ROLL CALL The meeting was called to order at approximately 7:00PM by Vice Chair Rimoli. City Attorney Boutsis swore in the Board’s Alternate Cheryl Baker-Hill. Board Clerk Ibel Larios called the roll. Discussions/actions were notated but were not limited to what was typed. For the record, the video’s audio was from the meeting but the video playing pictures were not from the meeting. Chair W. Motion passed 5-0. II. APPROVAL OF MINUTES 1. Approval of Minutes of the Planning and Zoning Board / Local Planning Agency from the May 17, 2023 regular meeting. Motion was made by Board Member Thomas to approve the minutes of the meeting of the Planning and Zoning Board/Local Planning Agency for May 17, 2023 as presented and was seconded by Board Member Hankerson. Motion passed 5-0. III. PUBLIC HEARINGS 1. VA-041-23: The applicant and property owner, Patrick Wheatley, is requesting a variance to allow a six (6’) foot high fence on a portion of the front property line of the property located at 337 SE 3rd Terrace. Planning and Zoning Board/Local Planning Agency Minutes 2 June 21, 2023 City Attorney Boutsis swore everyone in who was going to testify tonight on any item. Then she asked for any ex-parte communication for this item and there were no board member disclosures. PZ Senior Manager Viviana Bautista gave a slide presentation. She explained the location of this corner lot property with a homesteaded, residential single-family home with no code violations. The variance was for a fence to allow safety, security, etc. Staff’s recommendation was to approve the resolution. There was one board question from Vice Chair Rimoli and he was answered that they were going to add an additional portion of the fence which would have its own enclosure for the vessel and then to separate for the backyard which would be his pool area enclosure. She explained further that the access would be through the driveway and she showed this on the survey. As there were no further board questions and no one from the public wished to speak or ask questions, this item was closed. Motion was made by Board Member Stowers to approve VA-041-23 and was seconded by Board Member Thomas. Motion passed 4-1 (Board Member Hankerson opposed). 2. VA-046-23: The applicant and property owner, Shelly Miller, is requesting a variance to increase the maximum curb cut for a single-family home to forty (40) percent for the property located at 425 SE 3rd Place. City Attorney Boutsis asked for any ex-parte communication for this item and there were no board member disclosures. PZ Senior Manager Viviana Bautista gave a slide presentation. She explained the location of the property and that this was a homesteaded, residential single-family home with no code violations. The variance request was to allow the driveway to equal 40% of the lot width where a maximum of 30% was permitted. This would allow for double parking / side-by-side parking. All code criteria were met and the applicant provided all the information and justification for the variance request. Staff’s recommendation was to approve the resolution. Vice Chair Rimoli asked the applicant, Shelly Miller, how she was using this property. She replied it was her primary residence. There were no other board questions but someone from the audience wished to speak. John Delpiano said this would not impact him and heard the property owner state this property would not be used as an Airbnb. However, he was concerned if the property would be turned into an Airbnb there could be eight cars parked in front of that house. Vice Chair Rimoli said that he had that concern about the possibility of adding more cars but would take the property owner at her word. As there were no further board questions and no one else from the public wished to speak or ask questions, this item was closed. Motion was made by Board Member Stowers to approve VA-046-23 and was seconded by Board Member Hankerson. For Discussion: Board Member Hankerson felt that they would cross the subject of an Airbnb when and if they come to it and gave the benefit of the doubt to the applicant. Motion passed 5-0. 3. OT-043-23: The applicant, Dania Beach Distillery, LLC is requesting an alcoholic beverage waiver of alcohol distance for the property located at 110 NW 1st Street. City Attorney Boutsis asked for any ex-parte communication for this item and there were no board member disclosures. PZ Senior Manager Viviana Bautista gave a slide presentation. The property was currently located in the City Center Zoning District. She explained the requirements for an alcoholic beverage waiver of alcohol distance. Restaurants and cafés serving alcohol usually did not have these requirements for distance. However, because of the small space the tenant would be occupying, food service would not be available. She explained the Distance Survey that the applicant provided. She explained the Waiver of Distance Criteria and that Staff was recommending approval of the resolution. This application required the Planning and Zoning Board acting as the Local Planning Agency to make a recommendation to the City Commission tonight. The applicant was available for questions. Board Member Thomas asked staff or the applicant if there was parking for distillery staff/employees. PZ Senior Manager Bautista explained that the approval was for a distillery giving samples to clientele who could buy the bottle there and consume it Planning and Zoning Board/Local Planning Agency Minutes 3 June 21, 2023 elsewhere. There would be a tasting room and they would be selling alcohol. The problem was that they were close to churches and that was why they were requesting the distance waiver. Board Member Hankerson confirmed that the maximum number of people tasting would be between four and six. Board Member Stowers wanted to know about the type, if it was whiskey or vodka or what. The general manager, Ivan, and co-founder of Dania Beach Distillery explained that next door, they were opening a small gallery with