HomeMy WebLinkAboutR-2023-013 Sale of CRA-Owned Property to City Located at 524 NW 3rd Terrace and the SWC Old Griffin Road-NW 4 Avenue executed RESOLUTION NO. 2023-013 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF DANIA BEACH,FLORIDA,PURSUANT TO SECTION 163.358(4), OF THE FLORIDA STATUTES, AUTHORIZING THE SALE OF CRA-OWNED PROPERTIES LOCATED AT 524 NW 3`d TERRACE, AND THE SWC OLD GRIFFIN ROAD/NW 4th AVENUE, DANIA BEACH, FLORIDA ("PROPERTIES") TO THE CITY OF DANIA BEACH FOR THE PURPOSE OF USING THE PROPERTIES AS NEIGHBORHOOD PARKS; AUTHORIZING THE PROPER CITY OFFICIALS TO EXECUTE DEEDS AND RELATED DOCUMENTS FOR THE TRANSFER OF THE PROPERTIES TO THE CITY TO USE FOR PARK PURPOSES; PROVIDING FOR CONFLICTS; FURTHER, PROVIDING FOR AN EFFECTIVE DATE. WHEREAS,as set forth in Florida Statutes §163.358(4),the City Commission of the City of Dania Beach, Florida continues to vest in the governing body of the municipality the power to approve the acquisition, demolition,removal, or disposal of CRA-owned property; and WHEREAS, at the November 9, 2022 CRA Board meeting, the CRA Board discussed their potential interest to transfer or sell the CRA-owned properties located at 524 NW 3rd Terrace and the SWC Old Griffin Road/NW 4th Avenue, Dania Beach, Florida(Properties); and WHEREAS, Florida Statutes §163.380 requires the CRA to publish a Public Notice of its interest in selling a CRA-owned property and, at the direction of the CRA Board, the CRA published the required Public Notice in the Broward Business Review newspaper on December 23, 2022; and WHEREAS,there were no purchase proposals received for the Properties; and WHEREAS,the properties are not "buildable" by rights due to dimensional challenges; and WHEREAS,the City of Dania Beach is seeking additional neighborhood park land; and WHEREAS,the Community Redevelopment Plan gives due consideration to the provision of adequate park and recreational areas and facilities that may be desirable for neighborhood improvement,with special consideration for the health, safety and welfare of children residing in the Community Redevelopment Area; NOW,THEREFORE,BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY DANIA BEACH, FLORIDA: Section 1. That the above"WHEREAS"clauses are ratified and confirmed, and they are made a part of and incorporated into this Resolution by this reference. Section 2. That the CRA Board supports and authorizes the conveyance of the Properties, which are legally described in Attachment"A",to the City of Dania. Section 3. That the City Commission authorizes the appropriate City officials to execute a purchase and sale contract, with associated deed for the Property, in substantially the form approved by the City Attorney. Section 4. That the proper City officials shall record in the County public records the deed and shall provide a copy of such recorded instrument to the CRA Board within thirty (30) days of execution and final acceptance. Section 5. That all resolutions or parts of resolutions in conflict with this Resolution are repealed to the extent of such conflict. Section 6. That this Resolution shall be in force and take effect immediately upon its passage and adoption. PASSED AND ADOPTED on February 14, 2023.
