A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF DANIA
BEACH, FLORIDA, CREATING A CITY CHARTER REVIEW BOARD;
PROVIDING FOR THE APPOINTMENT OF MEMBERS, POWERS AND
DUTIES OF THE BOARD, AND FOR BOARD RECOMMENDATIONS;
PROVIDING FOR CONFLICTS; FURTHER, PROVIDING FOR AN
EFFECTIVE DATE.
BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF DANIA
BEACH, FLORIDA:
Section 1. That a City Charter Review Board ("Board") is established. The
composition and function of the Charter Review Board are as follows:
a) There shall be a Charter Review Board appointed by the members of the City
Commission. The Board shall consist of seven (7) members and three (3) alternate members.
The Mayor and each Commissioner shall each appoint one member. The remaining two
members and the three alternates shall be selected by the Commission as a whole, and shall be
considered "at large" members or "at large alternates". The terms of the members shall
commence upon their appointments and shall terminate upon the acceptance by the City
Commission of the Board's Report, or as otherwise provided below.
b) Each person selected to serve on the Charter Review Board shall meet the criteria
and serve in accordance with the City Charter (which requires a member to have been a resident
of the City for a period of at least (6) months prior to the appointment). All members of the
Board shall also be electors of the City. Any person selected to serve on the Board shall at all
times adhere to the Broward County and Florida Codes of Ethics applicable to public officials.
No person shall be eligible for appointment if he or she has been found to have violated any
provision of that Code. No member shall be permitted to use his or her appointment to promote
any personal political preferences. Any vacancy shall be filled by the appointing member of the
City Commission for the remainder of the Board member's unexpired term.
c) The powers and duties of the Charter Review Board shall consist of advising the
City Commission of the areas of the current City Charter in need of change and advising of
specific changes as recommended by a majority vote of the Board. The recommendations of the
Board, whether informal or formal and whether upon majority vote or in the course of
discussion, shall be of an advisory nature only and shall not be binding upon the City
Commission. The Board shall be empowered to conduct a comprehensive study of all provisions
of the Charter. The Board shall submit its report of recommendations to the City Commission
within three (3) months from the date of appointment of the last member of the Board. The City
Commission may decide to seek further recommendations from the Board after submission of its
report. Further, the City Commission shall coordinate for the Board Chair, or designee, to
provide a presentation to the Commission at a Commission meeting of the Board's
recommendations.
d) Each appointed board member and alternate member shall serve at the pleasure of
the Commissioner appointing him or her, or at the pleasure of a majority of the commission for
the "at large" members and shall remain on the Board until removed by the Commissioner who
appointed him or her or until such time as the appointing Commissioner no longer holds office.
e) All board members shall serve without compensation.
f) The Commission, from time to time, may appoint advisors and ad hoc members to
the Board. Each Board meeting shall occur in the Sunshine, with advanced notice and minutes
taken of the meetings.
g) The City Attorney shall provide the Board training on public records, sunshine
law, and ethics. The City Attorney shall provide guidance to the Board as to the Charter and
process for issuing recommendations and proposed amendments to the Charter. The City Clerk,
or his/her designee shall be designated as the Clerk of the Board meetings.
Section 2. That the Board will automatically be dissolved within one (1) year from
the date of adoption of this Resolution, unless extended by resolution of the City Commission.
Section 3. That all resolutions or parts of resolutions in conflict with this Resolution
are repealed to the extent of such conflict.
Section 4. That this Resolution shall be in force and take effect immediately upon its
passage and adoption.
