AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF DANIA
BEACH, FLORIDA, AMENDING CHAPTER 2, ENTITLED
"ADMINISTRATION", ARTICLE VI, ENTITLED "MARINE ADVISORY
BOARD", OF THE CITY CODE OF ORDINANCES, AT SECTIONS 2-120,
ENTITLED "MEMBERS' COMPENSATION; TERM"AND 2-121, ENTITLED
"RULES OF PROCEDURE" ARE AMENDED TO REDUCE THE NUMBER
OF MEMBERS AND QUORUM REQUIREMENT; PROVIDING FOR
CONFLICTS; PROVIDING FOR SEVERABILITY; FURTHER, PROVIDING
FOR AN EFFECTIVE DATE.
WHEREAS, in 1991 the City of Dania Beach created the Marine Advisory Board
(Board); and
WHEREAS, the Board has the charge of considering any relevant marine related subject
matter it considers appropriate, and is specifically directed to consider and make
recommendations on, amongst other things, the conditions of waterways and needed corrections,
including a study of the most feasible and economical method of maintaining the depths of
waterways within the City, waterway safety and traffic control on waterways, activities of
waterways patrol, operation of privately owned marinas, operation of small boat docking areas,
relations with the Coast Guard, and regulation of boat docking in public navigable waters; and
WHEREAS,the Board has had problems making quorum with a 10-person Board and as
such has not held regular meetings; and
WHEREAS, the City Commission desires to have a functioning and active Board, has
decided to decrease the quorum requirement and Board member number so as to better ensure
attendance and quorum for Board meetings;
NOW, THEREFORE,BE IT ORDAINED BY THE CITY COMMISSION OF THE
CITY OF DANIA BEACH, FLORIDA:
Section 1. That Article VI, entitled "Marine Advisory Board" of Chapter 2, entitled
"Administration" of the City Code of Ordinances is amended to read as follows:

Sec. 2-120. Members' compensation; term.
The members of the marine advisory board shall serve without compensation, and each member
shall serve for a term consistent with the duration of the term of the appointing Commissioner.
The board shall consist of five (5) ten (10) members appointed by the City Commission. Each
commissioner shall appoint one two (2) members who have been a residents of the Ceity for at
least six (6) months;_ It is recommended that one (1) of the two the appointees shall be engaged
in a marine related business or have prior marine related business experience.
Sec. 2-121. Rules of procedure.
(1) The Board shall select its own Chairperson and Secretary, unless the Chairperson is
designated by the City Commission.
(2) It is suggested that the Board meet not less than once a month, and more frequently if
business requires. Notice of the meetings shall be given by the Chairperson or his/her
representative.
(3) Unexcused absence by any Board member from two (2) consecutive meetings, or any
three (3) consecutive absences shall constitute an automatic resignation of such
member. Failure to have quorum to hold a meeting shall be considered an unexcused
absence.
(4) Three (3) Six (6) members of the Board shall constitute a quorum at any meeting of
the Board, but no action shall be binding when taken by the Board except at a
meeting as provided in this Section, and recorded in the minutes of the meeting.
(5) A record of the Board's proceedings shall be made and kept by the Secretary and
shall be open to inspection at all times.
(6) All meetings shall be open to the press and general public and all persons desiring to
appear before the Board shall be given reasonable time to present their views on any
matter being considered by the Board.
(7) The Chairperson shall act as presiding officer at all meetings of the Board, but may
designate another member to preside as Chairman Pro Tempore during the
Chairperson's absence.
(8) A written report shall be submitted to the City Commission not less than once each
three (3) month period setting forth the matters considered by the Board along with
the Board's recommendations to the City Commission. A copy of the minutes of
each meeting shall be submitted to the City Manager.
Section 2. That if any section, clause, sentence, or phrase of this Ordinance is for any
reason held invalid or unconstitutional by a court of competent jurisdiction, the holding shall
not affect the validity of the remaining portions of this Ordinance.

Section 3. That all ordinances or part of ordinances in conflict with the provisions of
the Ordinance are repealed.
Section 4. That this Ordinance shall be effective immediately at adoption on second
reading.
