Contract Award to Construct Two Additional Beach Lifeguard Towers (Vendor Selected under RFP 21-004)RESOLUTION NO.2022-011 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA, RELATING TO THE AWARD OF A CONTRACT FOR TWO (2) BEACH LIFEGUARD TOWERS TO BAUSCH ENTERPRISES, INC.; WAVING COMPETITIVE BIDDING TO AWARD THE CONTRACT TO THE SUCCESSFUL BIDDER UNDER THE CITY'S REQUEST FOR PROPOSAL (RFP) NO. 21-004 AND TO CONSTRUCT TWO (2) ADDITIONAL LIFEGUARD TOWERS THAT WERE NOT CONSIDERED IN THE ORIGINAL RFP; AUTHORIZING THE CITY TO EXCEED THE ANNUAL VENDOR THRESHOLD TOTAL AMOUNT OF TWENTY-FIVE THOUSAND DOLLARS ($25,000.00) FOR THE TOTAL COST OF ONE HUNDRED THIRTY-NINE THOUSAND SEVEN HUNDRED DOLLARS ($139,700.00); AND AUTHORIZING THE PROPER CITY OFFICIALS TO EXECUTE AN AGREEMENT; PROVIDING FOR CONFLICTS; FURTHER, PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the Dania Beach Code of Ordinances, Chapter 2, Article 1, Section 2-10, "Monetary thresholds for certain purchases and payment disbursement authorizations", Subsection (a), sets the monetary threshold at $25,000.00 for a vendor each fiscal year; and WHEREAS, in fiscal year 2021 via RFP No. 21-004, the Parks and Recreation Department purchased two (2) lifeguard towers from Bausch Enterprises, Inc; and WHEREAS, the Department requests to waive competitive bidding in order to use the successful vendor selected under RFP No. 21-004, to replace two (2) additional beach lifeguard towers, for a total cost of One Hundred Thirty -Nine Thousand Seven Hundred Dollars ($139,700.00) to maintain aesthetics among all towers; and WHEREAS, the Department requests to waive the annual vendor threshold of Twenty - Five Thousand Dollars ($25,000.00); NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA: Section 1. That the above "Whereas" clauses are ratified and confirmed as being true and correct, and they are made a part of and incorporated into this Resolution by this reference. Section 2. That the Commission approves to waive the competitive bidding process to include two (2) additional towers to Bausch Enterprises, Inc., for an annual amount not to exceed One Hundred Thirty -Nine Thousand Seven Hundred Dollars ($139,700.00), and further authorizes the proper City officials to execute an Agreement for these services. Section 3. That the amount of One Hundred Thirty -Nine Thousand Seven Hundred Dollars ($139,700.00) was planned and funded for these services in the Parks and Recreation Department FY 2022 Beach Division budget; however, due to inflation, the quote is over budget and requires a budget transfer of ($21,700.00) from Beach, Operating Supplies Miscellaneous into the Beach, Buildings and therefore, the Commission authorizes and approves these services for this bid award. Section 4. That the City Manager and City Attorney are authorized to make minor revisions to the Agreement related to the work as are deemed necessary and proper for the best interests of the City. Section 5: That the City Commission authorizes the annual vendor threshold of Twenty -Five Thousand Dollars ($25,000.00) to be exceeded each fiscal year the contract is in place subject to and made within the Parks and Recreation Department's approved level of annual budget appropriations from Recreation, Beach, Buildings Account No. 001-72-02-572- 62-10. Section 6. That all resolutions or parts of resolutions in conflict with this Resolution are repealed to the extent of such conflict. Section 7. That this Resolution shall be in force and take effect immediately upon its passage and adoption. PASSED AND ADOPTED on January 25, 2022.
