DANIA BEACH CITY COMMISSION
MONDAY, NOVEMBER 21, 2022 - 7:00 P.M.
1. Call to Order/Roll Call
Mayor Ryan called the meeting to order at 7:00 p.m.

2. Moment of Silence and Pledge of Allegiance
Mayor Ryan called for a moment of silence followed by the Pledge of Allegiance to the United
States Flag.
3. Presentations and Special Event Approvals
3.1 HR presentation
Linda Gonzalez, Chief Human Resources Officer, presented Commissioner Salvino with a giant
thank you card and plaque from City employees in appreciation of his spearheading the
Employee Appreciation Picnic held in October.
Commissioner Salvino thanked everyone for the card and plaque. He said the picnic was well-
deserved and as the first one it was well attended. He gave thanks to Cliff Barry and his staff for
supplying all the food and thanked Kelly and Sharon Sharaby for providing the bounce house,
face painting and petting zoo.
3.2 Special Event request from Marina84 Sports Bar & Grill to host "Marina 84 Bike
Night" every Wednesday beginning January 4, 2023, through Wednesday, December
27, 2023, to be held at 2440 West State Road 84, from 5:00 p.m. — 11:00 p.m.

Vice-Mayor Lewellen motioned to approve the Special Event request for Marina 84 Bike
Night; seconded by Commissioner James. The motion carried unanimously.
3.3 Special Event request from Dania Live 1748 and Dania Live II 1748, LLC to host
"Dania Pointe Annual Events 2023" beginning January 1, 2023 through December
31, 2023, to be held at various locations throughout Dania Pointe (Community
Development)
Brad Freeman, Dania Pointe, gave a PowerPoint presentation which is attached to and
incorporated into these minutes.
Commissioner Davis commented on the last three events Dania Pointe brought to the City, which
are making Dania Beach an iconic City.
Commissioner Salvino commented on Dania Pointe and noted he fully supports the events being
held.
Vice-Mayor Lewellen spoke about the Exotics event and noted people are excited to see it come
back again.
Commissioner James noted she attended the car show and it was more than what she could have
expected. She agreed with Commissioner Salvino about what Dania Pointe has given to our
community.
Commissioner James motioned to approve the Special Event request for Dania Pointe
Annual Events 2023; seconded by Commissioner Salvino. The motion carried
unanimously.
3.4 Special Event request from Dania Entertainment Center to host "The Florida Mega
Market" to be held at 301 E. Dania Beach Boulevard on December 17, 2022, from
11:00 a.m. —6:00 p.m. (Community Development)
Commissioner James motioned to approve the Special Event request for The Florida Mega
Market; seconded by Commissioner Salvino. The motion carried unanimously.
3.5 Special Event request from City of Dania Beach and the Dania Beach Lions Club for
the 16th Annual Dania Beach Vintage Motorcycle Show to be held at Frost Park, 300
N.E. 2nd Street, on January 28, 2023 from 5:00 a.m. - 4:00 p.m. (Parks &
Recreation)
Commissioner Salvino motioned to approve the Special Event request for the 16th Annual
Dania Beach Vintage Motorcycle Show; seconded by Commissioner James. The motion
carried unanimously.
3.6 Special Event request from Ravenswood Management Association to host a
"Community Yard Sale" to be held at 2121 SW 53 Court beginning Friday,
November 25, 2022 through Sunday, November 27, 2022 from 7:00 a.m. - 7:00 p.m.

