HomeMy WebLinkAboutR-2022-145 Amending Irrigation Meter Rates as Authorized by Ch. 27, Sec. 27-5 RESOLUTION NO. 2022-145 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA, AUTHORIZING THE AMENDMENT OF WATER RATES PURSUANT TO SECTION 27-5 OF CHAPTER 27 OF THE CODE OF ORDINANCES ENTITLED "COMMENCEMENT OF CHARGES" TO UPDATE THE COMMERCIAL / SPRINKLERS / LAUNDROMATS COMPONENT OF THE RATE STRUCTURE; PROVIDING FOR CONFLICTS; FURTHER, PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the City successfully submitted an application for a required Water Use Permit (Permit) from the South Florida Water Management District (SFWMD) and was granted said permit in May 2022; and WHEREAS, the five-year process to obtain the Permit required that the City demonstrate that sufficient water supply will be available to meet demand over the coming two decades; and WHEREAS, the permit application's analysis presented to the SFWMD took into account the City's historically low overall water use, which is in large part driven by the limited use of water for landscape irrigation purposes; and WHEREAS, to address the future requests for water meters specifically designated for irrigation, the Public Services Department worked in conjunction with the Finance Department and the consultant that prepared the Permit application; and WHEREAS, based on the above work, PSD recently presented proposed rates for irrigation meters, adjusting them upwards and considering the City's current water supply sources, demand, and the specifics of the Permit granted by the SFWMD; and WHEREAS, the City Administration was directed to proceed with amendment of water meter rates pursuant to Resolution, as authorized by Section 27-5 of the City's Code of Ordinances; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF DANIA BEACH,FLORIDA: Section 1. That the foregoing "Whereas" clauses are ratified and confirmed to be true and correct, and they are made a part of and are incorporated into this Resolution by this reference. Section 2. That the proper City officials are authorized to approve the amendment to the water rates, as authorized pursuant to Section 27-5 entitled "Commencement of Charges", as specified in Exhibit"A", which is attached to and incorporated by reference into this Resolution. Section 3. That all resolutions or parts of resolutions in conflict with this Resolution are repealed to the extent of such conflict. Section 4. That this Resolution shall take effect immediately upon its passage and adoption. PASSED AND ADOPTED on September 14, 2022.
