A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF DANIA
BEACH, FLORIDA, AUTHORIZING THE RENEWAL OF THE
COMPREHENSIVE PROPERTY & CASUALTY INSURANCE PROGRAM
FOR THE CITY THROUGH RISK MANAGEMENT ASSOCIATES, INC.,
D/B/A PUBLIC RISK INSURANCE ADVISORS, A WHOLLY OWNED
SUBSIDIARY OF BROWN & BROWN, INC., ("PRIA"), WITHOUT
COMPETITIVE BIDDING AND WITHOUT ADVERTISEMENT FOR BIDS,
WHICH INSURANCE PACKAGE SHALL INCLUDE COVERAGE FOR
PROPERTY, CRIME, GENERAL LIABILITY, (INCLUDING EMPLOYEE
BENEFITS LIABILITY AND DEADLY WEAPON), AUTOMOBILE AND
PHYSICAL DAMAGE LIABILITY, PUBLIC OFFICIALS LIABILITY,
(INCLUDING EMPLOYMENT PRACTICES AND CYBER/PRIVACY
LIABILITY), WORKERS' COMPENSATION, POLLUTION, MARINA AND
DOCKS PROPERTY INSURANCE, STORAGE TANK, FP&L GENERAL
LIABILITY, NATIONAL FLOOD INSURANCE PROGRAM ("NFIP"),
PUBLIC SERVICES BOAT (HULL) INSURANCE AND ANY NEEDED
SPECIAL EVENTS INSURANCE (TO BE DETERMINED), FOR A
COMBINED ANNUAL PREMIUM AMOUNT OF ONE MILLION FORTY-
ONE THOUSAND, SEVEN HUNDRED TEN DOLLARS, ($1,041,710.00) FOR
COVERAGE BEGINNING OCTOBER 1, 2020 THROUGH SEPTEMBER 30,
2021; PROVIDING FOR CONFLICTS; FURTHER, PROVIDING FOR AN
EFFECTIVE DATE.
WHEREAS, the City of Dania Beach (the "City") currently obtains its Comprehensive
Property & Casualty coverage through Risk Management Associates, Inc., d/b/a Public Risk
Insurance Advisors, a wholly owned subsidiary of Brown& Brown, Inc. ("PRIA"); and
WHEREAS, upon City Commission approval on September 24, 2020, PRIA will renew
the City's existing Package and Workers' Compensation insurance for Preferred Governmental
Insurance Trust and other Companies, with a one (1) year policy, and a two (2) year renewal
option, beginning October 1, 2020 and ending September 30, 2021; and
WHEREAS, the preferred governmental comprehensive policy offered by PRIA is
advantageous to the City as it relates to the amount of coverage, the rate of insurance, and to
ensure the budget stability for the City; and
WHEREAS, PRIA, continues to be responsive and provide guidance to the City relating
to loss control, claims handling, risk management and liability concerns on major contractual
agreements, special events programming, construction projects, appropriate vendor insurance
requirements, and bid specifications; and
WHEREAS, PRIA is able to offer insurance coverage enhancements in the Cyber
liability policy, increase the City's insurance coverage for general Property Business Income
Insurance from five hundred thousand dollars ($500,000.00) to one million dollars,
($1,000,000.00), and the City is able to add a five-hundred thousand ($500,000.00) business
income coverage to the docks property policy; and
WHEREAS, the City Commission waives competitive bidding and further authorizes
renewals with PRIA, and all associated insurers for Fiscal Year 2020—2021; and
WHEREAS, the City Commission further authorizes the City Manager to make
adjustments to the premiums as necessary due to required changes in coverage resulting from
additions or deletions of equipment, results of the annual Workers' Compensation audit, or other
insurance requirements necessary to protect the City and its assets; and
WHEREAS, the City Commission waives competitive bidding requirements and
advertising requirements, as the advantageous flat rate proposed by PRIA must be accepted
before October 1, 2020, to ensure that there is no lapse in insurance, and the City has determined
that the flat rate provided is economically viable and competitively priced (and below the
insurance standard for premium rate increases of 10%); and
WHEREAS, upon City Commission approval on September 24, 2020, the City will
obtain insurance coverages as described in this Resolution from PRIA, for Comprehensive
Property & Casualty coverage through Risk Management Associates, Inc., d/b/a Public Risk
Insurance Advisors, a wholly owned subsidiary of Brown & Brown, Inc., ("PRIA") which
approval of coverage will also authorize premium adjustments to be made by the City Manager,
as may be necessary to properly protect the City and its assets;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE
CITY OF DANIA BEACH, FLORIDA:
Section 1. That the above "WHEREAS" clauses are ratified and confirmed, and they
are made a part of and incorporated into this Resolution by this reference.
Section 2. That the City Commission approves the renewal of the City's
Comprehensive Property & Casualty coverage through Risk Management Associates, Inc., d/b/a
Public Risk Insurance Advisors, a wholly owned subsidiary of Brown & Brown, Inc., ("PRIA"),
which coverage includes property, crime, general liability, (including employee benefits and
deadly weapon liability), automobile and physical damage liability, public officials liability,

(including employment practices and cyber/privacy liability), workers' compensation, pollution,
marina and dock property insurance, storage tank, FP&L general liability, National Flood
Insurance Program (NFIP), Public Services boat (hull) insurance and any needed special events
insurance, (to be determined), for the 2020/2021 fiscal year for a combined annual premium
amount of one million forty-one thousand, seven hundred ten dollars, ($1,041,710.00) for
coverage beginning October 1, 2020 through September 30, 2021.
Section 3. That the cost of the Comprehensive Property & Casualty Insurance
coverage, which anticipates an annual adjustment needed for coverage due to changes in City's
risk exposures such as audited payrolls, vehicles, equipment, and real property inventory, is
planned, appropriated and has been made available through appropriate allocations to various
City Funds in the proposed Fiscal Year 2020-2021 budget.
Section 4. That the cost for coverage shall exceed the $25,000 annual authorization
provided under the Charter to the City Manager, and the City Commission waive the
competitive procurement requirements relating to the renewal of its Comprehensive Property &
Casualty coverage through PRIA.
Section 5. That all resolutions or parts of resolutions in conflict with this Resolution
are repealed to the extent of such conflict.
Section 6. That this Resolution shall be in force and take effect immediately upon its
passage and adoption.