Commissioner Salvino motioned to approve the Special Event request for the Community
Yard Sale; seconded by Commissioner James. The motion carried unanimously.
4. Proclamations
There were no proclamations on the agenda.
5. Citizen Comments
Shawn DeRosa, 408 SE 5th Street, spoke about the noise nuisance, illegal parking, blocking of
the right-of-way, and repeat violations at 414 SE 5th Street.
Ed Campion, 420 SE 5th Street, also spoke about the ongoing code violations occurring at 414
SE 5th Street.
Commissioner Salvino addressed the former Nuisance Abatement Board and he felt it needs to
be reviewed. Besides the fine, there must be a different avenue to resolve the issue. He spoke
about the Abatement Hearings and turning over control to the Magistrate and added we have to
do something about this property.
City Attorney Boutsis said the Special Magistrate has reduced liens once they have been
recorded and gave an example.
Commissioner James asked how we are choosing which residents we choose to reduce fees for.
City Attorney Boutsis explained it is up to the Special Magistrate to decide and they try to be
consistent on the amount. They usually do reduce it to 90% of the total fine with interest, but
there are exceptions as to corporations and Airbnb's, which are usually not reduced.
Commissioner James echoed what Commissioner Salvino said. She is not sure what we can do
but we have to give our residents some type of relief.
City Attorney Boutsis said we have clear directions.
Terrell McCombs, 41 SW 5th Street, spoke about agenda item #8.1 and historical preservation of
the Nyberg-Swanson house.
Mayor Ryan said he is a total proponent of preserving the history of Dania Beach. He noted the
agenda item is basically for windows to preserve the historical integrity of the house. The
$39,000.00 is not much to repair something but it is a step in the right direction, and we should
put more efforts in preserving the historical integrity of Dania Beach.

City Manager Garcia noted the administration has set aside $1.5 million for both the Nyberg-
Swanson House and the Women's Club. This agenda item is just to address the windows, but we
have a game plan to address all of it;this is only the beginning.
Commissioner James said this is not the entire cost for the entire amount,just a first phase; this is
very near and dear to all of us. We want to keep that in our City, and she assured the residents
this is just to start the process which has been long overdue.
Commissioner Salvino noted we talked extensively about the historical preservation of the two
buildings. We also talked about little placemarks along the way; he would guess we will do half
a million on this house.
Kathy Kay, 355 SW 2nd Avenue, commented she knew there was money set aside, but they had
heard rumors about it being moved and letting it decline. She is pleased to hear that is not the
case. Her husband, Ted Kay, would be willing to go in and evaluate it if the City is interested in
that.
Joanna Granett, 450 SE 7th Street, spoke about members of the Historical Society attending the
2022 Broward County Pioneer Day event. She is hoping the City will host the 2024 Pioneer Day
event as it falls in line with the City being 120 years old. She spoke about the Historical Society
booth at the Exotics at Dania Pointe event and added she is excited about the future of the
Historical Society. She also heard the Nyberg-Swanson House was going to be moved and
neglected but the Commission made her feel better about it; however, she does want to know
why restoration will not begin until fiscal year 2024.
Commissioner Davis reiterated what a wonderful job the Historical Society did for the City at the
Exotics at Dania Pointe event. She thanked all the members of the Historical Society.
Mayor Ryan said 2024 is going to be a really big year; the 120-year anniversary of the City is
something. We should start planning for it now and he is looking forward to it.
Linda Wilson, 1547 Adams Street, Hollywood, First Vice-President of the Friends of the
Library, noted she has been pushing for an historic district in the City. There has been
discussion of an art district, which should be inclusive of cultural and historic preservation and
be one district. She also commented on agenda item#8.1 and Honor the Legacy.
Deputy City Manager Sosa-Cruz clarified information circulating that is not factual. The item on
the agenda is strictly for preservation of the buildings; this is not the complete restoration. We
are working with an historical architect and neither one of the properties is going to be moved.
This is not the historical renovation; this is a preventative maintenance to ensure that the
property does not continue to deteriorate.
Debbie McElyea, 418 SW 2nd Place, said her family is a 4th generation family and business
owner in Dania Beach. She found out that another towing company is taking over Dania Beach.
They are still family owned and run and have been towing for the City since the 1970s. They are
a drug-free workplace and are available day and night. She found out that this is going on and no

