HomeMy WebLinkAboutR-2020-040 City Approving Site Plan Modification (SP-003-15-MOD2) and Design Variation (OT-016-20) Submitted by 4 N Federal Dania LLC, Property Located on NE Corner of Fed Hwy & Dania Bch Blvd. RESOLUTION NO. 2020-040 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA, APPROVING THE SITE PLAN MODIFICATION(SP-003- 15-MOD2) AND DESIGN VARIATION (OT-016-20), SUBMITTED BY 4 N. FEDERAL DANIA, LLC, FOR PROPERTY LOCATED ON THE NORTHEAST CORNER OF FEDERAL HIGHWAY AND DANIA BEACH BOULEVARD IN THE CITY OF DANIA BEACH, FLORIDA, AS LEGALLY DESCRIBED IN EXHIBIT "A," A COPY OF WHICH IS ATTACHED TO THIS RESOLUTION; PROVIDING FOR CONDITIONS; PROVIDING FOR CONFLICTS; FURTHER, PROVIDING FOR AN EFFECTIVE DATE. WHEREAS,the City Code of Ordinances,Chapter 28,entitled"Land Development Code" (the"LDC"),of Part 6,entitled"Development Review Procedures and Requirements,"Article 635, entitled "Site Plans," states that site plan approval is required as a condition to the issuance of a building permit; and WHEREAS, 4 N. Federal Dania, LLC ("Applicant") is requesting Site Plan Modification approval to allow the construction of an additional forty (40) dwelling units for a total of three- hundred forty (340) dwelling units and 13,600 square feet of commercial to be located on the northeast corner of Federal Highway and Dania Beach Boulevard in the City of Dania Beach, Florida, as legally described in Exhibit"A;" and WHEREAS,Chapter 28,Part 3,entitled,"Special Zoning Districts,"of Subpart 1,entitled, "Community Redevelopment Area("CRA")Form-Based Zoning District"of Article 301,entitled, "Legal and Administrative Provisions" of Section 301-50, entitled, "Variations In Design; Procedures For Review Of Design Variations,"provides that the City Commission is authorized to approve design variations within certain districts,if they are consistent with the intent of that section in lieu of the variance process provided for in Article 625, entitled, "Variances," of the LDC; and WHEREAS, the Applicant has requested a Design Variation (OT-016-20) to permit a setback and building recess between eleven(11)to twenty-seven(27)feet along US1,Dania Beach Boulevard,and NW 1 St Court,where Section 303-40(L)requires setback and building recess between zero (0)to five (5) feet; and WHEREAS,the City Commission conducted a duly noticed public hearing in accordance with Article 610 of the LDC; and WHEREAS, the City Commission finds that the approval of the proposed Site Plan Modification (SP-003-15-MOD2) and associated Design Waivers are consistent with the requirements of the Code and will protect the public health,safety,and welfare of the residents of the City, and furthers the purpose, goals, objectives and policies of the Comprehensive Plan; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA: Section 1. That the foregoing"WHEREAS"clauses are ratified and confirmed as being true and correct,and they are made a part of and incorporated into this Resolution by this reference. Section 2. That pursuant to Chapter 28"Land Development Code,"Part 6"Development Review Procedures and Requirements," Article 635 "Site Plan," the following Site Plan Modification(SP-003-15-MOD2),attached as Exhibit`B"which is made apart of and incorporated into this Resolution by reference, is approved. Section 3. Pursuant to Part 3,entitled,"Special Zoning Districts,"of Subpart 1,entitled, "Community Redevelopment Area("CRA")Form-Based Zoning District"of Article 301,entitled, "Legal and Administrative Provisions" of Section 301-50, entitled, "Variations In Design; Procedures For Review Of Design Variations"the application for Design Variation(OT-016-20)is approved consistent with the attached Site Plan provided in Exhibit`B." Section 4. That the approvals granted by this Resolution are subject to the Applicant's compliance with the following conditions: 1. A Traffic Memorandum was provided,please verify criteria of 9th and 1 Oth Editions per Sec. 605-30(k).A traffic impact study is required to supplement a development application that,if approved, would generate in excess of fifty (50) gross peak hour trips, provide a Traffic Statement/Report based on applicable trip generation rate(s) in the ITE -Institute of Transportation Engineers' Trip Generation manual, most recent edition -LOTH editions. Traffic Impact Study/ Traffic Memorandum must be approved by the City Engineer from Public Services Department(Engineering). 2. In compliance with Article 805. CONCURRENCY OF DETERMINATIONS of the City Code of Ordinances, applicants shall provide projected water demand, sewage and solid waste generation amounts in tabular format -utilities -plan. Please provide calculations to support tabular projected generation amounts (Engineering). 3. Provide regulatory agencies'approval documentation and Permits/Licenses(as applicable)as part of the final submittal,prior to issuance of the Building Permit(Broward County Surface Water License, Broward County Health Department Permit, Florida Department of 2 RESOLUTION#2020-040 Environmental Protection, FDOT, BC Environmental etc.). Also, include Utility/Right of Way Permits from City, Broward County and State Roads as applicable (Engineering). 