international artists. He spoke about the artists painting art on the bottles. They would combine art and beverages without aging (e.g., vodka). Discussion ensued about using local material. As there were no further board questions and no one from the public wished to speak or ask questions, this item was closed. Motion was made by Board Member Thomas to recommend approval of OT-043-23 to the City Commission and was seconded by Board Member Hankerson. Motion passed 5-0. IV. BOARD ITEMS 1. CITY OF DANIA BEACH COMMUNITY DEVELOPMENT DEPARTMENT STAFF REPORT DATE: July 19, 2023 TO: Planning and Zoning Board FROM: Eleanor Norena, CFM, Director Corinne Lajoie, AICP, Deputy Director Claudia Viviana Batista, Senior Manager SUBJECT: SP-023-23/VA048-23: The applicant, Franmar Properties of South Florida, LLC, requests approval of Site Plan and Variance for the development of a site for storage and bus parking for the property generally located on the north side of Southwest 42 Street, between Anglers Avenue/ Ravenswood Road and Southwest 22 Avenue. Request: VARIANCE To allow a minimum stacking area of ten (10) feet between the property line and the entrance to the first parking stall, where twenty-five (25) feet is required per Code Sec. 265-110(C)(6). SITE PLAN APPROVAL The applicant is requesting Site Plan approval to develop the site for overnight fleet parking of busses. PROPERTY INFORMATION: EXISTING ZONING: Industrial Research Office Marine Airport Approach (IROM-AA) LAND USE DESIGNATION: Industrial (I) SITE ACREAGE: 0.79-acre (34,305 SF) EXISTING USE: Vacant VIOLATIONS ON THE PROPERTY: No open violations on the property. Background: On November 9, 2021, the property received approval to re-zone the properties from Single Family (RS-6000) and General Business (C-3) to Industrial Research Office Marine Airport Approach (IROM- AA). This business’ headquarters is currently operating from the property across the street located at 4160 Ravenswood Road. The intent for this new site to be developed is to provide fleet parking for charter buses and employee parking. Half of the property is located in unincorporated Broward County with a County zoning district. The applicant applied for a voluntary annexation process, and it was approved by City Commission on December 14, 2021. An annexation petition is underway. The annexation is expected to be effective in the Fall of 2023. Academy Bus Site Plan July 19, 2023 Page 2 Variance STACKING SETBACKS The City’s Land Development Code requires a minimum twenty-five-foot (25’) setback from the property line to the first parking stall adjacent to a driveway. The applicant is proposing a ten-foot (10’) setback from the property line to the parking stalls. The Code regulations from this section are intended to promote standards of design for parking lots and to allow space for a vehicle to stop at the property line without blocking the first parking space. Section 625 of the City’s LDC states, the City Commission or Planning and Zoning Board, if applicable, shall hold its public hearing and, after consideration of the staff recommendation and public input, if any, may deny, approve, or approve with conditions the application for variance, based upon its determination that the request meets the criteria identified in Section 625-40, which are identified below. For each criteria, the applicant’s justification statement is provided, as well as Community Development staff’s findings in italics. 1. “That the requested variance maintains the basic intent and purpose of the subject regulations, particularly as it affects the stability and appearance of the city.” Applicant: The requested variance to provide a minimum stacking area of ten (10) feet between the property line and the entrance to the first parking stall, where twenty-five (25) feet is required, will not impact the stability and appearance of the city. The intent and purpose of the regulation is to ensure the site has adequate vehicle queuing, which the site will have. Ten (10) feet of queuing area is provided, the 2 bus stalls adjacent to the 25’ stacking area will not always be occupied, a portion of the site can only exit the site 1-way on to Ravenswood Road, the remaining portion of the site can by-bass SW 22nd Ave and utilize Ravenswood Road instead, if needed. Additionally, SW 22nd Avenue incurs scant traffic as it only provides access to/from SW 42nd Street to the subject site and the property to the west. It is +/- 300 feet in length and dead ends just north of the subject site. Community Development staff agrees with this assessment. 2. “That the requested variance is otherwise compatible with the surrounding land uses and would not be detrimental to the community.” Applicant: The requested vehicle stacking variance does not have an impact on compatibility with surrounding uses. The site/use will continue to be compatible and is not a detriment to the City. Rather, the proposed charter bus parking use will support the success of the Academy Bus enterprise on the subject site. Community Development staff finds the request is compatible with the surrounding land uses in this area. 3. “That the requested variance is consistent with, and in furtherance of, the goals, objectives and policies of the adopted Comprehensive Plan, as amended from time to time, and all other similar plans adopted by the city.” Academy Bus Site Plan July 19, 2023 Page 3 Applicant: The requested variance is consistent with, and in furtherance of, the goals, objectives and policies of the adopted Comprehensive Plan (including the below), as amended from time to time, and all other similar plans adopted by the city. Community Development staff confirms that the variance request is in keeping with the Goals, Objectives and Policies of the Dania Beach Comprehensive Plan, especially with policies in Objective IX Policy 9.2 of Future Land use: All proposed development and future land uses shall be compatible with adjacent land uses. 4. “That the plight of the petitioner is due to unique circumstances of the property or petitioner which would render conformity with the strict requirements of the subject regulations unnecessarily burdensome.” Applicant: The requested variance would not render conformity with the strict requirements of the subject regulations unnecessarily burdensome. However, the use of the site for parking charter buses is a limited and unique use and, as such, the ability to park said buses is fundamental and vital to the success of the proposed use. Community Development staff agrees with this justification. 