one sent a letter or anything; it is going out for contract on a rotation basis and only one
company, which is not hers, is in this contract. She would like an equal opportunity.
City Attorney Boutsis explained she is not losing the contract; it would be another company that
could also provide services. With that said, the item for the other towing company is being
pulled off the agenda tonight and will be on a future agenda. She assured Ms. McElyea she is
not being removed from the list; it was intended to provide more choices for the Police
Department and would be on a rotating basis. Nobody was trying to cancel Ms. McElyea's
contract.
6. Public Safety Reports
Captain Daniel Marks, BSO Chief of Police, recognized Deputy Blackwood for working with the
mentally ill and homeless population. He read a recognition letter aloud from Keith Cross, Chief
of Police, Aurora Illinois.
Deputy Blackwood expressed his gratitude and thanked Chief of Police Keith Cross, Sheriff
Tony, Captain Marks, and Lieutenant Rivera for recognizing his efforts.
Vice-Mayor Lewellen said Captain Marks' deputies have done a very good job with the
homeless population and she appreciates their efforts. She is proud of who we are.
Captain Sergio Pellecer, BSO District Fire Chief, gave an update on departmental activities
including call volumes for October and Tropical Storm Nicole, station renovations, team
participation in the 5K event at Dania Pointe, and the annual toy drive this weekend at Dania
Pointe.
Commissioner Davis noted it was a pleasure having BSO's presence at the 5K event.

City Attorney Boutsis read the title of Resolution #2022-179 and advised the item was a quasi-
judicial hearing and swore-in those who would speak. She asked the Commission to disclose
any communication they had on this matter.
Mayor Ryan noted he spoke to Leigh Kerr about the project.
Eleanor Norena, Director of Community Development, gave a presentation on the site plan
modification request for Parkview.
Liz Adler, Greenspoon Marder, gave a PowerPoint presentation which is attached to and
incorporated into these minutes.

Commissioner James asked if the applicant did any community outreach and inquired about the
height of the building.
Attorney Adler noted the original height was 144 feet;the new height is 133 feet and 8 inches.
Leigh Kerr, on behalf of the applicant, described the outreach conducted.
Commissioner James questioned if this followed the same protocol of reaching out to the radius
of residents that we typically do.
Community Development Director Norena explained staff asked them to provide the same
outreach of the 1,000-foot radius, but they were adamant about just reaching out to the people
that they had discussed this with previously.
Seeing as there was no one else to speak in favor or opposition, Mayor Ryan closed the Public
Hearing.
Commissioner Salvino motioned to adopt Resolution #2022-179; seconded by
Commissioner Davis. The motion carried on the following 5-0 Roll Call vote:

City Attorney Boutsis read the title of Resolution#2022-180.
Eleanor Norena, Director of Community Development, noted staff is requesting this item be
continued to the December 13th Commission meeting to allow the applicant time to provide
missing information.
Mayor Ryan opened the Public Hearing. Seeing as there was no one to speak in favor or
opposition, he closed the Public Hearing.
Commissioner Lewellen motioned to continue Resolution #2022-180 until the December 13,
2022 City Commission meeting at 7:00 p.m.; seconded by Commissioner James. The
motion carried unanimously.

