A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF DANIA
BEACH, FLORIDA, AUTHORIZING THE PROPER CITY OFFICIALS TO
EXECUTE A FIRST AMENDMENT TO THE AGREEMENT FOR
PROFESSIONAL LANDSCAPING SERVICES EXISTING BETWEEN THE
CITY OF DANIA BEACH AND SAM'S LANDSCAPE MAINTENANCE,
INC., RELATING TO ADDITIONAL WORK TO BE PROVIDED IN THE
SCOPE TO INCLUDE SMALL PROJECTS AND CONTINGENCY WORK ON
AN AS NEEDED BASIS FOR AN ANNUAL AMOUNT NOT TO EXCEED
THIRTY FIVE THOUSAND DOLLARS ($35,000.00); PROVIDING FOR
CONFLICTS; FURTHER, PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, Sam's Landscape Maintenance, Inc. was awarded the competitively bid
Citywide landscape services in November 2021 under Request for Proposal ("REP") No. 21-
017; and
WHEREAS, the scope in the Agreement did not specify a work category for small
projects and contingency work that is required from time to time during the year; and
WHEREAS, an amendment to the Agreement with Sam's Landscape Maintenance,
Inc. is required to address those services as part of the Agreement's scope;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF
THE CITY OF DANIA BEACH, FLORIDA:
Section 1. That the proper City officials are authorized to execute a first Amendment
to the Agreement for Professional Landscaping Services dated November 10, 2021, which
currently exists between the City and Sam's Landscape Maintenance, Inc., in accordance with
the need to include additional work in the scope that will involve unforeseen landscape work.
Section 2. That the City Manager and City Attorney are authorized to make minor
revisions to the Amendment to the Agreement which are deemed necessary and proper and in the
best interests of the City.
Section 3. That the cost of the Agreement for Fiscal Year 2021-2022 is already
funded in the fiscal year Streets Maintenance/Repair and Maintenance Account No. 001-39-06-
541-46-50 budget in an amount of Thirty Five Thousand Dollars ($35,000.00).
Section 4. That all resolutions or parts of resolutions in conflict with this Resolution
are repealed to the extent of such conflict.
Section 5.

That this Resolution shall be in force and take effect immediately upon its
PASSED AND ADOPTED on February 8, 2022.