5. “That the variance requested is the minimum variance that is necessary to afford relief to the petitioner, while preserving the character, health, safety and welfare of the community.” Applicant: The variance requested is the minimum variance that is necessary to afford relief to the petitioner, while preserving the character, health, safety and welfare of the community. In addition, the variance is not “active” all of the time because when buses are not utilizing the 2 stalls adjacent to 15’ of the 25’ required stacking area (because +/- 10’ is provided), the site complies with the 25’ code requirement. Community Development staff verifies that this is the minimum variance necessary to accommodate the project as proposed. Site Plan: The proposed site plan would consist of the development of the site to be a fleet parking lot for charter buses and employee parking. The property is located north of SW 42nd Street between SW 22nd Avenue and Ravenswood Road. Because of the proximity to the business headquarters, the property is a strategic location for proposed use. The use is permitted as long as the business is operating from premises. The adjacent property to the south will be used for the dispatch office. This property is in the process of annexation, it was reviewed and approved by the City Commission on December 14, 2021. The annexation is expected to be effective September 2023. COMMUNITY OUTREACH The applicant has reached out to adjacent property owners to answer any questions or concerns. A summary of the outreach efforts is included in the backup materials. One adjacent owner has met with the applicant and city staff to express his concerns. In response, staff is recommending the following items as a condition of approval: Academy Bus Site Plan July 19, 2023 Page 4 • Installation of “No Parking” signs. • Installation of an eight-foot (8’) wall on the western property line. • Limited hours of operation. • Light shields. IMPACT FEES Public Art: The City’s Public Art Program specifies a fee to be paid into the Public Art fund by new development projects over $1 million in construction value. Based on the construction value, the applicant must contribute into the City’s Public Art fund. Alternatively, they may choose to install public art on site equal to half of the required contribution and provide payment into the City’s Public Art fund. DEVELOPMENT REVIEW COMMITTEE (DRC) The site plan was reviewed by the DRC on March 1,2023, April 6, 2023, and June 30,2023 the committee includes personnel from the BSO Fire, Public Services, the City’s landscape consultant and Community Development Department’s Planning Division. The DRC comments are listed as conditions of approval in the site plan resolution and provided below. 1. The Applicant, prior to Certificate of Occupancy or Temporary Certificate of Occupancy shall be required to apply for, and pay for, an amendment to the City’s Comprehensive Plan Future Land Use Map from Commerce to Industrial and apply to, and pay to, rezone the property from the current county designation to Industrial Research Office Airport Approach (IROM-AA). (Planning) 2. Provide executed Unity of Title of the Dania Beach properties and the soon to be annexed properties to the south identified with parcel numbers 504229080060 and 504229080070 prior to Certificate of Occupancy. (Planning) 3. Demonstrate proposed site plan for the properties to the south identified with parcel numbers 504229080060 and 504229080070 reviewed by Broward County Urban and Planning Division meet the regulations and standards from the City’s Land Development Code. (Planning) 4. Install “NO parking signs”. This facility must be used for the charter buses and employee parking only, not for the public. (Planning) 5. Install an eight-foot (8’) height wall on the western property line for screening and buffering purposes. (Planning) 6. Provide a written engineering recommendation about the driveway location on SW 22 Avenue and the distance from the intersection prior to permit issuance. (Planning) 7. Provide hours of operation of dispatch office and parking limitations from 10:00 p.m. to 7:00 a.m. (Planning) 8. Provide light shields and provide details on photometric plans prior to permit issuance. (Planning) 9. For all projects resulting in buildout of the site, such that construction staging cannot occur on site, must obtain Staging Plan approval by the Community Development Director prior to issuance of a building permit. The Staging Plan must include, but is not limited to, location of equipment and material during construction. (Planning) 10. Per O-2017-027 & O-2018-019. Commercial properties under construction are required to provide security to fencing with screening showing project rendering covering at least 75% of the length of the fence along an arterial or state right-of-way & 25% for local roads and must include name and intended use of the project, project rendering, project website address, and owner or agent, the telephone number for the owner or agent, and the name and an emergency Academy Bus Site Plan July 19, 2023 Page 5 contact telephone number of the general contractor. Provide screen detail prior to issuance of master construction permit. City Commission must approve the use of City Logo. (Planning) 11. Must obtain a Certificate of Use and Business Tax Receipt (BTR) for the operations of the business on the subject property. (Planning) 