Federal Highway, in the City of Dania Beach, FL RESOLUTION NO. 2020-085 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA, APPROVING THE PLAT APPLICATION (PL-026-20) SUBMITTED BY PULICE LAND SURVEYORS,ON BEHALF OF AMOPT,LLC FOR PROPERTY LOCATED AT 922 S.FEDERAL HIGHWAY,IN THE CITY OF DANIA BEACH, FLORIDA, THE LEGAL DESCRIPTION IS CONTAINED IN EXHIBIT "A", A COPY OF WHICH IS ATTACHED TO THIS RESOLUTION; PROVIDING FOR CONFLICTS; AND FURTHER, PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, pursuant to Chapter 28 "Land Development Code" (the "LDC"), Part 6 "Development Review Procedures and Requirements," Article 640 "Plats," of the City of Dania Beach, (the "City") Code of Ordinances ("City Code"), Pulice Land Surveyors, on behalf of AMOPT,LLC (the"Applicant")has applied to the City for approval of a Plat(PL-026-20)attached as Exhibit"B," for the property bearing the legal description contained in Exhibit"A;"and WHEREAS, the AMOPT, LLC Plat(PL-026-20), will include a portion of the previously platted Taco Bell Plat which currently has a restriction of 3,000 square feet of commercial use and was recorded in Plat Book 166 Page 32; and WHEREAS,the incorporation of the Taco Bell Plat into the newly created AMOPT,LLC plat will create a new plat, which will be restricted to 16,000 square feet of specialty school: and WHEREAS, on March 26, 2020, and May 28, 2020, the City's Development Review Committee(the"DRC"),which includes representatives from the Broward Sheriff s Office,Broward Fire Department, Public Services Department, the City's landscape consultant and the Planning Division staff,reviewed the AMOPT,LLC plat for compliance with all applicable regulations;and WHEREAS, staff recommends approval of the Plat (PL-026-20); and WHEREAS,the City Commission conducted a duly noticed public hearing on July 28,2020 in accordance with Article 610 of the LDC; and WHEREAS,the City Commission finds that the Plat(PL-026-20)request is consistent with the LDC and Comprehensive Plan; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA: Section 1. That the foregoing"WHEREAS"clauses are ratified and confirmed as being true and correct and they are made a specific part of this Resolution. Section 2. That this certain application for the "AMOPT, LLC PLAT" (PL-026-20), a copy of which is attached as Exhibit"B," is approved with the no outstanding conditions. Section 3. That the issuance of a development permit by a municipality does not in any way create any right on the part of an applicant to obtain a permit from a state or federal agency,and does not create any liability on the part of the municipality for issuance of the permit if the applicant fails to obtain requisite approvals or does not fulfill the obligations imposed by a state or federal agency, or undertakes actions that result in a violation of state or federal law. Section 4. That all resolutions or parts of resolutions in conflict with this Resolution are repealed to the extent of such conflict. Section 5. That this Resolution shall be in force and take effect immediately upon its passage and adoption. PASSED AND ADOPTED on July 28, 2020.
