Stirling Road (TO BE CONTINUED).
3. LU-013-22: The applicant, the City of Dania Beach, request an amendment to the

1. RZ067-21: The applicant, property owner Iohn Schaaf, requests a rezoning from the
Single -Family Estate Residential District (E-1) to the Multiple -Family (10 dvlac)
Residenrial District (RM) for the property located at 4900 SW 3 1 Avenue.
The Applicant and Staff' who war¢ to sp¢a/r on this agenda Item were sworn in by Assistant City
Attorney Ev¢ Boutsis and any other speakers would b¢ sworn in ns they cam¢ along.
Senior Planner Anne -Christine Carrie gave a PowerPoint presentation explaining the variance request to
rezone the property from E-1 to the RM zoning district. She said that the subject property was a 12-acre
parcel developed for asingle-family home and she displayed a map showing the location of the property.
Ms. Carrie explained the surrounding neighborhood uses. The requested rezone would allow £or the
development o£ seventy-six townhomes (sixty by -right and sixteen assigned Flex Units. It was
previously stated that the corrected Staff Report was on the dais and the board members were to peruse
that one. Ms. Carrie said that although the RM zoning district was not consistent with the L-5 FLUM, the
flex unit assignment allowed the amount of density perm ittad by the RM zoning district (]O du/ac). The
associated site plan and plat would be heard separately by the City Commission and she showed what the
site plan should look like. Senior Planner Came want over the rezone criteria and told the board
members that they had to make a recommendation to the City Commission tonight. The applicant
submitted a justification statement demonstrating consistency with the rezone criteria and also held a
virtual outreach meeting on December 1, 2021 with property owners who were within 1,000 feet of the
subject property. Staff was recommending that the Board recommend approval of the Rezoning
Ordinance to the City Commission. It required two City Commission readings. She informed that the
applicant was present.
Chair Robertson asked i£ there were public meetings and did anything come from that. The Assistant
Director Community Development Corinne Lajoie said that Public Outreach did occur and Mr. Male
could speak regarding that. Mr. Male said that his consultants were also here and they were sworn in by
the Assistant City Attorney. Attorney Dennis Mele introduced himself and answered who was in
attendance at the Public Outreach Meeting on December fast He gave the Board a PowerPoint
presentation and from the Land Use Map slide, he explained units per acre For the surrounding properties.
Ha said that the subject property would come out to ba 6.333 units per acre (12-acre site with 76 units).
The RM zoning allowed ton units but they would have less. He reminded that the only thing voted upon
tonight was the rezoning and not the site plan. He showed a slide of the site plan so that everyone would
be aware of what they were doing. He said that at the Outreach Meeting, his Civil Engineer was asked
about drainage and the Civil Engineer said he designed it for the 100-year storm. At the end of the
PowerPoint presentation, Mr. Male answered the Chair that at the Outreach Meeting people had concerns
which would. be talked about tonight. He further answered the Chair that the l2 acres were for both the
land and the water. Mr. Mele also showed pictures of a similar townhome development they were
constructing in Naples so anyone attending tonight saw comparable elevations, layouts, etc. Board
Member Hankerson said that he would like to ask his questions after hearing fi'om the public. The Chau
opened up public comment.
Carlos Gonzalez was sworn in and said he lived in Coco Plum and was here for himself and others in the
Coco Palm Homeowners Association. He wanted to acknowledge the applicant for letting them know
their intent with the development. Mr. Gonzalez was not against the development but was hero to voice
concerns/questions. 1. The site plan did concern them because of building separation Even though
tonight had nothing to do with the site plan, they were objecting to the buildings on the north side. They
would like the designer/developer to consider a different solution maybe something similar to what they
offered the east side of the development He did not want the developments to be looking into each
other's windows. 2. Another concern was SW 31" Street. This was not the safest road and now there
would be another component to that street. What traffic calming or solutions would be offered to prevent
a dangerous situation due to even more trips, etc. 3. Even though drainage was addressed, he spoke
about the backyards. There was going to ba a ditch that could turn into a canal during bad storms. 4.
There was concern for wildlife and noted that the wetland has been there for a vary long time. They
enjoy seeing the migratory species. He requested the Board consider this when voting on this application.
Martha Moore lives in the townhomes to the west (ICey North) of the proposed development. She echoed
the concerns about vehicle safety on 31•` Avenue. This used to be a vary quiet road but not any more
since GPS and people figured out how to get to Stirling Road. She said lots of people walk and bicycle
on this road. She witnessed as 12 year old gat hit on this road and she did not want to see anyone die
there. She also echoed the wildlife concern. She just wanted to know how the City planned to keep the
citizens safe.
Conrad Taytor lived in Oak Ridge which was right in front of Key North. His concern mainly was the
traffic on 31•` Avenue. His development got the notice £or the December 1" meeting later than everyone
else and he explained why. He gave details about the drainage and that there was supposed to be a [hree-
foot pole that went to the Dania Bach Cut -Off Canal. He would like the City to look into the drainage
and the traffic plan. There was no way to widen the road there. He was okay with a new development

