Site Plan Modification (SP-078-21MOD), Design Variation (OT-080-22), and Lift Station Easement and Operating Agreement REVISED 12-13-22 RESOLUTION NO. 2022-189 REVISED 12/13/2022 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA, APPROVING THE REQUESTS SUBMITTED BY CITY PLACE APARTMENTS, LTD., THE PROPERTY OWNER, FOR A SITE PLAN MODIFICATION (SP-078-21MOD) AND DESIGN VARIATION (OT-080-22) FOR THE PROPERTY LOCATED AT 75 PARK AVENUE WEST, IN THE CITY OF DANIA BEACH, FLORIDA, AS LEGALLY DESCRIBED IN EXHIBIT "A", AND LIFT STATION EASEMENT AND OPERATING AGREEMENT AT THE PROPERTY LOCATED AT 49 PARK AVENUE EAST, IN THE CITY OF DANIA BEACH, FLORIDA, AS LEGALLY DESCRIBED IN EXHIBIT "B", COPIES OF WHICH ARE ATTACHED TO THIS RESOLUTION; PROVIDING FOR CONFLICTS; AND FURTHER, PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, The City Code of Ordinances, Chapter 28, "Land Development Code" (the LDC), Part 6, "Development Review Procedures and Requirements," Article 635, "Site Plans," states that Site Plan approval is required as a condition to the issuance of a building permit; and WHEREAS, Sun-Tech Engineering, Inc., on behalf of City Place Apartments, Ltd., (the "Applicant") has requested Site Plan approval (SP-078-21MOD) to permit the development of a new 152,304 square foot apartment building with a parking garage on the property at 75 Park Avenue West(the "Property") as legally described in Exhibit"A;" and WHEREAS, Chapter 28, Subpart 1 of the LDC, Article 301, "Legal and Administrative Provisions," Section 301-50 "Variations in design; procedure for review of design variations," states that the City Commission may approve design variations within the CC district using the procedure and criteria of this section in lieu of the variance process of Article 625; and WHEREAS, the Applicant has requested a Design Variation from the Build-to-Line or Setback standards (OT-080-22); and WHEREAS, the requested Design Variation is for reasonable accommodations of design flexibility that result in overall superior development and design consistent with the intent and principles of this subpart that govern the standard for which variation is requested; and WHEREAS, the requested Design Variation is appropriate to accommodate site conditions not anticipated in these regulations, or to reconcile conflicting requirements, and is generally consistent with the intent and principles of this subpart that govern the standard for which variation is requested; and WHEREAS,the Applicant has offered significant enhancements to other pertinent aspects of the site that the City Commission determines will offset any negative impact that a variation to these standards might otherwise create; and WHEREAS,the City Commission conducted a duly noticed public hearing in accordance with Article 610 of the LDC; and WHEREAS, the City Commission finds that the approval of the proposed Site Plan (SP- 078-21MOD)and Design Variation(OT-080-22)will protect the public health,safety,and welfare of the residents of the City, and furthers the purpose, goals, objectives, and policies of the Comprehensive Plan; and WHEREAS,the Applicant is seeking to enter into a Lift Station Easement and Operating Agreement (the "Lift Station Easement Agreement") with the City of Dania Beach; and WHEREAS, the Lift Station Easement Agreement will allow for the installation, maintenance, repair and replacement of a private lift station and other facilities to be located on the City's property more particularly described on Exhibit "B" attached hereto (the "Easement Area")to convey effluent from the Property to the Easement Area and from the Easement Area to sewage lines in the adjacent public right-of-way; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF DANIA BEACH,FLORIDA: Section 1. That the foregoing WHEREAS clauses are ratified and confirmed as being true and correct and they are made a part of and incorporated into this Resolution by reference. Section 2. That pursuant to Chapter 28 "Land Development Code," Part 6 "Development Review Procedures and Requirements,"Article 635 "Site Plan,"the following Site Plan(SP-078-21MOD), attached as Exhibit"C" is approved. Section 3. That pursuant to Chapter 28 "Land Development Code," Subpart 1, Article 301, "Legal and Administrative Provisions," Section 301-50, "Variations in design; procedure for review of design variations,"the following Design Variation Application(OT-080-22)is approved consistent with the Site Plan provided in Exhibit"C". Section 4. That the approvals granted by this Resolution are subject to the Applicant's compliance with the following conditions: 2 RESOLUTION#2022-189 REVISED 12/13/2022 ons, or to reconcile conflicting requirements, and is generally consistent with the intent and principles of this subpart that govern the standard for which variation is requested; and Conditions of Approval 1. Due to the fact that the City of Dania Beach is approaching their sewer capacity with respect to the large user agreements, additional flows may generate the need to modify the agreement; thus, there may be additional fees for the City of Hollywood to process the request. The Developer is responsible for all fees to update the agreement if required (Engineering) 2. Submit a copy of the fire flow test required by the Fire Department, copy of the Fire Department approval, and revised drawings indicating the new water main to service the project for Engineering and Public Services Department review and approval (Engineering). 