12. A new road shall be constructed along SW 22nd Avenue as per the design plans. (Engineering) 13. Detailed grading of the new road along SW 22nd Avenue shall be submitted at the time of building and Right-of-Way (ROW) permitting. (Engineering) 14. The existing berm adjacent to SW 22nd Avenue shall be maintained during construction. If the berm is disturbed during construction, then the berm shall be reconstructed at the owner’s expense. (Engineering) 15. A copy of the recorded access easement for the access on to SW 22nd Avenue shall be provided at the time of building and ROW permitting. (Engineering) 16. Demolition Plan and Erosion Control Plan and details are required at the time of building and ROW permitting. (Engineering) 17. Additional comments may apply and will need to be addressed prior to Building Permit approval. (Engineering) 18. In accordance with City Code of Ordinances in Article 415. SIDEWALKS AND SWALES, the Owner is responsible for the construction of sidewalks / swales within the ROW when buildings are constructed or substantially improved. (Engineering) 19. Provide BC standard details for pavement marking and signage. All traffic control signs shall conform to Broward County Traffic Engineering (BCTED) and MUTCD standards. BCTED signs specifications consist of Type XI retroreflective sheeting materials except for school zone and pedestrian signs which shall be comprised of retroreflective fluorescent yellow-green sheeting certified type IV. (Engineering) 20. All pavement markings shall be alkyd-based thermoplastic and fully retro-reflectorized, per BCTED specifications with the exception of parking stall striping. (Engineering) 21. Provide Maintenance of Traffic (MOT) Plan by a licensed General Contractor/Professional Engineer in the State of Florida (if applicable). (Engineering) 22. Detailed and complete engineering plans will be required at the time of building and ROW permitting. (Engineering) 23. Provide a utility piping conflict details plan, along with documentation to demonstrate acceptability of the separation between water, sanitary, storm-water service lines, etc. (Engineering) 24. Show all existing and proposed utilities on the landscaping plans for potential conflicts. (Engineering) 25. Provide ADA parking, access / driveway, and sidewalks /ramps including dimensions in accordance with Chapter 553 of the Florida Statutes. "Accessibility of Handicapped Persons" and latest edition of "Accessibility Requirements Manual" by Department of Community Affairs, Florida Board Building Codes and Standards, and in accordance with Americans with Disability Act (ADA). Provide regulatory agencies' approval documentation and Permits/Licenses (as applicable) as part of the final submittal, prior to issuance of the Building and ROW Permit (South Florida Water Management District (SFWMD), Broward County Surface Water License, Broward County EPGMD Wastewater Permit / BC Water and Wastewater Approval, Florida Department of Environmental Protection, FDOT, BC Environmental, BC Aviation, BCTED etc.). Also include the Academy Bus Site Plan July 19, 2023 Page 6 Utility / ROW Permits from the City, Broward County, and State Roads, as applicable. (Engineering) Strategic Plan: This application supports the City’s Strategic Plan by furthering the following goals: Objectives 3.4 Have a sense of community- One Dania Beach community. Value to Our Neighbors and Our Community 3.2 Protection and enhancement of property values. Short Term Challenges and Opportunities 3.2 Expanding business investment in Dania Beach. Budgetary Impact Approval of the Site Plan and variance will enable this site to be developed, expanding the City tax roll. The project will also pay impact fees for Public Art (determined at permitting based on value of construction, up to $250,000). Recommendation: Approve the resolution approving the Site Plan and Variance providing that the remaining DRC comments are made conditions of approval and must be addressed prior to the issuance of a building permit. RESOLUTION NO. 2023-PZ-004 A RESOLUTION OF THE PLANNING AND ZONING BOARD OF THE CITY OF DANIA BEACH, FLORIDA, APPROVING THE SITE PLAN (SP-023-23) AND VARIANCE (VA-48-23) REQUEST OF APPLICANT, FRANMAR PROPERTIES OF SOUTH FLORIDA, LLC, FOR THE PROPERTY LOCATED AT 4100 SW 22ND AVENUE, IN THE CITY OF DANIA BEACH, FLORIDA, AS LEGALLY DESCRIBED IN EXHIBIT “A”, A COPY OF WHICH IS ATTACHED TO AND INCORPORATED BY REFERENCE INTO THIS RESOLUTION; PROVIDING FOR CONFLICTS; FURTHER, PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, Franmar Properties of South Florida LLC (the “Applicant”), is requesting approval of a Site Plan (SP-023-23) and Variance (VA-48-23) to permit the future development of parking for the property located at 4100 SW 22nd Avenue, in the City of Dania Beach, Florida (the “City”), as legally described in Exhibit “A”, a copy of which is made a part of and incorporated into this resolution by this reference; and WHEREAS, the City Code of Ordinances, Chapter 28, entitled, “Land Development Code” (“LDC”) of Part 6, entitled, “Development Review Procedures and Requirements,” of Article 635, entitled, “Site Plans” of Section 635-20(B), provides that small-scale site plan approval is required prior to commencement of construction; and WHEREAS, the Applicant is requesting small-scale site plan approval to permit the future development of the subject property pursuant to and consistent with the attached Site Plan provided as Exhibit “B”; and WHEREAS, Chapter 28, Part 6 of the LDC, Article 625 “Variances”, Section 625-40 states that the Planning and Zoning Board may grant a variance based on its determination that the petitioner has demonstrated that the necessary criteria identified in the LDC have been satisfied; and WHEREAS, the Applicant is requesting a Variance (VA-48-23) to provide a minimum stacking area of ten (10) feet between the property line and the entrance to the first parking stall, where twenty-five (25) feet is required