Call to Order/Roll Call Mayor James called the meeting to order at 7:00 p.m. Present: Mayor: Vice -Mayor: Commissioners City Manager: City Attorney: City Clerk: Tamara James Marco A. Moment of Silence and Pledge of Allegiance ance Mayor James called for a moment of silence followed by the Pledge of Allegiance to the United States Flag. 3. Presentations and Special Event Approvals 3.1 Presentation of 1 st Annual Arts Gala by Kelly Sharaby Ms. Sharaby gave a PowerPoint presentation on the Koosh Art Gala event, which is attached to and incorporated into these minutes. Vice -Mayor Salvino noted this is very exciting and would be at no cost to the City. Commissioner Davis said she is deeply passionate about art, and this is the perfect time to enhance it with the gala. Mayor James felt this might be an opportunity to theme the galas. City Manager Garcia thanked Ms. Sharaby and described the meetings she had with her; this is an exciting opportunity for the City. 3.2 Special Event request from Memorial Healthcare System for their HEAL Kick -Off to be held at C. W. Thomas Park on May 7, 2022 from 11:00 a.m. - 3:00 p.m. (Parks & Recreation) Vice -Mayor Salvino motioned to approve the Special Event request for the HEAL Kick - Off; seconded by Commissioner Lewellen. The motion carried unanimously. 4. Proclamations 4.1 Global Love Day - Mayor James Mayor James read the proclamation for Global Love Day. 4.2 Municipal Clerks Week - Mayor James Mayor James read the proclamation for Municipal Clerks Week. 5. Citizen Comments Luis Rimoli, 902 Natures Cove Road, spoke about the Earth Day event and noted we want to make Earth Day an everyday event. He thanked Commissioner Davis, Parks & Recreation Director Brown, and all staff who were instrumental in the event. 6. Public Safety Reports Captain Daniel Marks, BSO Chief of Police, introduced Lt. Dave Lewis, who is new to the district, Sgt. Neal Dodge and Deputy Cortez. He reported on recent criminal activity in the City and gave updates on homeless outreach. He noted he and Chief Pellecer ran in the Mothers Against Drunk Driving 5K in Fort Lauderdale this past weekend. Captain Sergio Pellecer, BSO District Fire Chief, gave an update on departmental activities including work on the Comprehensive Emergency Plan, Autism Awareness event this Saturday, 19 recruits running for Dania Beach on Monday, the ISO inspections and hydrant flushing. 7. The motion carried unanimously. 8. Bids and Requests for Proposals There were no proposals on this agenda. 9. Public Hearings and Site Plans 9.1 ORDINANCE #2022-016 AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA, CREATING THE PUBLIC ART ADVISORY BOARD, BY AMENDING CHAPTER 28, ENTITLED THE "LAND DEVELOPMENT CODE", ARTICLE 811 ENTITLED "PUBLIC ART PROGRAM," BY CREATING SECTION 811-130, ENTITLED "PUBLIC ART ADVISORY BOARD," AND BY REMOVING ALL REFERENCE IN SECTIONS 811-20 AND 811-30 TO THE CREATIVE ARTS COUNCIL ADVISORY BOARD ("CACAB") AS THE CACAB HAS BEEN DISSOLVED; PROVIDING FOR THE APPOINTMENT AND TERMS OF MEMBERS, AS WELL AS DUTIES AND RESPONSIBILITIES; PROVIDING FOR CONFLICTS; FURTHER, PROVIDING FOR AN EFFECTIVE DATE. (SECOND READING) (Community Development) City Attorney Boutsis read the title of Ordinance #2022-016. Corinne Lajoie, Assistant Director of Community Development, gave a timeline for appointments to the Board; three members would be Dania Beach residents and the others could be residents of the City but also could be residents of Broward County in general, providing they meet the membership criteria. Vice -Mayor Salvino asked about the applications. Assistant Community Development Director Lajoie responded the Community Development Department and our consultant, Cultural Planning Group, would review them and pass them on to the Commission. She reviewed the criteria required of members to serve on the board. City Attorney Boutsis reviewed the change made to the criteria for resident members as requested by the Commission at first reading. Commissioner Davis asked if two members could be former CACAB members. Assistant Community Development Director Lajoie said yes. Mayor James opened the Public Hearing. Seeing as there was no one to speak in favor or opposition, she closed the Public Hearing. Vice -Mayor Salvino motioned to adopt Ordinance #2022-016, on second reading; seconded by Commissioner Odman. The motion carried unanimously. Minutes of Hybrid Regular Meeting 4 Dania Beach City Commission Tuesday, April 26, 2022 — 7:00 p.m. 9.2 ORDINANCE #2022-017 AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA, AMENDING THE TEXT OF THE FUTURE LAND USE ELEMENT OF THE DANIA BEACH COMPREHENSIVE PLAN TO AMEND THE REGIONAL ACTIVITY CENTER ("RAC') LAND USE CLASSIFICATION AS DESCRIBED IN EXHIBIT "A" ATTACHED TO THIS ORDINANCE, BY REDUCING ACREAGE FOR COMMERCIAL AND INCREASING RESIDENTIAL USES; PROVIDING FOR TRANSMITTAL TO THE BROWARD COUNTY PLANNING COUNCIL AND STATE AGENCIES; PROVIDING FOR ADOPTION PURSUANT TO SECTION 163.3184, FLORIDA STATUTES; REQUESTING RECERTIFICATION FROM THE BROWARD COUNTY PLANNING COUNCIL; PROVIDING FOR CONFLICTS; PROVIDING FOR SEVERABILITY; FURTHER, PROVIDING FOR AN EFFECTIVE DATE. (FIRST READING) (Community Development) City Attorney Boutsis read the title of Ordinance #2022-017. Corinne Lajoie, Assistant Director