RESOLUTION NO. 2020-064 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA, CONDEMNING ALL ACTS OF POLICE BRUTALITY, RACIAL PROFILING AND UNWARRANTED AND EXCESSIVE FORCE; PROVIDING FOR CONFLICTS; FURTHER, PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the City of Dania Beach ("City") has an estimated population of twenty percent (20%) black residents and an additional estimated ten percent (10%) of other minorities living in the City; and WHEREAS, the City stands in support of peaceful protestors and individuals using their voices to bring awareness and change to our local, regional and national community; and WHEREAS, the City condemns all acts of police brutality, racial profiling, and the use of unwarranted and excessive force throughout the country; and WHEREAS, police brutality and the use of unauthorized and excessive force are among the most serious ongoing human rights and civil liberties violations in the United States and have led to community destabilization, a decrease in public safety, and an erosion of public confidence in the equal application of the rule of law to all people; and WHEREAS, the system of uneven and disparate policing in areas of America, and its targeting and use of deadly force against people of color, particularly black people, stems from the long legacy of slavery, lynching, Jim Crow laws, and the war on drugs in the United States and has been perpetuated by the use of several violent and harmful law enforcement practices, such as unwarranted restraint of detained persons; and WHEREAS, police use of force is reportedly among the leading causes of death of young men of color; and WHEREAS, people with disabilities and other historically marginalized communities, including LGBTQ+ individuals, immigrants, and those experiencing homelessness are perceived by the public to be frequently more likely to be criminalized and become targets of police violence; and WHEREAS, the unequal application and enforcement of law has robbed communities of precious lives, inflicted intergenerational harm and trauma to affected families and is significantly contributing to divisiveness and racial discord in the nation; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA: Section 1. That the foregoing "Whereas" clauses are ratified and confirmed to be true and correct and they are made a part of and are incorporated into this Resolution by reference. Section 2. That the City condemns all acts of brutality, racial profiling and the use of unauthorized excessive force by law enforcement officers and others. The City supports and urges all law enforcement agencies throughout the country to redouble their efforts to train and educate all law enforcement personnel on the proper use of force, provide implicit bias training, conduct stringent oversight and independent investigations into allegations of instances of police wrongdoing and to hold law enforcement officers strictly accountable when all facts have been collected, examined and weighed, if it is determined that wrongdoing has been established. The City urges all law enforcement agencies to thoroughly investigate all claims of police misconduct to ensure meaningful and enduring community trust, oversight, transparency and accountability to the public are restored and preserved. Section 3. That the City Clerk is directed to distribute copies of this Resolution to President Donald Trump, Governor Ron DeSantis, Senator Marco Rubio, Senator Rick Scott, Congresswoman Debbie Wasserman-Shultz, Congressman Ted Deutch and the Broward League of Cities for distribution to all cities in Broward County. Section 4. That all resolutions or parts of resolutions in conflict with this Resolution are repealed to the extent of such conflict. Section 5. That this Resolution shall be in force and take effect immediately upon its passage and adoption. PASSED and ADOPTED on June 23, 2020.