coming into the area but with townhomes they would be looking into each other's windows. He wanted
the City to consider what was going to be built in this area and how the traffic would be affected before
anything was to be built The speeders and the drivers have gotten worse. His development seemed to 6e
forgotten but he was requesting answers and timely notifications.
Attorney Dennis Mele responded on beha7£o£the applicant and said that in no particular order, he would
answer regarding the concerns raised. He said that in the packet was the notice list and they used the
same notice list as the City used For tonight's meeting. Everyone was properly noticed. For concern o£
traffic on 3 L°0 Avenue, they did do a traffic analysis. That traffic analysis would be reviewed by the City
Engineering people and when the site plan went to the City Commission, all o£ the traffic issues would be
addressed. If something was needed to slow down speeders, they would participate in doing that during
the site plan approval process. They did a wildlife survey and there were no threatened or endangered
species £or either plants or animals on this property. Regarding the drainage, this should be their least
concern of all the issues. The County, the Environmental Protection Department, South Florida Water
Management District, and the City Engineer would all be reviewing the plans. The water for the
development came from the CounTy and we did not study the drainage for this property in Hollywood.
Pedro Caraballo lives in Coco Plum and said he was the president of the board in his communiTy. He
questioned i£ they needed to add more people to this area and to change the zoning. There was already
more traffic and speeders. There was also flooding in the streets when it rains. The City did not keep the
trees on the sides. There were about six or seven developments less than a mile from Coco Plum and
more density was not needed. Attorney Dennis Mele responded that the wildlife issue was the same
regaffiless of how many homes ware constructed on the property. The same thing applied for drainage.
You have to provide drainage for the whole property regardless o£ how many homes were built. They
were not asking for ten units per acre but rather 6.3 units. In terms of traffic, you could have congestion
or speeding but you could not have both. I£ there was congestion, there could 6e no speeders. Their
study showed that the road had plenty of capacity but people were speeding. They would be happy to
participate in any effort to help stop the speeders. He understood that 3180 Avenue was a City street.
Carlos Gonzalez asked to speak again. Ha thought this land was zoned for 5 units per acre. Assistant
Director Community Development Corinne Laj oie said that it was 5 ssnits per acre based on the future
land use plan. Mr. Gonzalez said that Attorney Dennis Mele was stating that he was under the threshold
based on neighboring developments but he was actually going above the density that was meant to be for
this property. Sixty units was the vested right £or that property and they were asking £or seventy-six
units. As a result, they would be cramped and made to suffer because the density has gone up sixteen
units. He just wanted to make that clear. Attorney Dennis Mele said that they would produce a line of
sight diagram before the site plan would go to the City Commission. This would show that you would
not be able to look into the window o£ one townhouse and see into one in the next development. That
was not going to happen. Assistant Duector Cotntztunity Development Corinne Lajoie answered the
Chair that tonight the Board was only making a recommendation to the City Commission regarding the
rezoning.
As there were no further public comrnents/questions, the Board was asked if they had any other concerns.
Detrick HaNcerson asked Carlos Gonzalez that with his concern for wildlife, did he have a specific
species in mind because what was described was typical £or development in South Florida. He himself
was a former neighborhood association president so he has empathy for those people who were
representing the people in their communiTy. Ha apologized to Conrad Taylor about notifwation being two
weeks late in his community. Trying to ftx this problem with the mail still has not bean accomplished.
Mr. Hankerson spoke about the use o£ some traffic calming devices. Conrad Taylor said that theta were
protected species in or by the lake like alligator gar (Atractosteus spatula) and others that include but not
limited to eagles, vultures, migratory birds, tarpon, and tad tail fox. He said 31•' Avenue was crowded
during the day and the speeders came in the evening. There ware no other questions/comments from
either the Board or the Public. The public hearing closed.