3. In accordance with City Code of Ordinances in Article 415. SIDEWALKS AND SWALES, Owner is responsible for the construction of sidewalks/ swales within the road ROW when buildings are constructed or substantially improved(Engineering). 4. Provide BC standard details for pavement marking and signage. All traffic control signs shall conform to Broward County Traffic Engineering (BCTED) and MUTCD standards. BCTED signs specifications consist of Type Xlretro reflective sheeting materials except for school zone and pedestrian signs which shall be comprised of retroreflective fluorescent yellow-green sheeting certified type IV (Engineering). 5. All pavement markings shall be alkyd-based thermoplastic and fully retroreflectorized,per BCTED specifications with the exception of parking stall striping (Engineering). 6. Provide Maintenance of Traffic(MOT)Plan by a licensed General Contractor/Professional Engineer in the State of Florida(If applicable) (Engineering). 7. Detail and complete engineering plans will be required prior to Building and R/W permit approval (Engineering). 8. Provide utility piping conflict details plan, along with documentation to demonstrate acceptability of the separation between water, sanitary, storm-water service lines, etc. (Engineering). 9. Show also all existing and proposed utilities on the landscaping plans for potential conflicts (Engineering). 10. Provide ADA parking, access / driveway, and sidewalks /ramps including dimensions in accordance with Chapter 553 of the Florida Statutes. "Accessibility of Handicapped Persons" and latest edition of "Accessibility Requirements Manual" by Department of 3 RESOLUTION#2022-189 REVISED 12/13/2022 Community Affairs,Florida Board Building Codes and Standards, and'in accordance with Americans with Disability Act(ADA) (Engineering). 11. Provide drawing file (dwg or dgn) disk of the approved site plan in Florida State Plane Coordinate (NAD 83). This should be addressed as part of the final submittal (Engineering). 12. Provide regulatory agencies' approval documentation and Permits/Licenses (as applicable) as part of the final submittal,prior to issuance of the Building Permit(South Florida Water Management District(SFWMD), Broward County Surface Created with idt Plans Review 10/20/22 SP-078-21MOD City Place Modification, 2nd Review Page 12 of 14 Page 3 of 4 Water License, Broward County EPGMD Wastewater Permit/BC Water and Wastewater Approval, Florida Department of Environmental Protection, FDOT, BC Environmental, BC Aviation, BCTED etc.). Also, include Utility / Right of Way Permits from City, Broward County, and State Roads as applicable (Engineering). 13. The applicant to pay $150,000 to the City for the City to construct improvements listed below,post a bond to the benefit of the City, or confirmation of cash escrow in the amount of one hundred fifty thousand dollars ($150,000) in the applicant's name reserved for the improvements described below. In the event the improvements are not completed prior to issuance of a final certificate of occupancy of the residential structure, subject to any extensions for completion of the improvements granted by the City in its discretion, the City may draw on the bond or cash escrow to complete the improvements. These improvements are to include: a. Remove surface parking lot south of City Hall (between City Hall and City Garage), b. Remove existing solar lights, c. Install additional perimeter sidewalk,widening in some areas and providing missing linkage in other areas. d. Install decorative lighting to match what is installed around the fountain to the east e. Install decorative pedestrian lighting along the perimeter sidewalk(Planning). 14. For all projects resulting in buildout of the site, such that construction staging cannot occur on site, must obtain Staging Plan approval by the Community Development Director prior to issuance of a building permit. The Staging Plan must include, but is not limited to, location of equipment and material during construction. 15. For all projects resulting in buildout of the site, such that construction staging cannot occur on site, the applicant must obtain Maintenance of Traffic Plan approval by the City Engineer for period of construction prior to issuance of a building permit. 