Call to Order/Roll Call Mayor James called the meeting to order at 7:00 p.m. Present: Mayor: Vice -Mayor: Commissioners: City Manager: City Attorney: City Clerk: Tamara James Marco A. Moment of Silence and Pledge of Allegiance Mayor James called for a moment of silence followed by the Pledge of Allegiance to the United States Flag. 3. Presentations and Special Event Approvals 3.1 Presentation on the Landscape Master Plan/Griffin Road Component by KCI Technologies, Inc. Fernando Rodriguez, Director of Public Services, gave a brief overview of the master plan and introduced Dan Williams, FDOT District 4 Landscape Architect. Mr. Williams gave a background on the Griffin Road corridor and planned enhancements, noting they would be utilizing a push button contract. He turned the presentation over to KCI Technologies. Kirk Hoosac, Director of Landscape Architecture, KCI Technologies, Inc., introduced Bruce Reed, KCI, and James Wang, Senior Designer, and gave a PowerPoint Presentation which is attached to and incorporated into these minutes. Vice -Mayor Salvino asked what kind of droppings the trees would produce and about maintenance. He expressed concern about roots pulling up the asphalt and said he likes how the trees look but you must consider maintenance. Mr. Hoosac addressed the tree droppings; in the median, the trees will be pretty much away from everything. He also addressed the roots of the Oak trees, which are very slow -growing roots. He does not feel the roots would be a problem as the medians are wide. Vice -Mayor Salvino felt the Commission should have a choice of which trees are used. Mayor James noted she had questions about the deciduous trees insofar as maintenance and she is concerned about the Crepe Myrtle trees. She agreed the Commission should understand the scope of the project so they can make the best decisions. Mr. Hoosac noted there are other options available and explained how the initial choices of trees were made. He said it is good to hear the Commission's feedback. Commissioner Lewellen expressed concern about the flowering trees losing their flowers and complaints from residents that the trees look dead. Mr. Hoosac explained the Crepe Myrtles flower a great deal of the year, depending on the species and he addressed them losing their leaves. Commissioner Odman said she favors flowering trees and of course they will change their fullness; it is inline with how the seasons change. She asked how many of the trees that would be used are native to Florida. Mr. Hoosac addressed native and non-native trees, noting half of them would be native. Commissioner Odman questioned if there would be value in staying with Florida native trees. Mr. Hoosac said using strictly native would not always look that good. Commissioner Odman asked the Commission if they wanted to keep all trees native. City Manager Garcia added we could go all green, but those flowering trees in the fall and spring would add to the green surroundings. She addressed Vice -Mayor Salvino's concerns and noted this all must be blessed by FDOT since it is their road. Further discussion ensued. Commissioner Davis agreed with using Florida native trees, but if they are not as beautiful, this is not that important to her. She would like to see all the options, so they look the best and last the longest. She questioned the push button contract. Mr. Williams further described the push button contract and how it works and explained the maintenance agreement which could take four to five months to finalize. FDOT would ask for a Letter of Intent, and he felt they could start in six months. Minutes of Hybrid Regular Meeting 2 Dania Beach City Commission Tuesday, February 22, 2022 — 7:00 p.m. City Manager Garcia noted staff would investigate whether there are options other than the Oak tree. Our goal is to plant the right tree in the right spot. 3.2 New employee introductions and promotions - City Manager Garcia City Manager Garcia thanked all the elected officials and our HR team. She introduced new managerial employees and those employees who have been promoted: Daryl McFarlane, IT Department Director Erin McClendon, Deputy City Clerk John Quintero, Public Services Engineering Karla Mercado, Parks & Recreation Program Manager Darius Williams, Public Services Beam Team Supervisor 3.3 Presentation on American Rescue Plan Act (ARPA) - Frank DiPaolo, Director of Finance Finance Director DiPaolo provided a brief overview and gave a PowerPoint presentation which is attached to and incorporated into these minutes. Mayor James said if she is seeing this properly, all the money has already been budgeted out. This came out of nowhere and we have not workshopped this. She does not know the ideas of her colleagues; she would like to explore this further as to what the Commission wants to bring to the table. City Manager Garcia noted this is not set in stone; staff has followed the Strategic Master Plan. We are just plugging in numbers, but it is not set in stone. Staff is asking the Commission to see if staff can investigate the costs of the actual projects. Mayor James further questioned the role the Commission has in this budget. City Manager Garcia said we could pivot; in the next months or so, the Commission could let administration know what they would like. Commissioner Davis would like further conversation about this even though what was included was in the Strategic Plan. She wants to make sure we get all the information; the