4. Verify,if resurfacing/refurbishing and work of existing ROW along NW 1 st Avenue,NE 1 st Court, Dania Beach Boulevard, and North Federal Highway are required by City, Broward County and/or FDOT as applicable.Utility/ROW Connection Permits are required on North federal Hwy., Dania Beach Boulevard and NE 1 st Court and NE 1 st Avenue. e.g., Parallel Parking,drainage improvements,sidewalk,dedications,etc.Including regrading of the ROW to improve any existing flooding conditions due to the proposed new development (Engineering). 5. A staging plan must be provided and approved showing any road enclosures, location of equipment and materials,employee parking and mitigation of construction related impacts to adjacent ROWS properties. In addition, provide Maintenance of Traffic (MOT) Plan by a licensed General Contractor/Professional Engineer in the State of Florida, if applicable (Engineering). 6. As-builts for all on-site and off-site improvements must be submitted and approved prior to a Certificate of Occupancy (CO) (Engineering). 7. Proof of Water Supply&Fire Flow Demand as follows:Please provide proof of water supply with a Fire Hydrant Flow Test. 8. SCHOOLS: Obtain a SCAD report from Broward County School Board regarding school impact fees (Planning). 9. IMPACT FEES: Impact fees that will be required for the project are attached to these comments for your reference (Planning). 10. SIGNS: Provide copy of all signs for compliance review, consistent with Article 635 (Planning). 11. The proximity to the airport will be required FAA/BCAD review and approval. PARKING: Tandem parking is only permitted in association with valet parking.Identify the 27 proposed tandem parking spaces a valet and provide proof of compliance with all of the valet parking regulations identified in Section 265-120 (Planning). 13. PARKING:Per Section 265-110(I)(2)parking spaces shall be delineated with a single strip, not double strip. Revise accordingly(Planning). 14. RAC TRAFFIC IMPACT MITIGATION: Provide an analysis, signed and sealed by a certified engineer,identifying the amount of CRA mitigation for traffic impact due based on 3 RESOLUTION#2020-040 resolution No. 2014-049 which established a rate of$21.26 per p.m. peak hour trip. The Traffic Memorandum provided by Traf Tech dated 12-9-19 identifies a revised total PM Hour trips as 325. Therefore, applicant must pay$6,909.50 ($21.26 X 325 =6909.50) into the RAC Traffic Impact Mitigation prior to issuance of a building permit. 15. Per Resolution No.2015-071,$1,825.00 per Single Family/Townhouse dwelling,$1,364.00 per Multifamily Dwelling, $1,140.00 per Mobile Home must be paid for Recreation and Open Space Impact Fee at time of building permit issuance. Therefore, the applicant must pay$463,760.00(340 X$1364=463,760)prior to issuance of a building permit(Planning). 16. For the purpose of evaluating flood and roadway conditions and mitigation related to the future development project,all topographic information will include LIDAR spot elevations within 150' of the subject property boundaries (Planning). 17. For any building 5-stories or greater, provide a shadow study identifying how adjacent properties will be affected (Planning). 18. Per 0-2017-022, for properties over an acre in size, the applicant must obtain and post property signs in accordance with the NEW City requirements. Please see the end of this document for guidelines (Planning). 19. Per 0-2017-027 & 0-2018-019, commercial properties under construction are required to provide security to fencing with screening showing project rendering covering at least 75% of the length of the fence along an arterial or state right-of-way&25% for local roads and must include name and intended use of the project, project rendering, project website address,and owner or agent,the telephone number for the owner or agent,and the name and an emergency contact telephone number of the general contractor.Provide screen detail with next submittal (Planning). 20. Per Article 280, provide photometric plan showing light levels at property lines to ensure compliance (Planning). 21. Identify dimensions between west property line and transformer room in NWC (Planning). 22. The proposed density and height is based, in part, on Sustainable Building incentives. Therefore,identify how the requirements of Section 305-50 are being met prior to issuance of a building permit. 23. Must provide unity of title unifying all lots,prior to issuance of a building permit(Planning, per R-2017-063). 24. Sheet A-001 is mislabeled. Sheet should not be identified as "Site Plan", rather"Amenity Deck" or"5th Level". Revise accordingly (Planning). 4 RESOLUTION#2020-040 Section 6. That pursuant to LDC Section 635-100 "Expiration of Site Plans,"the Site Plan(SP-003-15-MOD2)shall automatically expire and become null and void unless the Applicant files a complete building permit application with construction drawings for the improvements shown on the Site Plan, within eighteen(18)months from the date of this Resolution. Section 7. That the issuance of a development permit by a municipality does not in any way create any right on the part of an Applicant to obtain a permit from a state or federal agency, and does not create any liability on the part of the municipality for issuance of the permit if the Applicant fails to obtain requisite approvals or does not fulfill the obligations imposed by a state or federal agency, or undertakes actions that result in a violation of state or federal law. Section 8. That all resolutions or parts of resolutions in conflict with this Resolution are repealed to the extent of such conflict. Section 9.
