RESOLUTION NO. 2023-023 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA, APPROVING THE SITE PLAN (SP-068-23) AND VARIANCES (VA-005-23, VA-006-23, VA-007-23, VA-008-23, VA-009-23, VA-010-23, VA-011-23 VA-012-23) FOR PROPERTY OWNER CITY OF DANIA BEACH, AND PROPOSED OCCUPANT, LUCKY FISH II, LLC, A FLORIDA LIMITED LIABILITY COMPANY, FOR PROPERTY LOCATED AT 65 N. BEACH ROAD, IN THE CITY OF DANIA BEACH, FLORIDA, AS LEGALLY DESCRIBED IN EXHIBIT "A", A COPY OF WHICH IS ATTACHED AND INCORPORATED BY REFERENCE INTO THIS RESOLUTION; PROVIDING FOR CONDITIONS; PROVIDING FOR CONFLICTS; FURTHER, PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the City of Dania Beach, and Lucky Fish II, LLC (the "Applicants") are requesting approval of a Site Plan (SP-068-22) to permit the future development of property generally located at 65 N Beach Road, in the City of Dania Beach, Florida (the "City") as legally described in Exhibit "A", a copy of which is made a part of and incorporated into this resolution by this reference; and WHEREAS, the City Code of Ordinances, Chapter 28, entitled, "Land Development Code" ("LDC") of Part 6, entitled, "Development Review Procedures and Requirements," of Article 635, entitled, "Site Plans" of Section 635-20(A), provides that site plan approval is required prior to commencement of construction; and WHEREAS, the Applicants are requesting Site Plan approval to permit the future redevelopment of the subject property pursuant to and consistent with the attached Site Plan provided as Exhibit `B"; and WHEREAS, the City Commission conducted a duly noticed public hearing in accordance with Article 610 of the LDC; and WHEREAS, the City Commission finds that the approval of the Site Plan (SP-068-22) will protect the health, safety, and welfare of the residents of the City, and furthers the purpose, goals, objectives and policies of the Comprehensive Plan; and WHEREAS, the City of Dania Beach ("City") Code of Ordinances, Chapter 28, entitled "Land Development Code" ("LDC"), of Part 6, entitled "Development Review Procedures and Requirements," Article 625 "Variances," Section 625-40, entitled "Variance Review Criteria; City Action," states that the City Commission may grant a Variance based on its determination that the Applicants have demonstrated that the necessary criteria identified in the LDC have been satisfied; and WHEREAS, the Applicants have requested a Variance (VA-005-23) from Section 265- 40 of the LDC regarding required parking has been withdrawn as it is no longer needed; and WHEREAS, the Applicants have requested a Variance (VA-006-23) from Sections 270- 10 and 270-20 of the LDC to permit partial loading zone to be used during non -operational hours; and WHEREAS, the Applicants have requested a Variance (VA-007-23) from Section 275- 90 and 275-120 to remove five foot (5') vehicular use area buffer adjacent to a City park, and WHEREAS, the Applicants have requested a Variance (VA-008-23) from Section 290- 70(G)(3) of the LDC to reduce the required dumpster setback from twenty-five feet (25') to ten feet, two inches (10'2"), and WHEREAS, the Applicants have requested a Variance (VA-009-23) from Section 205- 10(E) of the LDC to waive minimum lot depth of 300 feet to allow 60', and WHEREAS, the Applicants have requested a Variance (VA-010-23) from Section 205- 10(E) of the LDC to waive the maximum building height of 1-story, sixteen feet (16') to allow a height of approximately forty feet (40'); and WHEREAS, the Applicants have requested a Variance (VA-011-23) from Section 205- 10(E) of the LDC to waive the minimum lot area of 80,000 SF to allow a lot area of 29,080 SF; and WHEREAS, the Applicants have requested a Variance (VA-012-23) from Section 205- 10(E) of the LDC to reduce ease side setback to seven feet, ten inches (7' 10"), and the west side setback to eight feet, four inches (8'4") where twenty-five feet (25') is request. WHEREAS, the requested Variances maintain the basic intent and purpose of the subject regulations, particularly as it affects the stability and appearance of the City; and WHEREAS, the requested Variances are otherwise compatible with the surrounding land uses and would not be detrimental to the community; and WHEREAS, the requested Variances are consistent with, and in furtherance of, the goals, objectives, and policies of the adopted Comprehensive Plan, as amended from time to time, and all other similar plans adopted by the City; and RESOLUTION 92023-023 WHEREAS, the applicant is requesting to use the City's logo on the construction fence, in accordance with Section 8-7 of the City's Code of Ordinances; and WHEREAS, the City Commission conducted a duly noticed public hearing in accordance with Article 610 of the LDC; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA: Section 1. That the foregoing "WHEREAS" clauses are ratified and confirmed as being true and correct and they are made a specific part of this Resolution. Section 2. That pursuant to Chapter 28 "Land Development Code," Part 6 "Development Review Procedures and Requirements," Article 635 "Site