per Sec. 265-110(C)(6); and WHEREAS, the Planning and Zoning Board conducted a duly noticed public hearing in accordance with Article 610 of the LDC; and WHEREAS, the Planning and Zoning Board finds that the approval of the Site Plan (SP- 023-23) and Variance (VA-48-23) will protect the health, safety, and welfare of the residents of the City, and furthers the purpose, goals, objectives and policies of the Comprehensive Plan; NOW, THEREFORE, BE IT RESOLVED BY THE PLANNING & ZONING BOARD OF THE CITY OF DANIA BEACH, FLORIDA: Section 1. That the foregoing “WHEREAS” clauses are ratified and confirmed as being true and correct a part of and incorporated into this Resolution by this reference. Section 2. That pursuant to Chapter 28 “Land Development Code,” Part 6 “Development Review Procedures and Requirements,” Article 635 “Site Plan,” the following Site Plan (SP-023-23), attached as Exhibit “B”, which is made a part of and incorporated into this Resolution by reference is approved. Section 3. Pursuant to Chapter 28 “Land Development Code,” Part 6 “Development Review Procedures and Requirements,” Article 625 “Variances,” the following Variance application (VA-48-23) are approved consistent with the attached Site plan provided in Exhibit “B”. Section 4. That the approvals granted by this Resolution are subject to the Applicant’s compliance with the following conditions: 1. The Applicant, prior to Certificate of Occupancy or Temporary Certificate of Occupancy shall be required to apply for, and pay for, an amendment to the City’s Comprehensive Plan Future Land Use Map from Commerce to Industrial and apply to, and pay to, rezone the property from the current county designation to Industrial Research Office Airport Approach (IROM-AA). (Planning) 2. Provide executed Unity of Title of the Dania Beach properties and the soon to be annexed properties to the south identified with parcel numbers 504229080060 and 504229080070 prior to Certificate of Occupancy. (Planning) 3. Demonstrate proposed site plan for the properties to the south identified with parcel numbers 504229080060 and 504229080070 reviewed by Broward County Urban and Planning Division meet the regulations and standards from the City’s Land Development Code. (Planning) 4. Install “NO parking signs”. This facility must be used for the charter buses and employee parking only, not for the public. (Planning) 5. Install an eight-foot (8’) height wall on the western property line for screening and buffering purposes. (Planning) 6. Provide a written engineering recommendation about the driveway location on SW 22 Avenue and the distance from the intersection prior to permit issuance. (Planning) 7. Provide hours of operation of dispatch office and parking limitations from 10:00 p.m. to 7:00 a.m. (Planning) 8. Provide light shields and provide details on photometric plans prior to permit issuance. (Planning) 9. For all projects resulting in buildout of the site, such that construction staging cannot occur on site, must obtain Staging Plan approval by the Community Development Director prior to issuance of a building permit. The Staging Plan must include, but is not limited to, location of equipment and material during construction. (Planning) 10. Per O-2017-027 & O-2018-019. Commercial properties under construction are required to provide security to fencing with screening showing project rendering covering at least 75% of the length of the fence along an arterial or state right-of-way & 25% for local roads and must include name and intended use of the project, project rendering, project website address, and owner or agent, the telephone number for the owner or agent, and the name and an emergency contact telephone number of the general contractor. Provide screen detail prior to issuance of master construction permit. City Commission must approve the use of City Logo. (Planning) 11. Must obtain a Certificate of Use and Business Tax Receipt (BTR) for the operations of the business on the subject property. (Planning) 12. A new road shall be constructed along SW 22nd Avenue as per the design plans. (Engineering) 13. Detailed grading of the new road along SW 22nd Avenue shall be submitted at the time of building and Right-of-Way (ROW) permitting. (Engineering) 14. The existing berm adjacent to SW 22nd Avenue shall be maintained during construction. If the berm is disturbed during construction, then the berm shall be reconstructed at the owner’s expense. (Engineering) 15. A copy of the recorded access easement for the access on to SW 22nd Avenue shall be provided at the time of building and ROW permitting. (Engineering) 16. Demolition Plan and Erosion Control Plan and details are required at the time of building and ROW permitting. (Engineering) 17. Additional comments may apply and will need to be addressed prior to Building Permit approval. (Engineering) 18. In accordance with City Code of Ordinances in Article 415. SIDEWALKS AND SWALES, the Owner is responsible for the construction of sidewalks / swales within the ROW when buildings are constructed or substantially improved. (Engineering) 19. Provide BC standard details for pavement marking and signage. All traffic control signs shall conform to Broward County Traffic Engineering (BCTED) and MUTCD standards. BCTED signs specifications consist of Type XI retroreflective sheeting materials except for school zone and pedestrian signs which shall be comprised of retroreflective fluorescent yellow-green sheeting certified type IV. (Engineering) 20. All pavement markings shall be alkyd-based thermoplastic and fully retro-reflectorized, per BCTED specifications with the exception of parking stall striping. (Engineering) 21. Provide Maintenance of Traffic (MOT) Plan by a licensed General Contractor/Professional Engineer in the State of Florida (if applicable). (Engineering) 22. Detailed and complete engineering plans will be required at the time of building and ROW permitting. (Engineering) 23. Provide a utility piping conflict details