Property owner, Lina Maria Marquez, Intends to demolish her existing home located on a large
single-family residential lot measuring 15,924 square feet In area. She would Ilke to split the
existing property Into two equally sized single-family lots each resulting in 7,962 square feet in
area, which is mor than the minimum required lot size of 6,000 square fleet. However, the width
of the two Iris will only come out to fifty-one Feet, nine inches (51.75 feet) which does not meet
the minimum lot width of sixty (60') feet as required in the Cit�/s LDC Section 205-10(A) for the
RS-60D0 zoning district. The variance application has been submitted to waive the minimum lot
width for the two lots. No other variances would be required, and construction of the two new
homes would be required to meet all other codes and regulations.
The surrounding neighborhood is characterized bysingle-family homes; however, the lot sizes of
the homes vary somewhat, some are larger and some are smaller with less uniformity than some
other neighborhoods. Due to this characteristic, while the resulting lots will be slightly narrower
than the other lots In the neighborhood, and since the lots themselves exceed the minimum lot
area requirement, the requested variance should not result in negative impacts to the
neighborhood character. Increased traffic and demand on services is minimal.
Section 626 of the Qb/s LDC states, the City Commission or -Planning and Zoning Board, if
applicable, shall hold its public hearing and, after consideration of the staff recommendation and
public input, If any, may deny, approve or approve with conditions the application for variance,
based upon Its determination that the request meets the criteria Identified In Section 625-40,
which are identified below.
(1) "That the requested variance maintains the basic intent and purpose of the
subject regulations, particularly as it affects the stability and appearance of the city."

CITY OF DANIA BEACH, FLORIDA, APPROVING A VARIANCE (VA-005-
22) TO SECTION 205-10(A) OF THE LAND DEVELOPMENT CODE (LDC),
TO PERMIT A LOT WIDTH FOR TWO LOTS OF FIFTY-ONE FEET, NINE
INCHES <51.75 FEET), WHERE SIXTY (60') FEET IS REQUIRED IN THE
RS-6000 ZONING DISTRICT; SUBMITTED BY THE APPLICANT,
PROPERTY OWNER LINA MARIA MARQUEZ, FOR PROPERTY
LOCATED AT 4985 SW 27 TERRACE, IN THE CITY OF DANIA BEACH,
FLORIDA, AS LEGALLY DESCRIBED IN EXHIBTT "A", A COPY OF
WHICH IS ATTACHED TO THIS RESOLT_I"PION; PROVIDING FOR

WIIDREAS, pursuant to Chapter 28, the Land Development Code (the "LDC") Part 6
"Development Review Procedures And Aequirements," Article 625, "Variances" of the City Code
of Ordinances, property owner Lina Maria Marquez (the "Applicant"), applied to the City of Dania
Beach (the "CiTy") for approval of a variance request (VA-005-22) for property located at 4985
SW 27 Tezrace, Dania Beach, Florida, located within the RS-6000 Single -Family 6000 Residential
Zoning District, legally described in Exhibit "A" and incorporated by this reference; and
WI�REAS, LDC Section 625-40 states that the Planning and Zoning Boatd may grant a
variance based on its determination that the Applicant has demonstrated that the criteria identified
in the City Code have been satisfied; and
WIdERDAS, the Applicant proposes to split the existing lot and to construct two (2) single-
family homes on the resulting substandard sized lots at the subject location;
WI�REAS, Section 205-10<A) of the Land Development Code (LDC) requires a lot
width of sixty feet (60') feet wide; and
WHEIth'.AS, the applicant requests thaz the City permit a lot width of fifty-ane feet, vine
inches (51.75 feet), as proposed; and
WHEREAS, the Applicant has provided sufficient justification demonstrating compliance
with the approval criteria to meet the requirements of the LDC; and
WHEREAS, the Planning and Zoning Board conducted a duly noticed public hearing in
accordance with Article 61 O of the LDC; and
WFIDREAS, the Planning and Zoning Board finds that the Variance (VA-005-22) request
is consistent with the Comprehensive Plan;
NOW, THEREFORE, BE IT RESOLVED BY THE PLANNING AND ZONING
BOARD OF THE CITY OF DANIA BEACH, FLORIDA:
Section 1. That the foregoing "WI3EREAS" clauses are ratified and confirmed as
being true and correct and They are made a specific part of this Resolution.
Section 2. That this certain application (VA-005-22) fox a variance to Section 205-
1 O(A) of the Land Development Code (LDC), to permit a lot width of fifty-one feet, nine inches
(51.75 feet), where a mi.,imum o£sixty (60') feet is required, is approved.
Section 3. That the issuance of a development permit by a municipality does not in any
way create any right on the part of an applicant to obtain a permit from a state or federal agency,
and does not create any liability on the part of the municipality for issuance of the permit if the
applicant fails to obtain requisite approvals or does not fulfill the obligations imposed by a state
or Federal agency, or undertakes actions that result in a violation of state or Federal law.
Section 4. Pursuant to LDC Section 625-50 "Expiration of Variances," the variance
(VA-085-21) shall automatically expire and become null and void unless the applicant files a
complete building permit application with constmction drawings £or the improvements shown on
the site plan, witr.in eighteen (18) months from the date of this Resolution.
Section 5. That the associated Planning � Zoning Division Staff Report prepared for
application VA-005-22 is hereby incozporated into this resolution as fmdings of fact.
Section 6. That all resolutions or parts of resolutions in conflict with this Resolution
are repealed to the extent of such conflict.
Section Z That this Resolution shall be in force and take effect immediately upon its
passage and adoption.

