AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF DANIA
BEACH, FLORIDA, AUTHORIZING THE EXPENDITURE OF CITY FUNDS
EXCEEDING ONE MILLION DOLLARS ($1,000,000.00) PER PROJECT,
WHICH EXPENDITURE IS NOT TO EXCEED THE PROJECTS' BID
AMOUNT APPROVED BY THE CITY COMMISSION, TO FUND THE SW
37 TH TERRACE DRAINAGE IMPROVEMENT PROJECT AND SW 54 TH
COURT DRAINAGE IMPROVEMENT PROJECT; PROVIDING FOR
SEVERABILITY; PROVIDING FOR CONFLICTS; FURTHER, PROVIDING
FOR AN EFFECTIVE DATE.
WHEREAS, pursuant to Section 2, "Certain Expenditures" of Article 3, "Powers of the
City", of the City Code of Ordinances, the City Commission must, by ordinance approve any
expenditures of City funds that exceeds One Million Dollars ($1,000,000.00) after two (2)
advertised public hearings of the ordinance; and
WHEREAS, the responses to the City -issued Invitations to Bid ("ITB") No. 22-006 for
the SW 37t" Terrance Drainage Improvement Project and ITB No. 22-007 for the SW 50' Court
Drainage Improvement Project both exceed the monetary threshold of $1,000,000.00; and
WHEREAS, the project expenditure shall not exceed the bid amounts of One Million
Two Hundred Thirty Thousand Four Hundred Thirty -Two Dollars ($1,230,432.00) for the SW
37th Terrance Drainage Improvement Project and One Million Two Hundred Forty -Six Thousand
One Hundred Ten Dollars ($1,246,110.00) for the SW 54th Court Drainage Improvement Project;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE
CITY OF DANIA BEACH, FLORIDA:
Section 1. That the proper City officials are authorized to expend more than One
Million Dollars ($1,000,000.00) per project in connection with the SW 37"' Terrace Drainage
Improvement Project and the SW 54 1h Court Drainage Improvement Project.
Section 2. That if any section, clause, sentence or phrase of this Ordinance is for any
reason held invalid or unconstitutional by a court of competent jurisdiction, the holding shall not
affect the validity of the remaining portions of this Ordinance.
Section 3. That all ordinances or parts of ordinances in conflict with the provisions of
this Ordinance are repealed.
Section 4. That this Ordinance shall take effect immediately at the time of its passage
and adoption.
