Bid Award for Rehabilitation of Lift Stations 1, 2 and 3 (ITB 22-026) and Retroactive Ratification of Issuance of Bid RESOLUTION NO. 2022-164 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA, RETROACTIVELY RATIFYING THE PUBLIC SERVICES DEPARTMENT'S ISSUANCE OF AN INVITATION TO BID (ITB) FOR THE REHABILITATION OF LIFT STATIONS 1, 2 AND 3 PROJECT; AUTHORIZING THE AWARD OF INVITATION TO BID ("ITB") NO. 22-026, ENTITLED "REHABILITATION OF LIFT STATIONS 1, 2 AND 3" TO SOUTHERN UNDERGROUND INDUSTRIES, INC, IN AN AMOUNT NOT TO EXCEED FOUR MILLION EIGHT HUNDRED TWENTY-ONE THOUSAND FIVE HUNDRED TWENTY DOLLARS ($4,821,520.00); PROVIDING FOR CONFLICTS; FURTHER, PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the City entered into an agreement with the Florida Division of Emergency Management pursuant to Resolution No. 2020-015, to fully refurbish sewer lift stations and add emergency generators to make the sanitary sewer system more resilient; and WHEREAS, the Public Services Department ("PSD") engaged Kimley Horn and Associates to design, prepare construction documents, obtain permits and provide post-design services for this project; and WHEREAS, on August 1, 2022,the City issued Invitation to Bid ("ITB")No. 22-026 for the"Rehabilitation of Lift Stations 1, 2 and 3 Project"; and WHEREAS,the PSD retroactively requests ratification from the City Commission of the Department's ITB No. 2022-026, for the rehabilitation of Lift Stations 1, 2 and 3 Project as the Department inadvertently neglected to ask the City Commission for prior approval to bid and to restart the bidding process would delay the project by approximately six months; and WHEREAS, on August 31, 2022, the City received two responses to ITB No. 2022-026, as shown below: 1. Southern Underground Industries, Inc $4,821,520.00 2. TLC Diversified, Inc. $15,380,950.00; and WHEREAS, the Bid Committee's assessment of the bid packages provided by the respondents, reviewed by the consultant project engineer, resulted in the selection of Southern Underground Industries, Inc as the lowest and most qualified. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF DANIA BEACH,FLORIDA: Section 1. That the above "Whereas" clauses are ratified and confirmed, and they are made a part of and incorporated into this Resolution by this reference. Section 2. That the City Commission retroactively ratifies the Public Services Department's issuance of ITB NO. 2022-026 for the rehabilitation of Lift Stations 1, 2 and 3 Project. Section 3. That the City Commission authorizes the proper City officials to execute an agreement with Southern Underground Industries, Inc for the Rehabilitation of Lift Stations 1, 2 and 3 Project in an amount not to exceed Four Million Eight Hundred Twenty-One Thousand Five Hundred Twenty Dollars ($4,821,520.00). Section 4. That Hazard Mitigation Grant Program funds will be appropriated to Hazardous Mitigation Lift Stations Infrastructure other than Buildings Account No. 402-35-28- 535-63-10 in the amount of$3,710,385.00, twenty five percent (25%) of which is in the form of a City matching contribution, although this match will likely be waived through the FEMA Global Match program. In addition, the balance required in the amount of$1,111,135.00 will come from the City's American Rescue Plan Act funds. Section 5. That all resolutions or parts of resolutions in conflict with this Resolution are repealed to the extent of such conflict. Section 6. That this Resolution shall become effective upon its passage and adoption. PASSED AND ADOPTED on October 25, 2022.
