HomeMy WebLinkAboutR-2023-028 Dania Townhomes 4580 LLC Townhomes Complex Site Plan (SP-061-22) Variance (VA-001-23) and Flex Units (OT-033-23) (revised) RESOLUTION NO. 2023-028 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA, APPROVING THE TOWNHOMES COMPLEX SITE PLAN (SP-061-22) THE ALLOCATION OF TWO (2) FLEXIBILITY UNITS (OT-033-23) AND VARIANCE (VA-001-23) APPLICATIONS FOR PROPERTY OWNER,DANIA TOWNHOMES 4580 LLC,WHOSE PROPERTY IS LOCATED AT 4580 SW 33''d AVENUE IN THE CITY OF DANIA BEACH, FLORIDA,AS LEGALLY DESCRIBED IN EXHIBIT"A,"A COPY OF WHICH IS ATTACHED TO AND INCORPORATED BY REFERENCE INTO THIS RESOLUTION; PROVIDING FOR CONFLICTS; FURTHER, PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the Legislature of the State of Florida has, in Chapter 166, Florida Statutes, conferred upon local governments the authority to adopt regulations designed to promote the public health, safety, and general welfare of its citizenry; and WHEREAS, Chapter 28, the "Land Development Code" (the "LDC"), Part 6, entitled "Development Review Procedures and Requirements," Article 635, entitled "Site Plans" of the City Code of Ordinances (the "City Code") provides that Site Plan approval is required as a condition to the issuance of a building permit; and WHEREAS, Part 6, of the LDC, Article 635 "Site Plans" states that site plan approval is required as a condition to the issuance of a building permit; and WHEREAS, the Applicant has requested the approval of a Site Plan (SP-061-22) and allocation of two (2) flexibility units to permit the development of a 22,536 SF Townhomes Complex(12 units) located on the property located at 4580 SW 33`d Avenue; and WHEREAS, the Applicant is requesting approval of the proposed Site Plan (SP-061-22) to permit the future development of the subject property pursuant to and consistent with the attached site plan provided as Exhibit"B"; and WHEREAS, the Applicant is requesting the allocation of two (2) flexibility units (OT- 033-23); and WHEREAS, the City of Dania Beach("City") Code of Ordinances, Chapter 28, entitled "Land Development Code" ("LDC"), of Part 6, entitled "Development Review Procedures and Requirements," Article 625 "Variances," Section 625-40, entitled "Variance Review Criteria; City Action," states that the City Commission may grant a variance based on its determination that the Applicant has demonstrated that the necessary criteria identified in the LDC have been satisfied; and WHEREAS, the Applicant has requested a Variance (VA-001-23) from Sec. 230-10 to allow a building length of 216'-9" where 150' is required; and WHEREAS, the requested variance maintains the basic intent and purpose of the subject regulations, particularly as it affects the stability and appearance of the City; and WHEREAS, the requested variance is otherwise compatible with the surrounding land uses and would not be detrimental to the community; and WHEREAS, the requested variance is consistent with, and in furtherance of, the goals, objectives, and policies of the adopted Comprehensive Plan, as amended from time to time, and all other similar plans adopted by the City; and WHEREAS,the City Commission conducted a duly noticed public hearing in accordance with Article 610 of the LDC; and WHEREAS, the City Commission finds that the approval of the proposed Site Plan (SP- 061-22), Allocation of two (2) flexibility units (OT-033-23) and Variance (VA-001-23) will protect the public health, safety, and welfare of the residents of the City, and furthers the purpose, goals, objectives, and policies of the Comprehensive Plan. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA: Section 1. That the foregoing "WHEREAS" clauses are ratified and confirmed as being true and correct, and they are made a part of and incorporated into this Resolution by this reference. Section 2. That pursuant to Chapter 28 "Land Development Regulations," Part 6 "Development Review Procedures and Requirements,"Article 635"Site Plans,"the following Site Plan(SP-48-21), attached and incorporated by this reference as Exhibit`B," is approved. Section 3. That pursuant to Chapter 28 "Land Development Code," Part 6 "Development Review Procedures and Requirements," Article 625 "Variances," the variance application(VA-001-23) is approved consistent with the Site Plan provided in Exhibit`B". Section 4. That the approvals granted by this Resolution are subject to the Applicant's compliance with the following conditions: 1. Broward County Water and Wastewater Services confirmed that their potable water system has sufficient capacity for the project. This approval is contingent upon the 2 RESOLUTION#2023-028 City of Hollywood's confirmation to treat the wastewater generated by the project. (Engineering) 2. The drainage design shall meet the City of Dania Beach and Broward County Stormwater Management criteria. The Broward County Stormwater Management License shall be provided to the Building Department at the time of Building and Right- of-Way permitting. (Engineering) 3. The berm determined by the stormwater management calculations, shall be met around the entire site including across the driveways. This condition shall be clearly indicated on the civil plans submitted to Community Development for the Building and Right- of-Way permits. (Engineering) 4. A new sidewalk along SW 33rd Avenue is required. (Engineering) 5. Pavement restoration limits will be confirmed at the time of the pre-construction meeting and must be approved by the Public Services Department prior to the closing of the ROW permit. (Engineering) 6. Pavement restoration and sidewalk repairs in the ROW are required to be completed per city and county requirements prior to the close out of