R-2022-183 City Place Apartments, LTD. Donation and Dedication of SW 3rd Avenue ROW
RESOLUTION NO. 2022-183 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA, AUTHORIZING THE CITY TO ACCEPT THE DONATION OF A PARCEL OF LAND TO BE USED AS PART OF THE CITY'S RIGHT OF WAY, AT SOUTHWEST 3an AVENUE, WHICH PARCEL OF LAND IS IDENTIFIED IN ATTACHED EXHIBIT "A" AND IS INCORPORATED BY REFERENCE INTO THIS RESOLUTION; PROVIDING FOR CONFLICTS; FURTHER, PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the City of Dania Beach, Florida, is authorized to accept the donation of a parcel of land to the City; and WHEREAS,the property owner, City Place Apartments, Ltd., owns the property located at 75 Park Avenue West, Dania Beach, and is seeking to donate a portion of the land adjacent to SW 3rd Avenue (Park Avenue West),to be used for public right-of-way; and WHEREAS, the City Commission authorizes the City to accept title to the parcel of land; NOW, THEREFORE,BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF DANIA BEACH,FLORIDA: Section 1. That the foregoing "WHEREAS" clauses are ratified and confirmed as being true and correct, and they are made a part of and incorporated into this Resolution by this reference. Section 2. That the City Commission accepts the donation of the parcel of land, as identified in Exhibit"A"to be used as part of the City right-of-way. Section 3. That all resolutions or parts of resolutions in conflict with this Resolution shall be repealed to the extent of such conflict. Section 4. BO TSIS ITY TTORNEY 2 RESOLUTION#2022-183 LEGAL DESCRIPTION - Right-of-Way EXHIBIT "A" SHEET 1 OF 2 A parcel of land being a portion of Lot 10, Block 21, TOWN OF MODELO, according to the Plat thereof, as recorded in Plat Book B, Page 49, of the Public Records of Miami-Dade County, Florida, being more particularly described as follows: BEGIN at the northwest corner of said Lot 10, Block 21; thence along the North line of said Lot 10, Block 21, North 88°09'20" East, 2.07 feet; thence along a line 2.00 feet southeast of and parallel with the westerly line of said Lot 10, Block 21, South 12°40'24" West, 155.47 feet to the South line of said Lot 10, Block 21; thence along said South line, South 88°06'43" West, 2.07 feet to the southwest corner of said Lot 10, Block 21; thence along the aforesaid westerly line of Lot 10, Block 21, North 12°40'24" East, 155.47 feet to the Point of Beginning.
