A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF DANIA
BEACH,FLORIDA,DUE TO THE CITY'S DECLARATION OF EMERGENCY
RELATED TO THE FLOODING THAT BEGAN APRIL 12TH, 2023, THE
CITY MANAGER PROCURED PROPERTY RESTORATION SERVICES
FROM FIRST ONSITE; THE CITY COMMISSION RETROACTIVELY
APPROVES THE CONTRACT WITH FIRST ONSITE AS THE SERVICES
MAY EXCEED THE ANNUAL VENDOR THRESHOLD TOTAL AMOUNT OF
FIFTY THOUSAND DOLLARS ($50,000); THE CITY COMMISSION
AUTHORIZES FIRST ONSITE TO PROVIDE THE REMEDIATION,
RESTORATION AND CONSTRUCTION SERVICES GOING FORWARD, AS
A SOLE SOURCE, AS THE CITY'S INSURANCE COMPANY APPROVES
FIRST ONSITE AS A VENDOR AND THE CITY'S INSURANCE PROVIDER
SHALL COVER THE COST OF RESTORATION, REMEDIATION AND
CONSTRUCTION; PROVIDING FOR CONFLICTS; FURTHER, PROVIDING
FOR AN EFFECTIVE DATE.
WHEREAS, the Charter of the City of Dania Beach, Part III, Article 3, Section 4,
Subsection (j), authorizes the City Manager to purchase supplies, services, equipment and
materials for the City government in amounts in excess of the established monetary threshold
without competitive bidding and without advertisement for bids, if she is authorized to do so in
advance by a resolution adopted by the City Commission; and
WHEREAS, the Dania Beach Code of Ordinances, Chapter 2, Article 1, Section 2-10,
"Monetary thresholds for certain purchases and payment disbursement authorizations", Subsection
(a), sets the monetary threshold at Fifty Thousand Dollars ($50,000.00) for a vendor each fiscal
year; and
WHEREAS, on April 13, 2023, the Mayor signed a Declaration of Emergency due to
conditions of extreme peril to the safety of persons and property within the City caused by the
storm event and high-risk flood conditions throughout Broward County; and
WHEREAS,the heavy rainfall resulted in localized flooding and damage to City property
and facilities, necessitating the procurement of emergency restoration services in the impacted
buildings; and
WHEREAS, the City's insurer recommended First OnSite to perform remediation,
restoration and construction services to the affected City facilities throughout the City and to
perform emergency-related repairs to certain facilities; and
WHEREAS, based upon the foregoing, as payment for the remediation, restoration and
construction shall be provided by the City's insurance, and as an insured authorized contractor is
required to receive the reimbursement, the City recommends that the City Commission declare
First OnSite, a sole source provider under these emergency circumstances; and
WHEREAS, the total cost of services will exceed the annual Fifty Thousand Dollar
($50,000.00)vendor threshold for the Fiscal Year 2022-23 and the City Administration is seeking
authorization to exceed the threshold(reimbursed by the City's insured);
NOW, THEREFORE,BE IT RESOLVED BY THE CITY COMMISSION OF THE
CITY OF DANIA BEACH, FLORIDA:
Section 1. That the foregoing findings are incorporated into this resolution by this
reference and they are made a part of it.
Section 2. That the City Commission authorizes the property restoration services from
First OnSite exceeding the annual amount of the Fifty Thousand Dollars ($50,000.00) purchase
threshold for a single vendor for Fiscal Year 2022-23; further, the proper City officials are
authorized to execute any documents related to this approval.
Section 3. That all claims have been filed with the City's liability insurance and
National Flood Insurance Program (NFIP) policies, and the City's current total out-of-pocket
expense is limited to policy deductibles totaling Seven Thousand Five Hundred Dollars
($7,500.00). All costs above the deductible will be paid by the City's liability insurance or
reimbursed under the NFIP policies.
Section 4. That all resolutions or parts of resolutions in conflict with this Resolution
are repealed to the extent of such conflict.
Section 5. That this Resolution shall be in force and take effect immediately upon its
passage and adoption.
