A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF DANIA
BEACH, FLORIDA, AUTHORIZING THE PROPER CITY OFFICIALS TO
EXECUTE THE FIRST AMENDMENT TO THE INTERLOCAL
AGREEMENT (ILA) WITH BROWARD COUNTY FOR SURTAX-FUNDED
MUNICIPAL TRANSPORTATION PROJECTS, INCLUDING THE
SOUTHWEST 43an TERRACE DRAINAGE IMPROVEMENT PROJECT TO
BE IMPLEMENTED BY THE CITY AND FUNDED WITH
TRANSPORTATION SURTAX FUNDS, IN THE AMOUNT OF TWO
MILLION SEVENTY-SIX THOUSAND EIGHT HUNDRED SEVENTY-FIVE
DOLLARS AND FIFTY CENTS ($2,076,875.50); PROVIDING FOR
CONFLICTS; FURTHER, PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, in November 2018, Broward County voters approved a 30-year sales surtax
(also known as "Penny for Transportation") to fund statutorily-permissible transportation
expenditures; and
WHEREAS, on January 26, 2021, the City Commission approved Resolution No. 2021-
012, entering into the Second Amended and Restated Interlocal Agreement Relating to
Transportation Surtax Funds (ILA). The ILA describes the necessary process for entering into a
project funding agreement with Broward County for this transportation penny tax-funded
project; and
WHEREAS, on May 24, 2022, the City Commission approved Resolution No, 2022-
076, authorizing the City to enter into an ILA with Broward County for the Surtax-funded
municipal transportation project, known as the SW 43rd Terrace Drainage Improvement Project,
to be implemented by the City and funded with Transportation Surtax funds in the amount of
$1,568,625.00; and
WHEREAS, Broward County increased Transportation Surtax funds by $508,250.50 for
the SW 43rd Terrace Drainage Improvement Project (DANI-019) to reflect the project cost
increases,thereby requiring an amendment to the ILA;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE
CITY OF DANIA BEACH, FLORIDA:
Section 1. That the proper City officials are authorized to accept and execute the first
amendment to the ILA with Broward County on behalf of the City in the amount of
$2,076,875.50, to fund the SW 43rd Terrace Drainage Improvement Project.
Section 2. That all resolutions or parts of resolutions in conflict with this Resolution
are repealed to the extent of such conflict.
Section 3. That this Resolution shall be in force and take effect immediately upon its
passage and adoption.
