MINUTES OF HYBRID REGULAR MEETING DANIA BEACH CITY COMMISSION TUESDAY, AUGUST 23, 2022 - 7:00 P.M. 1. Call to Order/Roll Call Mayor James called the meeting to order at 7:03 p.m. Present: Mayor: Tamara James Vice-Mayor: Marco A. Salvino, Sr. Commissioners: Joyce L. Davis Lori Lewellen Lauren Odman City Manager: Ana M. Garcia, ICMA-CM City Attorney: Eve Boutsis City Clerk: Thomas Schneider 2. Moment of Silence and Pledge of Allegiance Mayor James called for a moment of silence followed by the Pledge of Allegiance to the United States Flag. 3. Presentations and Special Event Approvals 3.1 Update on City's Investment Portfolio by Public Trust Advisors Frank DiPaolo, Chief Financial Officer, gave a brief introduction and introduced John F. Grady, Managing Director, Public Trust Advisors. Mr. Grady gave a PowerPoint presentation which is attached to and incorporated into these minutes. 3.2 Presentation by Alexis Guillen, Green Advisory Board member, on recycling contamination by vacation rental properties -requested by Mayor James Mr. Guillen gave a PowerPoint presentation which is attached to and incorporated into these minutes. Mayor James felt with short-term rentals, we should take the recycling bin away and provide another garbage bin. The Commission agreed the Green Advisory Board should meet with the City Manager and City Attorney to go through the recommendations and work on a solution to the problem. 3.3 Certificate of Commendation by Candido Sosa-Cruz, Deputy City Manager City Manager Garcia presented a Certificate of Commendation to Beach Ranger Alexandra Anaya for service above and beyond the call of duty in response to an intoxicated driver at the beach. 4. Proclamations 4.1 Suicide Prevention Awareness Month- Mayor James Mayor James read the Suicide Prevention Awareness Month proclamation and presented it to Julie Morrall, League of Women Voters of Broward County Gun Safety Committee member. Ms. Morrall thanked the Commission for the proclamation. 5. Citizen Comments David Kaplan, 111 SE 3rd #106, Dania Beach, FL 33004, spoke about recycling contamination and suggested stickers be used to distinguish between trash and recycling bins. He also spoke about traffic by the high-rise and along Stirling Road near Taco Bell. Mayor James asked about the lane closure near Taco Bell that has no signage. City Manager Garcia noted this is not a City project and she would consult with Public Services to determine why the lane has not been re-opened. 6. Public Safety Reports Captain Daniel Marks, BSO Chief of Police, spoke about the plan to add additional deputies to our district for the issues of homeless outreach, quality of life issues and a dedicated fraud detective for Dania Pointe. He spoke about the use of the LPR trailers and said they have LETF funds available that they plan to use to purchase 3-4 more LPR trailers. He reviewed the recent recipients of Deputy of the Month. He read the Florida Line of Duty Death in reference to Miami Dade Police Officer Cesar Echaverry and addressed the circumstances surrounding his death. Captain Sergio Pellecer, BSO District Fire Chief, gave an update on departmental activities including call volumes and types in July, property inspections, and completion of CFAI Minutes of Hybrid Regular Meeting 2 Dania Beach City Commission Tuesday,August 23,2022—7:00 p.m. accreditation. He noted the City Beam Team and Human Resources asked for his assistance to commemorate September 11th and said the event may need to be scheduled for September 12th due to the scheduling of various participants. After a brief discussion, Captain Pellecer noted he would see to it that the commemoration occurs on September 11cn 7. (Public Services) City Attorney Boutsis read the title of Resolution#2022-116. Mayor James asked if this was an increase from last year. Fernando Rodriguez, Director of Public Services, said yes, it is. We are going to almost double the number of lights wrapped around the poles and we are adding four medians with lit decorations. There will be six-feet high structures in the medians on Griffin Road. Mayor James asked how far west this goes. Public Services Director Rodriguez responded this will go to about 31 St or 32nd Avenue. Mayor James asked what the plan is to get us completely out west. She said she loves the idea of decorations in medians, but she does not want to concentrate on one area and not decorate out west. Public Services Director Rodriguez explained we will have decorations in 14 locations across different medians in all the major thoroughfares. We are starting at Griffin only because of the Directional Boring Permit that we got through FDOT but there is really no preference, we are going to go all over the City and do 14 different medians. Mayor James asked if we did not have decorations on Griffin Road at all last year. Public Services Director Rodriguez said no medians had decorations, only the poles. Mayor James asked if we are getting better decorations for the poles. Public Services Director Rodriguez noted we will have much nicer LED lights like in Aventura; they will be very bright white lights. Mayor James said she wanted to make sure we are including the entire City as we often hear the west side is forgotten about. Vice-Mayor Salvino motioned to adopt Resolution #2022-116; seconded by Commissioner Odman. (Public Services) City Attorney Boutsis read the title of Resolution#2022-117. Mayor James asked if this amount was coming out of Commission contingency. City Manager Garcia responded it would be coming from the contingency fund for this project. Commissioner Lewellen motioned to adopt Resolution #2022-117; seconded by Commissioner Odman. The motion carried unanimously. 