overall outline is good, and she would like to hear from her colleagues that we are prioritizing what we want. Vice -Mayor Salvino asked how much of the Strategic Plan was reflected in the proposed budget. City Manager Garcia said the majority of it comes from the plan and discussions with the Commission. Vice -Mayor Salvino felt the Commission should be given the items back to review and provide feedback to staff. Minutes of Hybrid Regular Meeting 3 Dania Beach City Commission Tuesday, February 22, 2022 — 7:00 p.m. City Manager Garcia said Finance Director DiPaolo would send the presentation to the Commission and she asked them to add to the list things they do not see there; after that, we could have a workshop if needed. Commissioner Lewellen questioned if there is a way to get what eligible costs are; right now, she felt we do not have enough information to say what should be taken out or put in. 4. Proclamations 4.1 Eating Disorders Awareness Week and Not One More Weekend - Mayor James Mayor James read the proclamation for Eating Disorders Awareness Week and Not One More Weekend. 5. Citizen Comments Phanna Chhuor, PharmD, Walmart Pharmacy Manager, 401 East Sheridan Street, introduced himself and noted he would like to continue building the relationship with the City and provide services to the City as well as participate in any City events. Walmart is still offering COVID vaccination and drive thru testing, and they will have a health fair in April and July at the store. 6. Public Safely Reports Special Presentation by Captain Daniel Marks, BSO Chief of Police, of Recognition certificates for Logan Peirce, Public Services, and Kenric Tucker, Centurion Security Group Captain Marks presented Certificates of Appreciation to Mr. Peirce and Mr. Tucker for service above and beyond the call of duty in preventing a vehicle theft at the City Hall parking garage on February 7, 2022. Captain Marks reported on recent criminal activity in the City and gave updates on motor deputies traffic enforcement, homeless outreach, and bringing back driveway initiatives. Captain Sergio Pellecer, BSO District Fire Chief, gave an update on departmental activities including officer development, (much of the training took place at Dania Pointe), hose testing, bi-annual fire drill testing, facility training, bunker gear cleaning and budget preparation. 7. The motion carried unanimously. 9.2 ORDINANCE #2022-010 AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA, AUTHORIZING THE EXPENDITURE OF CITY FUNDS EXCEEDING ONE MILLION DOLLARS ($1,000,000.00), WHICH EXPENDITURE IS NOT TO EXCEED THE PROJECT ESTIMATE APPROVED BY THE CITY COMMISSION IN THE PROJECTED AMOUNT OF EIGHTEEN MILLION ONE HUNDRED THOUSAND DOLLARS ($18,100,00.00) TO FUND THE PARKS MASTER PLAN PHASE I — CW THOMAS PARK PROJECT; PROVIDING FOR SEVERABILITY; PROVIDING FOR CONFLICTS; FURTHER, PROVIDING FOR AN EFFECTIVE DATE. The motion carried unanimously. 9.3 ORDINANCE 42022-011 AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA, AUTHORIZING THE EXPENDITURE OF CITY FUNDS EXCEEDING ONE MILLION DOLLARS ($1,000,000.00), WHICH EXPENDITURE IS NOT TO EXCEED THE PROJECT ESTIMATE OF ONE MILLION FIVE HUNDRED THOUSAND DOLLARS ($1,500,000.00) APPROVED BY THE CITY COMMISSION, TO FUND THE SW 43RD TERRACE DRAINAGE IMPROVEMENT PROJECT; PROVIDING FOR SEVERABILITY; PROVIDING FOR CONFLICTS; FURTHER, PROVIDING FOR AN EFFECTIVE DATE. Commissioner Lewellen motioned to adopt Ordinance #2022-011, on second reading; seconded by Vice -Mayor Salvino. The motion carried unanimously. 9.4 ORDINANCE #2022-012 AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA, APPROVING THE REQUEST OF THE PROPERTY OWNER JOHN SCHAAF, TO REZONE LAND AND ALLOCATE FLEXIBILITY UNITS FOR LAND BEARING THE ADDRESS OF 4900 SW 31 AVENUE, IN THE CITY OF DANIA BEACH, FLORIDA, AS LEGALLY DESCRIBED IN EXHIBIT "A", A COPY OF WHICH IS ATTACHED TO THIS ORDINANCE; AMENDING THE CURRENT ZONING CLASSIFICATION FROM ESTATE RESIDENTIAL DISTRICT (E-1) TO RESIDENTIAL MULTIFAMILY DISTRICT (RM); AND AMENDING THE CITY'S ZONING MAP TO REFLECT THE REZONING OF THE PARCEL; PROVIDING FOR SEVERABILITY; PROVIDING FOR CONFLICTS; FURTHER, PROVIDING FOR AN EFFECTIVE DATE. Commissioner Lewellen motioned to continue Resolution #2022-032 until the March 8, 2022, City Commission meeting at 7:00 p.m.; seconded by Commissioner Odman. The motion carried unanimously. 10. Discussion and Possible Action 10.1 Expansion of the Marine Industry Grant Program - Commissioner Lewellen Commissioner Lewellen noted there has been a lack of interest in the program; three are currently enrolled. She would like to expand the program to other areas including aviation, construction, health care and life sciences, hospitality and tourism, IT, and retail industries to utilize the funding available more fully and provide more opportunities to the community. The Commission consensus was to expand the Marine Industry Grant Program to construction, health care, IT, and hospitality. 10.2 Use of the City Logo for Camillus House/Broward Partnership for the Homeless 2022 Loving Soles Shoe Drive Drop Box program - Commissioner Lewellen Commissioner Lewellen noted she was approached by Camillus House about the shoe drive drop box program; they have partnered with Broward County. The box would be located at City Hall, and they would like to use our logo. Minutes of Hybrid Regular Meeting 8 Dania Beach City Commission Tuesday, February 22, 2022 — 7:00 p.m. The Commission consensus was to allow the use of the City logo for the Camillus House/Broward Partnership for the Homeless 2022 Loving Soles Shoe Drive Drop Box program. 