plan, along with documentation to demonstrate acceptability of the separation between water, sanitary, storm-water service lines, etc. (Engineering) 24. Show all existing and proposed utilities on the landscaping plans for potential conflicts. (Engineering) 25. Provide ADA parking, access / driveway, and sidewalks /ramps including dimensions in accordance with Chapter 553 of the Florida Statutes. "Accessibility of Handicapped Persons" and latest edition of "Accessibility Requirements Manual" by Department of Community Affairs, Florida Board Building Codes and Standards, and in accordance with Americans with Disability Act (ADA). Provide regulatory agencies' approval documentation and Permits/Licenses (as applicable) as part of the final submittal, prior to issuance of the Building and ROW Permit (South Florida Water Management District (SFWMD), Broward County Surface Water License, Broward County EPGMD Wastewater Permit / BC Water and Wastewater Approval, Florida Department of Environmental Protection, FDOT, BC Environmental, BC Aviation, BCTED etc.). That the issuance of a development order by a municipality does not in any way create any right on the part of an Applicant to obtain a permit from a state or federal agency and does not create any liability on the part of the municipality for issuance of the development order if the Applicant fails to obtain requisite approvals or does not fulfill the obligations imposed by a state or federal agency, or undertakes actions that result in a violation of state or federal law. Section 8. That all resolutions or parts of resolutions in conflict with this Resolution are repealed to the extent of such conflict. Section 9. I recently received notification of a Planning/ Zoning board meeting July 19th concerning development of property currently. owned by Academy Bus. While I cannot make the meeting I wanted to make my feelings known. We have had the property at 4100 Ravenswood for over 40+ years. In that time span we have witnessed several half hearted/ failed attempts to develop the property next door to us on the corner. That was until Academy Bus acquired the property. The improvements they've made to the property both inside and out are wonderful. Interior of the building was professionally decorated. The workmanship according to my son Rob( he is a tradesman) is top notch. Curb appeal was dramatically improved. New fencing, paved lot etc.A welcome change from past ownership. Academy Bus does it "right". Additionally they have been sensible, cooperative, attentive neighbors. I have no objections whatsoever to their plans for the parcel development being discussed on the 19th. They have shown to me time and time again they are a welcome asset to the "neighborhood". Tape and bundle control wire every 10' and run alongside the mainline. At all turns in direction, make a 2' coil of wire. At all valve boxes coil wire around a 3 4" piece of PVC pipe to make a coil using 30 linear inches of wire. Make electrical connections with 3MDBY/R connectors. Number all wires, using an electrical book of numbers, according to the plans. Number wires in all valve boxes, junction boxes and at the controller. Controller and pump station Control Panel grounding - Contractor to utilize 4"x8"x5 8" copper grounding plates, 5 8"x10' copper clad grounding rods, 'OneStrike' CAD wells at all connection points, #6 insulated copper wire, and earth contact material. Install these and other required components as outlined in the detail. Contractor to verify that the earth to ground resistance does not exceed 10 ohms. Contractor shall provide a written certification, on a licensed electrical contractors letter head, showing the date of the test, controller/pump location, and test results. Each controller/pump shall be so grounded an tested. Each component must have its own separate ground grid, unless they are sitting side by side, in which case up to two controllers can share a common grounding grid. LAYOUT Lay out irrigation system mainlines and lateral lines. Make the necessary adjustments as required to take into account all site obstructions and limitations prior to excavating trenches. Stake all sprinkler head locations. Adjust location and make the necessary modifications to nozzle types, etc. required to ensure 100% head to head coverage. Refer to the Edge of Pavement Detail on the Irrigation Detail sheet. Spray heads shall be installed 4" from sidewalks or curbed roadways and 12" from uncurbed roadways and building foundations. Rotors shall be installed 4" from sidewalks or curbed roadways, 12" from building foundations, and 36" from uncurbed roadways. Shrub heads shall be installed on 34" Sch 40 PVC risers. The risers shall be set at a minimum of 18" off sidewalks, roadway curbing, building foundations, and/or any other hardscaped areas. Shrub heads shall be installed to a standard height of 2" above maintained height of plants and shall be installed a minimum of 6" within planted masses to be less visible and offer protection. Paint all shrub risers with flat black or forest green paint, unless irrigation system will utilize reuse water; in this case the risers shall be purple PVC and shall not be painted. Locate valves prior to excavation. Ensure that their location provides for easy access and that there is no interference with physical structures, plants, trees, poles, etc. Valve boxes must be placed a minimum of 12" and a maximum of 15" from the edge of pavement, curbs, etc. and the top of the box must be 2" above finish grade. No valve boxes shall be installed in turf areas without approval by the irrigation designer - only in shrub beds. Never install in sport field areas. VALVES Sequence all valves so that the farthest valve from the POC operates first and the closest to the POC operates last. The closest valve to the POC should be the last valve in the programmed sequence. Adjust the flow control on each RCV to ensure shut off in 10 seconds after deactivation by the irrigation