of Community Development, gave a presentation on the Comprehensive Plan amendment concerning the Regional Activity Center (RAC) land use classification. Vice -Mayor Salvino remembers going back to 2014/15 and the developers holding units and we changed the grace period. He asked how long that is continued for and if there is a reason why it is continuing. Assistant Community Development Director Lajoie said we did look at that and vesting of the site plan for 12 months with an extension coming back in front of the Commission. City Attorney Boutsis addressed the emergency orders issued by the Governor and extension of development orders. Mayor James asked how many units have been used up in the past two years. Assistant Community Development Director Lajoie named three recent projects and the units for each but indicated she was not prepared to provide a full list of all projects. Mayor James referenced a slide with a list. Assistant Community Development Director Lajoie explained she did have a slide and referred to slide 6 of her presentation. Mayor James said she will need a number and asked where the breakdown is of how the units are going to be distributed. Assistant Community Development Director Lajoie noted it is broken down in the land use amendment. Mayor James commented her issue is that there is an asterisk and a message at the bottom of the page stating that we can override any of that. Minutes of Hybrid Regular Meeting Dania Beach City Commission Tuesday, April 26, 2022 — 7:00 p.m. Assistant Community Development Director Lajoie explained that is what has happened in the past and there is a provision that allows the ability to convert single-family homes to a higher density. Mayor James asked how many single-family homes have been converted to other types of development and asked if the language can be removed. Assistant Community Development Director Lajoie said property owners can improve their homes and makes additions; they cannot add additional units. She would be hesitant to take that provision out because it provides a lot of flexibility where necessary. City Attorney Boutsis noted she has talked to Assistant Community Development Director Lajoie and Community Development Director Norena about when we do our calculations, that we ensure we have enough for the vacant lots so that when the time comes, we have enough reserves for the vacant lots, so there will not be a time when the vacant lot cannot be developed. Mayor James said that is a huge problem because we have given out these units like lottery tickets and now, we cannot do affordable housing. She spoke about traffic and asked how approving this is preserving our neighborhoods. Assistant Community Development Director Lajoie explained our zoning defines the land use and controls the density; we are preserving the neighborhoods and only allowing development on major thoroughfares. Commissioner Davis said traffic and infrastructure are what residents speak to her about the most; she wants to get more specifics on the shuttles. Deputy City Manager Sosa-Cruz addressed the bus shuttles and commuter rail station to be built in Hollywood and Freebies. There will be multiple vehicles such as buses and Freebies. City Manager Garcia said in addition to that, we will be committing revenues from these developments each budget year to continue to augment the shuttles and Freebies and to add citywide trolley systems. There will be a multitude of transit opportunities to connect the people. Commissioner Davis questioned the water supply, which is another concern of residents. She asked if the 2042 water supply included the projections or is it based on what is currently available now. Assistant Community Development Director Lajoie responded it included our projections of the additional units. Commissioner Odman asked if there was a date for submission of units. Assistant Community Development Director Lajoie said no, what we have is submittal dates for the DRC. Minutes of Hybrid Regular Meeting 6 Dania Beach City Commission Tuesday, April 26, 2022 — 7:00 p.m. Commissioner Odman spoke about a moratorium, and how administration said be careful because it could make us look anti -development. Assistant Community Development Director Lajoie noted there were a lot of community workshops in 2010; she believes the form -based code is very modern and design -oriented. Staff is on the same page and is pushing for a higher level of development. We are taking this opportunity to work with multiple consultants and look at all the things the Commission has said are important and we will bring that information to the Commission. Commissioner Odman said even so, we still run that risk that we are not able to come to a consensus or that the next Commission is not able to come to a consensus and we still run into the same problem of no plan on our side. Deputy City Manager Sosa-Cruz noted last time we had the meeting where the Commission brought up styles, etc., we had meetings with our City Attorney and the timing was not the best timing because there were so little units left. The determination was to allow the remaining units to be under the current code and now we have 14 months to revamp our code to do incentives. Commissioner Lewellen commented this process takes 12-14 