HomeMy WebLinkAboutR-2022-136 Bahia Development LLC (Cold Storage) Site Plan (SP-014-21), Variances (VA-15-21, VA-35-21, VA-37-21) and Design Exception (OT-36-21) RESOLUTION NO. 2022-136 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA, APPROVING THE SITE PLAN(SP-14-21),VARIANCES (VA-15-21, VA-35-21, & VA-37-21), AND DESIGN EXCEPTION (OT-36-21) SUBMITTED BY BAHIA DEVELOPMENT LLC,FOR PROPERTY LOCATED AT 2401 SW 31ST STREET, DANIA BEACH, FLORIDA, FLORIDA, AS LEGALLY DESCRIBED IN EXHIBIT "A," A COPY OF WHICH IS ATTACHED TO THIS RESOLUTION; PROVIDING FOR CONDITIONS; PROVIDING FOR CONFLICTS; FURTHER, PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, Chapter 28, "Land Development Code" (the "LDC"), Part 6, entitled "Development Review Procedures and Requirements," Article 635, entitled "Site Plans" of the City Code of Ordinances (the "City Code") provides that Site Plan approval is required as a condition to the issuance of a building permit; and WHEREAS, Bahia Development LLC is requesting site plan approval to allow the construction of a cold storage building to be located on the north side of SW 31st Street and east of Anglers Avenue, at 2401 SW 31st Street, in the City of Dania Beach; and WHEREAS, the applicant is requesting variances for side setbacks (VA-15-21), parking in front (VA-35-21) and rear setbacks (VA-37- 21), and a Design Exception to have doors facing a street(OT-36-21) for the subject development; and WHEREAS,the City Commission conducted a duly noticed public hearing in accordance with Article 610 of the LDC; and WHEREAS, the City Commission finds that the approval of the Site Plan (SP-014-21), Variances (VA-15-21, VA-35-21, & VA-37-21), and Design Exception (OT-36-21) is consistent with the City's Land Development Code and the Future Land Use Element of the City's Comprehensive Plan; and NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA: Section 1. That the foregoing "WHEREAS" clauses are ratified and confirmed as being true and correct, and they are made a part of and incorporated into this Resolution by this reference. Section 2. That the Site Plan(SP-14-21), Variances (VA-15-21, VA-35-21 & VA-37- 21), and Design Exception (OT-36-21) are approved, consistent with the site plan provided on record, with the following conditions which must be complied with or resolved prior to issuance of a building permit,unless a different deadline is provided in the condition(references to Sections are to those in the LDC): 1. STAGING: For all projects resulting in buildout of the site, such that construction staging cannot occur on site, must obtain Staging Plan approval by the Community Development Director prior to issuance of a building permit. The Staging Plan must include, but is not limited to, location of equipment and material during construction. (Planning & Zoning) 2. MAINTENANCE OF TRAFFIC: For all projects resulting in buildout of the site, such that construction staging cannot occur on site,the applicant must obtain Maintenance of Traffic Plan approval by the City Engineer for period of construction prior to issuance of a building permit. (Planning &Zoning) 3. Per 0-2017-027 & 0-2018-019. Commercial properties under construction are required to provide security to fencing with screening showing project rendering covering at least 75% of the length of the fence along an arterial or state right-of-way & 25% for local roads and must include name and intended use of the project, project rendering, project land an emergency contact telephone number of the general contractor. (Planning & Zoning) 4. PUBLIC ART PROGRAM: Pay one-half of one percent(0.5%)of the cost of the proposed development project,as an"in-lieu"public art fee,with a minimum payment of$5,000 and a maximum payment of $250,000, prior to approval of building permit. (Planning & Zoning) 5. Any cost recovery account balances must be satisfied with the Community Development Department prior to approval of any Building Permit. (Planning& Zoning) 6. Any road cuts for utilities, curb cuts and/or others with the City ROW shall be restored to full lane width for 50' minimum length centered on the proposed cut. (Engineering) 7. Additional comments may apply and will need to be addressed prior to Building Permit approval. (Engineering) 8. Provide Maintenance of Traffic (MOT) Plan by a licensed General Contractor / Professional Engineer in the State of Florida(If applicable). (Engineering) 9. In accordance with City Code of Ordinances in Article 415. SIDEWALKS AND SWALES, Owner is responsible for the construction of sidewalks/swales within the road ROW when buildings are constructed or substantially improved. (Engineering) 2 RESOLUTION#2022-136 10. Provide ADA parking, access / driveway, and sidewalks /ramps including dimensions in accordance with Chapter 553 of the Florida Statutes. "Accessibility of Handicapped Persons" and latest edition of "Accessibility Requirements Manual" by Department of Community Affairs, Florida Board Building Codes and Standards,and'in accordance with Americans with Disability Act(ADA). (Engineering) 11. Provide drawing file (dwg or dgn) disk of the approved site plan in Florida State Plane Coordinate (NAD 83). This should be addressed as part of the final submittal. (Engineering) 12. Provide regulatory agencies' approval documentation and Permits/Licenses(as applicable) as part of the final submittal, prior to issuance of the Building Permit (Broward County Surface Water License, Broward County Wastewater Permit, Florida Department of Environmental Protection, FDOT, BC Environmental, BC Aviation, BCTED etc.). Also, include Utility / Right of Way Permits from City, Broward County, and State Roads as applicable. (Engineering) 13. Applicant shall submit a signed and sealed Boundary and Topographical Survey. (Engineering). 14. Applicant shall provide the letter from FPL indicating confirmation that the proposed utilities may be locating in the existing FPL easement. (Engineering) 15. Applicant to indicate on the Storm Pipe Table on Sheet C-4.0 which storm pipes are perforated for the proposed exfiltration trench. (Engineering) 16. Detail indicating perimeter wall must be provided during building permitting. (Engineering) 17. Runoff from the site into the right-of-way is prohibited. (Engineering) 18. It is recommended that the designer reviews Section C-C. A 3-foot grassed strip adjacent to the proposed retaining wall may be necessary so that the runoff does not undermine the wall. (Engineering) 19. The Site Plan approval shall be concurrent with variances approval. (Engineering) 20. Water and sewer availability letters are required from the utility providers. (Engineering) 21. All landscape buffering for this project should be in accordance with Section 275-120 (perimeter buffers for commercial/industrial). (Landscaping) Section 3. That such application must be reviewed by Broward County Aviation Department. (Engineering) 2 RESOLUTION#2022-136 Section 4. That Pursuant to Section 635.100 "Expiration of Site Plans" of the Land Development Code,the Site Plan(SP-14-21),Variances(VA-12-21,VA-35-21 &VA-37-21),and Design Exception (OT-36-21) approvals shall automatically expire and become null and void unless the Applicant files a complete building permit application with construction drawings for the improvements shown on the Site Plan, within eighteen (18) months from the date of this Resolution. Section 5. That the issuance of a development permit by a municipality does not in any way create any right on the part of an Applicant to obtain a permit from a state or federal agency, and does not create any liability on the part of the municipality for issuance of the permit if the Applicant fails to obtain requisite approvals or does not fulfill the obligations imposed by a state or federal agency, or undertakes actions that result in a violation of state or federal law. Section 6. That all resolutions or parts of resolutions in conflict with this Resolution are repealed to the extent of such conflict. Section 7. That this Resolution shall be in force and take effect immediately upon its passage and adoption. PASSED AND ADOPTED on August 23, 2022.