Criteria Statement
This request is to allow the current lot to be divided equally Into two Io4s. The variance Is only
to reduce the minimal lot width requirement of 60 feat to 51.75 feet each lot. The minimal

COMPREHENSIVE PLAN AMENDMENT
The amendment area is the Dania Beach Regional Activity Center (RAC) which contains
approximately 1,344 acres and Is genera ily located east of 1-95, between Griffin Roatl and Sheridan
Street. The subject area will remain designated RAG. The applicant proposes to amend the mix of
uses to reduce the commercial category by thirty (30) acres and add 4,000 dwelling units
consisting of 31'] single-family units and 3, 683 multi -family units.

The original RAC established in 20Y0 (0-2010-007) did not propose any additional units above
what was permitted under the existing future land uses at that time.
The proposed change in uses will help the Gity adjust to development that has occurred within
the RAC, as well as changing conditions anticipated to occur within the community. The successful
im plementatlon of the RAC, originally esta bltshed in 2010, has resulted in Dania Pointe, a +/- 100-
acre mixed -use development consisting of 1 million+sf of commercial, 1,000,000 sf office, 400
hotel rooms, and 1,400 dwelling units. Spirit Airlines recently developed an office complex within
the Dania Beach RAC, multiple hotels have been developed along Usi, and high-rise residential
developments have occurred along Dania Beach Boulevard. The proposed amendment will
facilitate the continued evolution of the RAC and will ensure that an appropriate mix of uses are
available so that it can continue to thrive and evolve as a vibrant, transit -supportive, mixed -use
urban center. The RAC is also coterminous wfih the Clt�/s CRA limits. Development within the RAC
will Implement the CRA and Its mission to revitalize and improve the quality of Ilfe for the
community.
Goals, objectives and policies that were added to the Clty's Comprehensive Plan in support of the
RAC will be maintained except for policy 27.19 which limits units/density east of U51. That policy
and text is proposed to be amended far a maximum of an additional 1,600 dwelling units. The City
remains committed to ensuring compliance with Policy 27.21 of the comprehensive plan
regarding the availability of water supplies to serve new development, and also to policy 2y.14
regarding day -night average sound levels (DNLs) of 66 decibels or greaser. It is understood that
Broward County is also revisiting this policy.
Recognizing potential traffic concerns in the City and the region, the proposed change in
mercial and residential uses was established in a manner that will mitigate changes in [rip
generation Thai might result from the amendment. The analysis indicates a net reduction pf +/-
279 trips resulting from the change in uses.
Community Development staff have had multiple acdo ns in preparation of this amendment, as
indicated below.
• 9-9-21 City Commission Workshop discussing the status of the remaining RAC units
• 10-26-21 City Commission selected a Planning Consultant to prepare the Comprehensive
Plan amendment to replenish RAC units.

STAFF RECOMMENDATION
The Planning and Zoning Board, acting as the Local Planning Agency, must make a
recommendation regarding the amendment to the Future Land Use Element of the City's

Regional Activity Center. Staff Is recommending the Board recommends approval to City

reason held invalid or unconstitutional by a court of competent jurisdiction, the holding shall not
affect the validity of the remaining portions of this Ordinance.
Section 4. That all ordinances or parts of ordinances in conflict with the provisions of
this Ordinance are repealed.
Section 5. That staff shall submit this amendment to the Broward County Planning
Council for a concurrent text amendment. to the Broward County Land Use Plan.
Section 6. That this Ordinance shall take effect immediately at the time of its passage.
However, this plan amendment shall not become effective until true conclusion o{the process and
time frames set out in Section 163.3187(3)(a) o£ the Florida Statutes and re-certificaflon by the
Broward County Planning Council.