controller. Using an electric branding iron, brand the valve ID letter/number on the lid of each valve box. This brand must be 2"-3" tall and easily legible. EQUIPMENT All pop-up heads and shrub risers shall be pressure compensating. All pop-up heads shall be mounted on flex-type swing joints. All rotors shall be installed with PVC triple joints unless otherwise detailed. All sprinkler equipment, not otherwise detailed or specified on these plans, shall be installed as per manufacturer's recommendations and specifications, and according to local and state laws. TRENCHING Excavate straight and vertical trenches with smooth, flat or sloping bottoms. Trench width and depth should be sufficient to allow for the proper vertical and horizontal separation between piping as shown in the pipe installation detail on the detail sheet. Protect existing landscaped areas. Remove and replant any damaged plant material upon job completion. The replacement material shall be of the same genus and species, and of the same size as the material it is replacing. The final determination as to what needs to be replaced and the acceptability of the replacement material shall be solely up to the owner or owner's representative. INSTALLATION Solvent Wld Pipe: Cut all pipe square and deburr. Clean pipe an fittings of foreign material; then apply a small amount of primer while ensuring that any excess is wiped off immediately. Primer should not puddle or drip from pipe or fittings. Next apply a thin coat of PVC cement; first apply a thin layer to the pipe, next a thin layer inside the fitting, and finally another very thin on the pipe. Insert the pipe into the fitting. Insure that the pipe is inserted to the bottom of the fitting, then urn the pipe a 14 turn and hold for 10 seconds. make sure that the pipe doesn't recede from the fitting. If the pipe isn't at the bottom of the fitting upon completion, the glue joint is unacceptable and must be discarded. Pipes must curwe a minimum of 30 minutes prior to handling and placing into trenches. A longer curing time may be required; refer to the manufacturer's specifications. The pipe must cure a minimum of 24 hous prior to filling with water. BACK FILL The back fill 6" below, 6" above, and around all piping shall be clean sand and anything beyond that in the trench can be of native material but nothing larger than 2" in diameter. All piping and excavations shall be backfilled and compacted to a density of 95% modified Proctor, or greater. Main line pipe depth measure to the top of pipe shall be: 24" minimum for 34" - 212" PVC with a 30" minimum at vehicular crossings; 30" minimum for 3" & 4" PVC with a 36" minimum at vehicular crossings. Lateral line depths measure to top of pipe shall be: 18" minimum for 34" - 3" PVC with a 30" minimum at vehicular crossings; 24" minimum for 4" PVC and above with a 30" minimum at vehicular crossings. Contractor shall backfill all piping, both mainline and laterals, prior to performing any pressure tests. The pipe shall be backfilled with the exception of 2' on each side of every joint (bell fittings, 90's, tees, 45's, etc). These joints shall not be backfilled until all piping has satisfactorily passed its appropriate pressure test as outlined below. FLUSHING Prior to the placement of valves, flush all mainlines for a minimum of 10 minutes or until lines are completely clean of debris, whichever is longer. Prior to the placement of heads, flush all lateral lines for a minimum of 10 minutes or until lines are completely clean of debris, whichever is longer. Use screens in heads and adjust heads for proper coverage avoiding excess water on walks, walls and paving. TESTING Schedule testing with Owner's Representative a minimum of three (3) days in advance of testing. Mainline: Remove all remote control valves and cap using a threaded cap on SCH 80 nipple. Hose bibs and gate valves shall not be tested against during a pressure test unless authorized by written permission from the owner. fill mainline with water and pressurize the system to 125 PSI. Monitor the system pressure at two gauge locations; the gauge locations must be at opposite ends of the mainline. With the same respective pressures, monitor the gauges for two hours. There can be no loss in pressure at either gauge for solvent-welded pipe. If these parameters are exceeded, locate the problem; repair it; wait 24 hours and retry the test. This procedure must be followed until the mainline passes the test. Lateral lines: The lateral lines must be fully filled to operational pressure and visually checked for leaks. Any leaks detected must be repaired. Operational Testing - Once the mainline and lateral lines have passed their respective tests, and the system is completely operational, a coverage test and demonstration of the system is required. The irrigation contractor must demonstrate to the owner, or his/her representative, that proper coverage is obtained and the system works automatically from the controller. This demonstration requires each zone to be turned on, in the proper sequence as shown on the plans, from the controller. Each zone will be inspected for proper coverage and function. The determination of proper coverage and function is at the sole discretion of the owner or owner's representative. Upon completion of the operational test, run each zone until water begins to puddle or run off. This will allow you to determine the number of irrigation start times necessary to meet the weekly evapotranspiration requirements of the planting material in each zone. In fine sandy soils, it is possible no puddling will occur. If this is experienced, then theoretical calculations for run times will be required for controller programming. SUBMITTALS Pre-Construction: Deliver five (5) copies of submittals to Owner's Representative within ten (10) working days from date of Notice to Proceed. Furnish information in 3-ring binder with table of contents and index sheet. Index sections for different components and label with