A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF DANIA
BEACH, FLORIDA, AUTHORIZING THE CITY CLERK TO RECORD WITH
BROWARD COUNTY THE CITY'S OFFICIAL RIGHT-OF-WAY MAP
INDICATING ALL OF THE CITY-OWNED PUBLIC RIGHTS-OF-WAY,
WHICH MAP IS IDENTIFIED IN ATTACHED EXHIBIT "A" AND IS
INCORPORATED BY REFERENCE INTO THIS RESOLUTION; PROVIDING
FOR CONFLICTS; FURTHER, PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, the City has not officially ever adopted an official right-of-way map
indicating all the city-owned public rights-of-way; and
WHEREAS, the City has completed its due diligence and desires to adopt an official
right-of-way map, which reflects all the dedicated City roads for public transportation purposes
as provided for pursuant to Section 95.361, Florida Statutes; and
WHEREAS, Section 95.361(3), of the Florida Statutes provides that the "filing of a map
in the office of the clerk of the circuit court of the county where the road is located showing the
lands and reciting on it that the road has vested in the municipality is considered prima facie
evidence of City ownership of the listed rights-of-way"; and
WHEREAS, the filing of the City's right-of-way map would be considered prima facie
evidence of ownership and control of said identified rights-of-way; and
WHEREAS, the City Commission authorizes the Mayor to sign off on the filing of the
City's official right-of-way map, and for the City Clerk to file same with the Clerk of Courts for
Broward County;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE
CITY OF DANIA BEACH,FLORIDA:
Section 1. That the foregoing "WHEREAS" clauses are ratified and confirmed as
being true and correct, and they are made a part of and incorporated into this Resolution by this
reference.
Section 2. That the Mayor is authorized to sign-off on the filing of the City's official
right-of-way map, and for the City Clerk to file same with the Clerk of Courts for Broward
County, which map is attached to this Resolution, incorporated by reference, as Exhibit"A".
Section 3. That all resolutions or parts of resolutions in conflict with this Resolution
shall be repealed to the extent of such conflict.
Section 4. That this Resolution shall be in full force and become effective upon its
passage and adoption.