4 RESOLUTION#2022-189 REVISED 12/13/2022 16. Per 0-2017-027 & 0-2018-019. Commercial properties under construction are required to provide security to fencing with screening showing project rendering covering at least 75% of the length of the fence along an arterial or state right-of-way & 25% for local roads and must include name and intended use of the project, project rendering, project website address, and owner or agent, the telephone number for the owner or agent, and the name and an emergency contact telephone number of the general contractor. Provide screen detail with next submittal. 17. Any cost recovery account balances must be satisfied with the Community Development Department prior to approval of any Building Permit(Planning & Zoning). 18. For all projects resulting in buildout of the site, such that construction staging cannot occur on site,must obtain Staging Plan approval by the Community Development Director prior to issuance of a building permit. The Staging Plan must include, but is not limited to, location of equipment and material during construction. (Planning) 19. Per 0-2017-027& 0-2018-019. OPEN SPACE IMPACT FEE: In accordance with Resolution No. 2015-071, $1,364.00 per Multifamily Dwelling must be paid for Recreation and Open Space Impacts at time of building permit issuance. A total of$135,036.00 (99 units X $1,364.00) will be due at the time of building permit. (Planning) 21. RAC TRAFFIC IMPACT MITIGATION: Per Resolution No. 2014-049, $21.26 will be due per p.m. peak hour trip at the time of building permit. Based on the Traffic Statement, this amounts to a traffic impact fee of$829.14 (39 trips x $21.26) will be due at the time of building permit. This amount may change based on the review of the traffic study by the City's consultant. (Planning). 22. PUBLIC ART PROGRAM: Per Article 811.New development and redevelopment in non- residential, mixed-use and multi-family zoning districts shall provide fee for the creation, acquisition and installation of public art in the city (Planning &Zoning). 5 RESOLUTION#2022-189 REVISED 12/13/2022 of construction prior to issuance of a building permit. 4 RESOLUTION#2022-189 REVISED 12/13/2022 Section 5. That pursuant to LDC Section 635-100 "Expiration of Site Plans,"the Site Plan (SP-078-21MOD) approval shall automatically expire and become null and void unless the Applicant files a complete building permit application with construction drawings for the improvements shown on the Site Plan, within eighteen (18) months from the date of this Resolution. Section 6. That the issuance of a development permit by a municipality does not in any way create any right on the part of an Applicant to obtain a permit from a state or federal agency, and does not create any liability on the part of the municipality for issuance of the permit if the Applicant fails to obtain requisite approvals or does not fulfill the obligations imposed by a state or federal agency, or undertakes actions that result in a violation of state or federal law. Section 7. That the City Commission approves, and authorizes the appropriate City officials to execute, the Lift Station Easement Agreement with the Applicant, which Lift Station Easement Agreement is incorporated by reference and attached as Exhibit"D". Section 8. That all resolutions or parts of resolutions in conflict with this Resolution are repealed to the extent of such conflict. Section 9. Grantor desires to grant and create, pursuant to the terms and conditions hereinafter set forth, and Grantee has agreed to accept, the lift station access and utility easement as defined below. NOW,THEREFORE,for Ten and No/100 Dollars and other good and valuable consideration, the receipt and sufficiency of which are hereby acknowledged, Grantor and Grantee hereby agree as follows: 1. Recitals. The recitals set forth above are true and correct and are incorporated herein by this reference. 2. Grant of Easement. Grantor hereby grants and conveys to Grantee, and to Grantee's contractors, employees, agents, and licensees an exclusive lift station access and utility easement (the "Easement") over, across and upon the Easement Area for the purpose of design, construction, and operation of a private lift station, sewer service lines, and other infrastructure to serve only Grantee's Property and no other,providing Grantee access for installation,maintenance,repair and replacement to the facilities installed or to be installed in the Easement Area and access to the utilities subject to the rights reserved by Grantor, as outlined below, and subject to completion of the improvements constructed or to be constructed on the Property, including those shown on the Site Plan. The Easement shall constitute a covenant running with the land and appurtenant to the Property and will be recorded,at the Grantee's expense,in the Public Records of Broward County,Florida. The Easement shall remain in full force and effect perpetually, except as specifically provided below,and shall inure to the benefit of, and be binding upon,the successors and assigns of the respective parties hereto,until such time as the Easement is no longer required to serve the improvements on the Property, whereupon Grantor, acting by and through its Director of the