specification section number and name of component. Furnish submittals for components on material list. Indicated which items are being supplied on catalog cut sheets when multiple items are shown on one sheet. Incomplete submittals will be returned without review. in lieu of hardcopies, an electronic package in PDF format can be submitted. After project completion: As a condition of final acceptance, the irrigation contractor shall provide the owner with: 1. Irrigation As-builts - shall be provided accurately locating all mainlines, sleeves, remote control valves, gate valves, independent wire runs, wire splice boxes, controllers, high voltage supply sources/conduit path, control mechanisms, sensors, wells and water source connections. All mainline and independent runs of wire shall be located every 30' for straight runs and at every change of direction. Sleeves will be located at end points and every 20' of length. All underground items shall include depth in inch format. 2. Controller charts - Upon completion of "as-built" prepare controller charts; one per controller. Indicate on each chart the area controlled by a remote control valve (using a different color for each zone). This chart shall be reduced to a size that will fit inside the controller door. The reduction shall be hermetically sealed inside two 2ml pieces of clear plastic. 3. Grounding Certification - Provide ground certification results for each controller and pump panel grounding grid installed. This must be on a licensed electrician letter head indication location tested (using IR plan symbols), date, time, test method and testing results. INSPECTIONS AND COORDINATION MEETINGS REQUIRED - Contractor is required to schedule, perform, and attend the following, and demonstrate to the owner and/or owners representative to their satisfaction, as follows: 1.Pre-construction meeting - Designer and contractor to review entire install process and schedule with owner/general contractor. 2. Mainline installation inspection(s) - All mainline must be inspected for proper pipe, fittings, depth of coverage, backfill and installation method. 3. Mainline pressure test - All mainline shall be pressure tested according to this design's requirements. 4. Flow meter calibration - All flow meters must be calibrated. Provide certified calibration report for all flow meters. 5. Coverage and operational test 6. Final inspection 7. Punch list inspection FINAL ACCEPTANCE Final acceptance of the irrigation system will be given after the following documents and conditions have been completed and approved. Final payment will not be released until these conditions are satisfied. 1.All above inspections are completed, documented, approved by owner. 2.Completion and acceptance of 'as-built' drawings. 3. Acceptance of required controller charts and placement inside controllers. 4. All other submittals have been made to the satisfaction of the owner. GUARANTEE: The irrigation system shall be guaranteed for a minimum of one calendar year from the time of final acceptance. MINIMUM RECOMMENDED IRRIGATION MAINTENANCE PROCEDURES 1. Every irrigation zone should be checked monthly and written reports generated describing the date(s) each zone was inspected, problems identified, date problems repaired, and a list of materials used in the repair. At minimum, these inspections should include the following tasks: A. Turn on each zone from the controller to verify automatic operation. B. Check schedules to ensure they are appropriate for the season, plant and soil type, and irrigation method. Consult an I.A. certified auditor for methods used in determining proper irrigation scheduling requirements. C. Check remote control valve to ensure proper setting, if present. D. Check setting on pressure regulator it verify proper setting, if present. E.Check flow control and adjust as needed; ensure valve closure within 10-15 seconds after deactivation by controller. F. Check for leaks - mainline, lateral lines, valves, heads, etc. G. Check all heads as follows: 1. Proper set height (top of sprinkler is 1" below mow height) 2. Verify head pop-up height - 6" in turf, 12" in groundcover, and riser in shrub beds 3. Check wiper seal for leaks - if leaking , clean head and re-inpect. 4. If still leaking, replace head with the appropriate head with pressure regulator and built-in check valve. 5. All nozzles checked for proper pattern, clogging, leaks, correct make & model, etc. - replace as needed 6. Check for proper alignment - perfectly vertical; coverage area is correct;p minimize over spray onto hardscapes 7. Riser height raised/lowered to accommodate plant growth patterns and ensure proper coverage. 8. Verify pop-ups retract after operation. If not, repair/replace as needed. H. Check controller/C.C.U. grounds for resistance (10 ohms or less) once per year. Submit written reports. I. check rain shut-off device monthly and clean/repair/replace as needed. J. Inspect all valve boxes to ensure they are in good condition, lids are in place and locked. K. Inspect backflow devices by utilizing a properly licensed backflow inspector. This should be done annually, at minimum. L. Inspect all filters monthly and clean/repair/replace as needed. M. Check pump stations fpr proper operation, pressures, filtration, settings, etc. - refer to pump station operations manual. N. Check and clean intake screens on all suction lines quarterly, at minimum. Clean and/or repair, as needed. O. Winterize, if applicable, as weather in your area dictates. follow manufacturer recommendations and blow out all lines and equipment using compressed air. Perform seasonal startup of system as per manufacturer recommendations. P. Conduct additional inspections, maintenance tasks, etc. that are particular for your site. SOIL MOISTURE SENSOR (When applicable) 1. Place all soil moisture sensor wiring in 1" SCH 40 PVC conduit 2. Soil moisture sensor should be placed in the middle of a spray or drip area as per manufacturer's recommendations. 3.