Plan," the following Site Plan (SP-068-22), attached as Exhibit `B" which is made a part of and incorporated into this Resolution by reference is approved. Section 3. That pursuant to Chapter 28 "Land Development Code," Part 6 "Development Review Procedures and Requirements," Article 625 "Variances," the following Variance Applications (VA-005-23, VA-006-23, VA-007-23, VA-008-23. VA-009-23, VA-010- 23, VA-011-23, and VA-012-23) are approved consistent with the Site.Plan provided in Exhibit "B» Section 4. That the approvals granted by this Resolution are subject to the Applicants' compliance with the following conditions: 1. Any road cuts within the ROW for utilities connections, curb cuts and/or any other reason must be restored to the city's standards (Engineering). 2. Demolition Plan and Erosion Control Plan and details are required at building permitting (Engineering). 3. Additional comments may apply and will need to be addressed prior to Building Permit approval (Engineering). 4. The Site Plan approval shall be concurrent with variance approval(s) (Engineering). 5. Provide BC standard details for pavement marking and signage. All traffic control signs shall conform to Broward County Traffic Engineering (BCTED) and NMTCD standards. BCTED signs specifications consist of Type XI retroreflective sheeting materials except for school zone and pedestrian signs which shall be comprised of retroreflective fluorescent yellow -green sheeting certified type IV (Engineering). 3 RESOLUTION #2023-023 6. All pavement markings shall be alkyd -based thermoplastic and fully retro- reflectorized, per BCTED specifications with the exception of parking stall striping (Engineering). 7. Provide Maintenance of Traffic (MOT) Plan by a licensed General Contractor/Professional Engineer in the State of Florida (if applicable) (Engineering). 8. Detail and complete engineering plans will be required prior to Building and R/W permit approval (Engineering). 9. Provide utility piping conflict details plan, along with documentation to demonstrate acceptability of the separation between water, sanitary, storm -water service lines, etc. (Engineering). 10. Show also all existing and proposed utilities on the landscaping plans for potential conflicts (Engineering). 11. Provide ADA parking, access / driveway, and sidewalks /ramps including dimensions in accordance with Chapter 553 of the Florida Statutes. "Accessibility of Handicapped Persons" and latest edition of "Accessibility Requirements Manual" by Department of Community Affairs, Florida Board Building Codes and Standards, and 'in accordance with Americans with Disability Act (ADA) (Engineering). 12. Provide drawing file (dwg or dgn) disk of the approved site plan in Florida State Plane Coordinate (NAD 83). This should be addressed as part of the final submittal (Engineering). 13. Provide regulatory agencies' approval documentation and Permits/Licenses (as applicable) as part of the final submittal, prior to issuance of the Building Permit (South Florida Water Management District (SFWMD), Broward County Surface Water License, Broward County EPGMD Wastewater Permit / BC Water and Wastewater Approval, City of Hollywood Water and Wastewater approval, Florida Department of Environmental Protection, FDOT, BC Environmental, BC Aviation, BCTED etc.). Also, include Utility / Right of Way Permits from City, Broward County, and State Roads as applicable (Engineering). 14. Per Section 505-120(0), 1 wall sign is permitted per street frontage. There is no street frontage on the south property line. Remove the proposed sign (Zoning). 4 RESOLUTION #2023-023 15. Per Section 265-51, 19 bicycling parking spaces are required. The one proposed fixture appears to hold 3-5 bike. Please identify location of additional bicycle parking on site (Zoning). 16. Public Art Program: Please provide estimated construction value of project for estimation purposes. Per Article 811 Of the LDC, new development and redevelopment in non-residential, mixed -use and multi -family zoning districts of $1 Million or more shall provide fee for the creation, acquisition and installation of public art in the City (Zoning). Section 5. That pursuant to LDC Section 635-100 "Expiration of Site Plans," approvals shall automatically expire and become null and void unless the Applicant commences with construction of the improvements shown on the Site Plan, within eighteen (18) months from the date of this Resolution. Section 6. That the issuance of a development order by a municipality does not in any way create any right on the part of Applicants to obtain a permit from a state or federal agency and does not create any liability on the part of the municipality for issuance of the development order if the Applicant fails to obtain requisite approvals or does not fulfill the obligations imposed by a state or federal agency or undertakes actions that result in a violation of state or federal law. Section 7. That all resolutions or parts of resolutions in conflict with this Resolution are repealed to the extent of such conflict. Section 8.