7.17 RESOLUTION#2022-128 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA, AUTHORIZING A NEW NEIGHBORHOOD SIGN FOR THE CORNER OF GRIFFIN ROAD AND SOUTHWEST 24TH AVENUE, CONFORMING TO THE CITY'S ADOPTED DESIGN REQUIREMENTS; PROVIDING FOR CONFLICTS; FURTHER, PROVIDING FOR AN EFFECTIVE DATE. (Community Development) City Attorney Boutsis read the title of Resolution#2022-128. Mayor James noted she had received emails regarding this item and asked for an explanation so that the neighborhood would be informed. Eleanor Norena, Director of Community Development, addressed the item. Vice-Mayor Salvino motioned to adopt Resolution #2022-128; seconded by Commissioner Lewellen. The motion carried unanimously. 8. Commissioner Odman asked about cigars. City Attorney Boutsis said it must be an unfiltered cigar. If it has a filter, it is prohibited, and all vaping devices are prohibited. Commissioner Davis asked for clarification of the 25-foot provision. City Attorney Boutsis explained it is 25 feet away from the entrance or exit of a business establishment. At the park or beach, the only place you can smoke is in your parking space, in your car with the window down if you want. Vice-Mayor Salvino said it would be a tough law to enforce and asked if there would be any designated smoking areas. City Attorney Boutsis noted we have not proposed that. We would have to create it. Vice-Mayor Salvino suggested staff come back to a future meeting about designated smoking areas. City Manager Garcia asked if this suggestion is just for the beach. She added the Commission could move forward with those or choose their own. Commissioner Lewellen noted there was a memorial tree planting for her mother at Dania Cove Park and thanked Public Services and Parks. She reminded everyone that we have a memorial tree program, and our team makes it very special. Commissioner Lewellen said she receives emails from residents and businesses about issues that are coming up, and she knows she is annoying staff; she thanks the whole team who helps quickly and mostly to the satisfaction of the people making the requests. 11.3 Commissioner Odman Commissioner Odman had no comments. 11.4 Vice-Mayor Salvino Vice-Mayor Salvino spoke of going to St. Thomas Virgin Islands. Administrative Reports 13.1 City Manager City Manager Garcia noted the Commission will be provided a monthly report of pending cases in Code and what is coming forward in the Special Magistrate hearings. The Community Development Block Grant was approved for solar lighting, and we are moving forward with this project. It is aligned with our city-wide lighting master plan that was adopted in 2020. It will be a brighter, more beautiful City. The $1 million investment of our pier is on schedule. By mid-September, all the southside railings will be completed. The southside that is currently closed for safety purposes will be re- opened. We are working with the contractor to mitigate the inconvenience to our pier visitors while ensuring the maximum safety. The clearing of the former Dania Beach Grill has been completed and we have an official date of September 13, 2022, at 6:30 p.m. for the groundbreaking event at our beach campus. The Budget Workshop is scheduled for August 30, 2022, at 4:00 p.m. City Manager Garcia noted we are planning an historic groundbreaking at CW Thomas Park on October 12, 2022, and she asked the Commission to agree on a time. The Commission agreed to hold the CW Thomas Park groundbreaking on Wednesday, October 12, 2022, at 5:30 p.m. City Manager Garcia reported the Mayor's State of the City address is on October 13, 2022, beginning with a 5:00 p.m. reception followed by the 6:00 p.m. commencement of the program. We are working with our Vice Mayor and our picnic committee to ensure the success of this endeavor. We are working with Commissioner Davis and another committee for a December hosting of another League of City's event. Mayor James requested money from her contingency funds for $790 for summer camp for kids that did not have funding, $500 for an ad sponsorship for Hollywood Hills Class of 1972 50th Celebration, and for permission to give a Key to the City to Evelyn Williams who turned 107 on August 2nd The Commission had no issues with any of Mayor James' requests. Vice-Mayor Salvino said we started talking about bringing in other deputies; we get called to the same place a lot and he asked about a nuisance abatement. If they cannot control their tenants, we need to have some sort of an ordinance to start giving them a bill. City Manager Garcia noted we started to send the General Manager of Dania Pointe the calls for service log. She wants to work with City Attorney Boutsis to have them either sponsor police officers or work with the City to ensure that we are not taking boots off the ground in our City to go constantly to the same places. We recommend they do what BrandsMart does; several businesses contract with us or have their own security. She thinks it is the responsibility of those businesses to invest in the security of their property. She and City Attorney Boutsis will be discussing it with them personally. Vice-Mayor Salvino asked if City Manager Garcia received the invitation to go to the AFL-CIO at the Diplomat for the Broward County Labor Ball and whether the City would like to pay for some of them to go to represent the City. City Manager Garcia said the Commission,paying from their contingency, can go to any of these things they are invited to as part of their duties, as long as they all agree. Vice-Mayor Salvino noted it is September 3rd and asked for permission that if anyone would like to go, he will get with them later, and asked about any City staff or City management that may want to go to represent the City as well.