months with several different layers to go through for approvals. She asked if we could continue to discuss and workshop these ideas as part of the code. Deputy City Manager Sosa-Cruz responded absolutely. We had already hired consultants to determine what are best practices and to assess the amount of affordable living units. We are attacking what the Commission is bringing up, but the key component is we need to replenish more units in order to move forward. Commissioner Lewellen asked if there are no units and this is not approved, whether anything can be done with the properties that are zoned residential. City Attorney Boutsis said if you have a single-family home now and you want to demolish it and rebuild, you cannot. The vacant lots that were not recognized in 2010 would remain vacant. The vacant lots would never have the opportunity to be developed and that is a legal concern that she has. Commissioner Lewellen questioned if that is the only option or if they can ask for re -zoning. City Attorney Boutsis explained you can always ask for rezoning, but you would have to change the land use partition of the map and it is not something that is easy to do. Commissioner Lewellen said that is something that is concerning to her. Deputy City Manager Sosa-Cruz noted commercial has higher traffic than residential does. City Manager Garcia added the last investors staff met with, their project is going to be live, work, play. That one development will be self-sustaining. We are starting to see cool projects Minutes of Hybrid Regular Meeting 7 Dania Beach City Commission Tuesday, April 26, 2022 — 7:00 p.m. that will reduce the traffic because there will be so much going on within that development. She felt between first and second reading we should have discussion. Mayor James noted she does not understand how adding more units reduces traffic when the development currently does not exist. City Manager Garcia said we are not saying that we are reducing traffic; we are mitigating the traffic challenges with transit opportunities. We are looking at projects with live, work, play, and unique opportunities to move people from point A to point B, free of cost, and incentivizing our community to be able to use public transportation. Mayor James commented she just heard reducing commercial to 30% is going to reduce the traffic. City Manager Garcia said since COVID, more and more companies are either hybrid or working from home. Leigh Kerr, Planning Consultant, explained you would be reducing the commercial by 30 acres and would reduce traffic in the future. Mayor James said she keeps hearing we have no other units available and questioned what happens if, and it is not guaranteed a project will be approved, what happens to those units if a project is denied. Assistant Community Development Director Lajoie noted it is correct, if a project is not approved, the units would be returned. City Attorney Boutsis clarified that if a project was denied, there would be an appeal period. Use of those units would be dependent upon when the appeal ends. Mayor James opened the Public Hearing. Elizabeth Bryan, 722 NW 8th Street, commented looking at the presentation gives her a dozen more questions she would like to ask. She questioned where all the vacant land is for all the additional units. She said the flexibility is to the developers and not the City, and transit ridership is down. The City needs to be more prepared before requesting additional units from Broward County. Jonathan Thomas, 421 NW 3rd Terrace, questioned how we can continue to say our infrastructure can support the additional units when studies have not been done. He supports development but questioned what the City is trying to accomplish. Rod Feiner, Coker and Feiner, addressed the game plan pursued by the City 10 years ago and the positive implications to increasing the number of units. The City has a year to refine the development code; it should not cut itself short. Minutes of Hybrid Regular Meeting 8 Dania Beach City Commission Tuesday, April 26, 2022 — 7:00 p.m. Anthony Amos, 101 SE 3rd Avenue, commented we have several projects that are not finished yet, but the City wants to allow other projects to be built. He addressed traffic and flooding in the City. Chickie Brandimarte, 101 SE 3rd Avenue, said the Commission does not have an idea of what our future problems will be until the buildings already approved are finished. The residents are opposed to this, and she requested that the Commission let this wait. Carol Stokrocki, 450 SE 7th Street, spoke against the increase in units and about the effects on the environment. Samantha Angelos, 43 SW 12th Street, commented the beach is already crowded and closed oftentimes due to overcrowding. Daniel Dabakaroff, 420 SW lst Avenue, said he is pro -growth and believes the units can be added over time and not all at once. Issues will arise as the City grows and they can be addressed then. Seeing as there was no one else to speak in favor or opposition, Mayor James closed.the Public Hearing. Commissioner Davis questioned if there would be a compromise on the number that could be requested; 4,000 seems too great to residents. Commissioner Lewellen wanted to address concerns voiced by the residents tonight. She asked City Manager