Home My WebLink AboutR-2022-154 BSO First Amendment to Agreement (10-1-20) for Police Services (8 Additional Deputies) RESOLUTION NO. 2022-154 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA, AUTHORIZING THE FIRST AMENDMENT TO THE AGREEMENT BETWEEN THE CITY OF DANIA BEACH, FLORIDA, AND THE BROWARD COUNTY SHERIFF'S OFFICE FOR POLICE SERVICES DATED OCTOBER 1, 2020; AUTHORIZING THE PROPER CITY OFFICIALS TO EXECUTE THE FIRST AMENDMENT TO THE AGREEMENT FOR SUCH SERVICES; PROVIDING FOR CONFLICTS; FURTHER, PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the City and Broward Sheriff's Office (BSO) executed an Agreement for five (5)years, beginning October 1, 2020 through September 30, 2025; and WHEREAS, the City and BSO desire to adjust the staffing structure by adding eight Deputy Sheriff positions, with four (4) starting on October 1, 2022 and four (4) starting on April 1, 2023 at a cost of One Million One Hundred Fourteen Thousand Eight Hundred Twenty Dollars ($1,114,820.00) in FY2022-23; NOW, THEREFORE,BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA; Section 1. That the above "Whereas" clauses are ratified, made a part of and incorporated into this Resolution by this reference. Section 2. That the proper City officials are authorized to execute the First Amendment to the Agreement between the City of Dania Beach, Florida, and BSO for Police Services, which Amendment will adjust the staffing structure and is deemed necessary and in the best interests of the City. A copy of the Amendment is attached as Exhibit "A" and made a part of and incorporated into this Resolution by this reference. Section 3. That the City Manager and City Attorney are authorized to make minor revisions to the First Amendment to the Agreement. Section 4. That the cost for the additional positions has been appropriated in the Fiscal Year 2022-23 budget to Account No. 001-21-01-521-31-10 in the amount of One Million One Hundred Fourteen Thousand Eight Hundred Twenty Dollars ($1,114,820.00). Section 5. That all resolutions or parts of resolutions in conflict with this Resolution are repealed to the extent of such conflict. Section 6. That this Resolution shall be in force and take immediately upon its passage and adoption. PASSED AND ADOPTED on September 27, 2022. B G UTSIS CI ATTORNEY 2 RESOLUTION#2022-154 FIRST AMENDMENT TO AGREEMENT FOR POLICE SERVICES This First Amendment is entered into this day of , 2022 by and between the Gregory Tony, as Sheriff of Broward County (hereinafter referred to as "BSO") and the City of Dania Beach (hereinafter referred to as the "CITY"). WHEREAS, on or about October 1, 2020, BSO and the CITY entered into an Agreement for Police Services; and WHEREAS, CITY and BSO are now desirous of adjusting the staffing structure by adding eight deputy sheriff positions, and NOW, THEREFORE, in consideration of the mutual terms and conditions contained herein, the parties agree as follows: 1. The foregoing recitations are true and correct and are incorporated by reference. 2. The staffing structure in the City is amended to add four (4) Deputy Sheriff positions effective October 1, 2022, and four (4) Deputy Sheriff positions effective April 1, 2023, as reflected on the Revised Exhibit A, attached hereto and incorporated within. The annual consideration will be increased to reflect the new positions, including salary, benefits, vehicles and equipment. The annual cost for the new positions will be prorated and be effective when the positions are filled. 3. Except as modified herein, all remaining items and conditions of the Agreement, shall remain in full force and effect. 3 RESOLUTION#2022-154 the staffing structure and is deemed necessary and in the best interests of the City.
