I. ROLL CALL II. APPROVAL OF MINUTES 1. Approval of Minutes of the Planning and Zoning Board/ Local Planning Agency from the May 17, 2023, regular meeting. III. PUBLIC HEARINGS 1. VA-041-23: The applicant and property owner, Patrick Wheatley, is requesting a variance to allow a six (6’) foot high fence on a portion of the front property line for the property located at 337 SE 3rd Terrace. 2. VA-046-23: The applicant and property owner, Shelly Miller, is requesting a variance to increase the maximum curb cut for a single-family home to forty (40) percent for the property located at 425 SE 3rd Place. 3. OT-043-23: The applicant, Dania Beach Distillery, LLC is requesting an alcoholic beverage waiver of alcohol distance for the property located at 110 NW 1st Street. IV. BOARD ITEMS 1. City Commission actions on items previously heard by the board: • VC-095-23: Vacation of ROW for Mullikin Park; City Commission 1st reading • TX-022-23: Public Art Escrow refund; City Commission 2nd reading 2. Upcoming meeting dates: July 19, 2023 V. ROLL CALL The meeting was called to order at approximately 7:01PM by Chair Robertson. Board Clerk Ibel Larios called the roll. Discussions/actions were notated but were not limited to what was typed. Chair W. Quin Robertson, PhD, GISP Present Eve Boutsis, City Attorney Vice Chair Derrick Hankerson Present Corinne Lajoie, AICP, Asst Director Comm Dev Jonathan L. Thomas Absent PZ Senior Manager, Viviana Bautista Morris Stowers Present Ibel Larios, Board Clerk Luis G. Rimoli Present Motion was made by Vice Chair Hankerson to excuse Board Member Thomas’ absence tonight and was seconded by Chair Robertson. Motion passed 3-1 (Board Member Rimoli opposed). II. APPROVAL OF MINUTES 1. Approval of Minutes of the Planning and Zoning Board / Local Planning Agency from the March 15, 2023 regular meeting. Motion was made by Board Member Stowers to approve the minutes of the meeting of the Planning & Zoning Board/Local Planning Agency for March 15, 2023 as presented and was seconded by Board Member Rimoli. Motion passed 4-0. III. PUBLIC HEARINGS 1. VC-095-22: The City of Dania Beach is requesting to vacate unimproved Right-of-Way (portion of SW 2nd Terrace and SW 2nd Place) adjacent to the North and South sides of Mullikin Park at 230 SW 1st Court. City Attorney Boutsis swore everyone in who was going to speak on this item. Then she asked for any ex- parte communication and there were no board member disclosures. PZ Senior Manager Viviana Bautista gave a slide presentation. She explained the location of this property. She showed and explained the areas allocated for the park and that the rest would be given to the adjacent owners to the north and south of the vacation. This application supported the Strategic Plan. Staff was recommending approval. Questions were called for. Planning and Zoning Board/Local Planning Agency Minutes 2 May 17, 2023 the land being given to adjacent owners for $100/parcel and donate the money to the City’s Parks and Recreation Department or to the Friends of the Library. City Attorney Boutsis said that what was suggested by the vice chair could not be done and she explained why. Board Member Stowers said this was a no brainer and to move on. As there were no further board questions and no one from the public wished to speak or ask questions, this was closed. Motion was made by Board Member Stowers to recommend approval of (VC-095-22) the Ordinance to the City Commission to vacate portions of SW 2nd Terrace and SW 2nd Place located between SW 1st Avenue and SW 1st Court and was seconded by Vice Chair Hankerson. Motion passed 4-0. 2. TX-022-23: The applicant, the City of Dania Beach, is requesting a text amendment to the City’s Code of Ordinances, amending the Public Art regulations allowing for the return of Public Art escrow funds. PZ Senior Manager Viviana Bautista gave a slide presentation. She explained that this was a text amendment for the return of public art escrow funds. She said that the text amendments were to update and clarify and she explained how. Staff recommended that the bord recommend approval of this text amendment ordinance to the City Commission. Questions were called for and Board Member Rimoli asked about the timing. Both Assistant Director Lajoie and City Attorney Boutsis explained. As there were no further board questions and no one from the public wished to speak or ask questions, this was closed. Motion was made by Vice Chair Hankerson to recommend approval of (TX-022-23) the Text Amendment Ordinance to the City Commission and was seconded by Board Member Rimoli. Motion passed 4-0. 3. TX-028-23: The applicant, the City of Dania Beach, is requesting several text amendments to the City’s sign regulations, to adopt amendments and refinements to the sign code in the Land Development Code. (Continued to June 21st Meeting) Assistant Director Lajoie said that this would be continued but to no date certain. They may need a little more time on this item. IV. BOARD ITEMS 1. City Commission actions on items previously heard by the Board. • TX-096-22: Several text amendments to the City’s Code; Approved by City Commission at 2nd Reading at the April 25th Meeting. 2. Upcoming Meeting Date: June 21, 2023 Vice Chair Hankerson said that he would like to resign as Co-Chair but was not resigning from the board and he explained why. The board decided to hold an election now and the floor was open for nominations. Chair Robertson nominated Board Member Rimoli as Vice Chair. There were no other nominations so it was closed. Board Member Rimoli accepted the nomination. Luis Rimoli is Vice Chair by acclamation and unanimous vote. V. MEETING ADJOURNED As all business was finished and without objection, the meeting was adjourned at approximately 7:14PM.
