Call to Order/Roll Call Mayor James called the meeting to order at 7:00 p.m. Present: Mayor: Tamara James Vice-Mayor: Marco A. Salvino, Sr. Commissioners: Joyce L. Davis Lori Lewellen Lauren Odman City Manager: Ana M. Garcia, ICMA-CM City Attorney: Eve Boutsis City Clerk: Thomas Schneider 2. Moment of Silence and Pledge of Allegiance Mayor James called for a moment of silence followed by the Pledge of Allegiance to the United States Flag. Mayor James moved out of the regular order of business to take up the addendum item under item 13.2 City Attorney. Addendum Report on retired firefighters insurance discussion City Attorney Boutsis explained the issue when the City firefighters joined BSO; there was an agreement for certain officers' insurance and pension rights. A recent retiree raised a concern with the separation agreement and the City's pension plan. He believes that family/dependent health insurance can be selected at a later date. Five firefighters have already retired from the City and have not signed up their dependents. They seek to add their dependents later. The remaining former City fire fighters (27) are seeking this same benefit and recognition, that the families of the fire fighters, upon their second retirement from the County's pension system, would be added on to the City's retiree health insurance plan at that later date, and the City would pay 2/3 of the insurance, as provided for in the City's Pension Ordinance. The Commission consensus was to move forward with an agreement. City Attorney Boutsis noted an agreement would be brought to the Commission. 3. Presentations and Special Event Approvals 3.1 Update on the Capital Improvement Program by Dincer Ozaydin, Deputy Director of Public Services/City Engineer, and Colin Donnelly, CIP and Grants Administrator Deputy Public Services Director Ozaydin and CIP and Grants Administrator Donnelly gave a PowerPoint presentation which is attached to and incorporated into these minutes. 3.2 Dania Beach Proud merchandise - Linda Gonzalez, Director of Human Resources Members of the Dania Beach team modeled Dania Beach Proud merchandise in a brief fashion show. Commissioner Davis noted the several different logos associated with the City and we need to be mindful of the purpose of branding. It becomes confusing with several logos, and we should be mindful of this. Mayor James agreed and noted we need consistency to build a special brand. 3.3 Special Event request from Parks & Recreation Department/MLK Renaissance, Inc. for the First Annual 2022 Juneteenth Freedom Day Celebration to be held at C.W. Thomas Park, 100 NW 8th Avenue, on June 20, 2022 from 9:00 a.m. - 4:00 p.m. (Parks &Recreation) The Commission consensus was to approve the Special Event request for the First Annual 2022 Juneteenth Freedom Day Celebration. 4. Proclamations 4.1 National Men's Health Month-Mayor James Mayor James read the proclamation for National Men's Health Month. 4.2 Code Enforcement Officers' Appreciation Week- Mayor James Mayor James read the proclamation for Code Enforcement Officers' Appreciation Week and presented it to the Code Compliance managers and officers in attendance. Minutes of Hybrid Regular Meeting 2 Dania Beach City Commission Tuesday,June 14,2022—7:00 p.m. 5. Citizen Comments Jose Armand, 50 SE 3rd Avenue, spoke about the CRA community workshop held last Wednesday where there were only 10 other residents in attendance. He addressed the Arts & Entertainment District discussed by the CRA Director at the CRA Board meeting earlier. 6. Public Safety Reports Captain Daniel Marks, BSO Chief of Police, reported on recent criminal activity in the City and gave updates on digital stop signs and speed trailers, homeless outreach, panhandling, Neighborhood Support Team, second driveway initiative on June 16, 2022 at Pat Chukerman's home, and the closure of Sheridan bridge due to construction. Discussion ensued regarding eastbound lanes of Dania Beach Boulevard east of TNT Fireworks being closed and used for westbound only traffic from 8:00 p.m. until 11:00 p.m. on July 4th due to the fireworks show on Hollywood Beach. Mayor James objected that Dania Beach was not involved in discussion of this closure. She noted we need follow-up discussion after this, so this does not happen again. Commissioner Odman felt a red alert should be broadcast on social media for our residents. Captain Marks continued with his report and noted the BSO Shred-a-Thon and Operation Medicine Cabinet would be held on December 17, 2022 at Bass Pro Shops. Captain Sergio Pellecer, BSO District Fire Chief, gave an update on departmental activities including the June 12th lifeguard alert at our beach which resulted in the fire rescue and transport of a victim, recent Stop the Bleed training at City Hall, Dania Beach Elementary field day, the Fire Safety Intervention Program, Fire summer camp at Frost Park, call volumes, EMS conference for agencies around the country, retirement of Fire Chief Holness, and the Emergency Management Plan. 7. Public Hearings and Site Plans 9.1 RESOLUTION#2022-096 Amended A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA, APPROVING THE SITE PLAN (SP-064-21) TO DEVELOP FIVE (5) SINGLE-FAMILY HOMES, SUBMITTED BY GMAX FL LLC FOR PROPERTY LOCATED AT GRIFFIN ROAD AND SW 25TH AVENUE IN THE CITY OF DANIA BEACH, FLORIDA, AS LEGALLY DESCRIBED IN EXHIBIT"A," A COPY OF WHICH IS ATTACHED TO THIS RESOLUTION AND