HomeMy WebLinkAboutO-2022-031 Authorize Expenditure of Funds Exceeding $1M for Rehabilitation of Lift Stations 1, 2 and 3 Project (ITB 22-026) ORDINANCE NO. 2022-031 AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA, AUTHORIZING THE EXPENDITURE OF CITY FUNDS EXCEEDING ONE MILLION DOLLARS ($1,000,000.00), WHICH EXPENDITURE IS NOT TO EXCEED THE PROJECT ESTIMATE OF FOUR MILLION EIGHT HUNDRED TWENTY ONE THOUSAND FIVE HUNDRED TWENTY DOLLARS ($4,821,520.00) APPROVED BY THE CITY COMMISSION, TO FUND THE REHABILITATION OF LIFT STATIONS 1, 2 AND 3 PROJECT; PROVIDING FOR SEVERABILITY; PROVIDING FOR CONFLICTS; FURTHER, PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, pursuant to Section 2, "Certain Expenditures" of Article 3, "Powers of the City", of the City Code of Ordinances, the City Commission must, by ordinance approve any expenditures of City funds that exceed One Million Dollars ($1,000,000.00) after two (2) advertised public hearings of the ordinance; and WHEREAS, the responses to the City-issued Invitation to Bid ("ITB") No. 22-026 for the "Rehabilitation of Lift Stations 1, 2 and 3 Project exceeds the monetary threshold of $1,000,000.00; and WHEREAS, the project expenditure shall not exceed the lowest bid amounts of Four Million Eight Hundred Twenty-One Thousand Five Hundred Twenty Dollars ($4,821,520.00) for the Rehabilitation of Lift Stations 1, 2 and 3; NOW, THEREFORE,BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF DANIA BEACH,FLORIDA: Section 1. That the proper City officials are authorized to expend more than One Million Dollars ($1,000,000.00) per project in connection with the Rehabilitation of Lift Stations 1, 2 and 3 Project. Section 2. That the Hazardous Mitigation Grant Program funds will be appropriated to account number 402-35-28-535-63-10 in the amount of$3,710,385.00, 25% of which is in the form of a City matching contribution, although this match will likely be waived through the FEMA Global Match Program. In addition, the balance required on the amount of $1,111,135.00 will come from the City's American Rescue Act funds. Section 3. That if any section, clause, sentence, or phrase of this Ordinance is for any reason held invalid or unconstitutional by a court of competent jurisdiction, the holding shall not affect the validity of the remaining portions of this Ordinance. Section 4. That all Ordinances or parts of Ordinances in conflict with the provisions of this Ordinance are repealed. Section 5. That this Ordinance shall take effect immediately at the time of its passage and adoption. PASSED on first reading on October 11, 2022. PASSED AND ADOPTED on second reading on October 25, 2022.