The amendment area is the Oanla Bach Regional Activity C¢nter (RAC)
which co ntalns approximately 1,344 acres and is generally located east
of 1-95, between Griffin Road and Sheridan Street.
The subject area will r¢main designated RAC. The applicant propos¢s to
amend the mix of uses to reduce the comm¢rcial category by thirty (30)
acres and add 4,000 dwelling units consisting of 317 single-family units
and 3,683 multi -family units. Refer to Table 1: Current and Proposed
Uses. The original RAC established in 2009 did not propose any additional
unlLs above what was permitted under the existing future land uses at

USE PLAN TEXT AMENDM ENT
The proposed change in uses will help the City adJust to development
that has occurred within the RAC, as well as changing conditions
anticipated to occur wlthln the community. The successful
implemen[ation of the RAC, originally established in 2009, has resulted
in Dania Pointe, a +/- 100-acre mixed -use development consisting of 1
milllon+sf of commercial, 1,000,000 sf offic¢, 400 hotel rooms, and 1,400
dwelling units. Spirit Airlines recently developed an office complex
within the Dania Beach RAG, multiple hotels have been developed along
U51, and high-rise resld¢ntlal developments have occurred along Dania
Beach Boulevard. The proposed amendment will faclll[ate the continued
evolution of the RAC and will ensure that an appropriate mix of uses are
available so that it can continue to thrive and evolve as a vibrant, translt-
supportive, mixed -use urban center. The RAC is also coterminous with
the Gity's CRA limits. Development wlthln the RAC wilt implement the
CRA and its mission to r¢vi[alize and improve th¢ quality of life for the
community.
An amendment to the RAC occurred In 2010 to Increase commercial and
employment center uses, No dwelling units were added at that time.
Only +/- 600 units are presen[ly available of the 7,818 units currently
permitted in the RAC. The Gity Continues to see interest in RAC units
which may rapidly outpace the number of units available for
(re)dev¢lopment. The additional 4,000 units requested will h¢Ip the RAC
meet the demand and ca ntinue to evolve. Additionally, a 15% set aside
for affordable housing is proposed which will also help the city meet
demands for affordable housing.
Goals, obJectives and policies that were added to the City's
Comprehensive Plan in support of the RAC will b¢ maintained except for
policy 27.19 which limits units/density east of U51. That policy and text
Is proposed to be am¢nded for an additional 1,500 dwelling units. The
City remains committed [o ¢nsuring compliance with Policy 27.21 of the
co mpr¢henslve plan regarding the availability of water su pplles to serve
new development, and also to policy 27.14 regarding day-n lght average
sound levels (DNLs) of 65 decibels or greater. It is understood that
Broward County is also revisiting this policy.
Recognizing potential traffic concerns in the Clty and the r¢gion, the
proposed change in commercial and residential uses was established in
a manner that will mitigate changes in trip generation that might result
from the amendment. The analysis Indicates a net reduction of +/-279
trips r¢sulting from the change in uses.
DANIA BEACH RAC LAND USE PLAN TEXT AMENDMENT
Existing neighborhoods will continue to be protected through the City's
Land Development Regulations. Development activity within [he RAC
district will be dev¢loped in accordance with the City's Land
Development Regulations, which ensure compatibility through
appropriate setbacks and buffers between uses.
3. AM ENDM ENT SITE DESCRIPTION
A. Concise written description of the general boundaries and gross acreage
(as defined by BCLUP) of the proposed amendment.
The amendment area is the Dania Beach Regional Activity Canter (RAC)
which contains approximately 1,344 acres and is g¢nerally located east
of 1-95, between Griffin Road and Sheridan Str¢et. The RAC is also
coterminous with the City's CRA Rmits.

located within the boundaries of the RAG is awned by Broward County
or the State of Florida, and Site #98 is owned by Florida Power and Light_
The City of Dania Beach's Comprehensive Plan contains policies which
protect such sites.
E. Priority Planning Area map and Broward County Land Use Plan Policy
2.21.1 regarding sea level rise.
A review of the Priority Planning Area Map indicates portions of the
subject site are located within a Prlo rity Planning Area_ These areas are
primarily located in the northeast portion of the RAC which Is primarily
developed as single family and along parts of Dania Bach Blvd which is
primarily developed with commercial uses. The City will coordinate with
the Broward County Environmental Resilient¢ Department to address BC
policies related to Priority Planning Areas.