INCORPORATED BY REFERENCE HEREIN; PROVIDING FOR CONFLICTS; FURTHER,PROVIDING FOR AN EFFECTIVE DATE. (Community Development) City Attorney Boutsis read the title of Resolution #2022-096 and advised this item was a quasi- judicial hearing and swore-in those who would speak. Corinne Lajoie, Assistant Director of Community Development, gave a presentation on the site plan request for Masri Estates. Mayor James opened the Public Hearing. Donna Eades, 4711 SW 15 Terrace, distributed handouts to the Commission (attached to and incorporated into these minutes) and spoke about her concerns with run-off water impacting her neighborhood. Dincer Ozaydin, Deputy Director of Public Services, explained staff visited the site, and the issue is that some of the swales are paved, and water cannot go anywhere. The crown of the road is the highest level and the sideways are supposed to be less elevation. On SW 25th Terrace, one of the areas at the crown of the road is equal to the side of the roadway, so the water cannot percolate through. To fix the issue, we have to re-grade the roadway and restore the swale. That is going to solve the problems on that street when it comes to drainage. At the back of the Minutes of Hybrid Regular Meeting 6 Dania Beach City Commission Tuesday,June 14,2022—7:00 p.m. properties, FEMA requires us to have the new buildings built higher than the regular grade. It is two private properties, and we cannot install drainage between them, but we may be able to ask the contractor to add some pipes or some type of solution for the existing residents. Mayor James noted she would like to ask the developers if they would be willing to do that on the back end. Maday Gutierrez, Saltz Michelson Architects, Project Manager, said she is willing to help the neighbors. They are having to raise the site because of FEMA requirements, however all the water is supposed to stay within each private lot and each property is graded for that. The new road is also being provided with a drainage system. There should not be any runoff to the neighbors. The design will contain all the storm water to the area. Mayor James asked Ms. Gutierrez if she was going to work with Public Services Deputy Director Ozaydin and assist the neighbors. Ms. Gutierrez responded yes, they will absolutely work with the neighbors and help with their current drainage problem. Mayor James asked Ms. Eades if this would satisfy the neighbors. Ms. Eades said it would be wonderful if they could work together to get a resolution. Mayor James asked Community Development Assistant Director Lajoie if we could add this as a condition of approval. Community Development Assistant Director Lajoie responded yes and asked if we are clear with what that language should be. Public Services Deputy Director Ozaydin said the good intention is to keep the rainwater on their side but also help the resident on their side. Helping the resident may mean keeping two feet of swale on their side. Ms. Gutierrez noted the owner does have an attorney who can help draft this document and they can submit it to the City for review. City Attorney Boutsis explained the additional condition would be the developer will help the adjacent resident by providing either two feet of swale adjacent to their property for runoff or some sort of French drain as approved by Public Services. At the back of the Minutes of Hybrid Regular Meeting 6 Dania Beach City Commission Tuesday,June 14,2022—7:00 p.m. Community Development Assistant Director Lajoie addressed the gate and construction times as set forth in City ordinances, as well as dust and noise. Ms. Gutierrez addressed the traffic study performed and noted the road can handle the additional traffic. Ms. La Roc said she is concerned about drainage on SW 46th Court. Public Services Deputy Director Ozaydin responded when she has drainage issues, he will come and look at it as he was not aware of any issues. The new developer is going to keep the rainwater and it should not be affecting us negatively or positively. Commissioner Lewellen asked what the distance is between each property. Ms. Gutierrez said in the front they are right at the 25-foot setback but on the sides, they have a little bit of wiggle room. In the back, they are also right at the 25-foot setback. There will be a sidewalk along the new right-of-way. Commissioner Lewellen asked if there would be an HOA. Ms. Gutierrez noted so far,there are no plans for an HOA. Seeing as there was no one else to speak in favor or opposition, Mayor James closed the Public Hearing. Vice-Mayor Salvino motioned to adopt Resolution #2022-096, as amended with an additional condition of approval; seconded by Commissioner Lewellen. The motion carried unanimously. 10. Discussion and Possible Action There were no items on this agenda. 