the ROW permit(s). (Engineering) 7. Demolition Plan and Erosion Control Plan and details are required at building permitting. (Engineering) 8. Additional comments may apply and will need to be addressed prior to Building Permit approval. (Engineering) 9. The Site Plan approval shall be concurrent with variance approval. (Engineering) 10. In accordance with City Code of Ordinances in Article 415, entitled "Sidewalks And Swales," Owner is responsible for the construction of sidewalks / swales within the road ROW when buildings are constructed or substantially improved. (Engineering) 11. Provide BC standard details for pavement marking and signage. All traffic control signs shall conform to Broward County Traffic Engineering (BCTED) and MUTCD standards. BCTED signs specifications consist of Type XI retroreflective sheeting materials except for school zone and pedestrian signs which shall be comprised of retroreflective fluorescent yellow-green sheeting certified type IV. (Engineering) 12. All pavement markings shall be alkyd-based thermoplastic and fully retro- reflectorized, per BCTED specifications with the exception of parking stall striping. (Engineering) 13. Provide Maintenance of Traffic (MOT) Plan by a licensed General Contractor/Professional Engineer in the State of Florida(if applicable). (Engineering) 14. Detail and complete engineering plans will be required prior to Building and R/W permit approval. (Engineering) 15. Provide utility piping conflict details plan, along with documentation to demonstrate acceptability of the separation between water, sanitary, storm-water service lines, etc. (Engineering) 16. Show also all existing and proposed utilities on the landscaping plans for potential conflicts. (Engineering) 17. Provide ADA parking, access/driveway, and sidewalks /ramps including dimensions in accordance with Chapter 553 of the Florida Statutes. "Accessibility of Handicapped Persons" and latest edition of"Accessibility Requirements Manual" by Department of 3 RESOLUTION#2023-028 Community Affairs, Florida Board Building Codes and Standards, and 'in accordance with Americans with Disability Act(ADA). (Engineering) 18. Provide drawing file (dwg or dgn) disk of the approved site plan in Florida State Plane Coordinate (NAD 83). This should be addressed as part of the final submittal. (Engineering) 19. Provide regulatory agencies' approval documentation and Permits/Licenses (as applicable)as part of the final submittal,prior to issuance of the Building Permit(South Florida Water Management District (SFWMD), Broward County Surface Water License, Broward County EPGMD Wastewater Permit / BC Water and Wastewater Approval, Florida Department of Environmental Protection, FDOT, BC Environmental, BC Aviation, BCTED, City of Hollywood, etc.). Also, include Utility / Right of Way Permits from City, Broward County, and State Roads as applicable. (Engineering) 20. Recreation And Open Space Impact Fee: In accordance with Resolution 2015-071, $1,825.00, per Dwelling, must be paid for Recreation and Open Space Impacts at the time the building permit is issued. A total of$21,900.00 (1,825 x 12 units)will be due at the time of building permit. (Planning) 21. Public Art Program: Please provide estimated construction value of project for estimation purposes. Per Article 811._New development and redevelopment in non- residential, mixed-use and multi-family zoning districts of $1 Million or more shall provide fee for the creation, acquisition and installation of public art in the city. 22. Per 0-2017-027&0-2018-019,commercial properties under construction are required to provide security to fencing with screening showing project rendering covering at least 75% of the length of the fence along an arterial or state right-of-way & 25% for local roads and must include name and intended use of the project, project rendering, project website address, and owner or agent, the telephone number for the owner or agent, and the name and an emergency contact telephone number of the general contractor. Provide screen detail with next submittal. (Planning). 23. For all projects resulting in buildout of the site, such that construction staging cannot occur on site, the applicant must obtain Maintenance of Traffic Plan approval by the City Engineer for period of construction prior to issuance of a building permit. (Planning). 24. Provide Homeowner's Association by-laws identifying the prohibition of vacation rentals and parking in Right-of-Ways as discussed at the Community Outreach meeting on April 3, 2023, prior to the Certificate of Occupancy(CO) issuance. (Planning) Section 5. That pursuant to Land Development Code Section 635-100 "Expiration of Site Plans" and Section 625-50 "Expiration of Variances," the Site Plan (SP-061-22) and Variance (VA-001-23) approval shall automatically expire and become null and void unless the Applicant files a complete building permit application with construction drawings for the subject property to develop a Townhomes Complex within eighteen(18)months from the date of this Resolution. 4 RESOLUTION#2023-028 Section 6. That the issuance of a development permit by a municipality does not in any way create any right on the part of an Applicant to obtain a permit from a state or federal agency and does not create any liability on the part of the municipality for issuance of the permit if the Applicant fails to obtain requisite approvals or does not fulfill the obligations imposed by a state or federal agency or undertakes actions that result in a violation of state or federal law. Section 7. That all resolutions or parts of resolutions in conflict with this Resolution are repealed to the extent of such conflict. Section 8.