10. Discussion and Possible Action
10.1 Review and approve City Commission meeting dates for 2023 - City Clerk
City Clerk Schneider reviewed the information included in the agenda packet.
The Commission consensus was to approve the City Commission meeting dates for 2023, as
amended, to cancel the April 11, 2023,November 28, 2023, and December 26, 2023 meetings.
City Clerk Schneider noted the CRA Board meeting dates for 2023 would mirror the dates of the
first Commission meeting of every month.
11. Commission Comments
11.1 Commissioner Davis
Commissioner Davis noted she was approached by Gasper Arts, requesting $5,000.00 for
assistance with a booth at Art Basel. She is the art liaison and they brought it to her to bring to
the Commission. It is something that would put Dania Beach on the map for the first time at Art
Basel and she would like to see what the Commission's thoughts are.
Vice-Mayor Lewellen asked what we would be getting for the $5,000.00.
Commissioner Davis explained they would be promoting Dania Beach and we could have
whatever we wanted to have there; basically, it is for recognition.
Commissioner James said her vote would only be if City staff were the holder of the booth.
Mayor Ryan asked if the $5,000.00 was for a private company and where they are located.
Commissioner Davis noted it is an art gallery in the City; they do want to have their art there on
exhibition but also want to promote the City at the same time.
Mayor Ryan asked if they could make a piece for us. He thinks if we are assisting them, they
can assist us. Art galleries are expensive; they could sell one of these pieces and make $5000. It
is good to promote us in another city like Miami, but he does not want to just give away money
to an artist. We need to figure out how we are going to be properly represented.
Vice-Mayor Lewellen said it is coming up quickly and we do not have enough time to vet it, to
ensure they are doing it properly. If we had more time, she would feel more comfortable about
it.
Commissioner Davis asked if anyone would have a problem if she wanted to give $2,500.00
from her contingency.

The Commission had no issues with Commissioner Davis using her contingency money.
Commissioner Davis said she attended Veteran's Day events at Posts 304 and 209; she is proud
of our veterans for serving our country and are also located here in Dania Beach.
Commissioner Davis noted she participated in the 5K Run at Dania Pointe and spoke about the
Dania Beach residents who placed in their age group.
Commissioner Davis commented one of the things that got to her was Hurricane Nicole. The
beach was torn down and sand was up to the toilet seats. The Beam Team and Public Services
worked around the clock to get our beach back to pristine condition.
Commissioner Davis spoke about America Recycles Day. She attended with Public Services and
said we were able to build our relationships and partnerships with Waste Management.
Commissioner Davis said she attended the National League of Cities Conference in Kansas City
and brought back some invaluable information to get some infrastructure grants going to benefit
our City. She knows the Manager is a big proponent of keeping everyone's mental health
together and taking our vacations. Dr. Sanjay Gupta was a guest speaker at the event, and he
really reiterated everything that we are doing here in the City.
11.2 Commissioner James
Commissioner James noted she attended the Exotics car show at Dania Pointe; it was amazing
and a big draw, and she is sure Dania Pointe got a lot of business that day. She gave a special
shout out to her son who won the super bowl this weekend in Coral Springs, and she is very
proud of his team. Tomorrow is the Tamara James Foundation Annual Thanksgiving Drive at
CW Thomas Park at 5:00 p.m.; first come, first serve.
Commissioner James spoke about Veteran's Day; she wants to do it all together one year, so we
do not have to split events.
Commissioner James said she met with the artists at the Quarterdeck and will have renderings
very soon.
11.3 Commissioner Salvino
Commissioner Salvino thanked everyone for the plaque.
Commissioner Salvino noted he is requesting money from his contingency for Olsen Middle
School as a resident has been working with the School Board and the principal for renovations.
They are taking donations to improve the school; he is asking for $1,000.00 from his
contingency.