11. Commission Comments 11.1 Commissioner Davis Commissioner Davis said our red alert service was excellent with the recent storm; our BEAM Team was exceptional. She attended the Lighthouse for Students summer event, and it was a wonderful community turnout. She also attended the PEA Annual Luncheon and reiterated how important sponsorship is for the City; she believes in investment. Lastly, she thanked the Community Development team for the first Public Art Advisory Board meeting which was very successful. At the back of the Minutes of Hybrid Regular Meeting 6 Dania Beach City Commission Tuesday,June 14,2022—7:00 p.m. 11.2 Commissioner Lewellen Commissioner Lewellen spoke about drainage issues related to the storm and residents' complaints. We need to make sure people understand, when you get that much rain, even with improvements,there will still be flooding. She also spoke about the PEA luncheon and noted the Disney terminal that will be opening in 2023; this will be an excellent opportunity for us as a City to be involved in. She noted the Regal Cinema is now open and is a great addition to the City. It is the only theater in South Florida that has 4DX and she encouraged everyone to check it out. 11.3 Commissioner Odman Commissioner Odman had no comments. 11.4 Vice-Mayor Salvino Vice-Mayor Salvino had no comments. 11.5 Mayor James Mayor James said the amount of flooding that occurred at Dania Pointe is concerning and she asked that we look at what they have there. She spoke of the Juneteenth celebration to be held on June 20th and thanked Parks & Recreation for all their support and invited everyone to the event. 12. Appointments 12.1 General Employees Pension Board The Commission appointed James Rizzo for a term beginning June 22, 2022 and ending June 22, 2024. 12.2 Parks, Recreation and Community Affairs Advisory Board Discussion ensued regarding the reduction in membership on the board from ten members to five with adoption of a resolution earlier in the meeting and the automatic removal of five members for non-attendance over the previous two months, leaving five remaining members, but leaving Commissioner Davis with no appointee to the board and Mayor James with two appointees. Mayor James and Commissioner Davis agreed that Commissioner Davis would take over Deborah Bell, one of Mayor James' two appointees, as Commissioner Davis' appointment to the board. Vice-Mayor Salvino motioned to approve the appointments; seconded by Commissioner Lewellen. The motion carried unanimously. Administrative Reports 13.1 City Manager City Manager Garcia said she will be reaching out to the general manager at Dania Pointe regarding the storm drainage. She thanked Deputy City Manager Candido Sosa-Cruz and the BEAM team for their efforts with the storm. They have discussed adding additional pumps. She also thanked Commissioner Odman for bringing forward their conversation about City merchandise and working with her to get it done. She sees the progress we have had with the West Wing, lobby and Commission Chamber and is excited that the ADA component has been addressed. City Manager Garcia noted she put together a Sister Cities Committee with Miami Beach. She is excited to work with Chief of Staff Singh, the CRA Director, and Deputy City Manager Sosa- Cruz to put together something that can be a win-win for tourism, and impactful with shared cultures. City Manager Garcia reported there has been a lot of progress regarding the projects for Public Services. She spent some time with Parks and Recreation Director Brown today. We have a full grant for Mullikin Park. We will start breaking ground at Tootie Adler Park on the beach and we are looking to break ground at C.W. Thomas Park by the end of the year as well. The lifeguard summer camp is remarkable as well as the other camps that we have. City Manager Garcia said she and the Mayor have discussed the future of the plaza outside of City Hall as we move into an Arts and Entertainment District and begin to do new things beyond Dania After Dark and stimulate what the corridor on NW/SW 1st can be. She met with Commissioner Lewellen to discuss a water component and she is excited to bring something forward. City Manager Garcia noted she met earlier today with Vice-Mayor Salvino, and they are working closely with Commissioner Ryan and the City of Hollywood for an annexation, so that we can move forward with the parking garage. 13.2 City Attorney Addendum Report on retired firefighters insurance discussion This item was taken up immediately after the Moment of Silence and Pledge of Allegiance. City Attorney Boutsis asked that the Commission schedule an executive session on June 28, 2022 prior to the Commission meeting to discuss the Navarro litigation case. The lifeguard summer camp is remarkable as well as the other camps that we have. City Manager Garcia said she and the Mayor have discussed the future of the plaza outside of City Hall as we move into an Arts and Entertainment District and begin to do new things beyond Dania After Dark and stimulate what the corridor on NW/SW 1st can be. She met with Commissioner Lewellen to discuss a water component and she is excited to bring something forward. City Manager Garcia noted she met earlier today with Vice-Mayor Salvino, and they are working closely with Commissioner Ryan and the City of Hollywood for an annexation, so that we can move forward with the parking garage. 13.2 City Attorney Addendum Report on retired firefighters insurance discussion This item was taken up immediately after the Moment of Silence and Pledge of Allegiance. City Attorney Boutsis asked that the Commission schedule an executive session on June 28, 2022 prior to the Commission meeting to discuss the Navarro litigation case. On SW 25th Terrace, one of the areas at the crown of the road is equal to the side of the roadway, so the water cannot percolate through. To fix the issue, we have to re-grade the roadway and restore the swale. That is going to solve the problems on that street when it comes to drainage.
