HomeMy WebLinkAboutR-2023-059 Authorizing Approval for the Use of Funding from Landmark Development, Inc for City Hall Park ProjectRESOLUTION NO.2023- 05-6) A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA, AUTHORIZING APPROVAL FOR THE USE OF FUNDING RECEIVED FROM LANDMARK DEVELOPMENT, INC. TOWARDS THE CONSTRUCTION OF THE CITY HALL PARK PROJECT AND AUTHORIZATION TO BID PORTIONS OF THE PROJECT CONSTRUCTION; PROVIDING FOR CONFLICTS; FURTHER, PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the City Administration is seeking to create an attractive green space on the south side of the City Hall building that will replace the surface parking lot; and WHEREAS, the "City Hall Park" Project (the "Project") will include the extension of the sidewalk connection from the parking garage to SW Yd Avenue, sidewalk connection from rear City Hall building to the parking garage, replacement of the parking lot pavement with sod and the addition of pedestrian lights along the sidewalk path; and WHEREAS, the Public Services Department (PSD) seeks authorization to apply the funding in the amount of One Hundred and Fifty Thousand Dollars ($150,000.00) received from Landmark Development, Inc., pursuant to the City Place Developer's Agreement, towards the construction of the Project; and WHEREAS, PSD is also requesting authorization to bid portions of the Project as necessary. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA: Section 1. That the above "Whereas" clauses are ratified and confirmed, and they are made a part of and incorporated into this Resolution by this reference. Section 2. That the City Commission approves the use of the funding in the amount of $150,000.00 provided by Landmark Development, Inc. to fund construction of the City Hall Park. Section 3. That the City Commission authorizes competitive bidding of portions of the Project. Section 4. That all resolutions or parts of resolutions in conflict with this Resolution are repealed to the extent of such conflict. Section 5. That this Resolution shall be in full force and take effect immediately upon its passage and adoption. PASSED AND ADOPTED on June 27, 2023.