Department of Community Development or his/her successor ("Director) and Grantee shall mutually agree in a recorded instrument joined in by any mortgagees of Grantee,to release and terminate the Easement(a"Termination"). If at any time hereafter the Easement is no longer required to serve the improvements on the Property and Grantee or the owner of the Property at such time, as applicable, fails or refuses within ninety(90) days after written request by Grantor to enter into a Termination and to cause any mortgagee(s)of such owner to join in or consent to such Termination,then Grantor,acting by and through its Director,may unilaterally execute and record such a Termination and it will have the same effect as if Grantee or the owner of the Property at such time, as applicable, had executed, and had caused its mortgagee(s) to join in or consent to, such Termination. 3. Maintenance and Repair. Grantee shall be responsible at its sole expense for maintaining the Easement Area and all equipment,piping,and other improvements installed by Grantee or on its behalf in a state of good repair,reasonably safe condition and neat and reasonably attractive manner including, without limitation,the maintenance of support structures and all landscaping, irrigation, lighting, and other infrastructure located within the Easement Area. In the event the equipment or other improvements in the Easement Area is damaged or destroyed in part or in whole, Grantee shall repair and restore same to the original condition, ordinary wear and tear excepted. Grantee shall maintain all risks casualty insurance, including windstorm coverage, in amounts reasonably determined by Grantee, for the repair and replacement of the equipment or other improvements in the Easement Area due to casualty and shall name Grantor as an additional insured on such coverage, which shall be written on a carrier licensed to do business in Florida with an AM Best rating of A- or better. 5. Other Required Insurance Coverage. Grantee shall maintain commercial general liability insurance with respect to the Easement Area and all equipment and improvements therein naming Grantor as an additional insured, written on a carrier licensed to do business in Florida with an AM Best rating of A- or better. Coverage must include, at a minimum: (i) Premises Operations, (ii) Products and Completed Operations, (iii) Blanket Contractual Liability, (iv)Personal Injury Liability, and(v)Expanded Definition of Property Damage. The minimum limits acceptable are $1,000,000 per occurrence, $2,000,000 per location aggregate. The use of an excess/umbrella liability policy to achieve the limits required by this paragraph will be acceptable as long as the terms and conditions of the excess/umbrella policy are no less restrictive than the underlying commercial general liability policy. 6. Notices. The provisions of this instrument shall become effective upon their recordation in the Public Records of Broward County, Florida, and shall continue in perpetuity unless release as set forth above. 12. Enforcement. Enforcement shall be by action against any parties or persons violating or attempting to violate any covenants. The prevailing party to any action or suit pertaining to or arising out of this Easement shall be entitled to recover, in addition to costs and disbursements allowed by law,such sum as the Court may adjudge to be reasonable for the services of its attorney. This enforcement provision shall be in addition to any other remedies available at law, in equity or both. 13. Severability. Invalidation of any provision in this easement by judgment of Court shall not affect any of the other provisions,which shall remain in full force and effect. 14. Cumulative rights.All rights,remedies and privileges granted herein shall be deemed to be cumulative and the exercise of any one or more shall neither be deemed to constitute an election of remedies, nor shall it preclude the party exercising the same from exercising such other additional rights, remedies or privileges. 15.Amendments. This Easement may be amended or modified only by a written instrument effectuating and acknowledging such amendment or modification executed by(i)Grantee, or, as applicable,the then owner(s)of the Property,with joinders by all mortgagees, if any and (ii) the Director, on behalf of Grantor. However, that minor amendments or minor modifications to correct or amend the location or configuration of the Easement as set forth on Exhibit "B" of this Easement may be executed by the then fee owner(s) and City Manager of Grantor without necessity of review and approval by the City Commission. Modifications or amendments shall be recorded in the Public Records of Broward County, Florida. 16. Entire Agreement.This Easement constitutes the entire agreement between the parties with respect to the subject matter hereof and supersedes all prior agreements, understandings and arrangements, both oral and written, between the parties with respect thereto. 17. Captions.