10.3 Charitable donations and City Commission discretionary expenditures policy - Frank DiPaolo, Director of Finance Finance Director DiPaolo gave an overview of the charitable donations program which was drafted last fall. We would open the application cycle in October and close it two months later so that the Commission could award the donations early in the new calendar year. Staff would vet the applicants and the Commission would choose which organizations would receive the donation and the amount. He recommends the Commission contingency discretionary accounts projects be brought to the Commission for approval. Vice -Mayor Salvino noted he is stuck in the middle with charitable donations; the accountability and auditing of the funds are important factors. He felt the discretionary accounts worked well because they accept responsibility for where the money is going. Mayor James said she would not agree with a surplus because having a non-profit, you are always in the mode of fundraising, and you might have $50,000.00 in the budget but you might not have that amount of money in the bank at that time. It may seem surplus, but it will be going towards programing in the next few months. She wants it to be consistent and she would prefer that everyone gets the same amount of money. We can continue to not have religious based organizations; they have non -profits attached that we could give to. She asked about an audited financial statement. Finance Director DiPaolo noted they would need a notarized statement from the treasurer. Mayor James said she wanted Commission approval to give to the Lighthouse for Students from her discretionary account. Commissioner Davis noted she had pledged to support them as well. Mayor James asked how much she was going to give them and said she had planned to give them $4,000.00. Commissioner Davis said she was going to give them $2,500.00. Mayor James noted she would give them $2,500.00 as well for a total of $5,000.00 together. Mayor James asked for authorization to work with a vendor for the Summer Financial Literacy program. She mentioned it to Parks & Recreation Director Brown and knows how he feels about it. She knows it is $7,000.00 for them to provide those services at all three parks for our youth during the summertime so she is looking for consensus and authorization to work with a vendor. She asked if there were any issues and there was no response. She asked Finance Director DiPaolo if he had everything he needed to move forward with these two. Minutes of Hybrid Regular Meeting 9 Dania Beach City Commission Tuesday, February 22, 2022 — 7:00 p.m. Finance Director DiPaolo said yes. Commissioner Lewellen noted she and Vice -Mayor Salvino have programs at the two elementary schools through the Prestige Club. She said he is doing Collins Elementary, and she would take Dania Beach Elementary. It would be $2,500.00. The Commission agreed. 11. Commission Comments 11.1 Commissioner Davis Commissioner Davis spoke about Valentine's weekend and thanked her colleagues for bringing the Let Love Guide Your Way weathervane to our City, Black History Month, her trip to Tallahassee with the City Manager for legislative meetings, Lighthouse Community Church's 20th anniversary, and the BEAM Team which made mention in County Commissioner Beam Furr's newsletter. 11.2 Commissioner Lewellen Commissioner Lewellen spoke about the unveiling of the sculpture at Dania After Dark and reminded everyone of the market being held every Saturday at the Community Bible Church. 11.3 Commissioner Odman Commissioner Odman had no comments. 11.4 Vice -Mayor Salvino Vice -Mayor Salvino spoke of the 20th anniversary of Lighthouse Community Church, upcoming beach cleanups, and Commissioner Beam Furr. 11.5 Mayor James Mayor James asked about the March 8, 2022, meetings in reference to a court subpoena she received for earlier that day which could present a conflict. City Attorney Boutsis noted Vice -Chair Salvino could preside at the meetings if she was late or absent. 12. Appointments 12.1 General Employees Pension Board Minutes of Hybrid Regular Meeting 10 Dania Beach City Commission Tuesday, February 22, 2022 — 7:00 p.m. There were no appointments at this meeting. 13. Administrative Reports 13.1 City Manager City Manager Garcia noted the Eagles Nest library has opened in the Human Resources Department and spoke about the unveiling of the Let Love Guide Your Way sculpture. On February 16d', she and Commissioner Davis went to Tallahassee for meetings regarding funding for City projects. On March 1" she will meet with the president of Dania Pointe about Spirit Airlines, and she is working closely with the Fort Lauderdale Alliance and the new Broward County Administrator to keep Spirit Airlines here. She is working with Mayor James and the other committee members putting together the hosting of the BLC meeting in Dania Beach on March 3rd Discussion ensued regarding Spirit Airlines and the local delegation being formed to go to Denver. Mayor James felt as Mayor she should be included in representing the City. 13.2 City Attorney City Attorney Boutsis noted she would like to schedule a Special Meeting for an attorney/client session on March 22"d at 5:00 p.m. to discuss current litigation matters regarding the Citizens for Responsible Development lawsuits.