the Broward County Emergency Management Agency). Provide a hurricane
evacuation analysis based on the proposed amendment, considering the number
of permanent and seasonal residential d. u: s (Including special residential
facilities) requiring evacuation, availability of hurricane shelter spaces, and
evacuation routes and clearance times. The hurricane evacuation analysis shall
be based on the best available data/modeling techniques as identifl ed by the

The eastern portion (east of US 1) of the amendment site is located In hurrlca ne
evacuation zone B. Attachment VIII outlines the City's hurricane evacuation
procedures. A part of this appllca[ion is amending [he restriction on units east
of USi to permit a maximum of an additional 1,500 units east of U51. The City
will coordinate with Broward County Emergency Management on appropriate
measures regarding evacuation as outlined In Attachmen[ VIII.
10. REDEVELOPM ENT ANALYSIS

The RAG Is coterminous with the CRA. The proposed change in uses will help the

to provide safe and comfortable service and to encourage

between the City and Broward County, the City is
responsible for monitoring development activity and
enforcing the permitted land use densities and intensities.
• Policy 27.14 The City shall not allocate additional
residential units within the area of the Regional Activity
Center that has aDay-Night Average Sound Level (DN L) of
66 decibels or greater.
• Policy 27.15 In order to ensure that all properties can be
developed within the overall density and intensity
Ilmltations of the Regional Activity Center, the City shall
establish and implement a development tracking system.
• Policy 27.16 The maximum intensity standards for
nonresidential development in the Regional Activity Center
are as follows:
1. All properties located within one -quarter mile of both the
FEC Rail Corridor (proposed for commuter rail) and US-1
are permitted a maximum Floor -to -Area Ratio (FAR) of
8.0.
2. All properties not located pursuant to 1., above, but
located within 750 feet of the US-1 or East Dania Beach
Boulevard transit corridors are permitted a maximum
FAR of 5.0.
3. All other locations are permitted a maximum FAR of 0.75.
4.Twenty (20) acres of Employment Center use shall be
limited to a FAR of 0.29 regardless of location, pursuant
to DCA Amendment No. 10-1 AR.
S. Thirty (3D) acres of Commercial shall be Ii mixed to a FAR
of 0.52 regardless of location, pursuant to DCA
Amendment No. 10- 1AR.
Policy 27.17 Acreage for non-residential land uses will be
assigned on a gross acreage basis to all lands included
within the development parcel needed to comply with on -
site land development requirements, such as, but not
limited to, building footprint, setbacks, parking, outdoor
pedestrian circulation, landscaping, drainage, etc. Within
mixed use projects, acreage shall be assigned according to
the proportion of floor area associated with each use (e.g.
if 50 percent of the floor area is used for A, then 50 percent
of the gross acreage of the development parcel will be
assigned to A).
Policy 27.18 Floor to Area Ratios shall be calculated using
the total gross acreage (on -site and off -site) used to

comply with any combination of parking, drainage, or open

Policy 27.19 The residential density within Traffic

16 before the adoption of the RAC land use category. The
boundaries of Traffic Evacuation Zone 16 are shown in
Broward Cou nty's Hurricane Evacuation Study, 2001.
Policy 27.20 In the event of discovery of any
archaeological artifacts during the construction of the RAC,
construction shall stop within athirty-foot radius of the find
and immediate notification shall be provided to the
Broward County Historical Commission: the Division of
H isto rtcal Resources, Florida Department of State; and the
City/Town. Construction may resume within the affected
area after the City/town, and the Broward County Historical
Commission, pursuant to 92-38 of the Broward County
Code of Ordinances; and the Division of Historical
Resources, pursuant to Rule 9J-2.043, FAC, have
determined the appropriate mltigatio n, ff any are
warranted, and such measures have been implemented by
Developer.
Policy 27.21 Prior to issuance of any building permit of
development, the City will consult with the appropriate
water supplier to ensure that adequate water supplies to
serve the new development will be available no later than
the anticipated date of the certificate of occupancy. Any
determination that adequate water supplies will be
available will require the demonstration that a consumptive
use permit has been issued to the City with sufficient
allocation available to serve the new development, given all
other existing commitments for that allocation. The
"sufficient allocation" in the CUP shall be defined consistent
with the permit's limiting conditions as they exist at the
time of building permit Issuance. Permitted projects may be
issued a Certificate of Occupancy only upon de monstratlon
by the city that adequate water supply exists within the
City's current legal allocation.
2. Housing Element
Policy 11.6 Promote mixed -use development that provides an
- - I array of housing types along transit corridors,
including the establishment of a Local Activity Center