Garcia what was spent on drainage. City Manager Garcia said in the past three years, we have spent or allocated to spend $100 million on infrastructure, storm drainage, and parks. Deputy City Manager Sosa-Cruz addressed comments made by residents regarding the water/sewer. He emphasized at the time of second reading of the ordinance, the Commission would have all the information and could determine the exact number of units then. He noted when new projects are developed, they must build new infrastructure. Commissioner Lewellen said she would support an amendment to reduce the number of units within reason. She thinks we need to make sure there is a cushion. Mayor James questioned why the decision is not made at Broward County first on the number of units; she also does not know where those residents who support this are. She asked City Manager Garcia what we are spending on drainage alone. City Manager Garcia responded drainage alone is approximately half of the $100 million. Minutes of Hybrid Regular Meeting 9 Dania Beach City Commission Tuesday, April 26, 2022 — 7:00 p.m. Mayor James said we are paying attention to our infrastructure, and we are taking note of what other cities have made mistakes on doing. We should be much more intentional about what we are approving; there are still 600 units left that have not been approved by this Commission. Assistant Community Development Director Lajoie commented she understands the number is scary; we could add language. There are ways that we can go a little bit more slowly and more intentionally. Commissioner Lewellen noted we could technically approve it on first reading and then tweak it and potentially reduce it at second reading, whether the County approves it or not. City Attorney Boutsis said yes. Assistant Community Development Director Lajoie explained we can add in language that builds in those required checks. Commissioner Odman said some of the Commissioners are getting a number in their head; we should move it to second reading where all the information will be presented. We can discuss it at second reading and see if we come to an agreement. We understand what it is; now it is what every individual Commissioner is comfortable with. Vice -Mayor Salvino noted we need to have plans and programs in place so that we have enough set aside for residential. He hears a lot of positive things about the growth and how we are developing. The new two or three thousand people moving into the City are two to three thousand new voters; this will be a diverse community that we are going to be in, come the next round. We should pass this on first reading and then reduce it if the Commission wants. Vice -Mayor Salvino motioned to adopt Ordinance #2022-017, on first reading; seconded by Commissioner Odman. Frank DiPaolo, Chief Financial Officer, reviewed the projects list and associated expenditure budget funded by the American Rescue Plan Act (ARPA) State and Local Fiscal Relief Fund (SLFRF). He noted the expenditures exceed $1 million and requires adoption of an ordinance following two public hearings pursuant to the Charter. Mayor James opened the Public Hearing. Seeing as there was no one to speak in favor or opposition, she closed the Public Hearing. Commissioner Lewellen motioned to adopt Ordinance #2022-019, on first reading; seconded by Commissioner Odman. The motion carried unanimously. 10. Discussion and Possible Action 10.1 Discussion on City advisory boards - Vice -Mayor Salvino Vice -Mayor Salvino asked the Clerk to review the advisory boards. Some of the boards have not been meeting since COVID. We need to look at our appointees and see if they are showing up or if we need to re -appoint or if the boards are not being utilized, we need to sunset them. He asked the Commission to look over the attendance records and said we can discuss it at the next meeting. If we are going to use the boards, they need to be active. Minutes of Hybrid Regular Meeting 11 Dania Beach City Commission Tuesday, April 26, 2022 — 7:00 p.m. Mayor James said she understands why he wants this. Commissioner Davis felts this is a longer discussion, and we need more in-depth discussion. Her recommendation is to bring it back and asked if all the attendance is in the agenda packet. City Clerk Schneider responded yes, there is a cover memo, rosters, and attendance records for six months. He indicated the Marine Advisory and Parks & Recreation Advisory Boards are having trouble achieving quorums to hold meetings. City Manager Garcia noted staff would meet about the boards and bring information so that the Commission could make an educated decision at the next meeting. 