Each Commissioner, along with the Mayor, Vice-Mayor, City Manager and City Attorney all
agreed to give $1,000.00 for a total of$7,000.00 to be donated to Olsen Middle School.
Commissioner Salvino congratulated Mayor Ryan and Vice-Mayor Lewellen.
11.4 Vice-Mayor Lewellen
Vice-Mayor Lewellen welcomed Mayor Ryan to the team.
Vice-Mayor Lewellen said she could not attend the Dog Park Halloween event at PJ Meli; she is
glad we are doing it in the future. She gave a shout out to Parks & Recreation for it and the Fall
Festival event, which was an amazing event.
Vice-Mayor Lewellen noted she attended both posts' events for Veteran's Day. She agreed with
Commissioner James about having to move from one event to another; it is hard to get to all
events to spend time with the veterans. She thanked Deputy City Manager Sosa-Cruz for his
service in the Marines.
Vice-Mayor Lewellen spoke of attending the Exotics car show; these events at Dania Pointe are
bringing a lot of people into the City. The Historical Society put up a booth and did a great job;
a lot of people were asking questions about the history. She is very proud of our Historical
Society as they are taking this challenge and moving it forward and doing what they can to
preserve the history of Dania Beach. She thanked the residents who voted and all the well
wishes; it is great to be back for four years to serve with everyone.
11.5 Mayor Ryan
Mayor Ryan spoke about the November 8th election and noted he looks forward to working with
his colleagues. He also spoke of attending Trunk or Treat at C.W. Thomas Park and about being
a member of the Sons of The American Legion at Post 304. He went to a meeting at the Marriott
and met the CEO of Memorial Hospital. He also met the elected officials of our neighboring
cities and looks forward to doing future business with those cities. He congratulated Vice-Mayor
Lewellen, and said he is looking forward to working with all the Commissioners. He was
welcomed by the staff like a family member and loves the teamwork concept.

13. Administrative Reports
13.1 City Manager
City Manager Garcia congratulated Mayor Ryan and Vice-Mayor Lewellen. She congratulated
Assistant Director of Parks & Recreation Waren on the birth of her third son. She congratulated
the whole Parks & Recreation team for a great job on the Fall Festival and Trunk or Treat. She
reminded everyone that on December 1st at 6:00 p.m. we will be holding the Christmas Tree
Lighting. She spoke about Hurricane Nicole and the impact it had on our beach; she is grateful
to the entire team.
Commissioner Salvino questioned the date of the Christmas Tree Lighting and it coinciding with
the League of Cities event.
City Manager Garcia said we would look at it and see if we could make it happen a couple days
before.
Commissioner Davis noted it has become a tradition to have it on December 1st. She does not
know if it is a good idea to shift it around at the last minute.
City Manager Garcia added it costs the City the same amount of money; that is why we have
made it the tradition to kick off the month and enjoy it.
Commissioner James said we need to do a better job looking at our schedules. It is about our
residents, more than it is about us. In the future, if we must shift that date, she does not mind
doing it. She would not recommend changing it this close to the event.
City Manager Garcia noted we could centralize our calendars with Chief of Staff Singh.

Vice-Mayor Lewellen commented she is on a Legislative Policy Committee that meets on
December 1st in Orlando. These meetings have tended to get out early so she might be able to go
there and come back early. It is something she must go to; it is something that she was appointed
to, and she is representing our City there. She does not mind and will do the drive if she has to.
Mayor Ryan agreed it should be put on as soon as possible; December 1st is perfect, and it sets
the tone for our residents.
13.2 City Attorney
a. Introduction of Jon Gurney, Assistant City Attorney City Attorney Boutsis
City Attorney Boutsis introduced the new Assistant City Attorney, Jon Gurney.
b. Proposed Interlocal Agreement regarding Airport
City Attorney Boutsis reviewed the information included in the agenda packet and requested
direction from the Commission to negotiate the best deal she can.
Commissioner James asked if we could put anything in the MOU about naming rights and noise
mitigation.
City Attorney Boutsis said she will raise the issue.
Commissioner James noted it is important, especially with the noise mitigation issues, and she
knows a lot of the Commissioners get questioned by the residents about it.
City Attorney Boutsis said she will bring it up but is not promising she will get it in there.
Mayor Ryan added while we are in negotiations, we might bring up more points so they know
what is on our mind as a City.
c. Discussion on possible Bryan Road Public Park
City Attorney Boutsis explained the negotiations with the County regarding the Bryan Road
proposed park.
City Manager Garcia said the latest development is that the developer has agreed to pay 100% of
the cost of the pipe installation required by the County.
City Attorney Boutsis noted then this is no longer an agenda item.