A. PROJECT INFORMATION
The amendment area is the Dania Beach Regional Activity Center (RAC) which contains
approximately 1,344 acres and is generally located east of 1-96, between Griffin Road and
Sheridan Street.
The subject area will remain designated RAC. The applicant proposes to amend the mix of
uses to reduce the commercial category by thirty (30) acres and add 4,00o dwelling units
consisting of 317 single -fa mlly units and 3,683 multi -family units. Refer to Table 1: Current
and Proposed Uses. The original RAC established in 2009 did not propose any additional
units above what was permitted under the existing future land uses at that time.

treatment. The level of service in the Gity of Hollywood Water is 315 gallons per day

B. DRAINAGE ANALYSIS
1. Provide the drainage level of service per the adopted and certified local land use plan.
Private Property: retain property and dispose of K inch of storm runoff during any
five minute period.
Buildings: To have the lowest floor el¢vallon no lower than the elevation for the
respectly¢ area depicted on the National Flood Insurance Rate Map (FIRM) by
Federal Emergency Management Agency (FEMA) for flood hazard areas based on
100 y¢ar flood elevation plus 1 foot.
2. Identify the dra to age district and drainage systems serving the amendment area.
South Florida Water Management District and Braward Coun[y Environm¢ntal
Engineering and Permitting Division.
3. Identify any planned drainage improvements, including year, funding sources and other
relevant information.
Drainage improyements will ba compl¢t¢d at time of construction, as needed.
4. Indicate if a Surface Water Management Plan has been approved by, or an application
submitted to, the SFWMD and/or any fnd ependent drainage district, for the
amendment site. Identify the permit nu mber(s), or application numbers) if the
project is pending, far the amendment site. If an amendment site is not required to
obtain a SFWMD permit, provide documentation of same.
Surface Water Management Permits will b¢ obtained as needed_
5. If the area in which the amendment is located does not meet the adopted level of
service and there are no improvements planned (by the unit of local government or
drainage authority) to address the deficiencies, provide an engineering analysis
which demonstrated how the site will be drained and the impact on the surrounding
properties. The information should include the wet season water level for the
amendment site, design storm elevation, natural and proposed land elevation, one
hundred year flood elevation, acreage for proposed water management retention
area, elevations for builtlings, roads and years, storage and ru Hoff calculations for
the design storm and estimated time for flood waters to recede to The natural land
elevation.

Development within The subject area shall meet the requirements of the City of
Dania Beach, SFW MD and Broward County. After development of [he site and
consistent with the drainag¢ standards of the City, County and SFWMD, the
subject area will meet the adopted level of service.

Dania Beach RAC Text Amendment
A. PROJECT INFORMATION
The amendment area is the Dania Beach Regional Activity Center (RAC) which contains
approximately 1,344 acres and Is generally located east of I-95, between Griffin Road and
Sheridan Street.
The su Eject area will remain designated RAC. The applicant proposes to amend the mix of
uses to reduce the commercial category by thirty (30) acres and add 4,000 dwelling units
consisting of 317 single-family units and 3,683 multi -family units. Refer to Table 1: Current
and Proposed Uses. The original RAC established in 2009 did not propose any additional
units above what was permitted under the existing future land uses at that time.

along and near roadways which are located within '/. mile of mass
transit services.
The RAC land use designation reflects amixed-use development pattern
mare supportive of transit and internalized traffic patterns that

Hurricane Evacuation Procedures

The following will 6e the procedure followed If evacuation (relocation) is necessary In the event of an
incoming hurricane or severe natural disaster.
All evacuation routing will ba coordinated through the EOC and BSO.
Directives as to the accassibil ity of specific causaway(s), streets, or other routes of travel will be
identified via radio massages (WSBR AM 74, WIOO B10 AM, or WKIS FM 99.9). Public address
vehicles will patrol the affected areas to broadcast pertinent information.
Surveillance groups (Police, Fire and other City Personnel) will report at regular intervals to the EOC
for the purpose of assessing building, road and bridge conditions- City building inspectors will assess
and report on the co nditlon of various buildings. The BSO, through the use of patrol cars, will assess
bridges and roadways, reporting hourly on road flooding and bridge conditions.
In the event that privet¢ modes of transportation are unavailable, public transportation (buses) will 6a
utilized. Pick-ups and routing will be coordinated through the EOC per Broward County Evacuation
Routes.
When horizontal (road travel) evacuation is too dangerous, vertical evacuation (in buildings 4 stories
or more) will ba suggested. This message will ba transmitted vta radio communications and/or
surveillance group public address systems.
HURRICANE EVACUATION PLAN (Residents 8a Visitors
This plan will provide for an orderly and coordinated evacuation of City of Dania Beach residents and
visitors to minimize the loss of life end suffering that could be caused by the effects of hurricanes.
The plan is designed for use in hurricane situations.
Basal on the predicted severity of a particular hurricane, evacuation may be required from coastal
areas, from low-lying inland areas, and during any hurricane from mobile homes.
Particularly vulnerable to severe wave action and the affects of titlal surge is that area east of the
Intracoastal water way with only one westward egress route available whose approaches could
become inaccessible due to high water, probability of evacuating this area merits foremost
consideration.
It is anticipated that at the earliest threat of the possible approach of a hurricane, many residents and
visitors will begin evacuating to distant inland points on their own initiative. This will not ba
discouraged but the increase in traffic will require monitoring by law enforcement agencies.
Significant increase in this early evacuation traffic will ba reported to the Broward Sheriff's Office for
dissaminatlon to adjacent jur(sdictions for their preparation for potential impact.
Privately owned vehicles are the principal source of evacuation transportation and must ba utilized
fully.