11. Commission Comments 11.1 Commissioner Davis Commissioner Davis spoke of the Health and Wellness Fair, the Conviva grand opening, the Dania Improv, Earth Day event at the beach, Paolo's closing (they were presented a Key to the City), and the Broward League of Cities scholarship dinner for high school kids. At the BLC event, she was approached for the 65�' Gala Dinner coming up in May. She said they would like us to consider being title sponsors for the event. Her suggestion was to do $1,500.00 for each Commissioner and to have the CRA do the other part. This would put us at the head; she thinks it is time for us to move forward. Discussion ensued among the Commission, City Manager Garcia and Chief of Staff to the Mayor and City Commission Singh as to what has been done historically, who will be present and what tier they would like to sponsor this year. It was decided to remain at the silver level of sponsorship this year as only two people will be attending. Commissioner Davis said Happy Clerk's Week and Happy Administrative Professionals Day. She thanked Maxine Singh, Chris Lottier, and Thomas Schneider for all the work they do. 11.2 Commissioner Lewellen Commissioner Lewellen spoke of the Conviva ribbon cutting, Paolo's closing, and a meeting with the City Manager in anticipation of the vote on the RAC and on development. Given the fact that the census was done in 2020, it may not be accurate due to COVID; there may be more people in the City than we realize. From that discussion, there may be some things we need to do before the new budget year, including public safety. Probably at some point, it will need to come forward. City Manager Garcia said she is meeting with Captain Marks and the Finance Department about bringing an adjustment. She does agree that we may be undercounted and believes it is a proactive thing to do. She will be bringing numbers for the first meeting in June. Minutes of Hybrid Regular Meeting 12 Dania Beach City Commission Tuesday, April 26, 2022 — 7:00 p.m. 11.3 Commissioner Odman Commissioner Odman had no comments. 11.4 Vice -Mayor Salvino Vice -Mayor Salvino had no comments. 11.5 Mayor James Mayor James said she had a conversation with the Education Advisory Board, and they are looking to give awards for Teacher of the Year. She wanted to get plaques for the awardees for a total of $539.00 from Commission contingency. The Commission agreed to the expenditure from Commission contingency for plaques for the awardees. Mayor James noted tomorrow is Administrative Professionals Day and commended the Clerk's office, Chris Lottier, and Maxine Singh for all their assistance. 12. Administrative Reports 13.1 City Manager City Manager Garcia echoed the sentiments of the Commission about the City Clerk's office, Chris Lottier, and Maxine Singh. City Manager Garcia reported as follows: On April 14th, she met with the Ft. Lauderdale Alliance, Airport CEO, and Monica Cepero, our new County Administrator. We are working on two strategies and two presentations: one for a possible Spirit -Frontier merger and another for a Spirit -Jet Blue merger. We expect a vote to come forward from the Spirit Board of Directors within the next month or so. On April 14th, she met with four members of the Dania Beach Improvement Committee. She briefed them on our commitment to historic preservation, and our Art in Public Places ordinance. They are extremely pleased with both endeavors. They requested several additional garbage cans on Federal Highway as part of their volunteer project, as well as space to work on their Minutes of Hybrid Regular Meeting 13 Dania Beach City Commission Tuesday, April 26, 2022 — 7:00 p.m. Historic Preservation Project for approximately three months. Both requests were granted as they serve a benefit to our community. Now that we are augmenting Art in Public Places and have additional security cameras, we would like to move the sculpture that is in the atrium and put it in a safe and secure location outside. On April 20t', she and Chief Financial Officer DiPaolo met with the ARPA team to commence dialogue on prioritizing projects and incentives discussed in the CRA. City Manager Garcia discussed the CRA and the arts and entertainment district as well as the PATCH masterplan. Mayor James asked if we could use some of the parking from Collins Elementary. City Manager Garcia said she wants to explore options at Collins Elementary and some of the local churches. We are going to have some outstanding programs and activities and an interlocal agreement with Collins Elementary is extremely important as well as with churches. We have an ongoing commitment to investing in our City Team. Additionally, we are committed to the health, wellness, and quality of life of our staff. On April 13th, our HR Director and her Team hosted a truly amazing Health Fair for our employees and City officials. We had 63 Team members participate. We had 45 biometric screenings, 22 angiograms, and 28 stress relief massages. The event was a huge success. We will continue to plan and execute any and all events that invest in all areas of employee wellness and professional development. We have $500,000 in this current budget and the Commission has approved $1.5 million from the ARPA $16.2 million towards Historic Preservation. Both the Nyberg -Swanson and the Women's Club will remain at the current site. We will continue with our commitment to protect these historic structures and will have the construction bidding documents ready by October to move forward with the historic renovation/restoration of both. The West Wing project that will yield an anticipated and necessary 2,500 square feet of office space is scheduled for completion this July. We are currently in the process of installing framing for the walls. We are currently working on a new and improved State of the City Address scheduled for Thursday, October 13th, at 5:00 p.m., at the Marriott at Dania Pointe.
