of the subject property boundaries. 14. Applicant must obtain a statement from the City Engineer saying that the traffic study/statement submitted by the applicant is complete and accepted (Planning). 15. Per Section 280-40 Maximum light spillage at property line cannot exceed 0.5 foot candles. Revise Sheet LTG-1 to show light levels at property line (Planning). Section 4. That such application must be reviewed by Broward County Aviation Department. That pursuant to LDC Section 635-100 "Expiration of Site Plans," approvals shall automatically expire and become null and void unless the Applicant commences with construction of the improvements shown on the Site Plan within eighteen (18) months from the date of this Resolution. Section 6. That the issuance of a development order by a municipality does not in any way create any right on the part of an Applicant to obtain a permit from a state or federal agency, and does not create any liability on the part of the municipality for issuance of the development order if the Applicant fails to obtain requisite approvals or does not fulfill the obligations imposed by a state or federal agency, or undertakes actions that result in a violation of state or federal law. Section 7. That all resolutions or parts of resolutions in conflict with this Resolution are repealed to the extent of such conflict. Section 8.