H urricana Annex
Broward County Mass Transit buses, augmented by County school buses If necessary, will ba
positioned at designated pick-up points to provide transportation to refuges for those individuals who
have not bean able to make other arrangements.
_Tempos ry Refuoass
Public or private high-rise buildings, preferably west of the Intracoastal Waterway, of substantial
construction used as temporary, quick access haven from hurricane winds and high water.
t. Refuges are expected to be occupied for more than six to twelve hours. Persons seeking
safety in temporary refuges, whether a public or private building, will occupy only the common
use areas of the bulltltng such as corridors, hallways, stairwells, lobbies, etc. no other areas
will ba used except with the permission of the owners or tananta concerned.
2. Occupants of temporary refuges can only expect to have access to available drinking
fountains, public sanitary facilities and any existing food, drink or candy vending machines.
3. Anything lase than exemplary conduct on the part of the occupants of temporary regress
cannot ba tolerated.
Central control and coordination of evacuation movement will emanate from the Broward County
Emergency Operating Center (EOC) in the Courthouse. Communications will ba maintained between
municipal evacuation coordinators and the Broward Sheriff's Offlca evacuation coordinator in the EOC
to report progress of evacuation movement and for resolution of problems that could Impact the
overall evacuation operation.
Reentry into evacuated areas will be permitted only after it is determined by damage assessment
teams that there no longer exists any hazard to public health or safety. Traffic control will continua to
facilitate movement of rescue and other emergency forces.
SPECIAL ATTENTION
Fire stations are not places of refuge and shall not ba utilized as such. Exceptions can ba made by
the BSO DFRES Command Staff in the case of an emergency.
Evacuation —District 7:
As part of the Broward County Hurricane Evacuation Plan, the City of Dania Beach has been
designated District 7.
To provide information in the event evacuation is necessary, the Broward County Transportation
Planning Unit did an extensive study of the coastal area of Broward. Tha following information
applies to District 7.
1. Evacuation route is west on Griffin Road, Stirling Road or Sheridan Street

BCT —Broward County Transit: Depending on time of day end day of weak, buses will be a mix of
school and County transit buses. All evacuees will ba transported via buses to the closest available
shelter. The Broward Sheriff's Office will assist as Headed to assure the smooth flow of the
evacuation process.

Hurricane Evacuation Servic¢s
In the avant of a hurricane, BCT buses are celled upon to assist in the evacuation of residents who
are unable to make other arrangements for transportation to designated shelters. Transportation for
residents with Spacial Needs will be coordinated through Broward County Human Services
Department and BCT's Paratransit (TOPS). Sea the hurricane evacuation map and shelter list
[insert].
After an evacuation order is given from the County Administrator, if buses are already in service, BCT
will start to wind down service gradually, end normal bus service, antl implement its evacuation plan.
Evacuation service will coincide with the opening of the American Red Cross shelters. It will not begin
before shelters era open. The pick-up points for evacuation era at any regular BCT bus stop along
A'IA and Fetleral Highway.
In the case of a Category 'I or 2 hurricane (Evacuation Plan A), buses will pick up along AtA. In a
Category 3 or higher (Evacuation Plan B), bus pick-up points will include AtA and Federal Highway.
Pick-up points are at any regular bus stop located along A'IA on the beaches, and/or Federal
Highway in a Category 3 or hlg her. Those evacuating from these areas can flag tlown any BCT bus
for pick-up. Ail buses will be marked "E mer9ency Evacuation" on the head sign.
Evacuation service will continue as long as weather permits.
